11.e Solid Waste and Recycling Report Staff Report Date of Meeting: September 19, 2023 For: Honorable Mayor and Council From: Kyle Morell, City Administrator Subject: Waste and Recycling: Solid Waste and Recycling Ordinance Background: The City has been working with Washington County and their consultant Foth, on an update to Chapter 52 of the City Code of Ordinances. The current ordinance was passed in 1970 and does not meet current solid waste disposal and recycling standards. Foth presented the original ordinance language for review by the City and County. Both entities made comments and suggested changes. City Attorney Eric Larson also weighed in and recommended additional changes incorporated into the draft presented to the Council. Current Proposal: The draft ordinance was presented to the Council at their September work session. The council expressed concerns over language requiring waste and recycling collection by the contracted hauler for all city residents and businesses. Staff worked with Foth and the County to revise that language. The term “Self-Hauler” was added to the ordinance, allowing residents to haul their garbage to the licensed drop off center and businesses who generate less than 60 gallons of garbage a week to self-haul their garbage to their home or drop off center. Discussion: The passage of a new ordinance requires a public hearing. The City Council or the Planning Commission could hold that hearing.
