Deadline/ Timeline: N/A Background: • The Council held the public hearing on the proposed special assessments at its October 16, 2007 meeting. Five objections to the assessment were registered at the meeting. • On October 24, the Council held a special meeting to visit the five sites for which objections were filed. Based on the findings at the special meeting, assessments for two parcels have been changed: o 23950 Manning Trail N., PID No. 06-032-20-21-0003 Owner: Glenn and Sally DelGiudice-- reduced from $1,196 to $598.00. o 16360 209th St. N. PID No. 19-032-19-22-0005 Owner: Jason and AmyJo Helke-- reduced from $3,588 to $1,794.00. • In the revised assessment roll, the total amount of the assessment is reduced from $352,820 to $350,428 (-$2,392) • The assessment to property owners is $1,196 per unit for collector streets, and $3,588 per unit for non-collector streets. Assessments will be for 10 years, at an interest rate of 6.5%. Assessments paid in full prior by December 6, 2007 will not incur interest. Recommendation: I recommend that the Council adopt the resolution. Mayor Dennis Seefeldt called the meeting to order at 4:30 p.m. The following councilmembers were present: Dolores Peterson, Peter Crum, Donnette Yehle and Mayor Dennis Seefeldt. Councilmember Michael Harnetty was absent. Staff present: Administrator Anne Hurlburt and City Attorney Dave Hebert. The Council and staff visited five sites for which objections have been filed to assessments for the 2007 Street Improvement Project. After the site visits, the Council convened in the Board Room of the Community Center for a discussion of the site visits. The findings were as follows: • 23950 Manning Trail N., PID No. 06-032-20-21-0003 Owner: Glenn and Sally DelGiudice This is a corner lot proposed to be assessed for one unit for paving of 240th St. The driveway for the home is on Manning Ave., not 240th Street, so the assessment should be for one-half unit in accordance with the established policy for corner lots. • 11240 228th St. N., PID No. 07-032-20-11-0002 Owner: Michael and Nancy Peterson This is a 20-acre site which may be subdivided to create an additional lot, under current zoning ordinance provisions. The assessment for two units was found to be correct. • 23500 Meadowbrook Ave. N., PID No. 05-032-20-14-0002 Owner: Scott and Rebecca Muellner. Access to this property is from 235th, even though the mailing address is Meadowbrook. The assessment for one unit for paving of'235th Street was found to be correct. • 20969 Quadrant Ave. N., PID No. 24-032-20-11-0001 Owner: Peter and Susan Schwarz The assessment for one unit was found to be correct. The City is not responsible for paving driveways within the right-of-way. • 16360 209th St. N. PID No. 19-032-19-22-0005 Owner: Jason and AmyJo Helke This is a corner lot on Highway 95. The driveway access is from a road section that was already,paved as part of Highway 95. The assessment should be reduced from one unit to one- half unit,consistent with the policy for corner lots. Staff was directed to make the appropriate changes in the assessment roll for approval at the November 6 meeting. The meeting adjourned at 5:55 p.m. Respectfully submitted, Anne Hurlburt City of Scandia Administrator/Clerk CITY OF SCANDIA RESOLUTION NO. 11-06-07-01 RESOLUTION ADOPTING ASSESSMENT WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the improvement of the following streets and roads in City of Scandia, to-wit: 1. 232"d Street North from Lofton Avenue to west end; 2. 235th Street North from Meadowbrook to west end; 3. Ostrum Avenue North from Oakhill to south end; 4. Penrose Avenue from Highway 97 to south; 5. 223rd Street from Olinda to east end; 6. 220th Street North from Highway 95 to Quarry; 7. 209th Street North from Highway 95 to Quadrant Avenue; 8. Quadrant Avenue from 209th Street to north end; 9. Quality Trail from 209th Street to west end; 10. 235th Street North from Highway 95 to Quentin Avenue; 11. Quentin Avenue North and South of 235th Street; 12. 228th Street North from Manning Trail to Lofton Avenue; 13. 240th Street North from Morgan to Oldfield; 14. 240th Street from Manning to west end; 15. 240th Street from Manning to east end; 16. 197th Street from Highway 95 to the top of the bluff; by application of Class 5 or other aggregate and other subgrade construction, ditch construction and application of bituminous surfacing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CITY OF SCANDIA, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 1 2. Such assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable on or before the first Monday in January, 2008, and shall bear interest at the rate of 6.5% per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2008. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Clerk, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the City Clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the county. Such assessment shall be collected and paid over in the same manner as other municipal taxes. Adopted by the City Council this 6th day of November, 2007. Dennis D. Whereas, under the Washington County "201" Sewer Use Ordinance, the incorporated community (the City) in which the treatment system is situated is responsible for operation, maintenance and replacement of all publicly owned components of the community sewage treatment system; and Whereas, the City desires to contract with the County for the performance of routine operation and maintenance of the community wastewater treatment system (hereinafter referred to as the "201 system") owned by and under the jurisdiction of the City; and Whereas, the County agrees to render such operation and maintenance services on the terms and conditions hereinafter set forth; and Whereas, such Agreements are authorized and provided by Minnesota Statute 471.59; Now Therefore, in consideration of the mutual promises contained herein, it is mutually agreed between the County and the City as follows: Section I. County's Responsibilities 1. The County agrees to provide, through its Department of Public Health and Environment, 201 system operation and maintenance within the corporate limits of the City to the extent and in the manner set forth in this section. 2. The County will provide routine operation and maintenance of the existing 201 wastewater treatment system in accordance with the approved Operating and Maintenance Manual for the system and as anticipated and planned for in the annual operating budget as adopted by the City Council. Routine operation and maintenance as provided in this contract specifically excludes decisions or actions regarding 201 system upgrade, expansion of use and/or replacement of the system. The most recent agreed upon version of the Operating and Maintenance Manual for the system is incorporated herein by reference. Further, the parties by mutual agreement may modify or update said manual with the new version then being automatically incorporated herein without the need to otherwise amend this agreement. 3. In providing such routine operation and maintenance, the County will provide staff, equipment and other supplies and materials as may be needed to conduct such routine operation and maintenance. The standards of performance, method of providing services and other matters incident to the performance of operation and maintenance services Page 1 of 7 under this Agreement, including personnel to be employed, shall be determined by the County except to the extent that specific operating policies and procedures have been adopted for the 201 system. 4. The County can expressly subcontract pumping services and/or routine maintenance and repair to the 201 system (such as excavating services, pump or tank repair, repair to lift stations and collection lines) as necessary to fulfill its obligations under this Agreement. As part of an agreement with any subcontractor under this paragraph, the County will require that subcontractor's maintain insurance coverage as defined in Washington County Policy #1202 which is attached hereto as Exhibit A. and is made a part of this agreement. 5. The County will prepare an annual proposed budget for the 201 system operation and maintenance and present such proposed budget to the City each year, by November 30, for the following year of operation. 6. Following the policies and procedures established by the City, the County will prepare annual charges to be assessed to the residents on the 201 system. These charges, along with the documentation by which the charges were determined, will be submitted to the City Clerk on a time schedule determined by the City. 7. In the event that the 201 system requires maintenance and/or repair which will result in expenditures beyond that which has been approved by the City in its annual budget, the County will contact the City in advance of authorizing and/or proceeding with such repairs. Emergency repairs will be managed in accordance with the operating policy mutually developed between the County and the City. 8. The County will submit, on behalf of the City, all reports required by the MPCA under the SDS permit for the 201 system. The County will provide timely reports to the City on individual maintenance, repair or emergency incidents. The County will also provide an annual operating, maintenance and repair report to the City together with an assessment of the overall status of the 201 wastewater treatment system. Such annual report shall be made by February 1 of each year for the prior operating year. 9. The County will cooperate with the City's officials and/or employees (including engineering staff) in fulfilling its obligations under this Agreement. Section II. City's Responsibilities 1. The City, its officers, agents and employees, will cooperate and assist the County in the performance of this Agreement. 2. The City will provide policy and procedural direction for the operation and maintenance of the 201 wastewater treatment system and will communicate such policies and procedures to the County through written notice to the county along with copies of said Page 2 of 7 policies and procedures as adopted and/or revised. 3. The City specifically authorizes the County to subcontract, on its behalf, for services to be provided by the County under the provisions of this Agreement. 4. The City will be responsible for approving the budget for 201 system operation and maintenance and for advising the County of its budget decision. The City, at its sole discretion, will be responsible for determining the type of and/or amount of any replacement fund for its 201 system. 5. The City will approve any maintenance and/or repairs to the 201 system which, in the County's estimation, will exceed the budget established by the City. Such approval shall be in advance of the County's proceeding with repair and/or maintenance except that emergency repairs will be made in accordance with the operating policy mutually agreed to between the County and the City. 6. The City will be responsible for determining, through its engineering firm or its own consultants, the amount of available capacity for expanded use of the system. 7. The City will be responsible for making decisions regarding upgrade, expansion of use and/or replacement of the 201 system. Such decisions include the issuance of building permits and review of variances for new construction which would be connected to the 201 system and/or expansion of existing homes which are currently on the 201 system. 8. The City will approve annual billings to residents on the 201 system and will send such bills to the residents on City letterhead. The City will be responsible for collection of all annual billings to residents. 9. The City shall maintain and be responsible for its 201 system monetary fund. 10. The Parties agree that this agreement is strictly for the benefit of the City and no benefits from this Agreement, third-party or otherwise, will inure to the individual residents of the City. Section III. Payment for Services 1. The City agrees to reimburse the County for its expenses related to the services provided under this Agreement. Reimbursement for staff personnel time shall be $95.00 per hour for the calendar year 2008; and $100.00 per hour for the calendar year 2009. Mileage will be reimbursed at the current County reimbursement rate to its employees as determined annually by the Washington County Board of Commissioners. 2. The City agrees that it shall bear the sole responsibility for the cost of any necessary replacement motors, parts and related labor, subcontractor costs, and utilities necessary for operation and maintenance of the 201 system and all expenses in excess of staff costs Page 3 of 7 and mileage expense. 3. Quarterly,the County shall submit its actual expenses to the City for reimbursement. The request for payment shall be accompanied by an explanation of the charges. Charges shall be submitted in April (for the period from January 1 to March 31), in July (for the period from April 1 through June 30), in October (for the period from July 1 to September 30) and in January (for the period from October 1 to December 31 of the previous year). 4. The City shall pay the County's invoices within forty-five (45) days of receipt, except for those individual invoice items where a legitimate question exists. In such cases, the City will pay all unquestioned amounts in the time specified above, while the parties agree to work in good faith to resolve any billings in question. 5. At the end or termination of this Agreement, the City will pay all reimbursable expenses incurred by the County in performance of this Agreement up to and including the final date of the effective date of the Agreement. Section IV. Indemnity 1. The County, its officers, agents, and employees shall not be liable for any intentional or negligent act of the City or any officer, agent or employee of the City and the City agrees to hold the County, its officers, agents, and employees harmless from any intentional or negligent act of the City or any officer, agent or employee of such City and the City agrees to defend the County, its officers, agents or employees from any claim for damages resulting from the negligent or intentional act of the City, or any officer, agent or employee of the City. 2. The City, its officers, agents and employees shall not be liable for any intentional or negligent act of the County or any officer, agent, or employee of the County, and the County agrees to hold the City, its officers, agents, and employees harmless from any intentional or negligent act of the County or any officer, agent or employee of the County, and the County agrees to defend the City, its officers, agents or employees from any claim for damages resulting from the negligent or intentional act of the County, or any officer, agent or employee of the County. 3. The County agrees to assume all liability for injury, sickness or death of any County employee performing maintenance, repair or other services under this Agreement and agrees to hold harmless and indemnify the City, its employees and agents for any claims, damages, losses and expenses related thereto notwithstanding Section IV., paragraph 1. Section V. Nondiscrimination During the performance of this Agreement, the County agrees to the following: Page 4 of 7 No person shall, on the grounds of race, color, religion, age, sex,disability, marital status, public assistance status, criminal record, creed or national origin be excluded from full employment rights, participation in, be denied the benefits of or be otherwise subjected to discrimination under any and all applicable Federal and State laws against discrimination. Section VI. Records—Availability and Retention Pursuant to Minnesota Statute 16C.05, Subd 5., the County agrees that the City, County, the State Auditor, or any of their duly authorized representatives at any time during normal business hours and as often as they may reasonably deem necessary, shall have access to and the right to examine, audit, excerpt, and transcribe any books, documents, papers, records, etc. which are pertinent to the accounting practices and procedures of the County and involve transactions relating to this agreement. The County agrees to maintain these records for a period of three years from the date of termination of this Agreement Section VII. Data Privacy All data collected, created, received, maintained or disseminated for any purposes by the activities of the County because of this Agreement is governed by the Minnesota Government Data Practices Act, Minnesota Chapter 13, as amended, the Minnesota Rules implementing such Act now in force or as adopted, as well as Federal Regulations on data privacy, including but not limited to, the Health Insurance Portability and Accountability Act (HIPAA) where it applies. The County agrees to abide by these statutes, rules and regulations and as they may be amended. Section VIII. Firearms Prohibited Unless specifically required by the terms of this Agreement, no provider of services pursuant to this Agreement, including but not limited to employees, agents or subcontractors of the County shall carry or possess a firearm on county premises or while acting on behalf of Washington County or the City pursuant to the terms of this Agreement. Violation of this provision shall be considered a substantial breach of the Agreement; and, addition to any other remedy available under law or equity. Violation of this provision is grounds for immediate suspension or termination of this Agreement. Section IX. Term of the Agreement 1. This Agreement shall be effective on January 1, 2008. Unless sooner terminated as provided herein, this Agreement shall terminate on December 31, 2009. This Agreement shall not be self-renewing; however, the Parties may renew this agreement beyond the December 2009 expiration date, subject to agreement to extension of the agreement, in writing, by each of the Parties. 2. It is understood that this Agreement contains the entire Agreement between the County and the City and that any statement, promises or inducements made by any Party hereto, or officer, agent, or employee of either Party hereto, which is not contained in this written Page 5 of 7 Agreement shall not be valid and binding; and this Agreement may not be enlarged, modified or altered except in writing signed by each of the parties hereto. It is expressly understood between the Parties, and this understanding shall be considered in interpreting the provisions of this Agreement, that upon notice given by any Party hereto, later negotiations may be undertaken for the purpose of revising, adding to or striking any provision of this Agreement which appear unworkable or insufficient to perfect, maintain and insure the purpose of this Agreement. Any change of the original provisions of this Agreement shall be written, signed by both parties and attached to this Agreement as provided above and this later revision, addition or deletion shall only apply to the provision revised, added or deleted and the remainder of this Agreement shall remain in full force and effect. 3. This Agreement may be terminated at any time and with or without cause by either Party by providing one hundred eighty (180) days written notice to the other Party of intent to terminate. Section X. Severability Every section, provision or part of this Agreement is declared severable from every other section, provision or part thereof to the extent that if any sections, provision or part of this Agreement shall be held invalid by a court of competent jurisdiction, it shall not invalidate any other section, provision or part thereof Page 6 of 7 In Witness Whereof, the City has caused this Agreement to be signed by its Mayor and attested to by its Clerk, and the County has caused this Agreement to be signed by the Chair of its Board of County Commissioners and attested to by its County Administrator. When appropriate, contracts should hold Washington County harmless and indemnify the county for any loss it may have to pay due to activities of those performing the contract. 2. Vendors are to provide insurance coverage for general liability and auto liability with minimum limits consistent with statutory liability limits, presently $300,000 per claimant and $1,000,000 per occurrence, and standard worker's compensation coverage. 3. In instances where a vendor can only provide lesser limits of coverage, the county may accept these limits, realizing there is some added risk exposure. In addition, there are occasions where the services provided by vendors expose the county to very little risk, and the insurance requirement may be waived in part or entirely. However, in cases where lower insurance limits are sought or a waiver of insurance requirements is requested, all such requests should be made in writing to the county's risk manager in Human Resources for approval. Deadline/ Timeline: N/A Background: • In September, Eide-Bailly, the long-time auditor for New Scandia Township, informed the City that us that they will no longer have the time or resources to retain Scandia as a client. At the September 18 meeting, the Council authorized release of an RFP for audit service for the fiscal years 2007, 2008 and 2009. • The RFP was advertised on the City's website, with the League of Minnesota Cities, and mailed to seven accounting firms that provide audit services to other municipalities. Five responses were received by the October 26, 2007 (4:00 p.m.) deadline. • The RFP requested prices for auditing the Scandia Fire Relief Association as part of the Audit. The additional cost quoted ranged from $3,000 to $3,750 per year for the first year. This is more than the Relief Association has been paying for their audit. • The proposed costs (not including the Relief Association audit) over the three-year period range from $50,564 (Smith Schafer) to $81,000 (HLB Tautges Redpath.) • All five of the firms are qualified to provide services to the City. In staffs initial review of the proposal, we were most impressed with Abdo Eick & Meyers. They submitted a good sample management report and have other valuable services available (such as assistant with capital assets.) Most of their practice consists of city government clients. They have the Banyon accounting software we use in our office. They also made a personal contact with staff to ask questions about the RFP. Even though their cost proposal was the second highest, they also proposed the highest level of effort (220 hours.) • Smith Schafer's proposal was the least expensive, but provided the least information and the lowest level of effort (155 hours.) • HLB Tautges Redpath was the highest cost proposal, even though their level of effort was lower than several others (170 hours.) Page 1 of 2 11/01/07 Their timing(field work in May, reports in mid-June) was also outside of what was requested in the RFP. For these reasons, we suggest that they could be removed from further consideration. • The Council could decide to select an audit firm based upon the proposals, or interview two or more of the firms before making a selection. If interviews are held, they should be scheduled so that a firm may be selected at the December 4 Council meeting. Recommendation: I recommend that the Council select firms for interviews. The entire Council could conduct interviews, or appoint a subcommittee. The interviews should be held when Treasurer Colleen Firkus is available, as she is the principal contact between the City and the auditing firm. Deadline/ Timeline: N/A Background: • Ordinance#91 provides that the Park and Recreation Advisory Committee consists of nine members appointed by the Council for staggered terms of five years, expiring on January 31st of each year. The Committee had seven members until the recent resignation of Ron Couture, whose term was to expire in 2010. • The Committee recommended, and the Council agreed, to consider expanding the Committee to the allowed nine members. After advertising the openings on the city web site and through press releases, applications were received from Joan Benner, Tom Triplett and Edward Ruf. • On October 30, a committee consisting of Council members Mike Harnetty and Donnette Yehle, and Committee members David Smith and Karen Schik, interviewed the three applicants. They recommended that all three be appointed to the Committee. • One of the applicants should be appointed to fill Ron Couture's un-expired term (to January 31, 2010.) The others should be appointed to terms expiring January 31, 2012 to ensure the staggering of terms with other members. Recommendation: I recommend that the Council make the appointments. The proposed subdivision is unique in that it is being proposed as a major subdivision so that the subdivision can An Employee Owned Company Promoting Affirmative Action and Equal Opportunity Old Marine Estates Preliminary Plat Page 2 October 31, 2007 Scandia, Minnesota be created through the platting procedures rather than a metes and bounds survey. The property consists of approximately 13.9 acres with lakeshore frontage on Big Marine Lake. The subdivision would create three (3) lots, one of which already has a house on it. The Camp Lakamaga Girl Scout Camp shares the subject property's southeasterly boundary. EVALUATION OF THE REQUEST: Lot Size Big Marine Lake is classified as a Recreational Development Lake. The Scandia Development Code requires a minimum lot size of 2.5 acres for the first tier of lots within the Shoreland District. The proposed lots are 5.31 acres, 3.77 acres and 4.45 acres in size. The remaining .39 acres is part of Lakamaga Trail. Lot Width and Frontage The minimum lot width for lots on a Recreational Development Lake is 150 feet. The Shoreland Ordinance requires the minimum lot width of 150 feet at the shoreline. The proposed lots meet these minimum requirements. However, Lots 2 and 3 have the appearance of flag lots. The Subdivision Ordinance, Chapter 3, Section 10.7 (1), specifies that lot lines must be substantially at right angles to straight streets or radial to curved streets. The lot configuration and proposed shared driveway for Lots 2 and 3 are a response to topographic conditions, and provide access to the lots while avoiding impacts to the adjacent wetlands. Wetlands Three wetlands are shown on the subject property. The Applicant has submitted a Wetland Delineation Report. The report has been reviewed by the Washington Conservation District (WCD). A vegetative buffer will be required around the wetlands, and the required buffer width will depend on the types of the wetlands. The Applicant is proposing a shared driveway to serve Lots 2 and 3 to avoid impacts to the wetlands. Jyneen Thatcher of the Washington Conservation District, has reviewed the wetland delineation, and she recommends that the City accept the delineation as surveyed. The plans as presented by the applicant show four proposed raingardens on the property. The Carnelian Marine St. Croix Watershed District (CMSCWD) in correspondence dated October 31, 2007, addresses issues related to drainage computations, design of raingardens and additional detail for erosion and sediment control plans. See letter from CMSCWD. These issues must be addressed by the Applicant. Setbacks and Wetland Buffers All setback requirements and vegetative buffer requirements must be met. The setback from the Big Marine Ordinary High Water Level (942.2 feet) is 75 feet. The yard setbacks are: side yard of 10 feet, front yard of 40 feet, and rear yard of 50 feet. Bluff setbacks are 30 feet and 100 feet from the Ordinary High Water Level. There is adequate space for dwelling units on Lots 2 and 3 that can meet appropriate setbacks. Lot 1 already has a house,which infringes slightly on the lake setback. The subject property is located within the Carnelian Marine Watershed District's jurisdiction. In her letter of October 8, 2007, Ms. Thatcher states that the proposed plat adequately depicts the setback zones of 75 feet from the permanently flooded zone (OHW) of the Type 3 wetland and 20 feet from the delineated edge of both wetlands. She states that "notes and graphics indicate a 50-foot buffer around the Type 3 wetland which is consistent with County standards."The Applicant should consult with the Watershed District regarding Old Marine Estates Preliminary Plat Page 3 October 31, 2007 Scandia, Minnesota permit requirements, and to determine the Watershed District's buffer requirements based upon the draft Watershed Management Plan. Wetland No. 2 is a category 2 wetland with a minimum 50-foot natural buffer. The proposed buffer needs to be identified on the plans. Big Marine Lake is a recreational development lake and has a minimum 50-foot natural buffer requirement. The proposed buffer for Big Marine Lake needs to be identified on the Plans,. Buffers need to be delineated on the plans and a declaration recorded on the property deed for each lot. Ms. Thatcher goes on to point out that the wetland on Lot 3 is crossed by horses in the shallow areas along the property line. A condition of this plat should be that no wetland fill be allowed on this wetland. The Plans also indicate 400 square feet of wetland impact,but do not show where that impact will occur. The CMSCWD does not recognize a deminimus exemption. The Applicant must identify the potential impact and work with the CMSCWD to protect the wetland. The Department of Natural Resources has reviewed the Preliminary Plat, and has no comments on the subdivision. Maximum Lot Coverage/Buildable Land The Scandia Zoning Ordinance sets limits on the maximum percentage of lot coverage (impervious surface) per lot (25%). It is not specifically called out on the information provided by the surveyor. However, for Lots 2 and 3, the surveyor shows 9,800 square feet of disturbed area for house, garage, and shared driveway for each lot. The gross size of Lot 2 is 164,090 square feet and the size for Lot 3 is 193,923 square feet. Based on this information, the impervious surface would be 5.9% and 5% respectively, well within the 25% limits set by the City. The ordinance also requires at least one acre of buildable land. Lot 1 has 2.9 acres buildable; Lot 2 has 1.18 acres buildable, and Lot 3 has 1.2 acres buildable. All lots meet the buildable area requirements. Woodland Preservation The aerial photograph of the subject property shows that there are some woods on the site. A Woodland Preservation plan was prepared as required by the Scandia Zoning Ordinance. This plan shows that 98 trees will be removed,primarily from the joint driveway area. Some of these trees, mostly white pine, will be relocated onto Lots 2 and 3. This will leave a net loss of 73 trees. From the information provided, it is not clear how the Applicant will replace the trees. The tree replacement schedule in Chapter Two, Section 9.11(4),provides the needed size and type of replacement trees. In the event that land area is not available for replacement trees, the ordinance allows a tree replacement payment of$100 for each net tree lost. The Applicant must either show where the remaining trees will be replaced on a reforestation plan or pay the City $100 for each tree lost. Accessory Structure From the aerial photo it appears that there is an accessory structure on Lot 1 between the existing house and the lake. The structure must meet the setback requirements, or must be removed. Lakamaga Trail From the aerial photo it appears that the Lakamaga Trail right-of-way extends to the subject property, but that the roadway surface stops north of the property. The proposed dead-end road would be approximately 1,800 feet long, or about a third of a mile. Old Marine Estates Preliminary Plat Page 4 October 31, 2007 Scandia, Minnesota The Planners find that creation of a dead-end at the end of Lakamaga Trail is appropriate in that there are no opportunities for future street connections in the area. In the event of changes in land use at the Girl Scout Camp property, roadway access would be provided north of the proposed subdivision. Since the last meeting the surveryor provided additional information regarding the existing hammerhed turnaround on the Swanson property. The Preliminary Plat now shows a small boxed-off area at he south end of Lakamaga Trail. The Detail of Southwest End, Lakamaga Trail shows the bituminous surface turn around but not the box. The intention for this area is not clear from the information provided. Since this will be a public turn around, land dedication to the City should be made for the area shown boxed off on the Preliminary Plat and included in the right of way for Lakamaga Trail. The area should be enlarged (20-30 feet) to allow for snow removal. Park Dedication The subject property is not shown within a park search area in the Comprehensive Parks, Trails, Open Space, and Recreation Plan. Cash in lieu of park land dedication should be required. Drainage Easements The Preliminary Plat shows a drainage area passing through Lots 2 and 3. This drainage area must be shown as a drainage easement to the City on the final plat. Septic Systems The Applicant has provided soil tests for proposed septic systems to serve Lots 2 and 3. Approval of the Preliminary Plat is conditioned upon approval of the septic areas and drainfields by Washington County. Shared Driveway The Applicant is proposing to provide a shared driveway to serve Lots 2 and 3. The shared driveway is necessary to avoid filling a large wetland on Lot 3. The proposal is for a 33-foot driveway easement with a 16-foot driveway made of Class 5 aggregate. This shared driveway must be designed and built to meet the requirements of the Fire Chief to allow emergency vehicle access. Maintenance of the shared driveway will be determined by the future landowners of these lots. Lowest Floor Elevation The Preliminary Plat states that"All lots abutting a lake...The lowest floor elevation shall be no lower than two feet above the regulatory flood protection elevation. The lowest floor elevation...shall be a minimum of three feet above the 100-year flood elevation or three(3) feet above the ordinary high water mark, whichever is greater." Lowest floor elevation will be verified at the time of issuance of the building permits. Neighbor Letter A letter form Tim Pratt received October 30, 2007 to the northwest of the proposed develop has raised questions about use of the shoreline, structure heights and raingardens. The first concern is access to the lake from the blufftops. The neighbors are requesting that the City provide information regarding erosion control and aquatic vegetation and its benefits and penalties for removal. While providing that information to prospective home buyers is a good idea, it would be difficult to provide this information to prospective buyers. At the time of the building permit application, the building inspector will provide information to the builder regarding vegetation removal and erosion control. Old Marine Estates Preliminary Plat Page 5 October 31, 2007 Scandia, Minnesota Regarding height of the houses, sometimes the maximum height allowed is reduced if the Applicant requires a setback variance from the lake. The rationale for this action is that if someone is placing a home closer to the water, in order to mitigate the visual effect of the structure, a greater height restriction is imposed. In this case, no variances will be required. Height restrictions can also be increased as they were in the Ti Gavo development, which was a Planned Unit Development (PUD). The nature of a PUD is that some negotiating can take place on various requirements; there is give and take between the City and the landowner/developer, this is the nature of a PUD. Again, the subdivision proposed is not a PUD, and negotiation for height is not part of an ordinary subdivision without need for variances. In this case there is no variance requested and it is not a PUD, therefore increasing the height limitation is not possible. Because this proposal meets code requirements, an attempt to place greater height limitations on the two houses that could be placed on these lots could be viewed as arbitrary. Of course, the landowner could decide on his own to reduce the heights allowed, but this cannot be required. On the issue of flooding as water drains from the wetland into the lake. The Carnelian Marine Watershed District will recommend a raingarden, or some other feature to collect the water before it floods onto the Pratt's property. As noted above, the plans do include sites for four raingardens already. PLANNING STAFF RECOMMENDATIONS: Staff recommends approval of the Preliminary Plat for Old Marine Estates with the following conditions: 1) That the wetland on Lot 3 not be filled or disturbed and that the Applicant work with the Carnelian Marine St. Croix Watershed District on any other potential impacts to the wetlands. 2) That the Applicant consult with the Carnelian Marine Watershed District regarding wetland rules and setbacks and other issues associated with this proposal and obtain a watershed permit. That the Applicant delineate buffers around the wetlands and Big Marine Lake and address these issues as outlined in the Letter from Dan Fabian dated October 31, 2007. 3) That the Applicant obtain approval by the City Engineer of the erosion and sediment control plan with additional detail before final plat approval. That the Applicant design and construct a raingarden or other feature to prevent flooding onto the neighbor's property. 4) That the Applicant address issues related to drainage computations, design of raingardens, and additional detail for erosion and sediment control plans, as mentioned in the October 31, 2007, correspondence from the CMSCWD. 5) That the Woodland Preservation Plan be amended to include additional replacement trees or payment of$100 to the City if adequate space does not exist on the proposed lots for replacement trees. 6) That the preliminary plat meet all requirements of the City Engineer, including road design, driveway design, drainage, etc. That the Applicant dedicates land for the turn-around shown boxed off on the Old Marine Estates Preliminary Plat Page 6 October 31, 2007 Scandia, Minnesota Preliminary Plat and included in the right-of-way of Lakamaga Trail. The site is located at the end of Lakamaga Trail. The site is part of Government Lots 1 & 2, Section 29, T32N, R2OW. Three (3) wetlands were delineated. The site is located in the St. Croix River Watershed (#37), in New Scandia Township in Washington County, Minnesota. This report describes the characteristics of the wetland basins and documents their status under the various wetland regulations. If your project will not impact the wetlands, or is below the threshold limits outlined below, this report can be submitted to the Local Units of Government to document compliance with the various wetland regulations. Wetland Delineation Methodoloj v As part of our wetland delineation, Hult & Associates, Inc., reviewed the available background wetland information on this site. This information included: ➢ National Wetlands Inventory Map (NWI); ➢ Minnesota Department of Natural Resources Protected Waters Map; ➢ Washington County Soil Survey;; ➢ U.S.G.S. 7.5 min. Quadrangle Map; and ➢ Some aerial photographs. The basin were field delineated (on-site) July 26, 2007 using the principles of the 1987 Corps of Engineers Wetland Delineation Manual including adopted modifications, guidance letters and memorandum of agreement. The routine delineation method was generally used and dominant vegetation was evaluated by estimated area cover and the 50/20 rule. Wetlands were classified according to the methodologies in Wetland and Deepwater Habitats of the United States (FWS/OBS Publication 79/31; Cowardin et. al. 1979) and Wetlands of the United States (USFWS Circular 39; Shaw and Fredin 1971). The wetland boundaries and observation points were staked with pink metal pin flags and orange flagging. The location of the staked basins were surveyed by Hult & Associates, Inc. and incorporated into the site plans. The size of the basins reported here is based on that survey. Basin Characteristics Table 1. The basin consisted of Common Cattails, Broad-Leaf Arrowhead, Lady Tear Thumb, Goldenrod and Reed Canary Grass. The soil consisted of 10YR 2/1 muck to a depth greater than 24 inches. Standing water and saturated soils were observed at a depth of 8 inches. The adjacent uplands were marked by a topographic and vegetation break consisting of Kentucky Blue Grass, Creeping Charlie, Canada Thistle and Common Dandelion, Virginia Creeper, Downey Bromegrass and Easter Red Cedar. Wetland 2 is a 56,760 ft2 (on-site) square foot, Palustrine Emergent, Saturated (PEMB, Type 2) sedge meadow located on the easterly portion of the site. The basin consisted of Lady Tear Thumb, Goldenrod, Blue Vervain, Boneset, Sedges, Red Osier Dogwood and Reed Canary Grass. The soil consisted of 10YR 2/1 muck over a 10YR 3/1 loam to a depth greater than 24 inches. Standing water and saturated soils were not observed in the extremely dry conditions. The adjacent uplands were marked by a topographic and vegetation break consisting of Kentucky Blue Grass, Common Mullein, Canada Thistle and Common Dandelion, Virginia Creeper, Downey Bromegrass and Easter Red Cedar. Wetland 3 is a 29,969 ft2 fringe wetland adjacent to Big Marine Lake. The basin consisted of Reed Canary Grass and Cattails The adjacent uplands were marked by a severe topographic and vegetation break consisting of Kentucky Blue Grass, Common Mullein, Canada Thistle and Common Dandelion, Virginia Creeper, Downey Bromegrass and Easter Red Cedar. Wetland Jurisdiction Clean Water Act, Section 404 The U.S. Army Corps of Engineers (COE) regulates dredge and fill activities in navigable waters, wetlands adjacent, tributary, or with significant nexus to navigable waters and isolated wetlands important to interstate commerce. A 2001 Supreme Court ruling has limited the COE jurisdiction over isolated wetlands, but the COE has not yet finalized guidance for implementing this ruling under Section 404 of the Clean Water Act. In most cases, if the proposed impacts are less than 400 square feet, the COE does not require notification of the project. If proposed impacts are between 400 square feet and 2.0 acres, the COE requires notification and approval (letter of permission) prior to beginning the project. If the wetland impacts occur in or adjacent to "special waters" and/or exceed 10,000 square feet, the COE review will include a 30-day public/interagency notice. If the proposed impacts exceed the WCA deminimus limits (see below), the COE will require mitigation for the full amount of the impacts regardless of the WCA exemption. If more than two acres of wetland impacts are proposed, an individual permit will automatically be required which includes sequencing (providing there are no alternatives) review by other environmental agencies, a public comment period, and compensatory mitigation. Minnesota Protected Waters Act The Department of Natural Resources (DNR) has jurisdiction over waters of the state that are generally Wetland Type 3, 4, and 5, and are larger than 2.5 acres in incorporated areas or 10 acres in unincorporated areas. There is one DNR protected wetland listed on this site, wetland# 3 (Big Marine Lake) with an Ordinary High Water (OHW) level of 942.2 established. The OHW for a lake or wetland is determined by the DNR as the elevation at which the vegetation changes from aquatic to terrestrial. For a watercourse the OHW is the average elevation of the top of the channel banks at any given location. The DNR has jurisdiction over areas below the OHW. No impacts are allowed below the OHW which would have the effect of converting protected waters to upland. Although some activities such as vegetation clearing, sand blankets, docks, etc. may be allowed by the DNR, they may require a permit and the DNR should be consulted as to limitation on any activity below the OHW. Minnesota Wetland Conservation Act (WCA) A Local Unit of Government (LGU) will have jurisdiction over the wetlands on the site, based on the WCA as amended through 2000. The LGU for this site is the Washington Conservation District (Jyneen Thatcher, 651-275-1136). There is a WCA deminimis exemption for the project for the first 2,000 square feet of wetland impacts to Type 1, 2, and 6 wetlands outside of a shoreland protection zone. Within a shoreland protection zone (1,000 feet for a lake and 300 feet from a river) and for other types of wetlands the deminimus exemption is limited to 400 square feet. This site is within the shoreland district and will be limited to 400 square feet. If the site plans include wetland impacts, which exceed the exemption limits, a WCA permit will be required from the County. Under the WCA rules, an applicant must demonstrate that wetland impacts have been avoided and unavoidable impacts minimized before the activity would be permitted. These rules also require a 2:1 mitigation ratio for filling or draining in any wetland, or excavation in semi permanently to permantely flooded wetlands. Projects with proposed wetland impacts must also develop a 5-year monitoring plan to determine if the mitigation plan is successful. Permanent deed restrictions will be required over the mitigation area. Clean Water Act Section 402 Under Section 402(P) of the Clean Water Act, the U.S. Environmental Protection Agency is required to develop regulations for stormwater discharges. The Minnesota Pollution Control Agency(MPCA) has the authority to regulate the stonmwater program under the National Pollution Discharge Elimination System (NPDES)program. The MPCA has written a general permit for construction sites, which grade more than 1 acre. As of July 1, 2003, a permit application and fee of $400 (no plans or specifications) must be sent to the MPCA at least 48 hours prior to commencement of land disturbance activities. The permit application required the site owner and contractor to certify the provision of the general permit, including developing and implementing temporary and permanent erosion and sediment control plans, will be followed. The general permit requires that stormwater discharges be preponded before discharge to waters of the state (including wetlands). The general permit also requires inspection and maintenance of the erosion and sediment control facilities on a weekly basis. If site grading exceeds one-acre, this permit will have to be obtained from the MPCA. The delineation flagging appears to adequately capture the wetlands on the site,and appropriately identify the wetland type.Based on my site review, the delineation documents submitted to date,and the preliminary plat map,I would recommend the City accept the delineation as surveyed. Regarding the preliminary plat for the minor subdivision,I would offer the following comments.. 1. The proposed plat adequately depicts the set-back zones of 75 feet from the permanently flooded 'one(ohw)of the Type 3 wetland and 20 feet from the delineated edge of both wetlands. 2. The notes and graphic indicate a 50-foot buffer around the Type 3 wetland,which is consistent with County standards.However,the Carnelian Marine on St Croix Watershed District has a draft wetland inanagernent plan that categorizes wetlands and applies buffers relating to the specifics of the individual wetlands.That agency should be consulted as to the management class assigned to these wetlands,and the recommended buffer distance. 3. Lot 3 is an L-shaped parcel,which is split by Wetland#2.Currently, the wetland is crossed by the resident horses in the shallow area along the property line.On parcels like this,we frequently receive requests from owners requesting wetland fill to improve the crossing path. While this subdivision proposes for Lot 3 to share the access drive with Lot 2,I would urge the City to consider the potential for future wetland impacts to Lot 3.„ 4. The shoreline wetland is slightly above the Ordinary High Water Level of the lake.Any alterations to the shoreline could impact this wetland fringe.Traditional lakeshore improvements(such as sand beach blankets,tiprap,or retaining walls)ate subject to regulation under the Wetland Conservation Act(WCA)if they impact/fill the wetland above the OHWI... Temporary docks are usually considered not a regulated impact,under the WCA. Overall,this preliminary plat could lead to some wetland impacts that could be avoided with some additional planning and review at this stage. Please provide copies of CMSCWD comments to the City Council/Planning Commission for consideration at their November 6, 2007, meeting. 1. Comments are based on a copy of the proposed preliminary plat and plans prepared by Hult & Associates, dated 10-23-07. 2. Proposed project is a minor-subdivision and requires a permit from the CMSCWD. Please include requirement to obtain Watershed District permit prior to start of construction. 3. Low floor elevations for each lot need to be identified on plan sheet and must be set a minimum of 2-ft above the 100-yr flood elevation. The plan sheets identify some requirements for low floor elevations but it is not clear what is the lowest allowable floor elevation for each building site. Based on the location of the proposed building pads the 100- yr flood elevations of Wetland#2 probably controls low floor elevations. 4. Wetlands: a. A copy of the wetlands delineation report and comment letter from Jyneen Thatcher, WCD (City Wetlands Administrator) was received. Jyneen's specific recommendations should be sought and implemented prior to approval. Lakamaga Trail is platted over a portion of Wetland#1. Is there filling/grading or any other impacts proposed for either of the wetlands? The plans identify up to 400 ft^2 of wetland impact but do not identify where this is located. The Watershed District does not allow the deminus exemption identified on the plan sheets. b. District Management Standards identify Wetland No. 1 as a category 3 wetland with a required minimum 25-ft natural buffer. Proposed average buffer for wetland No. 1 meets this requirement. Wetland No. 2 is a category 2 wetland with a minimum 50-ft natural buffer. Proposed buffer needs to be identified on the plans. Big Marine Lake is a recreational development lake and has a minimum 50-ft natural buffer requirement. Proposed buffer for Big Marine Lake needs to be identified on the plans. Buffers need to be delineated on the plans and a declaration recorded on the property deed for each lot. City may want to require the developer to clarify on the plans or in the developers agreement what type of access is allowed down the bluff to the lake. Something to inform potential lot buyers as to what is allowed before they purchase the property. 6. Drainage Computations: a. Subwatershed divides need to include off-site areas that drain to the site. Based on our review of contour mapping for the adjacent properties there appears to be a significant contributing drainage area SE of Wetland#2. Also the Lakmaga Trail culvert is included in the model but the drainage area NE of the culvert is not included in the model. b. Runoff curve number computations assume 100%of pervious area consists of Woods with "A" soils. The soil survey identifies some of the soils as "B" soils and the wetland areas would have "C: or"D"soils. The lawn portion of the property where the new homes will be should be assumed to be lawn with "B" soils. c. Drainage Model is needed for both undeveloped and developed conditions. Rates should not be increased from undeveloped to developed conditions, for the 2-yr, 10-yr or 100-yr 24-hr storm event. (The District has heard concerns from neighboring properties that the road in this area is frequently overtopped causing drainage issues and that the additional impervious of this development will increase those problems). d. Wetland #1 and Wetland #2 are landlocked basins. Determination of the 100-yr flood elevation needs to use the 100-yr 10-day snowmelt event (frozen ground no infiltration) as the design storm. 7. Additional details are needed for the 4-proposed raingardens. At a minimum area, volume and typical construction detail should be included. How will the developer ensure that the new home owners construct the raingardens as designed? a. We suggest that the City require the raingardens to be constructed by the developer at the same time that the shared driveways are constructed. b. We also suggest relocating the four proposed raingardens to place one at the upstream end of the proposed culverts for the individual driveways. The remaining two should be combined to a larger raingarden/ infiltration basin (if soils are appropriate) located at the intersection of the proposed driveway and Lakamaga Trail. This basin could also provide storage to help reduce flows from the site and address concerns of neighbors. We anticipate this basin would be similar to what the City installed by the Shaw property to address a similar drainage issue. Except in this case rather than having to redo-fit the project could be included in the initial driveway construction and shaped to fit more naturally into the topography. If construction is proposed for this winter then erosion control for winter construction needs to be included in the plan. Driveway ditches should probably be blanketed with rock checks to help stabilize. Erosion and sediment control plan should be approved by the City Engineer. Scandia,MN 55073 CITY OF SCANDIA Dear Ms. Hurlburt, I'm writing on behalf of the Pratt Family Big Marine LLC to let you know our thoughts about the subdivision proposal submitted by our neighbors John and Sandra Swanson, 11980 Lakamaga Trail. We are concerned the subdivision, if not done properly,has the potential to harm the water quality of Big Marine Lake, diminish the esthetics of the lake and create flooding on our property and adjacent properties. We want to share our concerns now so that they can be addressed before construction activities commence. Water Quality We realize the new owners will want to access the lake. However, the two proposed lots will have steep, sandy slopes from the bluff line to the lake shore. Even minimal action has the potential to create significant damage to this fragile area. We believe it is imperative that new owners receive information from the Washington County Code on Shoreline Management as to how best to access the shoreline from the bluff while causing minimal damage and erosion. While the City does not typically present this information to an owner until after the lot has been purchased and a building plan presented,we believe the City should make it a condition of the subdivision that potential purchasers be given this information before closing on the lots. If erosion of the slope occurs, as would be likely with virtually any development of this fragile area, the impact on lake water quality can be minimized by the aquatic vegetation that is currently near shoreline. We are concerned that the new owners may not realize the benefits of the cattails,reeds and other plants and they may try to remove them. The new owners also may not be aware of the shallow depths of that portion of the lake. Further,we ask that the new owners be made aware of the limited need to construct a beach type environment because just 50 feet or so out from the shore is an extensive, sandy,shallow and vegetation-free area that is ideal for swimming.We believe the City should make a further stipulation of the subdivision to require that potential purchasers be given information from either the DNR or the Watershed District regarding the benefits of the aquatic vegetation and the potential penalties for removing the aquatic vegetation. We also urge the Swansons to let potential purchasers know about the lake depths so that the new owners can determine the best way to enjoy the lake while having minimal impact on the natural environment. Esthetics The bluff where the new lots will be located is a high elevation point on the lakeshore. We are concerned that if the new owners attempt to put the tallest home allowed by code as close as permitted to the shoreline that it would have a negative impact on the esthetic experience of other lake users. We encourage the City protect the lakeshore viewshed by requiring lower heights for the homes that would go on the new lots. Flooding The wetland on the Swanson property just east of Lakamaga Trail drains westward into Big Marine Lake. For many years we and our neighbors have had problems with localized flooding as runoff from the wetland drains through our properties. We are concerned that increased impervious surface in the wetland watershed would mean higher flows during snowmelt and large rainfall events, to the detriment of our property. We feel it would be reasonable to require a rain garden infiltration area large enough to capture the increased flow from the rooftops, driveways, and other impervious surfaces built on the development.
