Box 128 Scandia, MN 55073 (651)433-2274 Action Requested: Hold a public improvement hearing for the 2007 Paving Project, and consider adopting Resolution 11-21-06-01 ordering the improvement and preparation of plans. A four-fifths majority vote of the Board is required to adopt this resolution. Deadline/ Timeline: If the project is ordered on November 21,plans would be prepared for approval by the City Council in January, 2007. Bids would be awarded in March. Construction would occur May through August, with the assessment hearing in October, 2007. Background: • The Board accepted the Feasibility Report prepared by engineers Bonestroo Rosene Anderlik (BRA) on October 17, 2006. • Notice of the hearing was published and mailed to property owners proposed to be assessed. • A public information meeting was held on November 15, 2006. • The estimated total project cost is $2,221,140. • Chisago Lakes Township will share in the cost of the project pursuant to the terms of a joint powers agreement. Their share of the project is estimated at $364,234. • New Scandia's share of the project would be financed by a general obligation improvement bond issue, to be repaid through special assessments and property tax revenue over a 10-year period. A preliminary analysis of the bond issue, the projected impacts on property tax rates, and a debt service analysis (both before and after the bond issue) were prepared by Northland Securities. Please see the attached. • The estimated assessments are $1,462 per assessable unit on collector streets and $4,384 per unit on residential streets. The final amount will be determined at the assessment hearing, following construction. Page 1 of 2 11/17/06 • The financial analysis assumes that the assessments would be repaid over a 10-year period; this is longer than the 5-year period for previous projects due to the larger assessment amount. The analysis also assumed a 6 percent interest rate. However, the final terms will be determined at the assessment hearing and should consider the interest rate on the bond issue and prevailing rates at that time. Recommendation: The Board should hold the public hearing. After the hearing, you have several options: 1. Adopt the resolution ordering the improvement and preparation of plans for the entire project described in the Preliminary Report and listed in the resolution; 2. Reduce the size of the project by deleting road segments as you deem appropriate before adopting the resolution; or 3. Delay a decision to a future date(must be within 6 months of the improvement hearing); or 4. Decide not to proceed with the project. Of all the street segments proposed for paving, the most concern has been raised for 205th Street and Quint Avenue, the roads serving the "log house landing"on the St. Croix River and the surrounding (mostly seasonal) residences. There is a trout stream, and other environmental features, that may require extra care in design and construction. Concerns have also been raised due to steep grades on 197th Street, also near the St. Croix River. If these segments were postponed until the 2009 project, additional study could be undertaken without risk of delay to the rest of the 2007 paving project. Deleting segments from the project will affect the total cost of the project, as well as the calculation of the estimated assessments depending upon the cost and how many assessable units are on each segment. Ostrum Avenue North from Oakhill to south end; 4. A summary of the questions and answer follows. What will be the tonnage rating of the newly paved streets? Collectors will be paved to a 9-ton rating; local streets will be 7-ton. Will gravel trucks continue to use 228" Street? The Township cannot prohibit gravel trucks on the road but that will be taken into account in the design. How wide is the existing right-of-way? That varies by road segment, but most streets have 60 or 66 feet of right-of-way. Some existing ditches are steep; will they all be changed to a 3:1 slope? Some will be widened and flattened; some steeper areas may be left. What feedback has been sought and received from the DNR and watershed on paving of 205h Street to the St. Croix River? Why is it necessary to pave the road? We have been in contact with the DNR,National Park Service and watershed. They recognize the right of the township to pave its roads. The gravel roads require more maintenance, and gravel washes out and runs off to the trout stream and river. The project can include storm sewer improvements to limit runoff. There have been no formal comments at this time but the other agencies are willing to listen and review plans. They will make suggestions on devices and options for dealing with the water before it reaches the river. What are "benefited properties?" All abutting properties or those that use the road are considered to be benefited. Corner lots are considered 1 '/2 units for calculating assessments. 2007 Street Improvements Public Information Meeting,November 15,2006 Page 2 of 4 How do properties without driveway access benefited by improving the abutting road? They benefit from reduced dust, noise and maintenance cost. Will Dressel Contracting, which has heavy truck traffic impacting 240th Street but no frontage, be assessed? If they do not abut the road they are not assessed. However, because 240th is a collector, the township bears more of the cost and less is assessed to the abutting property owners. Many land owners on my road are seasonal residents only; how do they benefit with their minimal use? There is no "credit" for seasonal use. Are there other costs besides blacktop included in the assessment? Engineering, legal and other costs are built into all the estimates. Will storm drainage improvements be assessed? No, only the cost of the bituminous pavement will be assessed. Are driveway culverts included in the project? No; the road will be matched into the existing driveways but we will not put in any driveway culverts. What will happen at the dead-end at the end of 240? There will be a turn-around; additional land may be required from the Chisago Lake Township side of the road. Will 240th west to July Ave., in Forest Lake/Wyoming Township be paved? Staff has been in contact with Forest Lake and they have no plans to pave the road at this time. A small portion of Penrose was paved as part of an adjacent development project. Will property at the end of the road be assessed? Each parcel must be reviewed individually. Exact assessments will be determined at the assessment hearing. Could 205`h to the log house landing be considered a collector road, as it has more benefit to the whole community than to the abutting property owners? The board could consider that. 2007 Street Improvements Public Information Meeting,November 15,2006 Page 3 of 4 Should the township pay all the cost of the project? Some communities pay all the cost of this type of projects; others assess 100% of the cost to property owners. Only 29% of the total cost is proposed to be assessed. Extra work beyond the paving, such as for storm sewers, is not assessed at all. Will someone who is knowledgeable about natural resource protection be advising on the project? BRA, the township's engineering firm, has natural resource specialists who are consulting on the project. Will properties that already have partially paved roads (such as 209th Street off Highway 95) be assessed for what was already blacktopped by the state? Such situations will be looked at on an individual basis. What is an assessable unit? One home or one buidable lot is one assessment unit. What about undeveloped land? The number of units is based on how many homes could potentially be built considering front footage and land area. What if a new road would be required to develop additional units? Would the units assessed include those potential lots? No, only potential lots that would front on the road to be paved are counted as units. The spring box water lines under Quint Ave. are very fragile. How will they be protected during construction? If the water lines can withstand current traffic, they should be okay as there will be no digging in that area. How does the assessment process work? Can special circumstances be considered? The assessment hearing will be held after the project has been built, and special circumstances may be considered at that time. Must the board decide to pave all the roads, or nothing? No,they can take all factors into consideration and decide what roads to pave. A policy decision was made in 1989 to pave all roads but the board can decide not to pave in specific situations. 2007 Street Improvements Public Information Meeting,November 15,2006 Page 4 of 4 What happens when the board changes to the new city council? The city council may make changes in the decisions made by the board before the project is bid. Will residents have input on design? Yes, all suggestions are welcome. Will access to homes be maintained during the construction process? Yes, the contract will require access be maintained at all times. Will the railroad be assessed? No. Unbuildable property, such as that along the railroad tracks, cannot be assessed. Will the short road parallel to the railroad tracks to the south of 205"St. be paved as part of the project? Yes. It will be about the same width as it is now. Will trees be removed? It may be necessary to remove some trees if they hang over the roadway, but we will try to avoid them as much as possible. The river corridor regulations allow for cutting of trees in road right of way if needed. Has the railroad been contacted? No, but they will be. Why do roads need to be paved? The cost to maintain paved roads is significantly less. Will property owners be able to work with the road contractor to pave driveways and private roads at the same time? Yes, but that will be between the property owner and the contractor. Some contractors are willing to do that but others are not. New Scandia Township Memo To: Town Board Members From: Anne Hurlburt, Administrator Date: 11/16/2006 Re: Financial Analysis, 2007 Improvement Bond Issue Attached are several spreadsheets prepared by Monte Eastvold, V.P. of Northland Securities, with the assistance of Township Treasurer Colleen Firkus, to illustrate the financial impacts of the bond issue that will be necessary to finance the 2007 paving project. A bond issue of$2,010,000 was modeled. This amount is preliminary and could be reduced depending upon the bids received and any cash on hand that might be used for the project. This should be considered a preliminary analysis and may change when final figures for interest rates, etc. are known. As shown on page 1 of the attachment, the bond issue would be paid in 10 annual installments beginning in 2008. A portion of the issue ($540,730, or 26.9%)would be assessed to benefiting property owners over a 10 year period, also beginning in 2008. The remainder would be repaid from general property tax revenues. Debt service payments estimated at approximately$250,000 per year. After projected assessment income, the tax levy is estimated at$170,000 the first year, increasing to approximately$205,000 in year 10. Page 2 of the attachment shows how the projected tax levy would affect the property tax of homes of various values. (This does not reflect any decrease in existing debt levies as they are paid off.) Pages 3 through 6 of the attachment are a debt management analysis of the Township's five existing bond issues. Page 3 summarizes the combined debt service requirements of all five issues. It shows that the required payments will decrease substantially over the next three years when the four of the current issues are paid off. Page 7 shows what the debt management analysis would look like with the addition of the proposed 2007 bond issue. Finally, page 8 is the debt service schedule for the proposed bond issue. Mr. Eastvold is not available for the November 21 meeting; however, he will be present for future meetings concerning the financing of this project. Dear Sirs and Madams: Thank you for the notice of the November hearing regarding the proposed New Scandia Township road improvements (paving). I appreciate the township's efforts to implement changes which will reduce the long-term costs of maintaining New Scandia roads. My specific concerns pertain to 205th St. N (east of Quinnell) and Quint Ave. N are listed below. 1. Notification of hearing. I have reviewed a copy of the mailing list which was used to notify landowners adjacent to the roads proposed for paving. It appears that none of the land owners on Quint—south of 205th St. were notified, nor were any of the property owners on the south side of 205th St. notified, and some of the landowners on Quint—north of 205th were not notified. These omissions represent a significant portion of the area. The hearing for these two roads should be renoticed so that all landowners may participate in the discussion. 2. Public Landing. The heaviest use of these two roads is generated by the public's use of the landing road to access the St. Croix. How will this public use be dealt with in the assessment process? 3. RR Crossing. The RR which crosses 205th St was not listed as a landowner on the mailing list. Wll they be notified and assessed? There are significant drainage issues within the RR's ROW, particularly where the elevated track parallels Quint Ave. The drainage issues should be dealt with before or during the paving of the road. 4. Protection of Significant Natural Resources. In recent discussions with neighbors, it became apparent that protection of the unique and rare natural resources of the area is of primary importance. I have attached a copy of a map "Scandia Rare Natural Features" developed by MN Department of Natural Resources. In viewing this map, what is most noteworthy is that throughout the township most of our rare plants, animals and communities are gone. The majority of the remaining rare features are found along the Lower St. Croix National Riverway — and some will be adversely effected or destroyed if the 205th and Quint paving project does not include special construction and stormwater management guidelines. Gilbertson's Creek is directly below 205th St. This creek is a state designated trout stream. Neither this stream, other ephemeral streams in the area, nor the Lower St. Croix Riverway can withstand the thermal impacts of the proposed paving projects, as well as increases in runoff rates, and additional sedimentation and erosion. The good news is that the Marine Watershed Management Organization (WMO) has conducted two major studies within the watershed. One, "Lower St. Croix River Spring Creek Stewardship Plan" provides detailed assessment and management recommendations. I have attached a copy of the portion of the report that deals with Gilbertson's Creek. The second report details "best management" practices for activities throughout the watershed. The recommendations in these reports should be implemented during the paving process. 5. Ownership Issue. Currently, the owners of land at the west and east ends of 205th St. have surveys of their property which show that the roadbed has and continues to "move" northward onto private land. Spring Creek Name : Gilbertson's Creek 6U neral Watershed Description lbertson Creek outlets to the St. Croix River just downstream of the Loghouse Landing boat access. +extson Creek begins along the Wisconsin-Central Rail where a ditch collects numerous sceps scharging along a terrace slope. From the Wisconsin-Central Rail, Gilbertson Creek flows a short , stance though a black ash seepage swamp, crosses CR 53 and then begins its descent to the St. Croix ',River. The total watershed area contributing to Gilbertson Creek is 85 acres. The watershed land use ludes a large agricultural field, some partly wooded residential areas and forest land. • nificant Features Gilbertson Creek arises from one of the larger groundwater dependent wetland complexes in the study area. Extending from the north boundary of William O'Brien State Park to just north of the junction of CR 53 and the Wisconsin-Central Rail, this wetland complex includes rich fen, black ash seepage swamp and mixed hardwood seepage swamp. Downstream of CR 53, Gilbertson Creek drops over a V waterfall into a scenic gorge bordered by good quality white pine-hardwood forest. This ravine/stream system includes records for several rare species including Louisiana waterthrush (Seiurus motacilla), red shouldered hawk (Buteo lineatus), bald eagle (Halliaeetus leucocephalus) and American ginseng Y- '(Panax quinquefolius). Gilbertson Creek contains a population of naturally reproducing brook trout ( alvelinus fontinalis)below CR 53. Key Management Recommendations 1. The public access road (Log House Landing) to the St. Croix River is subject to significant scour and erosion during storm events. The WMO should work with the NPS, DNR and Township to stabilize eroded areas and lower peak flow rates into the Gilbertson's Creek Gorge. 2. Water pipes pass from these springs beneath Quint Ave to each home site. How will liability be assessed if any damage occurs to any of these water sources during proposed ditch construction and paving project? 4. Necessity for Improvements. There are 9 property owners who access Quint Ave. 1 is a year round resident and 1 a year round rental property. The remaining 7 properties are seasonal use, most of which are occupied no more than 3-4 weeks/year. Is the assessed cost to the property owners justified considering use by each? Also, any future development on Quint Ave. is prohibited by the NPS. 5. Environmental impacts. This entire area is historically significant and environmentally unique to the Scandia area, regulated by the NPS, St Croix River Wild and Scenic River Way. Any widening or alterations in the course of existing road bed will necessitate the removal of a significant number of 100+ feet/100 year old hard and soft wood trees, basswood, white pine, and red oak. My family owned three pieces of property on Quint Avenue North along with a significant stretch on the Wisconsin side, opposite the properties. My family then all have passed away, but I still own property at the above address which I am keeping for my children. The various properties that lie north of 205th Street remain pretty much as they were more than half a century ago. Quint Avenue North, north of 295th Street, is basically a road to nowhere, other than the several properties that lie to the east of it. This stretch of the Avenue has a wonderful county road charm to it. Paving and widening it would be an environmentally unsound desecration of natural beauty and an unjustifiable expense of taxpayers' money. For those of you who have not gone out to see this little piece of early 20th century country lane, please do so. You will understand what I am trying to get at here. - 2 - I understand that the plan to widen and pave this part of Quint Avenue North has been developed and put forward with the best of intentions, but, being such a small piece of road, the reality of its charm and the lack of need for improvement have probably never been noticed. The money it would cost to do this unfortunate thing could be well spent elsewhere—education, parks and recreation, charitable endeavors and various other causes come to mind. Well, that's my personal input. There are a couple of other issues that pertain to widening and paving Quint Avenue North, north of 205`h Street, that you might want to consider: 1 Quint Avenue North dead end parking area. We appreciate the time that the Board, Administrator and Engineer have taken to explain the project, and entertain questions. Allow us to set out our very serious concerns about the proposal with respect to the Quint Avenue segment. UNKNOWN ENVIRONMENTAL IMPACT Our primary and overwhelming concern - and one that greatly distinguishes this road from many others in the City—is the potentially adverse environmental effects that may result from paving the road. Unlike other roads and streets proposed for paving, this one small spur is adjacent to the St. Croix River Valley and the Federal Wild and Scenic River System. Extensive and restrictive regulations forbid many activities here in an effort to preserve the natural setting and protect the waterway. The potential impacts of adding an oil-based, impervious surface include possible oil-tainted run off into the St. Croix River and adjoining trout stream, and severe erosion of the soil and slope to the river. None of this has been evaluated. In contrast, rainwater currently is fully absorbed along the road with little run-off. A trout stream-runs through this area, one of the most pristine in the county. Nothing is known about potential disruption to this fragile resource. I Three spring box lines-run under the road and provide the sole source of fresh water to three homes, including that of the family residing year-round along the road. While the City Engineer doubtedd any excavating-would occur, no evaluation has been completed of the sensitivity of the lines that can guarantee that such disruption will not permanently interfere with this water source. And nothing in the plan addresses indemnification of springbox users for this potential loss and cost of drilling new wells (estimated 100+ feet into the river bedrock) in case of disruption. Finally, neighbors are concerned that unusual plant and bird life along the roadway—not common in the region or county- may be disrupted. The oaks,maples, and basswoods along this road are among the oldest in Washington County, and this narrow strip of tall New Scandia Township Board November 17, 2006 Page Two upland forest supports an especially pristine understory plant community. The breeding bird community of this mature forest is unique to Minnesota(e.g., it is the only site where Cerulean Warbler, Pine Warbler, Mourning Warbler, and Louisiana Waterthrush come together). The loss of even a few of these old tees jeopardizes this unique community. As reported at the hearing, the City has not had time yet to time to do more than make initial phone calls to the Department of Natural Resources, the National Park Service, the Watershed and other environmental agencies whose jurisdictions include this road. It has not formally requested, let alone received and reviewed any definitive environmental impact assessments; we also understand that the Watershed may recommend that this be done. At the same time, we are considering filing an Environmental Assessment Worksheet and are in preliminary contact with the Minnesota Department of Natural Resources. In short,both the residents and the City do not have adequate environmental information upon which to base any decision to pave. We strongly urge the City to delete the road from the plan altogether and save the attendant cost, time and effort. Barring this,we ask that you remove this road at this time from the 2007 plan, to permit further study and consideration. CITY'S GOALS ARE NOT FRUSTRATED BY DELETING QUINT PAVING The City's stated goals for paving are not frustrated by abandoning the paving of this little service road. The City representatives advised us that their greatest concern is the expense of owning and contracting for the use of the graders. In fact, this road's maintenance does not require a large grader,but is gradable using a simple blade on a pick-up truck. The road is only about 8 feet across and at least one neighbor has easily done this on the extension of the road into the Plowman property. Consequently, retaining this road's natural character will not necessitate the City's retention of the grader, or incurring expensive contracts. Furthermore, there are no safety concerns presented by not paving this flat, short and relatively straight service road that results in a dead end. Currently ambulances, fire trucks and other service vehicles can use and have used the road without any problems. New Scandia Township Board November 17, 2006 Page Three NATURAL BEAUTY OF THE ROAD Finally, the sheer nature of this road distinguishes it from any other in the project—and justifies its exemption from paving: • Quint Avenue North is not a through street,but rather a dead end road • The road only services seven seasonal cabins, save for one house and one rental cottage. These cabins are only used for the equivalent of a few weeks per years by their owners. As such there is no a regular stream of traffic year round and no other reason for anyone else to use the road. • There never will be any new construction of permanent residential or seasonal structures, which might yield higher traffic usage year-round. Any new construction is barred by the Federal Wild and Scenic River Act, as it has been for over three decades. Only 50-100 year old structures remain, and the National Parks Service and federal regulation bar further development along the road. • There are dozens of 100-200 year old pines,hardwoods,bass and other trees dotting the passage through the woods. The proposed paving undercuts the entire purpose at play in every other aspect along that road—the desire to preserve this treasure of a river valley and bluff in pristine quality for this and future generations. The small country lane, which has not presented a problem for going on a century, drops into the woods and old cabins appear on land that owners are otherwise forbidden from polluting, clearing, or adding new construction. These old, modest cabins and their woods have been carefully protected from adverse impact for generations (one of our families dates back to the 1850's settlement). Defacing this gem of Scandia with an asphalt scar insults generations of care, as well as local concern for and national attention to this beautiful river valley. We urge the City to recognize and celebrate this historic and beautiful setting in its midst. REQUEST In light of the facts above and further statements that we will enter in person on Tuesday, we strongly and collectively urge you to: 1. Completely abandon the paving of the Quint Avenue spur in recognition of the potential environmental risks, its unique legal and natural setting, and the potential cost and time of evaluating the impact. Barring abandonment, defer until the next paving cycle consideration of this road to permit thorough evaluation of the impact and formal,professional environmental impact statements to be conducted and considered. 3. Our concerns are primarily based on the difficulty of traversing the hill in the winter and spring months. Safety is our primary concern if the surface is blacktopped. As you know, the grade of the hill combined with the runoff from the sandrock walls often creates a very slick surface and sometimes large ice flows. A blacktop surface could worsen these conditions especially in the spring when the ice melts during the day and refreezes in the evening, making it nearly impossible to climb the hill. Secondly, we are concerned with the environmental impact of the use of calcium chloride on a blacktopped surface on the plants, trees and water. While we agree that the improvements are necessary, our concern rests solely on the issue of whether the paving is the optimal solution versus keeping a gravel surface. As an abutter to 205`h Street, the road leading to the Scandia Town Landing on the St. Croix River, I wish to register my strong opposition to the proposal to pave 205t Street and the adjoining Quint Avenue. Since 1911, when my grandfather George Edmund Ingersoll purchased land along the St. Croix River, my family has owned the property immediately south of 205`h Street, which is identified on the Washington County tax rolls as"Reserve No. 3". Reserve No. 3 is a wooded ravine formed by a free-flowing and natural stream, identified by the Minnesota DNR as "Gilbertson's Stream". This stream has been cited by the DNR as one of very few remaining natural and pristine streams in the St. Croix watershed in this area, and as such the DNR has studied the stream in recent years, measuring water quality, stream flow rates, and fish population, with the intent of preserving this unique natural resource, and preventing degradation of the stream environment. I am very concerned that the paving of 205`h Street will inevitably have an adverse effect on this stream, due to stormwater runoff, oil and gas pollution, and soil erosion. As a gravel road these concerns have been negligible over the years due to the absorption of the road surface. A paved road, on the other hand, would have to incorporate carefully engineered systems for handling stormwater runoff and preventing degradation of the stream and the river as well. 1 It is further my belief that paving 205`h Street and Quint Avenue would serve no constructive purpose and provide no tangible benefit to the Town of New Scandia. 205th Street terminates at the St. Croix River in a large turnaround and parking area for boat and canoe trailers that have launched their boats. Paving that large area, and the launching ramp down to the river, would inevitably have a very negative impact on the water quality of the St. Croix, which of course is a federally-protected National Scenic River. Stormwater cascading down the hill, across the parking area and down the ramp to the river will cause serious erosion of the river bank, increased sediment in the river, and will result in unsightly scarring of the bank as seen from the river. The federal government has an obligation, one that is shared by all landowners along the river, to preserve and protect this scenic riverway, and that obligation is one we and our neighbors take seriously. It is most important that the Town of Scandia take no action that negatively impacts that requirement. The proposal to pave these two roads would benefit no one and should be eliminated from the Road Improvement Project. Lastly, I wish to point out that the southern extension of Quint Avenue, running parallel with the Soo Line tracks extending south of 205`h Street to Quinnell Avenue, is not a town road. This short road was privately constructed in 1949 on land owned by my family, under an easement granted by my father in order to eliminate the necessity for families living on Quint Avenue to make two dangerous crossings of the railroad tracks in order to reach their homes. The land that road is on is still owned by me, it is still included in the property on which I pay taxes each year to Washington County, and I emphatically do not want that road to be paved. DESCRIPTION OF PROJECT RESULTS The northern portion of Washington County contains numerous streams, wetlands, and plant communities that are rare or unique to the Metropolitan Area. These resources are dependent on groundwater to sustain a constant, cold, and clean supply of water to the resource and are identified as high priority resources by Washington County, the MN Department of Natural Resources, and local watershed organizations. In addition, these resources often contain plant, animal and insect assemblages that are rare or endangered in Minnesota. These resources are so rare because they are extremely sensitive to alterations in the landscape. Changes to contributing surface water quality and temperature, hydrology, and groundwater contribution have a direct impact on these systems. As a result of the location of these unique resources and their sensitivity to changes in the landscape, Washington County and a number of local water management organizations have undertaken studies to better understand them. These studies have generated information regarding location and quality and have clearly identified the need for protection. While additional efforts have been conducted to develop standards to protect these resources, the main conclusion of these efforts is that a more thorough technical evaluation of the surface water/groundwater interactions must be performed. This type of comprehensive evaluation would provide the justification for legally binding standards. This project takes an innovative approach to natural resource management by providing the rationale and technical justification for management and protection before the need for restoration. The proposed project will use previously completed studies to further the understanding of groundwater dependent natural resources. The study area includes five designated trout streams, four of which contain a naturally reproducing Brook Trout population. The objective of this project is to develop resource management plans to (1) protect trout streams and (2) develop a framework for the protection of similar types of resources. Result 1 "Groundwater Dependent Natural Resource Database" Budget: $ 13,800 Collect and compile existing studies, monitoring data, and natural resource data in an easy to use database for the purposes of this project. MEASUREABLE OUTCOME—Develop a GIS webmapping application for the Washington County website. Database can be accessed by resource name and updated as the project progresses. Result 2 "Development of Five Comprehensive Resource Management Plans"Budget: $549,760 A comprehensive resource management plan will be developed for each of the five designated trout streams. These plans will provide the county, local water management organizations, and communities with the technical basis to incorporate standards into rules and into land-use and conservation plans. Each plan will evaluate existing surface water and groundwater contributions through robust technical analyses, potential impacts of construction activities and development (impervious surfaces) to the resource, and the potential role of stormwater infiltration to mitigate impacts of development. While the WMO understands the Township's desire to improve 205th St. North.,the WMO wants to ensure that any work that is completed deals with.stormwater in way that is consistent with the MWMO policies. From the Lower. St. Croix Spring Creek Stewardship Plan, it was recommended that peak flows into the Gilbertson's Creek Gorge be reduced and that the volume resulting from the 2-year event be maintained. Because Gilbertson, Creek is considered a Groundwater. Dependant Natural Resource,the improvements along Quint Avenue and 205th St will be subject to Washington County s Model. Groundwater Rules as laid out in the MWMO Watershed Management Plan. In order to meet the above storm.water criteria, the MWMO strongly encourages New Scandia. Township not to simply pipe the stormwater runoff to the St. Croix but to utilize infiltration or biofiltrati,on Best Management Practices and other innovative storm.water practices that promote recharge. The MWMO has worked with the Arcola Mills Historic Foundation located in May Township to implement such practices along their driveway which is adjacent to Arcola Creek, another sensitive groundwater dependent natural resource. Gilbertson Creek begins along the Wisconsin-Central Rail.where a ditch collects numerous seeps discharging along a terrace slope. From the Wisconsin-Central Rail,Gilbertson. Creek flows a short distance though a black ash seepage swamp,crosses CR 53 and then begins its descent to the St.Croix River. The total watershed area contributing to Gilbertson Creek is 85 acres, The watershed land use includes a large agricultural field, some partly wooded residential areas and forest land. Significant Features Gilbertson Creek arises from one of the larger groundwater dependent wetland complexes in.the study area. Extending from the north boundary of William O'Brien State Park to just north of the junction of CR 53 and the Wisconsin-Central Rail, this wetland complex includes rich fen., black ash seepage swamp an.d mixed hardwood seepage swamp. Downstream of CR 53, Gilbertson Creek drops over a waterfall into a scenic gorge bordered by good quality white pine-hardwood forest. This ravine,/stream system.includes records for several rare species including Louisiana waterthrush (Selurus motacilla), red shouldered hawk(Buieo lineatus), bald eagle(Halliaeerus leucocephalur) and American ginseng (Panax quinquefolius). PARK AND RECREATION COMMITTEE Winter Program Deb Campobasso, Chair of the Park and Recreation Committee,presented the Committee's recommendations for the 2006-07 winter program. 1) Continue the after school skating program; 2) Organize an instructional ice skating class; 3) Continue the Winter Festival on January 28, 2007; 4) Organize a snowshoeing tour of the Wind in the Pines Park. Supervisor Harnetty suggested that additional supervision be added to the after school program. It was agreed to add two paid staff to run this program. Discussion of hiring a Winter Program Director to be in charge of recommendations land 2 began. Michael Harnetty made a motion to proceed with the Park Committee's recommendations in the manner that a Winter Program Director would supervise activities#1 and#2, and the Park Committee would run#3 and#4. Nancy Madden seconded the motion and motion adopted unanimously. Nancy Madden made a motion to appoint Marty McKelvey as the Winter Program Activity Director, with possible expansion of the program.Michael Hinz seconded the motion and motion adopted unanimously. Summer 2007 Program Ms. Campobasso presented a timeline for preparing the summer program. A subcommittee will meet soon to begin planning, followed by discussion within the Park Committee. A presentation will be given at the December Town Board meeting. A goal is to have the summer program finalized by March 1st, with possible expansion of the program to include seniors and group home residents. Ice Rink Ms. Campobasso presented recommendations for the skating facility. Supervisor Seefeldt will refer this to a sub-committee to review. Members of the sub-committee will include Supervisors Seefeldt and Harnetty, Administrator Hurlburt, Moose Malmquist, Mike White, Deb Campobasso and other interested parties. New Scandia Town Board October 17, 2006 Page 3 Supervisor Harnetty summarized a recent meeting held by the Ice Rink sub-committee. General replacement of the dasher boards is a priority for next season,with a"band-aid fix"for this year, as the current boards are over forty years old. Mike White will continue with the sealing of cracks on the base. Park Dedication Sub-Committee Administrator Hurlburt reported on the findings of the sub-committee. An alternative approach will need to be looked at to justify an increase in park dedication fees.The sub-committee will meet again in November to research this,and report to the Board in December. POLICE DEPARTMENT Deputy Chris Howard was present to report on police activity. In response to an increased report of cars passing on the right shoulder of the road, it was suggested to post a notice along Highway 97.Deputy Howard also reported on the increase in excessive speed along Highway 95 north of Pilar Road. Deputy Howard asked for clarification of the wording of ordinance violations/citations. Administrator Hurlburt will address this. Supervisor Harnetty asked for an update on the status of drug activity in the Township.As the public is more aware of meth labs,they are becoming less of a problem. The manufacture and selling of drugs is not a current problem,although personal use of drugs is occasional. FIRE DEPARTMENT Fire Chief Steve Spence asked for advice on the legalities of releasing information, as he is getting requests for reports on fire and rescue calls. Much of the information is public,but a formal request should be made to Administrator Hurlburt. TOWN ENGINEER 2007 Street Paving Project Town Engineer Tom Peterson presented the 2007 Street Paving Project Feasibility Report. The project includes the paving of 18 separate gravel roads, located in the northwest and easterly portions of the Township,at an estimated cost of$2,221,140. Nancy Madden made a motion to approve Resolution 10-17-06-02 Receiving the Feasibility Report and Calling for a Hearing on Improvement.A Public Information meeting to be scheduled for November 15,2006. The 2007 paving project will be financed with a bond issue that will be repaid with a combination of special assessments and a property tax levy. Nancy Madden made a motion to approve Resolution 10-17-06-03 Declaring the Official Intent of the Town of New Scandia to Reimburse Certain Expenditures from the Proceeds of Bonds to be Issued by the Town. Blair Joselyn seconded the motion and motion adopted unanimously. Olson-Sandgren-Hawkinson Storm Sewer Project Mr. Peterson reported on the status of this project. The berm has been constructed, but the outlet structure could lead to water flow across the property, causing the adjoining land to be unusable. Property owner Nancy Peterson requested a meeting with staff to study these modifications. New Scandia Town Board October 17, 2006 Page 4 TOWN ATTORNEY As a follow-up to concerns of releasing public information,Town Attorney Dave Hebert recommended that Administrator Hurlburt be appointed to oversee these reports. Michael Hinz made a motion to appoint Administrator Anne Hurlburt as the Data Practices Officer for New Scandia Township. Nancy Madden seconded the motion and motion adopted unanimously. Mr. Hebert reported on the findings of the Administrative Law Judge in regards to the Town's incorporation petition. The official approval of the petition was released on October 16, 2006. The city status will become effective on January 1, 2007. A special election will be held for a mayor and four city council members on December 12, 2006. Candidate filing will occur between November 15 to November 28, 2006. TOWN ADMINISTRATOR Insurance Renewal Town Administrator Anne Hurlburt reported on the renewal of insurance through the League of MN Cities Insurance Trust. The renewal date for all LMCIT insurance coverage is December 1, 2006. The question of whether to continue to waive the statutory limits on tort liability was discussed. Administrator Hurlburt also addressed open meeting law coverage and a faithful performance bond currently provided by Minnesota Association of Townships. Nancy Madden made a motion to approve coverage through the League of MN Cities Insurance Trust to include a waiver of the statutory limit on tort liability,open meeting law coverage and a faithful performance bond(coverage of$100,000).Michael Hinz seconded the motion and motion adopted unanimously. 2006 Summer Program Report Marty McKelvey, Summer Program Coordinator,presented results of a survey given to families that participated in the Summer Program. Responses were gathered from 29 of the 45 families that participated. Overall,parent were supportive of the program. Ms. McKelvey's goals for the summer program include financial success(break-even goal), customer satisfaction and a higher level of participation. It was suggested to include offerings to a broader range of age groups. A sub-committee of the Park and Recreation Committee will be meeting on October 26"'to further refine the program, with a report to the Board in December. Grading Permit Big Marine Development has applied for a grading permit to construct an access road in the future Tii Gavo development. As a development agreement is not yet in place, any grading requires a permit under Section 9.5 of the zoning ordinance. The developer plans to install an access road approximately 2,000 feet into the site from Newgate Avenue, along with the associated storm sewer and temporary ponds. Town Engineer Tom Peterson recommended a financial guarantee of$250,000. Nancy Madden made a motion to approve the grading permit for Big Marine Development on the condition that the applicant obtain required watershed permits and submit a Letter of Credit in the amount of$250,000.Blair Joselyn seconded the motion and motion adopted unanimously. There was a recent school bus accident on this road, which the Obsts' provided details on. MnDOT sets speed limits on all roads in the state. Nancy Madden made a motion to request that MnDOT conduct a traffic and speed study of 230th Street; that the City of Forest Lake be contacted to partner with the study on the portion of 2306 Street that extends west of New Scandia Township; and that signs be posted, if allowed.Michael Hinz seconded the motion and motion adopted unanimously. POSTING"NO PARKING"ALONG 209TH STREET During community events, vehicles have been parking along both sides of 209th Street between Oakhill Road and Olinda Trail, in front of the Community Center. This is a potential hazard to emergency vehicles that may need access along this route.Township Engineer Tom Peterson recommended prohibiting parking on the north side of 209th Street. The Planning Commission began their meeting at 7:30 p.m.The following members were in attendance: Chairman Chris Ness,James Malmquist,Peter Schwarz,Donnette Yehle and Kevin Nickelson. DAVE AND AMY HUME—VARIANCE Mr. David Hume, 14939 Old Marine Trail N., Marine on St. Croix, 55047,presented a request to construct a 960 sq. ft. accessory structure on their property. Legal: SW 1/4 of SE 1/4, Sec. 26. PID: 26-032-20-43-0008. This would constitute a third accessory structure on their 10.29-acre parcel November 14, 2006 New Scandia Town Board Page 2 and requires a variance.The two existing accessory structures, a 1,800 sq. ft. barn and a 288 sq. ft. chicken coop, are used to house chickens and llamas, and are not suitable for storing vehicles, so the proposed garage is needed. A variance would not be required to attach the proposed garage to the house,but this would harm the historic character of the house, which was build in the 1850's. The total square footage of accessory structures would be 3,048 feet,whereas 3,500 square feet is allowed on the 10.29-acre parcel. All setbacks would be met. The Planning Commission recommended to the Town Board that they grant the variance request of David&Amy Hume to construct a third accessory structure and to adopt Resolution 11-14-06- 01 that contains the findings of the Town Planner. ORDINANCE 89—PUBLIC HEARING AMENDING SECTION 11.2,CH.2 Mr. David Hebert presented Ordinance No. 89 to allow cluster/open space developments in the Shoreland Overlay District if part of a planned unit development. Chairman Ness opened the floor to public comment.Maria Hinz, 13800 182nd St., asked why not use this rule to be more strict with lakeshore development, like Tii Gavo, and why allow all the uses listed in the Ordinance for PUD's.The Planning Commission's response was that the lake would be better served with fewer homes on the lakeshore, which the Tii Gavo development would accomplish.Mike White, 13310 188th St., likes the Tii Gavo development and sees it as better for the lake than a standard development. Discussion among the Town Board continued. Supervisor Hinz felt a change should not be made for one developer. Chairman Seefeldt thought that a PUD can have more restrictions put on them, and that a community septic set back from the lake is better for lakeshore property. ORDINANCE 90—PUBLIC HEARING AMENDING SECTION 9.13(1),CH.2 Mr. David Hebert presented Ordinance No. 90 to allow metal sided buildings on parcels larger than 4-acres,rather than 5-acres,and apply the requirement that the accessory buildings resemble the principal building only on parcels less than 4-acres in size. There were no public comments. SCANDIA DEVELOPMENT,LLC—EMERALD ACRES Mr. Greg Johnson presented a request to add one lot for a total of 26 lots on the cul-de-sac, in the wooded area. Mr.Johnson indicated it would be economically unfeasible for them to continue the November 14, 2006 New Scandia Town Board Page 3 project without this extra lot due to the soft housing market and increase in costs. Two letters of refusal for financing were submitted. They have also asked the estate to reduce the price, but have not heard from them. The Planning Commission indicated they had recommended 23 lots and the Town Board approved 25 lots. The Commission said they had accommodated the developer as much as possible. Supervisor Hinz commented on the initial concern of building in the woods, and that this additional lot is to be located in the woods. Supervisor Madden stated that the request is not acceptable, as decisions such as this are not based on economics. Mr. Johnson thanked the Boards for their time. RESCHEDULE THE JANUARY PLANNING COMMISSION MEETING The January meeting of the Planning Commission has been rescheduled to the 9th, due to the new City Council holding their first meeting on January 2nd. It would be desirable for the Council to have at least one meeting prior to a scheduled Planning Commission meeting. The new Council will determine the schedule of meetings for the coming year. KEITH'S LANSCAPING—CUP Staff investigation of the sewer/water facilities found that no sewage system is required by the Building Code or Washington County sanitation regulations as the building is essentially cold storage with a dirt floor,no water supply and no office or employees working on site. However, original conditions required three paved parking spaces. Deadline/ Timeline: N/A Background: • The Ice Rink Repair Committee requested that LMCIT, our insurer, review the safety of the ice rink prior to the skating season. • The inspection was made on Friday, November 17. The report is attached. The main recommendations are to fill in gaps between the boards, tighten protruding screws, and replace pieces of plastic dasher boards where there are gaps. • The recommendations were reviewed with Mike White and he is beginning to work on some of the recommendations. Recommendation: LMCIT recommended that the Board discuss the report at a public meeting, and that your decisions be described in the minutes. While we have begun to implement the recommendations, it may be difficult to complete them this fall because of the weather and the cost of the repairs. A decision will be made in 2007, when the new City Council takes office, on whether or not to spend additional funds to repair the present dasher boards, to purchase new boards, or to obtain and install a set of used boards that may be available from another community. During today's survey,I noted that there are several areas that have gaps between the pieces of plastic dasher boards. To help prevent a skater from getting their stick caught in these gaps,it is recommended that you either fill-in or cover these gaps. 2-11/06 Tighten all the screws that are protruding out from the plastic dasher boards. There are potentially hundreds of screws that are protruding out from the plastic dasher boards. Individna s skating on this rink can catch there clothing or skin on these protruding screws. It is recommended that you tighten all of the protruding screws. If the wood behind the screws is rotten and the screws will not tighten, it is recommended that you remove the screws. 3-11/06 Replace the broken plastic dasher boards. I noted during today's survey that there are several locations were the plastic dasher boards are broken. It is recommended that you cut out the broken pieces and replace them with new plastic. I noted that there are three or four pieces of the same plastic in the Vamboni room. 4-11/06 Review and discuss these recommendations with the Township Board. As we discussed,the city/township may find it difficult to complete these recommendations this fall because of weather, economics and the transition from a township to a city. The city has verbally committed to purchase different dasher boards from a neighboring city next spring and may not want to put a lot of money into these boards. It is recommended that you bring these recommendations to the Township Board for their review. The Township Board should make their decision on these recommendations based on the economic and political environment at this time. Their decision should be outlined in the Board meeting minutes. EXECUTIVE SUMMARY Washington County's Mission: To provide quality public services in a cost-effective manner through innovation, leadership, and the cooperation of dedicated people. Washington County's All-Hazard Mitigation Plan Mission: To work with surrounding communities, local emergency responders, businesses, organizations, and the public to create a proactive and results-oriented plan by identifying measures that will prevent loss of life and damage to property and reduce future risks in Washington County. Purpose of the Plan Washington County is subject to many natural and human caused disasters. These events could cause injury or loss of life,property damage, and damage to the infrastructure that would affect the quality of life for its residents. As development moves east from St. Paul and its suburbs,population vulnerability is spread over a wider geographic area. Because of this, Washington County Emergency Preparedness has drafted this mitigation plan so that hazards are ranked, strategies identified, and goals set for reducing or eliminating the effects of a natural or human caused disaster. The purpose of the All-Hazard Mitigation Plan is to identify hazards,risks, and vulnerabilities throughout the county and then determine how to reduce or eliminate the loss of life and property damage resulting from natural and human-caused hazards. Washington County's mitigation plan encompasses natural, technological, and human-caused hazards in an effort to prepare for a variety of dangers. Hazards are listed and examined for potential effects in Washington County. Capabilities are analyzed and local, state, and federal resources are identified. Washington County will utilize the plan by implementing specific mitigation projects or changing day-to-day operations within the local government to reduce impacts of various hazards. Approval of the plan does not incur direct costs. It involves, rather, a paradigm shift. A relatively small amount of money spent before a disaster can greatly reduce the damage and expense after it happens. We believe the ultimate success of a planning project depends on its acceptance and support by the community. Working with the New Scandia Township, we will develop the Plan in a timely and efficient manner that meets the needs of the community and guides the Township through 2025. We will concentrate on your priorities, but our approach is flexible so we can address the changing needs of the community throughout the planning process. General Description of the Major Planning Tasks. The following provides a general overview of the major tasks associated with our proposed work program. We will provide a more detailed work program once we have had the opportunity to discuss the program with you and refine it to meet your needs. Task 1: Project Start-Up A. Meet with Township to refine work program, schedule, and public participation program. B. Gather and review existing data from the Township and other sources. We understand the Township has existing electronic mapping data from the County that will be available for our use. Task 2: Inventory and Analysis A. Conduct a general analysis of parks, trails, open space, and recreation facilities in the Township and surrounding region. Our analysis will identify regional parks, school district recreation facilities, and significant private recreation facilities. B. Conduct a detailed analysis of parks, trails, open space, and recreation facilities in the Township. We will visit existing facilities in the Township and identify issues and opportunities with each. We will map each existing facility based on available information and aerial photographs. We will also map significant open space in the Township based on site visits, and input from the Township, and other sources including the DNR. C. Analyze demographic characteristics and recreation needs. Using the latest census data, we will analyze and map key demographic characteristics as they relate to the Plan. We will also identify existing and future recreation needs based on the current and projected population. Conduct optional survey of residents. The$20,000 and $30,000 options budget $3,000 to solicit public input beyond the open houses and committee meetings. We will discuss various participation options with the Township and implement the most appropriate option for the community. This could include a limited telephone or mail survey. If additional public participation is desired, we will adjust our work program accordingly. Task 3: Vision, Goals,and Policies A. Prepare draft vision, goals, and policies. We will work with the Park and Recreation Committee to develop a draft vision, goals, and policies that are meaningful and accurately represent the desires of the community. B. Conduct community open house. We will conduct a community open house to solicit input from the general community on the inventory and analysis and the draft vision, goals, and policies of the Plan. Task 4: Plan Preparation A. Prepare draft Plan. We will develop a draft Comprehensive Parks, Trails, Open Space, and Recreation Facilities Plan (including text,photographs, and maps). B. The$20,000 option budgets $1,400 to prepare conceptual master plans for existing and future parks in the Township. The$30,000 option budgets $6,000 to allow for the preparation of more detailed master plans. C. Conduct committee meeting so develop and review the draft Plan. We anticipate meeting with the Park and Recreation Committee once a month throughout the planning process. We would also update the Planning Commission and the Town Board on the progress of the draft Plan. D. Refine draft Plan. Based on input from the Park and Recreation Committee, Planning Commission, and City Council, we will refine the draft Park Plan accordingly. Task 5: Plan Implementation A. Identify funding sources and opportunities. B. Set priorities, develop an implementation schedule, and identify responsible entities for implementing the Plan. All three options would provide the Township with a meaningful and useful Plan. The following Board Members were also present: Chairman Dennis Seefeldt,Vice Chairman Michael Hinz, Lisa Crum, Blair Joselyn and Nancy Madden. Blair Joselvn/Park and Recreation/BMX Track Mr. Blair Joselyn reported the following information from the meeting that was held with the Park and Recreation Committee and the parents of the BMX Track users. 1)use Township money for upkeep and to construct the track, 2)user pays for construction,3)Township users-split the costs,4)Township money constructs the track and the upkeep comes from a new formed bikers association fund, 5)Township leases the track to the users. The Board Members informed the residents that were attending the meeting that the Township is in the planning process of preparing a Comprehensive Parks, Trail,Open Space and Recreation Facilities Plan for the entire Township and the BMX Track would be addressed in the plan. The parents were not willing to wait for the plan and expressed that they would like the BMX Track rebuilt now. Michael Hinz made a motion to rebuild the BMX Track close to the current location, but move the track north and east from the woods per Mr. Gribble's recommendations. The plan for the rebuilding submitted by Julie O'Neil be used with the Township supplying the material. Mr.Harris will contact parents to do the rebuilding of the BMX Track. Nancy Madden seconded the motion and motion adopted unanimously. Letter From Minnesota Pollution Control AaencvBliss Collector A letter was received from Minnesota Pollution Control regarding the proposed MPCA permit for operation of the Bliss Sewage System. Mr.Pete Genzel Washington Department of Health had addressed and submitted a letter to the Minnesota Pollution Control regarding the additional monitoring and action plans and how it will increase operating costs and ultimately user charges. It was agreed Dennis Seefeldt and Blair Joselyn should meet with Pete Genzel and review the issue. Comprehensive Parks,Trails,Open Space and Recreation Facilities Plan Blair Joselyn made a motion to sign the contract with Sanders Wacker Bergly Inc. for the Comprehensive Parks,Trail,Open Space and Recreation Facilities Plan. Deadline/ Timeline: The transition from New Scandia Township to the City of Scandia will be official on January 1, 2007. Background: • Letterhead,business cards, forms, signs and many other materials will need to change over time to reflect the new municipal identity. • Current letterhead bears a small image of the Swedish Settler's monument,but other symbols have also been used (such as a Dala horse.) • There is an opportunity at this time to create a new logo with little or no additional expense as new materials and signs are ordered. • Cities sometimes use a contest to solicit designs for new logos, inviting residents and local artists to submit their designs. Often a small prize is offered as an incentive, in addition to recognition by the community. The winner may be chosen by the Board/Council, or by a committee appointed to do so. Contest rules should specify that entries become the exclusive property of the city, and that the city has the right to reject all entries. Some graphic standards should also be included, such as the format for entries and that it be reproducible in color as well as black and white. Representing the history of the community, or its natural resources, or some other theme could be chosen. • Another option would be to hire a graphic designer to develop logo options; however, this would involve additional expense and would not have the advantage of involving the community in creating the new image. Recommendation: I recommend that the Board discuss a preferred approach to developing a new logo. Should you wish to hold a contest, some lead time for publicity,judging, etc. will be needed so it would be desirable to start the process soon. A Watershed District is a special purpose local unit of government. It is established for the purpose of managing water resources. It is different from all other local government units in that its boundary is determined by the natural divide that defines the drainage basin of a river, stream, or a lake, rather than the political boundaries of townships or counties. There is no maximum or minimum size set for watershed districts. By law, districts have been established for relatively small watersheds, as well as very large ones, such as the Red Lake Watershed District, which encompasses more than 6000 square miles. The Watershed Act allows districts to act on a broad range of water problems. Some of these include drainage and flood control, lake management, soil erosion and sedimentation, water quality, groundwater management, water supply, and floodplain management. What are the responsibilities of Watershed District Authorities? The Watershed Act provides districts with authorities needed to manage water resources. Some of their responsibilities are as follows: • To develop the Watershed Management Plan • To investigate and undertake water management improvement projects • To act as grant-eligible body for the application for and administration of state and federal grants • To adopt rules to regulate activities that can cause water-related problems • To acquire property needed for improvement projects • To assess properties benefitted by improvement projects • To exercise limited authority to levy taxes to finance district operation establishment petitions have been submitted by counties, rather than cities or landowners. When a petition is filed, B.W.S.R. is required to conduct a public hearing within the area of the proposed district to receive comments on the proposed district. In order to establish a district, B.W.S.R. must find that the proposed district would serve the purposes of the Watershed Act. Watershed Districts and the Watershed Management Plan The first responsibility of a new district is to prepare a watershed management plan. A watershed management plan must be written before the district can carry out any projects. This plan must describe existing and potential water problems in the district, describe possible solutions, and define the general objectives of the board of managers. The board of managers is required to appoint a local advisory committee to assist it in putting together the watershed management plan. The Board of Water and Soil Resources is required to conduct a public hearing on the watershed management plan before it can be put into effect. How do State and Federal laws and regulations apply to Watershed Districts? Watershed Districts are not exempt from other state and federal laws and regulations. It is important to realize that although the Watershed Act provides the district with a number of authorities to deal with local water management. the districts' actions must be consistent with other applicable laws and rules. For example. if a district is going to carry out a lake level control project, the district would need to obtain a permit from the Minnesota Department of Natural Resources to install a lake level control structure, the same as any other local unit of government or individual. There are common misconceptions about this. solutions to water problems. For example, once a district's Watershed Management Plan is in place, landowners can petition the board of managers for any type of project that conforms to the plan. This flexibility makes it possible for a district to become involved in just about any type of project that may be needed to alleviate a local water problem. It is important to remember that watershed districts are not the sole managers of water resources.
