RESOLUTION NO. 11-19-13-04
A RESOLUTION OF THE CITY OF SCANDIA,WASHINGTON COUNTY,
MINNESOTA,PROVIDING FOR THE SUMMARY PUBLICATION OF ORDINANCE
NO. 146,AN ORDINANCE AMENDING ORDINANCE NO. 122,THE SCANDIA
DEVELOPMENT CODE, CHAPTER 1,SECTION 4 RULES AND DEFINTIONS AND
CHAPTER 2,ADDING SECTION 4.32 REGARDING RURAL EVENT FACILITY
WHEREAS, On November 19, 2013, at a Regular Meeting of the Scandia City Council,
by majority vote,the City Council adopted Ordinance No. 146, an ordinance amending
Ordinance No. 122, the Scandia Development Code, Chapter 1, Section 4 Rules and Definitions
and Chapter 2, adding section 4.32 regarding Rural Event Facility. The proposed amendment
would allow a Rural Event Facility to be operated with an approved Interim Use Permit on
parcels 20 or more acres in size. The proposed definition of the Rural Event Facility is "A
facility that operates on a for-profit basis to host outdoor or indoor gatherings that do not exceed
twelve (12) hours in duration. The gatherings may include, but are not limited to, events such as
weddings or other ceremonies, dances, festivals, picnics or any other gathering of a similar
nature that the City determines to be consistent with and supportive of the rural and historic
character of the community. Gatherings may not include activities that include the discharge of
firearms, competitions among motorized vehicles, or other events that the City determines to be
incompatible with the community's character or intent of this chapter [of the Development
Code]." The proposed ordinance also includes the application reyuirements and performance
standards for a Rural Event Facility, An Annual Operating Permit would be required if the
Interim Use Permit is approved; and
WHEREAS, State law requires that all ordinances adopted be published prior to becoming
effective;and
WHEREAS,the City Council far the City of Scandia has determined that publication of the title
and a summary of Ordinance No. 146 would clearly inform the public of the intent and effect of the
Ordinance; and
WHEREAS, the City Council for the City of Scandia has reviewed the summary of Ordinance
No. 144 attached and incorporated herein as Exhibit A;and
WHEREAS, the City Council for the City of Scandia has determined that the text of the
summary clearly informs the public of the intent and effect of Ordinance No. 146.
NOW THEREFORE BE IT RESOLVED,the City Council for the City of Scandia hereby:
l. Approves the text of the summary of Ordinance No. 146 attached as Exhibit A.
2. Directs the City Clerk to post a copy of the entire text of Ordinance No. 146 in all public
locations designated by the City Council.
3. Directs the City Clerk to publish the summary in the City's legal newspaper within ten
days.
4. Directs the City Clerk to file the executed Ordinance upon the books and records of the
City along with proof of publication.
