Rural Commercial District Allowed and Permitted Uses—Draft Ordinance
The Planning Commission recently updated the lists of uses allowed and permitted in the VMU
A and B Districts to move a significant number of uses from the group that requires a
Conditional Use Permit to the list of uses that are allowed in those districts.
The lists of uses allowed and permitted in the Rural Commercial District were based on those
allowed in the VMU A and B District, and therefore the uses in that district should be reviewed
as well and amended for consistency.
The draft ordinance attached has been updated in the same way as the VMU A and B District
ordinance.
The Planner made one change to the list of uses permitted with a CUP to add “Yard Waste
Facility.” This use is currently occurring with a CUP at the Abrahamson Nursery on a parcel
within the Rural Commercial District. The use was granted a CUP when the parcel was in an
Agricultural zoning classification.
Brewery Definitions
The EDA requested that Craft Brewery be added to the list of uses allowed in the VMU A and B
Districts. Many communities are adding this use, brew pubs, and craft distillery uses to their
ordinances, hoping to encourage new local businesses.
These uses are defined in Minnesota Statutes. Minnesota is stricter than many states in
defining these uses, and distinguishing between “on-sale” and “off-sale” liquor uses. In
Minnesota, Brew Pubs and Craft Breweries are different uses.

The Commission indicated general interest in adding the craft brewery and related uses to the
ordinance at the meeting on July 5. The Planner included the Brew on Premises Store use in
the allowed uses in the R COMM District, and the other uses (Craft Brewery, Craft Dist illery,
Brew Pub and Craft Winery) uses in the list of uses that require a CUP in the District, to be
consistent with other alcohol-related uses in the ordinance.
The Commission may also considered whether these uses should be permitted in the VMU A, d
VMU B, and VN districts.

AN ORDINANCE AMENDING
ORDINANCE NO. 122, THE SCANDIA DEVELOPMENT CODE,
CHAPTER 1, SECTION 4.2, DEFINITIONS, AND CHAPTER 2, SECTION 2.11
REGARDING THE RURAL COMMERCIAL (R COMM) ZONING DISTRICT
The City Council of the City of Scandia, Washington County, Minnesota hereby ordains:
Section 1. Amendment. Ordinance No. 122, the City of Scandia Development Code
(“Development Code”, or “Code”), Chapter 1, Section 4.2, Definitions, shall be amended to read
add the following:
Brew on Premises Store: A retail business that sells the ingredients and equipment to
customers to brew beer, other malt liquor or wine at the store for personal or family
consumption.
Brewery, Craft: A facility with a capacity to manufacture twenty thou sand (20,000) or
fewer barrels of alcoholic and nonalcoholic malt liquor a year. This definition excludes
small breweries operated in conjunction with a bar or restaurant defined herein as an
accessory use.
Distillery, Craft: A distillery producing premium, distilled spirits not exceeding 40,000
proof gallons in a calendar year.
Small Brewery or Winery as an Accessory Use to a Bar or Restaurant (Brew Pub): A
craft brewery or winery operated in conjunction with a bar or restaurant, provided the
beer or wine is sold for consumption on the premises and not sold to other bars,
restaurants, or wholesalers; except that an establishment licensed under Minnesota
Statutes may sell “growlers” off-sale with an appropriate City license.
Winery, Craft: A facility that manufactures wine, as defined by Minnesota Statutes §
340A.301, with a capacity of six hundred twenty thousand (620,000) or fewer gallons per
year.
Section 2. Amendement. Ordinance No. 122, the City of Scandia Development Code
(“Development Code,” or “Code”) Chapter Two, Section 2.11, Rural Commercial District (R
COMM) shall be amended to read as follows:
2.11 Rural Commercial District (R COMM)
(1) Purpose. The R COMM District is established to support commercial development in places of
historic commercial activity. R COMM District areas are designated Rural Commercial Nodes in
the Comprehensive Plan.
(2) PermittedAllowed Uses. The following are permittedallowed uses in the R COMM District:.

publication according to law.
