9.b Ordinance 176 Opting out of Temporary Family Health Care Dwelling requirements ORDINANCE NO. 176 CITY OF SCANDIA WASHINGTON COUNTY, MINNESOTA AN ORDINANCE OPTING OUT OF TEMPORARY FAMILY HEALTH CARE DWELLING REQUIREMENTS WHEREAS, on May 12, 2016, Governor Dayton signed into law the creation and regulation of temporary family health care dwellings, codified at Minn. Stat. § 462.3593, which permit and regulate temporary family health care dwellings; and, WHEREAS, subdivision 9 of Minn. Stat. §462.3593 allows municipalities to “opt out” of those regulations; and WHEREAS, the City of Scandia’s Development Code permits an existing use called Temporary Dwelling Unit—Care Facility that meets the same needs and goals Minn. Stat. § 462.3593 in a manner that is more compatible with the needs of Scandia’s residents and is consistent with the City’s ordinances and codes; NOW, THEREFORE, CITY OF SCANDIA DOES ORDAIN: Section 1. Pursuant to authority granted by Minnesota Statutes, Section 462.3593, subdivision 9, the City opts-out of the requirements of Minn. Stat. §462.3593, which defines and regulates Temporary Family Health Care Dwellings. Section 2. Effective Date. This ordinance shall be in full force and effect upon its adoption and publication according to law. Passed and adopted by the City Council of the City of Scandia this 16th day of August, 2016.
