Included in your packet is a letter from Steve and Irene Kronmiller.
Issue:
How should the City respond to the Kronmiller request?
Proposal Details/Discussion:
The Kronmillers are requesting some street vacations and land conveyances after 188t� St was
moved to the north during paving to eliminate a curve in the road. The City obtained a
permanent easement from Gloria Hawkinson and then the roadway continued through the old
town drainfield and connected back up with the gravel area on the northern end of the Kronmiller
property.
In May 2003 the town board minutes read:
Michael Hinz made a motion to approve the plan submitted by Tom Peterson,Township
Engineer for the street realignment between Kronmiller and Kramer on 188`�Street.
Nancy Madden seconded the motion and motion adopted unanimously.
A copy of Tom Peterson's recommended plan is included in your packet. There is no record of a
hearing and action by the town to vacate the road right-of-way and the rectangular parcel is still
listed as owned by the City of Scandia.
Former Town/City Attorney Dave Hebert provided additional background information.
Landmark Surveying had discussions with the County Recorder's office on what would be
allowed for recording as far as the subdivision was concerned. The property is registered under
the torrens system. Part of the discussion was whether quit claim deeds or a plat of some sort
would be required. During this discussion it was also discovered that a Declaration of Lien in
favor of the State and Federal Governments had been filed against the title. The property had
been acyuired with State and Federal grant money for a neighborhood drainfield system ("201").
In order to convey the property to the affected landowners, the Registrar of Titles was requiring a
release of the Declaration. It seemed that would have required an appraisal of the unneeded
portion of the property and the possible partial payback of the grant funds.
A beginning effort was made to see what would be required but the acquisition of the property
was done by Washington County under the "201"program and records were difficult to locate. A
contact was made with someone from the PCA but getting cooperation from the Federal
government seemed problematic. That is where the process ended in 2003. It appears from the
Kronmillers recent letter that these difficulties were not shared with them.
Also of note is that there are drainage utilities on the north side of the road so staff would not
recommend conveying that parcel to the Hawkinsons as originally approved by the Town Board
in 2003. An alternative to trying to get the federal and state government to release the lien and
pay back a portion of the grant money, would be for the City to vacate those portions of the road
noted on the plan from 2003 and draft driveway easements for the properties that cross the City
parcel before getting to the road right of way.
Options:
1) Direct staff to prepare notices for street vacation and attempt to get release from state and
federal government for land south of the paved portion of 188`h St.
2) Direct staff to prepare notices for the street vacation portions only and have City Attorney
draft easements for driveway access over City parcel formerly the drainfield.
3) Take no action to vacate streets or convey land to adjoining property owners.

Honorable Mayor and City Council Members,
Scandia and Washington County improved 188"'Street over 10 years ago.The road way realigned and
finally paved. Many of the homes in our area were hooked up to the 201 sewer system to protect Big
Marine �ake and lellum's Bay.This was seen as a wonderful thing by many of our neighbors!
Unfortunately, issues created by the new road alignment are still impacting our property and three
others to the west of ours.The roadway was moved further away from our homes.Scandia extended
our four driveways to connect with the newly paved road surface.We were all assured the right of way
would be vacated and given to the affected landowners, in accordance with State law.When the right of
way was surveyed, it was determined that over 20 individual parcels needed to be dealt with. In May of
2003 a lot configuration was approved by Scandia.See the attached diagram for our understanding of
what was agreed to.The 20 parcels consisted of Government Lots,Deeded Lots,Torrens Property,etc.
You name the classification... it was found here.After lengthy discussions with the County Land
Surveyor, it was agreed that Scandia would create and register a minor subdivision to address the needs
of our four properties and the existing, but undeveloped road (Oak Street).
When the survey reviled a significant portion of our driveway would not be on our property,we asked if
the lot corner could be moved. In 2003 the Council felt it was more important the lot line be
perpendicular to the right of way than to protect our legal property rights. It should be noted that none
of the existing lot lines in the area run perpendicular today.Since then,it has also occurred to us that
another corner of our property was taken by Scandia without compensation and paved as part of the
new road!
We are writing this letter to ask for two things:
1. Get the minor subdivision filed so legal lots exist that reflect what actually exists. For example,
right now the plat shows our home to be approximately 30 feet from the road.We would need
a variance to the road setback if we wanted to make any improvements to our home.The road
is actually about 200 feet away.This could also impact our ability to refinance or sell our
property as it does not technically have access to the relocated roadway.
2. Please approve a new placement of our northwest lot corner so our driveway is entirely on our
property.A significant portion of our driveway should not be part of the road right of way!We
are happy to consider this a fair swap for the two thousand square feet of property taken from
us by the new road.
