NOTICE: This meeting will be closed under an exception to the Minnesota Open Meeting Law
that allows the Council to close a meeting to evaluate the performance of an employee. The
Council will summarize its conclusions regarding the evaluation at the meeting scheduled for
7:00 p.m., Tuesday, January 20, 2009.

Re: Maintenance Supervisor John Morrison �
Maintenance Supervisor John Morrison has been on a medical leave since August 1,2008. John
desires to return to work,and I am working with him to secure the documentation from his doctors
that he is able to perform all of the essential duties of his job description before he returns. He has
several doctors treating him,and I have received some conflicting information from them. I am
currently waiting for a report that may or may not resolve the conflict and clearly answer whether or
not he can return,with or without restrictions.
At the special meeting(6:30 p.m. on January 20)I will update the Council on John's status. Since we
will be evaluating John's ability to perform his job,the City Attorney has advised it is permissible to
close the meeting under an exception to the open meeting law. We will record the meeting,and must
report on the conclusions of the special meeting at the regular meeting at 7:00 that same evening.
John has been notified of the meeting and knows that he can attend if he wishes.
John has exhausted his banked sick leave and paid time off. The city's personnel policies allow the
Administrator to approve a maa�imum of 10 days of leave without pay. I have approved the leave,
which will extend until January 22,2009. Additional leave without pay requires a written request
from the employee and prior approval by the City Council(see excerpt of policy,attached.)
John has submitted a written request for additional leave. He is not able to give a specific end date,
but would return to work as soon as medically possible.
I recommend that the Council approve a leave of up to 30 days. If for any reason the leave needs to
extend beyond that time the Council may consider an extension at a future date.

3) Where possible, notice is to be provided to the City at least ten (10) working
days in advance of the requested leave.
4) Employees returning from military service will be reemployed in the job that
they would llave attained liad they not been absent for military service and
with the same seniority, status and pay, as well as other rights and benefits
detennined by seniority. Unpaid military leave will be considered hours
worked for the purpose of paid time off(PTO) accruals.
5) Eligibility for continuation of insurance coverage for employees on military
leave beyond fifteen (15) days will follow the same procedures as for any
employee on an unpaid leave of absence.
i) Leaves of Absence Without Pay
1) The City Administrator may, giving consideration to the needs of the City and
the ability of the remaining staff to accomplish work responsibilities,
authorize regular employees to be absent without pay for personal reasons for
a period or periods not to exceed a total of ten (10) working days in any
calendar year.
2) Requests for leave of absence without pay in excess of ten (10) days in a
calendar year must be submitted to and approved in advance by the City
Council. Employees shall request such leaves of absence without pay in
writing in advance of the date so desired indicating the reason(s) for absence,
the specific absence period and anticipated date of return to work.
3) Leaves of absence will not be given for the purpose of enabling any employee
to work for another employer or to engage in any form of self-employment.
Any employee who obtains a leave of absence by misrepresenting its purpose
shall be discharged.
4) While on approved leave of absence without pay exceeding ten consecutive
working days, an employee will not receive city contributions to city
sponsored insurance(s) in which he/she is a member or be eligible to accrue
PTO or holiday pay. Nor will the time on leave of absence without pay be
considered for purposes of calculating time in active service where the period
exceeds ten consecutive working days.
j) Parenting I.eave
1) E:nployees who work twenty(20)hours or more per week and have been
employed more than one year are entitled to take an unpaid leave of absence
in connection with the birth or adoption of a child. The leave may not exceed
six weeks, and must begin within six (6) weeks after the birth or adoption of
the child.
2) Employees are not required to use accumulated PTO during Parenting Leave
but may do so at their option.
3) The employee is entitled to return to work in the saine position and at the
same rate of pay the employee was receiving prior to commencement of the

I hereby request that the Scandia City Council approve a leave of absence without
pay beginning on January 22, 2009.
I anticipate returning to work as soon as my doctor certifies that I am fully able to
return to my job duties as Maintenance Supervisor.
