Adjournment tC) ) December 19, 2006 Chairman Dennis Seefeldt called the final meeting of the New Scandia Town Board to order at 7:30 p.m. The following members were present: Chairman Dennis Seefeldt, Vice-Chairman Michael Hinz, Michael Harnetty, Blair Joselyn and Nancy Madden; Administrator Anne Hurlburt. PUBLIC FORUM Scott Graven, 22811 Perkins Avenue, commented on problems of water run-off along Perkins Avenue. Water currently runs through Mr. Graven's backyard, over his septic and driveway. Town Engineer Tom Peterson was asked to look at this. Mike White, 13310 188th Street, thanked the Board members for their many years of serving on the Town Board. Nancy Madden made a motion to approve the consent agenda. Blair Joselyn seconded the motion and motion adopted unanimously. PARK AND RECREATION COMMITTEE Deb Campobasso, Chair of the Park and Rec Committee, was present to report on a proposal to sponsor a Family Open Gym time on Saturday mornings at Scandia Elementary. This program would run on four Saturdays beginning January 27 from 9:00 a.m. to noon at no cost to participants. The Committee has received approval from the Forest Lake School District, but will need to cover the cost of having a custodian on duty during activities. The Committee has approached both the Scandia-Marine Lions and the Forest Lake Athletic Association for possible funding. Supervisor Harnetty felt that this is a cost of having a recreation program and that the funding could come from Town funds if donations do not materialize. The Board instructed Ms. Campobasso to proceed with the program and to request funding from the two organizations. Michael Harnetty made a motion to allocate up to $600.00 towards the Open Gym program. Blair Joselyn seconded the motion and motion adopted unanimously. New Scandia Town Board December 19, 2006 Page 2 POLICE DEPARTMENT Deputy Chris Howard was present to report that police activity has been quiet during the past month. Deputy Howard also expressed his pleasure in working with the Town Board the past two years as the assigned deputy for New Scandia Township. FIRE DEPARTMENT Fire Chief Steve Spence was present to report on the Homeland Security Grant that has recently been awarded to Washington County to cover the cost of radio communication upgrades. Scandia Fire and Rescue will receive approximately$44,000.00 in grant aid. This leaves a cost of$22,000 to the department for the radio purchase. Fire Chief Spence will present more details on the timeline of this purchase as they become available. The 2007 pay schedule was presented to the Board with a $1.00 per hour increase in the base pay level for paid-on-call firefighters. Nancy Madden made a motion to approve the 2007 Pay Schedule for the Fire and Rescue Department. Dennis Seefeldt seconded the motion and motion adopted unanimously. Fire Chief Spence extended his compliments to the Board for their fine work these past years. TOWNSHIP ENGINEER Tom Peterson was present to report on an update of the 2007 Road Improvement Project. Mr. Peterson stated that 205th Street looks like a good candidate for DNR grant funding as it provides access to public water. Mr. Peterson expects a response from the DNR by January or February. The timeline for the 2007 project is on schedule, as surveying has begun and studies of 197th and 205th Streets is currently underway. Mr. Peterson suggested an informal meeting with residents of 197th and 205th Streets be scheduled for later in January. Supervisor Joselyn recommended an ecological consultant study the plant community in the vicinity of these sensitive roads. Mr. Peterson will refer to the"Spring Creek Report"done by the Watershed. ADMINISTRATOR ANNE HURLBURT Recreation Program Coordinator Recreation Program Coordinator Marty McKelvey was present to report on proposed 2007 recreation programs. Many new program offerings are being added. Camp Lakamaga has offered to co-sponsor a number of programs. Programs for seniors and the disabled are also being looked into. Community Education may handle registrations, but details are being negotiated. The consensus of the Board was that everything looks good. Park and Recreation Budget Administrator Hurlburt suggested that a Parks Capital Improvement Fund be created in which revenues can be deposited to better ensure that state law requirements for park dedication fees are New Scandia Town Board December 19, 2006 Page 3 met. There is currently a deficit of$5,328.59 in the Park Fund due to improvements to the Hay Lake parking lot in 2006 at a cost of$12,134.50, with revenue of$6,200 from park dedication fees. Michael Hinz made a motion to create a Parks Capital Improvement Fund with funding from all future park dedication fees. Nancy Madden seconded the motion and motion adopted unanimously. Nancy Madden made a motion to move funds from the Capital Improvement Fund left from the 2006 budget into the newly created Parks Capital Improvement Fund. Michael Harnetty seconded the motion and motion adopted unanimously. Audio-Visual Equipment Update Administrator Hurlburt reported on the lack of response for bid proposals for A/V equipment in the Town Board Room that were requested by December 1, 2006. It was suggested to contact a designer to prepare plans and to outline equipment needed, so that the request for bids can then be more specific. JANUARY 2, 2007 COUNCIL MEETING Plans were discussed for a formal swearing-in of new council members at 7:00 p.m. with a short reception to follow. The community will be invited to attend the program in the Community Center hall. The business meeting will then begin at 8:00 p.m. A draft of an invitation and program were reviewed. CERTIFYING 2007 TAX LEVY—RESOLUTION 12-19-06-01 Cities are required to certify a final levy by year-end. Washington County staff has recommended that the township certify a final levy for 2007 to ensure that there are no problems or issues with the tax levy due to the transition to city status. Michael Hinz made a motion to adopt Resolution 12-19-06-01 Certifying Property Tax Levy Payable in 2007. Nancy Madden seconded the motion and motion adopted unanimously. CERTIFICATE OF COMPLICANCE EXTENSION—JIM SIMPSON A Certificate of Compliance for a 5,500 square foot ag building was issued to Jim and Peggy Simpson, 23393 Nolan Avenue, on November 1, 2005. Site preparation has begun, but the building has not yet been constructed. Mr. Simpson has asked for an extension of the CC, as they expire after one year. Michael Hinz made a motion to approve Resolution 12-19-06-02 Extending the Certificate of Compliance for Jim and Peggy Simpson. Blair Joselyn seconded the motion and motion adopted unanimously. Mr. Simpson's Certificate of Compliance will expire on November 1, 2007. New Scandia Town Board December 19, 2006 Page 4 EMERALD ACRES —EXTENSION OF PRELIMINARY PLAT New Scandia Township approved the preliminary plat of Emerald Acres on June 20, 2006. The Development Code reads that the final plat must be presented within 180 days (December 20, 2006). Steve May, developer, has requested an extension due to negotiations for the purchase of the property. Michael Hinz made a motion to grant an extension of 180 days to Scandia Development, LLC to submit a final plat of Emerald Acres. Michael Harnetty seconded the motion and motion adopted unanimously. APPOINTMENT OF A PROSECUTING ATTORNEY Upon incorporation of the township, Washington County will no longer provide for prosecution of petty misdemeanor, misdemeanor and gross misdemeanor-level offenses committed in Scandia by adult offenders. Michael A. Welch, Hebert and Welch, P.A., has submitted a resume offering prosecution services. Nancy Madden made a motion to appoint Michael A. Welch as the prosecuting attorney for the City of Scandia. Michael Hinz seconded the motion and motion adopted unanimously. 201 SEPTIC SYSTEM Washington County Department of Public Health has submitted a draft budget of$35,362 for maintenance and operation of the Bliss and Anderson/Erickson sewer system. Michael Hinz made a motion to approve the 2007 budget for the 201 sewer system. Blair Joselyn seconded the motion and motion adopted unanimously. A letter was received from the State Auditor concerning the operating losses of the Sewer Fund in 2004 and 2005. The primary reason for the losses was an unfunded depreciation expense of $30,000 per year. There were also some expenses in 2005 for system repairs, which were not passed along to users but taken from the fund balance. The annual budget does include funds for future repairs and replacements, and at the end of 2005 the fund balance was $115,394.50. Washington County staff have indicated that major replacements will not be needed for at least 20 years, and that annual repairs have been relatively inexpensive. The annual replacement fund contribution ($5,000 for 2006) and balance should be adequate. Collections on unpaid bills, which are certified to property taxes, have lagged. Billing procedures will be reviewed in the coming year and Ordinance 24 will be updated as it relates to billing procedures and rates for the sewer system. A letter drafted by Administrator Hurlburt in response to the State Auditor's concerns was discussed. Michael Harnetty made a motion to approve the response letter to the State Auditor. New Scandia Town Board December 19, 2006 Page 5 2007 PAY RATES Michael Hinz made a motion to approve the 2007 pay rates for hourly Town employees. Nancy Madden seconded the motion and motion adopted unanimously. GENO CAMPOBASSO—PETITION FOR ADDITIONAL HOCKEY ICE TIME Geno Campobasso, 12590 Mayberry Trail,presented a petition to the Board stating a request for additional ice time to be set aside for open hockey on the ice rink. Mr. Campobasso would like the schedule revised to allow for alternating times between pleasure and open hockey hours on the rink. Supervisor Harnetty felt his request was logical but too late in the season to make a change in the schedule. Mr. Campobasso was advised to attend a scheduling meeting in the fall of 2007 to make suggestions. Hockey teams were allowed to reserve ice time up to December 1, 2006. Unused blocks of time may be designated as open hockey. Michael Harnetty made a motion to now close reservations for ice time to hockey teams. Nancy Madden seconded the motion and motion adopted unanimously. TEMPORARY SNOW PLOW OPERATOR Bob Lindblom, hired as a temporary snowplow operator, will be on vacation through January 1, 2007. Arrangements have been made with Tom Helke to fill this position. Michael Hinz made a motion to designate Tom Helke as temporary snowplow operator at a rate of$16.50 per hour. Nancy Madden seconded the motion and motion adopted unanimously. FAREWELL Chairman Dennis Seefeldt recognized the out-going Board members Michael Hinz, Blair Joselyn and Nancy Madden with a listing of their many contributions to the Town Board. Mayor Dennis Seefeldt called the meeting to order at 8:00 p.m. The following councilmembers were present: Mayor Dennis Seefeldt, Pete Crum, Michael Harnetty, Dolores Peterson, Donnette Yehle; City Administrator Anne Hurlburt. ORDINANCE NO. 91 —ESTABLISHING RULES FOR THE ORGANIZATION AND PROCEDURE OF THE CITY COUNCIL OF THE CITY OF SCANDIA The first order of business was to adopt rules for the organization and procedure of the City Council through an ordinance, as recommended by the MN League of Cities. A draft ordinance was reviewed. The practice of holding a City Council meeting along with the Planning Commission on the first Tuesday of the month will continue. Councilmember Yehle suggested staff reports be moved up on the agenda to better accommodate the use of the police and fire chiefs time. Mayor Seefeldt felt that the agenda may be flexible to allow for addressing reports earlier in the meeting if necessary. As Public Hearings will be posted to begin at 7:00 p.m.,it was decided to have the hearings scheduled at the front of the agenda. It will be the practice of the council to approve the agenda at the beginning of the meeting so that any additions can be noted at that time and will be acted upon at the appropriate place in the meeting. A separate meeting will no longer be held prior to the start of the business meeting for the payment of vouchers. The councilmembers will receive a list of all claims to be paid prior to the meeting. This will allow the business meeting to begin at 7:00 p.m. and eliminate the handling of bills and checks at the Council table. Dolores Peterson made a motion to adopt Ordinance 91 Establishing Rules for the Organization and Procedure of the City Council of the City of Scandia.Pete Crum seconded the motion and motion adopted unanimously. RESOLUTION 01-02-07-01— APPOINTMENT OF AN ACTING MAYOR AND OTHER CITY OFFICIALS AND REPRESENTATIVES Councilmember Peterson nominated Michael Harnetty to serve as Acting Mayor for 2007 in the absence of Mayor Seefeldt. No other nominations were made. Donnette Yehle made a motion to appoint Michael Harnetty as Acting Mayor. Pete Crum seconded the motion and motion adopted unanimously. Resolution 01-02-07-01 includes the appointments of additional city staff and representatives. Michael Harnetty made a motion to adopt Resolution 01-02-07-01 Appointing an Acting Mayor and Other City Officials and Representatives.Donnette Yehle seconded the motion and motion adopted unanimously. RESOLUTION 01-02-07-02—DESIGNATING OFFICIAL DEPOSITORIES FOR 2007 Councilmembers reviewed the recommendations for depositories for banking and investment purposes. Michael Harnetty made a motion to adopt Resolution 01-02-07-02 Designating Official Depositories for 2007. Dennis Seefeldt seconded the motion and motion adopted unanimously. RESOLUTION 01-02-07-03—RATIFYING SURETY AND BLANKET BONDS FOR CITY EMPLOYEES FOR 2007 State Statutes require the City to provide surety and blanket bonds to ensure the faithful performance of various employees. Dolores Peterson made a motion to adopt Resolution 01-02-07-03 Ratifying Surety and Blanket Bonds for City Employees for 2007. Donnette Yehle seconded the motion and motion adopted unanimously. January 2, 2007 Scandia City Council Page 2 DESIGNATION OF AN OFFICIAL NEWSPAPER FOR 2007 Attorney Hebert reviewed the state law qualifications a paper needs to meet to be designated as an official newspaper.For a city the size of Scandia,the paper must have at least 500 copies delivered to local residents and have an office located within the county. As the Country Messenger,the designated legal paper for 2006,has a circulation of 359 and an office outside of Washington County, it does not meet the legal qualifications.The Forest Lake Times also submitted a bid.The Times delivers to 965 households in the 55073 zip code and does meet the qualifications.The Council discussed that although the Messenger is the local paper, legally it does not qualify.The councilmembers agreed that the designated legal paper needs to reach as many readers as possible. Carter Johnson,editor of the Country Messenger,was present and asked the council if the decision could be reconsidered at a future time.Mr.Johnson was told that if he could supply supporting conditions of meeting legal requirements,the Council could take the matter up at another time within the year. Donnette Yehle made a motion to designate the Forest Lake Times as the official newspaper for the City of Scandia in 2007.Michael Harnetty seconded the motion. Voting as follows: Crum—yes; Peterson—yes; Seefeldt—yes; Harnetty—yes; Yehle—yes.Motion adopted. RESCHEDULING THE JANUARY PLANNING COMMISSION MEETING Due to an error on the part of the Country Messenger,required legal notices for public hearings that were scheduled for January 9, 2007 were not published. A new date of January 23,2007 was selected to hold the City Council and Planning Commission meetings.Publication and mailing deadlines can be met for this date. Michael Harnetty made a motion to reschedule the January 9,2007 City Council and Planning Commission meetings to January 23,2007.Donnette Yehle seconded the motion and motion adopted unanimously. BOARD OF APPEALS AND EQUALIZATION MEETINGS Washington County needs to include meeting dates for the Board of Appeals and Equalization for the City of Scandia in notices to taxpayers.The County has tentatively set the date for April 9, 2007 from 4:00 p.m. to 6:00 p.m. A reconvened meeting needs to occur within 20 days. Dolores Peterson made a motion to approve the dates of April 9,2007 from 4:00 p.m.to 6:00 p.m. with a reconvened meeting on April 17,2007 at 6:30 p.m.for the Board of Appeals and Equalization meetings.Michael Harnetty seconded the motion and motion adopted unanimously. CITY COUNCIL REGULAR MEETING SCHEDULE FOR 2007 The Council reviewed the meeting schedule for 2007. The practice of holding its regular meeting on the third Tuesday of the month and a meeting with the Planning Commission on the first Tuesday of the month, as the Town Board had met, will be continued.Notice of any special meetings will be posted at the Community Center. Pete Crum made a motion to adopt the City Council meeting schedule for 2007.Donnette Yehle seconded the motion and motion adopted unanimously. CITY COUNCIL AND ADVISORY COMMITTEES The Council reviewed the status of current committees. Both the Planning Commission and the Park and Recreation Committee each have one vacancy.The Incorporation Committee will be abolished. The Road Committee, formed to provide input on paving projects,evaluate road repair issues and advise on capital improvement for equipment, will be disbanded as it was felt that these issues would better fit with the Capital Improvement Committee. A Public Works Supervisor will evaluate and monitor pavement conditions and report to the Administrator. The addition of a Comprehensive Plan Committee will be January 2, 2007 Scandia City Council Page 3 necessary for the update of the Comp Plan as needed by the end of 2008. The need for a Commercial and Retail Development Committee was also agreed upon. Additional discussion continued on the structure of the Rural Landscape Preservation Committee,perhaps expanding the scope and emphasizing"Rural Character Preservation"as its mission. Councilmember Harnetty felt that the Park and Recreation Committee may be devoting too much time on environmental elements rather than programs and facilities and that there may be a need for an environmental committee. Councilmembers Harnetty and Crum were appointed to review the current standing committees and report on recommendations at a future meeting. Donnette Yehle made a motion to proceed with advertising a notice for filling appointments to the Planning Commission,Park and Recreation Committee, Comprehensive Plan Committee and a Commercial and Retail Development Committee. Dolores Peterson seconded the motion and motion adopted unanimously. February 15, 2007 was selected as a deadline for applications to the Planning Commission, so that an appointment can be made by the March meeting. ORDINANCE 92—REGULATING THE SALE AND USE OF TOBACCO PRODUCTS WITHIN THE CITY OF SCANDIA Washington County has renewed all current tobacco licenses for 2007.No new licenses may be approved until the city adopts its own ordinance. Dolores Peterson made a motion to adopt Ordinance 92 Regulating the Sale and Use of Tobacco Products within the City of Scandia. Dennis Seefeldt seconded the motion and motion adopted unanimously. RESOLUTION 01-02-07-04—SETTING TOBACCO LICENSE FEES The proposed license fees are the same as that charged by Washington County for 2007. Donnette Yehle Made a motion to approve Resolution 01-02-07-04 Setting Tobacco License Fees. Dolores Peterson seconded the motion and motion adopted unanimously. ORDINANCE 93—ADOPTING LIQUOR REGULATIONS FOR THE CITY OF SCANDIA Current liquor licenses issued by Washington County will expire on March 31, 2007.The city must adopt a liquor ordinance, followed by a public hearing to set fees after a 30 day written notice to license holders. Pete Crum made a motion to adopt Ordinance 93 Adopting Liquor Regulations for the City of Scandia.Michael Harnetty seconded the motion and motion adopted unanimously. The public hearing to set fees will be scheduled for February 20, 2007. ORDINANCE 94—SETTING SALARIES OF MAYOR AND CITY COUNCIL Councilmembers Peterson and Yehle worked with Administrator Hurlburt to draft an ordinance setting salaries for the council. A salary of$3,700 per year for Mayor and $3,000 per year for Councilmember was presented. There would be no additional compensation to members that serve on special committees. The total compensation for 2007 would equal $15,700. The amount budgeted for 2007 was $16,000. This amount falls slightly below the average compensation level for a city between 4,000 to 6,000 in population as calculated by the League of MN Cities. Donnette Yehle made a motion to adopt Ordinance 94 Establishing Compensation for the Mayor and City Council of the City of Scandia. Dolores Peterson seconded the motion and motion adopted unanimously. January 2,2007 Scandia City Council Page 4 REIMBURSEMENT POLICY Councilmembers reviewed an expense reimbursement policy as drafted by Administrator Hurlburt. Compensation for Planning Commission and committee members would be changed from a per meeting or per hour rate to a flat dollar amount,to be paid quarterly. Members would need to attend a majority of the official meetings during that quarter to receive their payment. Compensation for Planning Commission and Park and Recreation Committee are addressed in the policy as follows: Planning Commission member : $250 per quarter Planning Commission chair : $300 per quarter Park and Rec Committee : $60 per quarter Compensation for any other advisory committee members shall be set by the City Council when the appointment is made. Dolores Peterson made a motion to approve the Expense Reimbursement Policy for the City of Scandia.Michael Harnetty seconded the motion and motion adopted unanimously. CITY COUNCIL TRAINING AND ORIENTATION NEEDS A Workshop Meeting of the Council will be scheduled for January 30, 2007 at 7:00 p.m. to review the city's budget and finances. An Open Meeting Law video from the League of MN Cities will also be viewed. Prior to the Board of Appeals, the council must have at least one member receive training on this process. Michael Harnetty has previously attended the training. Donnette Yehle and possibly Pete Crum will attend the January 18, 2007 Board of Appeals training.The League of MN Cities is offering training to councilmembers at a conference scheduled for January 26 and 27, 2007. Michael Harnetty and Donnette Yehle indicated that they would attend this conference. Councilmember Harnetty indicated a need for a communications point person designated to issue a press release of the official version of city business as decided by the council. A need for quarterly newsletters was also discussed. Councilmember Harnetty and Administrator Hurlburt will discuss this topic and provide a position statement at a future meeting. Deadline/Timeline: Background: • Planning and zoning application fees must be established by ordinance, following a public hearing. • Fees may be sufficient to cover the costs of the city's review. The draft ordinance provides for a non-refundable application fee to cover city staff time and overhead, with an escrow deposit against actual out-of-pocket costs to be paid by the applicant. When mailed notices to property owners are required, an additional deposit against the cost of the parcel search (paid to the county) would also be required, as is the current practice. • The township charged application fees for variances ($150), conditional use permits ($200), minor subdivisions($100), preliminary plats ($250) and rezonings ($150). The draft ordinance would keep the same fees for all of these applications except for rezonings, which are recommended to increase from $150 to $500. The driveway permit fee($25) would remain the same as was charged by the township. • The township did not charge an application fee for certificates of compliance. The fee proposed ($75 for residential, $150 for commercial) is the same as what has been charged by Washington County. • Fees were also added for several other application types, including grading and land alteration ($125, same as what was charged by the county) interim use permits ($200, same as a conditional use) and environmental reviews ($750.) A relatively small fee for sign permits ($25) is recommended, as the cost to issue the permit would be small and the permit fee should not deter compliance. • Higher fees are proposed for planned unit developments and open Page 1 of 2 01/02/07 space conservation subdivisions ($750) than for other subdivisions. These types of applications will require significantly more time and effort on the part of the city to process. • The draft ordinance provides for a minimum escrow deposit against which all of the city's out-of-pocket costs would be charged. Minimum escrows would be lowest for applications likely to be requested by homeowners (variances and CUPs, $250) but significantly higher for those relating to developments for which significant expenditures for planning, engineering and legal consultants are expected. No application shall be cbrnsidered complete until the fees have been paid. For requests requiring mailed notice for'public hearings the applicant shall also pay the minimum fee for a parcel search at the time of application. Application fees are not refundable. (B) In addition to the application fee, applicants shall be required to reimburse the city for all out-of-pocket costs that are incurred for processing,reviewing and hearing the application. These costs shall include,but are not limited to: publication and mailing of notices; review by the city's engineering, planning and other consultants; legal costs,and recording fees. Consider the request to contract with Bunker Park Stable, Inc. to provide a hay ride during the event. Deadline/ Timeline: The event is scheduled for Sunday,January 29, 2007 Background: • At its October 17, 2006 meeting the Town Board gave the committee the go-ahead for the winter event. • The flyer announcing the event is attached. The budget for this event is approximately$700, including the proposed hay ride (approximately$550). • The contract for the hay ride includes a provision releasing and holding harmless the operator from all liability for personal injury or property damage. The City would assume all risk. This provision has been reviewed by the City's insurance agent and our insurer, LMCIT. They recommend that the City not sign this contract. • Staff contacted Bunker Park Stable, Inc. to inform them of this concern. They indicate that they do have insurance,but they will not conduct any hay ride unless the customer agrees to assume liability. Recommendation: The Council should receive the report, and discuss whether or not to authorize the contract with Bunker Park Stable for the hay ride. Penny Esch in our Underwriting Department forwarded a copy of the proposed agreement between the City and Bunker Park Stable, Inc. to me. Under the contract, Bunker Park Stable is to provide hayrides (in a wagon drawn by horses)at the City's festival. The contract states that the city will "assume all risk and hazards"and will "release and agree to hold harmless all agents and employees of Bunker Park Stable from all liability for personal injury or property damage." This provision in the contract is the opposite of what LMCIT recommends to cities. LMCIT advises cities that when hiring any contractors, they should ensure that the contractor has liability insurance and also names the city as an additional insured. The mere fact that the contractor wants the city to assume the risk, where the city really has no control over the activity, raises some red flags. While I cannot say that a hayride is a "high risk"activity, where you have an activity involving horses and kids, it certainly seems like an activity where someone could be easily injured, perhaps seriously. It's not very hard to imagine someone falling of the hayride wagon or being stepped on, bitten or kicked by a horse. Just a brief search of the Internet revealed many concerns about the safety of hayrides. Attached is a link from the National Safety Council about hayrides: http://www.nsc.org/news/nr092603.htm#psa Accordingly, I recommend that the City not enter into the contract with Bunker Park Stable. Review the report on the 205th and 197th Street Environmental Study and discuss how to share this information with affected residents. Deadline/ Timeline: Background: • When the Board voted to order the 2007 Road Improvement Project, 205th Street and 197th Street were excluded from the project, pending further study of the environmental impacts. • BRA has completed their study, which includes recommendations for the improvements to minimize impacts. • The Engineer has previously recommended that the next step could be to schedule an informal meeting with concerned residents, early in February. • A meeting with residents could be held on one of the following dates: Wednesday, February 7; Monday, February 12; or Tuesday, February 13. The Council could then consider whether or not to include these street segments in the project at its February 20, 2007 regular meeting. Recommendation: The Council should receive the report, and decide whether or not to hold a meeting with residents to review the findings on 205th and 197th Streets. It should be noted that "205th" includes Quint Avenue to the south and "197th" includes Quint Avenue to the south. Concerns for both streets pertain to: • Safety • Drainage and stormwater treatment issues • Impacts to a nearby trout stream and the St. Croix River • Tree removal • Impacts to the habitats of animals and plants in the area Bonestroo, Rosene,Anderlik&Associates, Inc. (Bonestroo), the City of Scandia Engineer,has studied the environmental concerns for both streets.We have carefully considered all feedback and information from residents and associated agencies, as well as previous studies pertaining to the area.The following is a brief analysis of the current conditions,environmental concerns, and proposed improvements for each street, followed by a summary of effects the street paving will have on the area. • 205th Street Existing Conditions 205th Street is a steep gravel road that ends with a circular , boat launch area adjacent to the St. Croix River. The road - varies from 14' to 19' in width and extends 1,000' between the railroad tracks and the river. Several significant white pines closely border the road, along with dense vegetation. Residents stressed their desire to not have any trees removed, particularly the pines. Environmental Concerns Protecting the unique natural resources in this area of the Lower St. Croix National Riverway is essential.The Watershed District, Department of Natural Resources, and area residents have made this very clear since the first discussions regarding paving. Our water resources engineer and natural resources expert have been on-site with the City engineer to view the conditions and have reviewed existing information. Detailed surveys have been done along the road. Attached to this report are three pages from the Spring Creek Stewardship Plan referring to Gilbertson's Creek. We are aware of the rare natural features that exist on either side of the road.The trout stream is very sensitive to temperature increases that could occur with runoff from bituminous pavement. The 100-year-old trees are important aesthetically and are habitat for many birds and other wildlife. Wetlands are nearby and natural springs are located west of the Canadian National Railroad tracks, providing water to several residents. The proposed work will be very confined, staying mostly within the township right-of- way and slightly wider than the existing gravel surfacing. The new pavement will tip to the north, directing all runoff from the road away from Gilbertson's Creek. As a result, runoff volumes to Gilbertson's Creek will decrease (see Figure 2) and there will be no thermal impacts to the trout stream. The new street layout, as shown on Figure 3,will incorporate curves to avoid large trees and preserve the area's natural beauty. The new ditch on the road's north side will incorporate rock ditch checks and turf reinforcement matting to reduce erosion and promote infiltration of runoff into the ground. The proposed road work will not affect the spring boxes west of the tracks. A small pond adjacent to the turnaround will provide additional treatment of water before flowing to the river. Proposed Improvements 205th Street will be paved from Quinnell Avenue to the boat and trailer turnaround area. Quint Avenue will be paved for 400'between Quinnell and 205th. Paving will eliminate the problem of dust, washboarding, and gravel erosion.205th Street will be widened to 26 feet(22' wide pavement), similar to other Scandia streets. The 26-foot width meets the DNR's minimum requirements for roads with boat launch access, and provides for better parking along the road. See Figure 3 for proposed design details. The new street alignment is designed to minimize tree removal. While all white pines in the area will be preserved by curves in the street, removing some smaller, non-specimen trees will be inevitable with the street expanding. Expanding root systems can tear up the surface, and fallen branches or trees near to the 't road can pose a safety hazard. A small easement will need to be acquired for the ponding area. • 197th Street Existing Conditions A steep embankment on 197th Street's east side, a rock _._.. a'' • bluff on the west side, and a steep,narrow stretch near 4 ;i the bottom of the hill combine to make the roadway unsafe and difficult for oncoming cars to navigate. Conditions on the gravel road worsen in the winter, 9y when ice forms on the road from natural springs flowing from the limestone bluff. Stormwater drains along the road's west side into a shallow ditch near the bottom of the hill. Overall, the narrow street width, steep slopes, and drainage issues present a safety concern for Scandia residents, particularly those who use it as the primary access to their homes along the St. Croix River. Environmental and Safety Concerns Residents along 197th Street have expressed their concerns by writing to the City and attending public meetings. Our water resources engineer and City engineer have inspected the road in great detail. Surveys were conducted and pictures taken to obtain accurate information regarding the steep hill.This information was reviewed by traffic engineers and construction specialists in our office. Our survey shows the steepest part of the hill is 19 percent. By all transportation standards, this is off the charts for Minnesota streets. If designing a new street, the maximum grade is typically 8 percent. We are aware people are concerned that pavement may be slicker than gravel. Cars have gone off the road and slid down the steep embankment. Runoff and spring water from the limestone bluffs has created icy conditions in the spring at the bottom of the hill. There is also concern about the environmental impact of calcium chloride on plants and the river. The proposed design will make the hill less steep which should reduce slipping. Tipping the road toward the bluff will force vehicles away from the steep hill and a guard rail will provide further protection. The wider road will allow two-way traffic. An improved drainage system will reduce or eliminate ponding and ice flows.A stormwater pond will properly treat the runoff so it will not be an environmental concern. Proposed Improvements As shown on Figure 4, the road will be widened to the west by about eight feet.The widening will require rock excavation near the top of the hill, and the road grade will be reduced to 15.5 percent by cutting at the top and filling at the bottom.A paved surface will replace the existing gravel road. Installing a guard rail will improve safety along the road's east edge. The road will be pitched toward the bluff side, rather than toward the steep embankment to improve safety and also prevent drainage/erosion down the steep side slope. Stormwater runoff from the road will be collected in curbing, storm sewer, draintile and ditch and sent to a treatment pond before discharging into the St. Croix River. Several trees will be removed since the road will shift west into the bluff. Also, a short retaining wall will be necessary south of the bluff. A Project Summary can be found on the following page. On 205th Street, the proposed improvements will: • Eliminate erosion of road gravel into Gilbertson's Creek • Promote infiltration of runoff with a ditch and rock check dams on the north side • Treat storm water before it flows into the St. Croix River • Avoid all the established white pine trees adjacent to the road • Blend in to the landscape with aesthetically pleasing curves in the road • Provide better parking because of slightly increased width • Avoid thermal impacts to the trout stream since all road runoff drains away • Not adversely affect rare plant or animal communities in the area • Eliminate continuous maintenance issues with grading and adding gravel On 197th Street, the proposed improvements will: • Eliminate erosion of road gravel down the steep side slope • Widen the road to allow safe travel for two-way traffic • Flatten the grade of the hill to reduce slipping • Modify the pitch of the road toward the west,keeping water and cars off the steep,wooded slope • Provide a safety guard rail along the top of the steep slope • Improve drainage along the bluff with a new ditch/storm sewer system to channel runoff to a pond • Provide treatment of storm water before it flows to the St. Croix River {{Bonestroo,Rosene,Anderlik&Associates,Inc. 5 \\City of Scandia—197"and 205"Street Improvements ,zb t', t ( • Spring Creek Name • Gilbertson's Creek 6U 4,1 eral Watershed Description :bertson Creek outlets to the St. Croix River just downstream of the Loghouse landing boat access. X:-:*bertson Creek begins along the Wisconsin-Central Rail where a ditch collects numerous seeps ciiiirtischarging along a ten-ace slope. From the Wisconsin-Central Rail, Gilbertson Creek flows a short M,distance though a black ash seepage swamp, crosses CR 53 and then begins its descent to the St. Croix n' iver. The total watershed area contributing to Gilbertson Creek is 85 acres. The watershed land use 'k ' ncludes a huge agricultural field, some partly wooded residential areas and forest land. iz„ Significant Features `Gilbertson Creek arises from one of the larger groundwater dependent wetland complexes in the study + area. Extending from the north boundary of William O'Brien State Park to just north of the junction of t 'R 53 and the Wisconsin-Central Rail, this wetland complex includes rich fen, black ash seepage i 1,swamp and mixed hardwood seepage swamp. Downstream of CR 53, Gilbertson Creek drops over a F% : waterfall into a scenic gorge bordered by good quality white pine-hardwood forest. This ravine/stream a system includes records for several rare species including Louisiana waterthrush (Seiurus motacilln), til red shouldered hawk (Buteo lineatus), bald eagle (Halliaeetus leucocephalus) and American ginseng ht 4''k:=#Panax quinqueft lius). Gilbertson Creek contains a population of naturally reproducing brook trout , . (Salvelinuc fontinalis) below CR 53. 1. Key Management Recommendations t0, I. The public access road (Log House Landing) to the St. Croix River is subject to significant scour e and erosion during storm events. Absent official city communications, the private web sites, the "grapevine" or other informal communications may fill the gap, and can spread misinformation and misunderstandings. While local media outlets may cover some meetings and events, information provided by the city can help ensure that they report accurately, and are aware of all the issues that may be of interest to residents. For some city functions and programs, direct communications with residents via a newsletter may be necessary. And the internet continues to grow in importance as an information source. The communications strategy needs to consider the types of information that need to be shared, the advantages and limitations of the various media available, and that different people need and want their information in different ways. Resources (budget, staff time)to carry out the strategy are also an issue. We suggest a three- pronged strategy: 1) press releases for day-to-day communications; 2) a twice- yearly city newsletter; and 3) an upgraded web site. Press Releases Short press releases (usually only a paragraph or two in length) are a quick and efficient method to get information in the hands of media outlets. Local papers find them an easy alternative to researching and writing a longer story, and will often print them as written. Or, if they find the topic of interest, the press release gives them the basic facts and additional contacts for a longer story. While press releases are • Page 1 primarily directed to media contacts, they can also be used to provide content for the website or for future newsletters if the information is still timely. Examples of when press releases could be issued are: • To announce a significant council action (such as adopting a new ordinance) • To announce a program or event • To announce an appointment to a board or committee A short summary of significant actions could be prepared in the form of a press release after each council meeting. This would get information out quickly and far in advance of approval of official meeting minutes. City Newsletter A newsletter mailed directly to all residents is probably more effective in getting information in the hands of each resident than other communications options. It's also the most costly in terms of time and money. Newsletters compete with other direct mail so must be interesting enough to capture the reader. Editorial content can focus on topics that may not be considered news by the media—such as a discussion of a broad community issue or long-range planning policy. If useful reference material is also included, the newsletter may have a longer shelf-life. Contents of a city newsletter could include: • Schedule of upcoming events or meetings • Summaries of new laws and ordinances • Information about new development proposals or approvals • Contact information for local officials and staff • How-to's on obtaining permits, etc. • Information about the web site • Election information • Program descriptions and registration forms for upcoming recreation programs • Guest columns by council members or others discussing community issues The township newsletter(6 pages) produced in the spring of 2006 cost about $1,000 (printing, postage, and some time from the graphic designer.) The cost would increase as more pages are added. The 2007 budget does not include any specific line-item for newsletters (or other communications activities, such as the website.) The office supplies budget has absorbed the costs. In 2007, the city should consider publishing two newsletters; one on approximately April 1 and a second on approximately October 1, 2007. This timing would work well for the announcement of summer recreation programs this spring, and to report on • Page 2 the swearing-in of the new Council and major actions taken in the first couple months of 2007. Upgraded Website Websites are becoming the preferred way to obtain information for many people. It's not unusual for people to check the website to answer a question or find a document or form before making a telephone contact or visiting the office. A website is an ideal method for providing basic information about the community and the services it offers, making codes and ordinances accessible, publishing meeting minutes, agendas and reports, and publicizing news and community events. Providing information via the web can help reduce paper and save time and energy for citizens as well as the city. The city should consider upgrading and expanding the use of the website to provide information and documents to the public. Scandia currently has a presence on the web. The township address was www.newscandia.orq and recently we registered www.ci.scandia.mn.us, which is the address format used by most cities. The content of the current website is managed by a contractor(Cheri Cunningham)who makes changes upon our request by editing the html and uploading to our host server. While Cheri is very responsive, because staff is not able to make changes directly we are somewhat limited in what we can do with the website. The current site does not offer the functionality offered by many city websites and major changes or additions could be costly. A user-friendly, flexible method of publishing a website is available through the Minnesota League of Cities. GovOffice provides a powerful, web-based tool for managing website content, and is used by many small cities in Minnesota to create professional-looking websites. More advanced features include forms, surveys, bulk e-mail, and modules to take registrations for recreation programs. The cost of using this tool would be a one-time license fee and a re-direct fee for our current URL (total of about$1,000), which covers initial set-up, training and support. There would be a monthly hosting fee of$40 month, which would cover all upgrades and ongoing maintenance and web hosting. (We are currently spending about $20 per month for hosting the existing site, plus an hourly rate for updates.) After start-up, the total costs of the website should not be significantly more than what we currently spend, but with much greater functionality and a more sophisticated look. Staff is currently testing GovOffice using a free demonstration site provided by the vendor and it appears to be a very good product. An upgraded website could provide all of the information on the current site, and add other features as time permits. Deadline/Timeline: N/A Background: • At the January 2 meeting,the Council directed staff to advertise for members for the Planning Commission, Park and Recreation Committee, Comprehensive Plan Committee and a Commercial and Retail Development Committee. A press release was issued, and a description of these four committees was posted on the website. • The committee met on January 10, and their recommendations of are listed in a chart, attached. The major recommendations are: o Eliminate the Road Committee, and incorporate its functions in the Capital Improvements Committee. o Eliminate the Architectural Review for Commercial Property Committee and the Landscape Committee. If, during the development review or enforcement process, a committee is needed to review a specific issue, appoint an ad-hoc committee at that time. o Eliminate the Rural Landscape Preservation Committee. Defining and developing policies for preserving the city's rural character will be a major focus of the Comprehensive Plan. Incorporate these issues into the Plan committee,possibily a sub-committee if needed. If, after completion of the plan, a separate group apart from the Planning Commission is needed to implement the plan, then the Council could consider re- constituting a separate committee. o The Employment Policy/ Salary Committee should change to a Human Resources Committee, to work with the Administrator Page 1 of 2 01/11/07 on all personnel-related issues. The Commission reviews land development applications for conformance to the City's Comprehensive Plan and Development Code, and makes recommendations to the Council. They also participate in developing long- range plans, and in revising and updating the codes and ordinances governing land use in the city. The Planning Commission meets on the first Tuesday of each month. Park and Recreation Committee The Park and Recreation Advisory Committee consists of nine members appointed by the Council for staggered terms of five years, expiring on January 31st of each year. The Committee advises the Council in all matters relating to park and recreation programs and facilities. Recent Committee projects include an update to the Parks, Recreation, Trails, Open Space and Recreation Plan, and a master plan for Lions Park. The Committee meets the first Monday of each month. Comprehensive Plan Committee All cities and towns in the Twin Cities Metropolitan Area are required to update their long-range comprehensive plans by the end of 2008. The plan will be important to setting the vision for the character of Scandia, looking forward to 2030. Elements of the plan will include growth management and land use, transportation, parks and open space, housing, utilities and water resources. A committee consisting of Council members, Planning Commissioners and other citizens will be formed to participate in this major effort, which will begin in 2007. Subcommittees may be formed to work on particular issues. The number of members and the meeting schedule have not yet been determined. I plan to attend the meeting either way. 1 LAND PROTECTION PLANNING IN THE CITY OF SCANDIA The tremendous increase in housing developments throughout the Twin Cities Metropolitan Area in recent years has put increasing pressure on natural and rural areas. In Scandia, that development could lead to loss of the"rural character"that the community so strongly values. What many area landowners do not realize, is that they do not necessarily need to sell their land to a developer in order to obtain the revenue they need from the land. In addition, where housing developments that do take place, the city does not have a good tool for knowing what lands are most important to set aside as park dedication. What Scandia lacks is not only a coordinated greenway map,but also a means for working with individual landowners to explore land protection options. This document is intended to provide a general overview to the Scandia City Council of the land protection process and to explore how Scandia might proceed in this direction. The Land Protection Process The land protection process can be viewed as having four distinct, yet interconnected components. These components are: identification and mapping, landowner outreach, formal protection, and land management. Phase 1: Identification and Mapping The Identification and Mapping phase consists of identifying and prioritizing the areas that are important to protect. The primary basis for identification is ecological features, such as: native plant communities, rare plant and animal species records, water features (lakes, streams, wetlands), threat of groundwater contamination, slopes, soil types, etc. A second and very important piece of the identification phase, however, is obtaining qualitative data from the public. A public process, in which area residents are asked for their thoughts and insights on land protection and specific natural areas that might be protected, typically accompanies the quantitative, science-based aspect. The result of this work is a map that identifies greenways (or greenway corridors)where land protection is most desired. It is critical to include the community in the mapping process because, although the map is conceptual, land owners can become upset if,without prior knowledge, they see their property identified on a map for a particular purpose. It is important to inform the public that the map is a tool,that no "land takings" are being considered, and that the process is entirely voluntary. While greenways protect high quality natural areas and other areas important to the local community,they also are critically important as pathways for animals and plants to move across the landscape. In many cases, greenways can also provide non-motorized trail opportunities for the community. Phase 2: Landowner Outreach Once a greenway map is adopted by the city, parcels may be protected either as part of the process that occurs with a new development and associated park dedication, or private landowners may choose to obtain permanent protection for their land. In order for the latter to occur, a Landowner 1 Outreach process will be required. This involves dedicated staff to focus on a particular series of steps and a long-term process. It starts with letters sent to the highest priority sites, and continues with phone calls, site visits and on-going meetings with interested landowners. Phase 3: Formal Protection Permanent land protection occurs when a landowner within a greenway decides to explore and pursue protection options. Skilled conservation professionals are needed to ferry this process forward, and to identify and collaborate with funding agencies, easement holding entities, and other associated parties. Formal protection includes ecological assessment of the land and development of a natural resource management plan. Phase 4: Land Management Once a property is legally protected the process is still not complete. Preserving the natural resources of a site involves on-going management and maintenance. Because natural processes have been altered considerably since European settlement in the mid-1800s, natural areas must be managed to enhance, improve and protect the parcel's ecological health. Exotic species,human impact and the elimination of natural processes such as fire, combine to degrade existing natural areas. The management plan developed for the formal protection of the property serves as a guide for this management work. This document will clarify the target condition/natural community for the site and provide details on the activities that should be employed to achieve this goal. The conservation professional assists the landowner with obtaining funding and implementing management activities. A Proposal for Scandia Various factors have converged such that now is an excellent time for the City of Scandia to be considering pursuing a land protection plan. These factors include: • Passage of the Washington County Land and Water referendum in November 2006 means that funds will be available soon to communities that are ready to pursue protection. • Scandia has more high quality natural areas than most other communities in the county, making it more likely to receive county funding, IF it is prepared to do so. • Scandia has a Park and Recreation Comprehensive plan that has initiated the process of identifying important lands. • Besides the county, other funding has also been identified the can provide assistance. The Embrace Open Space Campaign (www.embraceopenspace.org), that has already committed to providing technical assistance to Scandia in the immediate future. • Housing developments in Scandia have been abundant in recent years,but tools for protection were not in place. A current slowing of the housing market provides a good opportunity to accomplish the tasks needed for identifying important areas to protect. • As a newly incorporated city, Scandia has more control over how its development progresses. The local ordinance must comply with but may be more restrictive than state law. • The draft ordinance,prepared by the city attorney, would regulate lawful gambling requiring state licensing, such as pull-tab or bingo operations. There are currently two such gambling organizations/establishments in the city: Forest Lake Athletic Association(Prospects) and Scandia Marine Lions (Meisters.) These organizations previously received township approval for their state licenses. The new ordinance would require that they submit records and reports to the city, and that they expend 75% of their lawful purpose expenditures within the city's trade area (defined as Scandia, contiguous cities and townships, and all of ISD 831.) A $100 investigation fee would be charged. • The ordinance also would require local permits for lawful gambling excluded or exempted from state licensure requirements. These activities include certain bingo games and raffles. No permits have previously been required for these events. The Council could deny permits if the organization or the establishment in which the event is held had previously violated various laws, if the organization had not been in existence for at least three years or had at least 15 members, and several other criteria. The proposed permit fee would be $15.00. Recommendation: The Council should review and discuss the ordinance, and after making any changes, refer the draft ordinance to the current gambling license holders for their review and comment prior to adopting it at a Page 1 of 2 01/11/07 future meeting. Penalty SECTION 1. PURPOSE. The purpose of this Ordinance is to regulate lawful gambling within the City, to prevent its commercialization, to ensure the integrity of operations, and to provide for the use of net profits only for lawful purposes. SECTION 2. ADOPTION OF STATE LAW BY REFERENCE. The provisions of M.S. §349, as they may be amended from time to time, with reference to the definition of terms, conditions of operation, provisions relating to sales, and all other matters pertaining to lawful gambling, are hereby adopted by reference and are made a part of this Ordinance as if set out in full. It is the intention of the Council that all future amendments of Draft, 1/11/2007 1 M.S.§349 are hereby adopted by reference as if they had been in existence at the time this chapter was adopted. SECTION 3. CITY MAY BE MORE RESTRICTIVE THAN STATE LAW. The Council is authorized by the provisions of M.S. § 349.2313, as it may be amended from time to time, to impose, and has imposed in this Ordinance, additional restrictions on gambling within its limits beyond those contained in M. S. §349, as it may be amended from time to time. SECTION 4. DEFINITIONS. In addition to the definitions contained in M.S.§349.12, as it may be amended from time to time, the following terms are defined for purposes of this Ordinance: BOARD. The State of Minnesota Gambling Control Board. LICENSED ORGANIZATION. An organization licensed by the Board. LOCAL PERMIT. A permit issued by the City. TRADE AREA. This City, each City and Township contiguous to this City and any additional area situated within the boundaries of Independent School District No. 831. SECTION 5. APPLICABILITY. This Ordinance shall be construed to regulate all forms of lawful gambling within the City. SECTION 6. LAWFUL GAMBLING PERMITTED. Lawful gambling is permitted within the City if the Council, by resolution adopted by a majority of its members, authorizes lawful gambling to occur, provided it is conducted in accordance with M.S. §§609.75 to 609.763, inclusive, as they may be amended from time to time; M.S. §§ 349.11 to 349.23, inclusive, as they may be amended from time to time, and this Ordinance. SECTION 7. AUTHORIZED ORGANIZATIONS. An organization shall not be eligible to conduct lawful gambling in the City unless it meets the qualifications in Minnesota Statutes 349.16, Subd. 2, and also meets at least one of the following conditions: (A) The organization has at least fifteen (15) members that are residents of the City; or Draft, 1/11/2007 2 (B) The physical site for the organization's headquarters or the registered business office of the organization is located within the City or a municipality contiguous to the City and has been located within the City or a municipality contiguous to the City for at least two (2) years immediately preceding application for a license; or (C) The organization owns real property within the City and the lawful gambling is conducted on the property owned by the organization within the City; or (D) The physical site where the organization regularly holds its meetings and conducts its activities, other than lawful gambling and fund raising, is within the City or an adjacent city and has been located within the City or adjacent city for at least two (2) years immediately preceding application for a license. (E) The organization is a fire relief organization that provides fire protection services to the City. SECTION 8. QUALIFICATIONS. The City Council shall not adopt a resolution approving a premises permit or bingo hall license from any applicant: (A) Which has an officer, director, or other person in a supervisory or management position, who: (1) has ever been convicted of a felony; (2) has ever been convicted of a crime involving gambling; (3) is not of good moral character and repute; (4) has ever been convicted of(i) assault, (ii) a criminal violation involving the use of a firearm, or(iii)making terroristic threats; or (B) Which owes or which has an officer, director, or other person in a supervisory or management position, who owes delinquent local, state or federal taxes, or is delinquent on any other City bill. SECTION 9. LOCATION CRITERIA FOR PREMISES PERMITS AND BINGO HALL LICENSES. All organizations applying for a premises permit or bingo hall license must meet criteria set forth herein relating to location of lawful gambling activities. (A) An organization may conduct lawful gambling only on premises it owns or leases, except as authorized by Minnesota Statutes §349.18. Draft, 1/11/2007 3 (B) Lawful gambling in the City may be conducted only in the licensed organization's hall where it has its regular meetings or in a licensed on-sale liquor, wine and beer establishment. (C) No location shall be approved unless it complies with the applicable zoning, building, fire and health codes of the City and other regulations contained in this Ordinance. SECTION 10. APPLICATION AND LOCAL APPROVAL OF PREMISES PERMITS. (A) Each organization licensed to conduct lawful gambling in the City shall complete the City's investigation form, submit copies of all state gambling application forms, all records and reports required to be filed with the State Gambling Control Board pursuant to Minnesota Statutes §349, and the rules and regulations promulgated thereunder, and submit any additional information required by the City. (B) Any organization seeking to obtain a premises permit or bingo hall license or renewal of a premises permit or bingo hall license from the Board shall file with the City Clerk an executed, complete duplicate application together with all exhibits and documents accompanying the application as filed with the Board. The application and accompanying exhibits and documents shall be filed not later than three days after they have been filed with the Board. (C) Upon receipt of an application for issuance or renewal of a premises permit or bingo hall license, the City Clerk shall transmit the application to the City Peace Officer for review and recommendation. (D) The City Peace Officer shall investigate the matter and make a review and recommendation to the City Council as soon as possible, but in no event later than 45 days following receipt of the notification by the City. (E) Organizations or bingo halls applying for a state-issued premises permit or bingo hall license shall pay the City a $100 investigation fee. This fee shall be refunded if the application is withdrawn before the investigation is commenced. (F) The applicant shall be notified in writing of the date on which the Council will consider the recommendation. (G) The Council shall receive the City Peace Officer's report and consider the application within 45 days of the date the application was submitted to the City Clerk. (H) The Council shall, by resolution, approve or disapprove the application within 60 days of receipt of the application. (I) The Council may disapprove an application for issuance or renewal of a premises permit for any of the following reasons: Draft, 1/11/2007 4 (1) Violation by the gambling organization of any state statute, state rule or City ordinance relating to gambling within the last three years. (2) Violation by the on-sale establishment or organization leasing its premises for gambling of any state statute, state rule or City ordinance relating to the operation of the establishment, including, but not limited to, laws relating to alcoholic beverages, gambling, controlled substances, suppression of vice, and protection of public safety within the last three years. (3) Lawful gambling would be conducted at premises other than those for which an on-sale liquor license has been issued. (4) More than one licensed organization would be permitted to conduct lawful gambling activities at one premises. (5) Failure of the applicant to pay any investigation fee provided by subdivision (E) of this section within the prescribed time limit. (6) Operation of gambling at the site would be detrimental to health, safety, and welfare of the community. (J) Any organization leasing premises for the conduct of lawful gambling shall, upon request of the City, file with the City a copy of the lease within one (1) week after execution of the lease. The lease shall not provide for rental payments based on a percentage of receipts or profits from lawful gambling. SECTION 11. LOCAL PERMITS, EXCLUDED OR EXEMPTED GAMBLING. (A) No organization shall conduct lawful gambling excluded or exempted from state licensure requirements by M.S. § 349.166, as it may be amended from time to time, without a valid local permit. (B) Applications for issuance or renewal of a local permit shall be on a form prescribed by the City. The application shall contain the following information: (1) Name and address of the organization requesting the permit. (2) Name and address of the officers and persons accounting for receipts, expenses, and profits for the event. (3) Date of gambling occasion for which permit is requested. (4) Address of premises where event will occur. Draft, 1/11/2007 5 (5) Copy of rental or leasing arrangement, if any, connected with the event, including rental to be charged to organization. (6) Estimated value of prizes to be awarded. (C) The fee for a local permit shall be $15.00. The fee shall be submitted with the application for a local permit. (D) The applicant shall be notified in writing of the date on which the Council will consider the issuance of the local permit. (E) The Council may disapprove an application for issuance or renewal of a local permit for any of the following reasons: (1) Violation by the organization of any state statute, state rule or City ordinance relating to gambling within the last three years. (2) Violation by the establishment leasing its premises for gambling of any state statute, state rule or City ordinance relating to the operation of the establishment, including, but not limited to, laws relating to the operation of the establishment, laws relating to alcoholic beverages, gambling, controlled substances, suppression of vice, and protection of public safety within the last three years. (3) The organization has not been in existence in the City for at least three consecutive years prior to the date of application. (4) The organization does not have at least 15 active members. (5) More than one licensed, qualified organization will be conducting exempted or excluded lawful gambling activities at any one premises. (6) Failure of the applicant to pay permit fee provided by subdivision (C) of this section within the prescribed time limit. (7) Operation of gambling at the site would be detrimental to the health, safety, and welfare of the community. (F) Local permits shall be valid for only the occasion or occasions they are issued. SECTION 12. LICENSE AND PERMIT DISPLAY. All permits issued under state law or this chapter shall be prominently displayed during the permit year at the premises where gambling is conducted. Draft, 1/11/2007 6 SECTION 13. NOTIFICATION OF MATERIAL CHANGES TO APPLICATION. An organization holding a state-issued premises permit or a local permit shall notify the City in writing whenever any material change in the information submitted in the application occurs within ten days of the change. SECTION 14. DESIGNATED TRADE AREA. (A) Each organization licensed to conduct gambling within the City shall expend 75% of its lawful purpose expenditures on lawful purposes conducted within the City's trade area. (B) This section applies only to lawful purpose expenditures of gross profits derived from gambling conducted at a premises within the City's jurisdiction. SECTION 15. RECORDS AND REPORTING. (A) Organizations conducting lawful gambling shall file with the City Clerk one copy of all records and reports required to be filed with the Board,pursuant to M.S. Ch. 349, as it may be amended from time to time, and rules adopted pursuant thereto, as they may be amended from time to time. The records and reports shall be filed on or before the day they are required to be filed with the Board. (B) Organizations licensed by the Board shall file a report with the City proving compliance with the trade area spending requirements imposed by §14 of this Ordinance. Such report shall be made on a form prescribed by the City and shall be submitted annually and in advance of application for renewal. SECTION 16. HOURS OF OPERATION. Neither lawful gambling nor exempt or excluded gambling shall be conducted between 1:00 a.m. and 8:00 a.m. on any day of the week. SECTION 17. SEVERABILITY. If any provision of this Ordinance is found to be invalid for any reason by a court of competent jurisdiction, the validity of the remaining provisions shall not be affected. SECTION 20. PENALTY. Any person who violates: (A) Any provision of this Ordinance; (B) M.S. §§ 609.75 to 609.763, inclusive, as they may be amended from time to time; or Draft, 1/11/2007 7 (C) M.S. §§ 349.11 to 349.21, as they may be amended from time to time, or any rules promulgated under those sections, as they may be amended from time to time; shall be guilty of a misdemeanor. A local permit may be revoked or temporarily suspended for a violation by the gambling organization of any state statute, state rule or City ordinance relating to gambling. Additionally, a violation of this Ordinance may result in a recommendation by the City to disapprove or not renew a license or premises permit. The City may also revoke a premises permit for any violation of this Ordinance which is not corrected within 10 days of notice of such violation from the City. A license shall not be revoked or suspended until notice and an opportunity for a hearing have first been given to the permitted organization. The notice shall be personally served and shall state the provision reasonably believed to be violated. The notice shall also state that the permitted organization may demand a hearing on the matter, in which case the permit will not be suspended until after the hearing is held. If the permitted organization requests a hearing, the Council shall hold a hearing on the matter at least one week after the date on which the request is made. If, as a result of the hearing, the Council finds that an ordinance violation exists, then the Council may suspend or revoke the permit. Nothing in this Ordinance shall be construed to require the City to undertake any responsibility for enforcing compliance with Minnesota Statutes § 349 other than those provisions related to the issuance of premises permits as required in M.S. §§ 349.213 as it may be amended from time to time.
