Re: Reinhardt Variance Fee Request

Background:
The Council approved Resolution 10-16-18-08 in October 2018, granting Joe and Katherine
Reinhardt an after-the-fact variance for the driveway they constructed at 18884 Layton Ave N.
The conditions of the variance were never met, and the conditional approval of the driveway
expired. At a court hearing in January of 2023, Mr. Reinhardt was instructed to apply for a
variance to keep his driveway.
Issue:
A variance was applied for on July 18, 2023. When the application was submitted, staff assumed
the variance had been paid for. When asked to pay for the variance, Mr. Reinhardt stated he
believed he did not have to pay again, based on the numerous fees previously paid and on
conversations with Mr. Soltis, as he details in his attached request to waive his variance fees.
Proposal Details:
The Reinhardt’s are applying for a variance for a driveway constructed at 18884 Layton Ave N.
Historically, when residents have filed multiple applications or petitions for the same project due
to past denials, they pay the necessary fee each time they apply. This is done because each
application requires a staff review and reporting.
Fiscal Impact:
The current Variance fee is $200.00, with a $1,200.00 escrow deposit.
Options:
1) Approve Reinhardt’s request to waive their variance fees
2) Deny Reinhardt’s request and waive their variance fees
