Adjournment April 15, 2008 A regular meeting of the Scandia City Council was held on the above date. Mayor Seefeldt called the meeting to order at 7:01p.m. The following councilmembers were present: Councilmembers Pete Crum, Michael Harnetty, Dolores Peterson, Donnette Yehle, Mayor Dennis Seefeldt. Staff present: Administrator Anne Hurlburt, City Attorney Dave Hebert, Bonestroo Engineer Paul Hornby, Treasurer Colleen Firkus, Deputy Clerk Brenda Eklund. PUBLIC FORUM There were no public comments. APPROVAL OF AGENDA Mayor Seefeldt introduced two additional agenda items: 8f3) Willowbrook Church's request for an extension regarding their CUP application, and 8f4) Summer Recreation program staffing. Councilmember Peterson added a discussion of a video tape made by the Scandia Civic Club. Councilmember Yehle, seconded by Councilmember Peterson, moved to approve the agenda as amended. The motion passed unanimously. The motion passed unanimously. POLICE REPORT Deputy Chris Majeski was present to report on police activity over the past month. A search for stolen items at a residence on Manning Trail resulted in discovery of a drug manufacturing operation. Two individuals were taken into custody. Testing of possible contamination to the soil April 15, 2008 Scandia City Council Page 2 and water is being undertaken by the EPA at this site. Deputy Majeski also reported on the successful completion of the D.A.R.E. program at Scandia Elementary School. FIRE DEPARTMENT Assistant Fire Chief Jim Finnegan reported on the Fire Department's activity within the past month. EMT Refresher courses for 2009 were awarded to Lakes Region Medical Training in Wyoming, resulting in a $4,000 savings through the RFP process. In response to concerns about the uptown fire siren, state statute information was presented which states that a reliable means of sounding an alarm is necessary for the department to continue to receive state fire aid. A recommendation to purchase a new alarm system and to relocate the alarm to the fire station will be referred to the Capital Improvements Committee. The current alarm is becoming aged and outdated and does not have the capability for installation of a timing device to turn the alarm system off during overnight hours. Skip Stromberg stated his opinion that the alarm is a public nuisance and is unnecessary. The Fire Department will research the costs of handling emergency calls by means of a "reverse 911" system with Washington County. CITY ENGINEER Paul Hornby, Bonestroo, presented the monthly engineering update. Mr. Hornby reported on the issues that need to be addressed regarding the future paving of Pilar Road. Bonestroo is recommending that the city do preliminary work with the residents now, either by a public information meeting or by mailed surveys. It was agreed that involving public input before the design stage will be helpful in determining specific concerns, and help better estimate the potential costs for the city's Capital Improvement Program. Administrator Hurlburt and Mr. Hornby will develop a sample survey for review at next rnonth's council meeting. CITY ADMINISTRATOR Policy for Rental of Old Community Center Chairs A request was recently received from the Duck Soup Players, a non-profit theater company serving the Scandia area, to borrow or rent 70 of the old metal folding chairs that were recently replaced in the Community Center. Councilmember Harretty suggested selling the chairs at a nominal cost to avoid storage handling, but Councilmember Yehle recommended that the chairs be borrowed out at no charge, as storage of the chairs is currently not a problem. Council agreed on a policy to limit the use to community groups and not individuals. Administrator Hurlburt will prepare a release form for use of the chairs acknowledging that the chairs are "as-is" and releasing the city from any liability. Status Report on Carnelian-Marine-St. Croix Watershed District Proposed Rules At the March 18th Council meeting, a letter addressing concerns about the proposed rules was approved to be forwarded to the CMSCWD for their public hearing on April 7, 2008. Mayor Seefeldt, Attorney Hebert and Administrator Hurlburt attended the hearing. Some changes were made in response to the comments, but there remain some major concerns about other proposed changes. Attorney Hebert has submitted a letter to the city office outlining concerns that have not April 15, 2008 Scandia City Council Page 3 yet been adequately addressed by the Watershed. This letter will be forwarded to Jim Shaver, Watershed Administrator. Among the concerns are the rules to expand regulations for wetland buffers and mitigation requirements beyond what is now required by local ordinances and state law (MN Wetland Conservation Act). The Car-Mar-St. Croix Watershed has agreed to meet on April 21st at Scandia City Hall with concerned agencies for further discussion on the proposed rules. Willowbrook Church's Request for an Extension of the CUP Review Administrator Hurlburt presented a request from Gary Monn, Chairman of Willowbrook Church, to extend the review deadline of the Conditional Use Permit for construction of a place of worship by six months. At the February Planning Commission meeting, the review period was extended to May 17, 2008. The church feels that this will give them adequate time to have funding in place to move forward. Councilmember Peterson, seconded by Councilmember Harnetty, moved to approve the extension of the CUP review process to November 17, 2008. The motion passed unanimously. 2008 Summer Recreation Program Staffing Recreation Coordinator Marty McKelvey has requested the hiring of part-time, seasonal instructors for the skateboarding and tennis programs. The instructors who have taught in past seasons are not available to teach this year. One or two instructors are needed for each program, depending upon enrollment. Kristin Stenborg will return as a recreation program leader to assist with Camp Lakamaga programs. Councilmember Yehle, seconded by Mayor Seefeldt, moved to 1) authorize the advertisement for and hiring of part-time, seasonal Recreation Program leaders or instructors for the skateboarding and tennis programs; and 2) approve the hiring of the Kristin Stenborg as a part-time seasonal recreation program leader at the pay rate of$8.00/hour. The motion passed unanimously. 2008 CONTRACT WITH LAKES AREA YOUTH SERVICE BUREAU The Youth Service Bureau has requested that the city sign a new contract for service year 2008 to provide health, social and recreational services to the residents of Scandia. The 2008 budget included funding of$5,407.00 for this service. City Attorney Hebert recommended amending Section 8 of the contract to increase liability insurance to the amount of$1,200,000. Councilmember Peterson, seconded by Councilmember Crum, moved to approve the 2008 Contract with the Lakes Area Youth Service Bureau with a change to Section 8, and to make a lump sum payment of$5,407.00. LEAGUE OF MN CITIES ANNUAL CONFERENCE Council discussed who might represent the city at the LMC annual conference, to be held June 11-13 in Rochester. Councilmember Crum, seconded by Yehle, moved to authorize up to two councilmembers to attend the LMC annual conference along with payment of their expenses. The motion passed unanimously. April 15, 2008 Scandia City Council Page 4 HISTORY OF SCANDIA VIDEOTAPE Councilmember Peterson would like to have a VHS tape, which was made by the now disbanded Scandia Civic Club, transferred to DVD media. This tape, made in 1993, documents the history of Scandia, and Councilmember Peterson felt it is important to preserve this footage in a more permanent manner. Mike White, member of the Forest Lake Cable Commission, offered to have the videotape transferred to DVD at the cable studio for a nominal cost. Councilmember Peterson, seconded by Councilmember Yehle, moved to adjourn. Mayor Seefeldt called the meeting to order at 7:00 p.m. The following council members were present: Council members Michael Harnetty, Dolores Peterson, Mayor Dennis Seefeldt, Donnette Yehle. Councilmember Pete Crum joined the meeting at 7:45 p.m. Staff present: Administrator Anne Hurlburt, City Attorney Dave Hebert, Building Official Steve Thorp, Deputy Clerk Brenda Eklund. APPROVAL OF THE AGENDA Councilmember Yehle, seconded by Councilmember Peterson, moved to approve the agenda as presented. The motion passed unanimously. LAWFUL GAMBLING PREMISES PERMIT, FOREST LAKE ATHLETIC ASSOCIATION—RESOLUTION 05-06-08-01 The Forest Lake Athletic Association has submitted an application for continuing their lawful gambling operation at Prospects. This is FLAA's first application to the City since adoption of Ordinance No. 100 on March 6, 2007. FLAA has submitted all required documentation and have been found to meet the qualifications of the ordinance. Councilmember Peterson, seconded by Councilmember Yehle, moved to adopt Resolution 05-06-08-01 Approving a Lawful Gambling Premises Permit for the Forest Lake Athletic Association. The motion passed unanimously. UTILITY PERMIT FOR EXCEL ENERGY An emergency repair for replacement of an underground electrical service line at 23679 Meadowbrook Avenue was recently approved by City Engineer Tom Peterson. As work was done in the right-of-way, it is necessary for Xcel Energy to secure a utility permit from the City. Councilmember Peterson, seconded by Mayor Seefeldt, moved to approve the Utility Permit for Excel Energy, contingent upon payment of the required $50.00 fee. The motion passed unanimously. PARK AND RECREATION COMMITTEE—FRIENDS OF THE PARK Park and Recreation Committee members Karen Schik and Tom Triplett presented information on establishing a 501(c)3 non-profit group to be known as "Friends of the Parks", or something similarly named. This volunteer organization would function independently of the city and be eligible for funding not available to government agencies. The principle motivation is to generate funds and gather volunteer workers for projects supported by the Park and Recreation Committee. Mr. Triplett proposes that a minimum of 100 people be committed to this group and will then proceed with the application for tax-exempt status with the IRS. MN Parks and Trails Association has offered assistance with this application. Consensus of the council considered this to be a good idea and registered no objections to the proposal. PUBLIC WORKS SALT/STORAGE STRUCTURE In 2007, the Capital Improvements Committee recommended construction of a covered shelter to allow for storage of a salt mix that is currently transported from the Washington County storage garage on an as-needed basis. A concrete slab adjacent to the Public Works/Fire Department May 6, 2008 Scandia City Council Page 2 building was installed in 2001 for the storage of salt on site. Building Official Steve Thorp reported on structures that could be built over this slab. A wood building would require walls about 20 feet in height and would exceed a cost of$50,000. Mr. Thorp presented quotes for a fabric covered structure commonly used for this purpose. A Cover-All building installed by Greystone Construction fits within the $20,000 budgeted for this project. Councilmember Peterson voiced her opposition to this proposal, stating that this hoop style building is not allowed under the current accessory structure ordinance, and that the visibility of this would be an eyesore next to the Public Works/Fire Department building. Peterson stated that the Council should wait to levy the extra money to build it right. Councilmember Yehle was in agreement with the undesirable appearance of a fabric covered shelter and requested additional options be researched and compared. Councilmember Harnetty felt that he could support the style of a hoop building if there is a positive economic payback. Administrator Hurlburt relayed that the Capital Improvements Committee strongly felt that on-site storage of salt does result in cost and labor savings, given that time is not spent on travel to the County garage during a snow event when the trucks could be out plowing snow. Staff was directed to gather cost and needs/benefits information for alternate buildings and report back at a future meeting. SCANDIA-MARINE LIONS REQUEST TO DISPLAY FLAG The Scandia-Marine Lions Club has requested permission to display a flag on the walls of the Community Center. The flag, flown on a mission in Iraq, was a gift to the Club. Councilmember Peterson thought the Heritage Room would be a more appropriate setting for display rather than in the large hall. Consensus of the council approved displaying the flag in a case, along with the accompanying certificate, in the Heritage Room. The Planning Commission meeting was called to order at 7:40 p.m. The following were present: Commission Chair Chris Ness, Commissioners Tom Krinke, Christine Maefsky, Susan Rodsjo, Peter Schwarz and TKDA Planner Richard Thompson. DAVID & WYNNESS HOLMBERG—REQUEST TO REZONE PROPERTY (RESOLUTION 05-06-08-02/ORDINANCE NO. 111) Applicants David and Wynness Holmberg have requested that their property at 21300 Olinda Trail be rezoned from General Business (GB) to Single Family Estate (SFE) to allow for construction of a new attached garage for the existing home, which is a non-conforming use under the current commercial zoning. Planner Richard Thompson presented an evaluation of the request. The property formerly included a commercial greenhouse, which has since been removed. The Planning Staff recommends approval of the request as the current use of property is residential, rezoning is consistent with adjacent properties (no spot zoning), and the request conforms with the Comprehensive Plan which supports residential use in the village center. Chairman Ness opened the public hearing. May 6, 2008 Scandia City Council Page 3 • Mike White, 13310 188th Street, supports the rezone, stating that removing the existing garage and building a new attached garage is an improvement to the property. As there were no other comments, Chairman Ness closed the hearing. Commissioner Schwarz questioned how this zoning would affect the new proposed Comprehensive Plan. Administrator Hurlburt advised that this would not be a conflict as the proposed Village Center Mixed Use allows for residential and commercial zoning. The Planning Commission recommended to the City Council to approve both Resolution 05-06- 08-02 and Ordinance No. 111 to change the designation of 21300 Olinda Trail from General Business to Single Family Estate. Councilmember Peterson, seconded by Councilmember Harnetty, moved to accept the recommendation of the Planning Commission to approve Resolution 05-06-08-02 and Ordinance No. 111 To Change the Designation of 21300 Olinda Trail from General Business to Single Family Estate. The motion passed unanimously. GRAVEL MINING CONDITIONAL USE PERMITS—CONTINUATION OF PUBLIC HEARINGS Public hearings were opened on March 5, 2008 to consider new Conditional Use Permits for three mining operations: Bracht Bros., Inc., Dresel Contracting, Inc. and Tiller Corporation. The review period ends June 12, 2008 for all three applications. TKDA Planner Richard Thompson presented the concluded reports for each application. David Hume, a hydrogeologist with Leggette, Brashears & Graham, Inc., who were retained to review groundwater issues, also presented reports for each mining operation. All applicants were present, as was Kirsten Pauly, Sunde Engineering, representing the engineering firm which prepared the CUP applications. BRACHT BROS., INC—CONDITIONAL USE PERMIT The key issue regarding Bracht Pit appeared to be the installation of observation wells to better determine the depth to the water table surface and the direction of the groundwater flow. Frequent monitoring of water levels and comparison to precipitation records will be a requirement of the Annual Operating Permit to establish seasonal variations and long-term trends. LBG recommends that Bracht install a monitoring well adjacent to the production well to measure the depth to surface water. A down-gradient well must also be installed along the east property line. This well configuration will be useful in establishing the hydraulic gradient of the water table across the site. The groundwater samples must be collected on a monthly basis and tested for contamination of diesel range organics (DRO) and gasoline range organics (GRO) if gasoline is to be used on the site. The Planning Commission requested a copy of the depth to water table reports as they become available. The excavation depth limit of three feet above the water table was established, as this conforms to the Carnelian-Marine-St. Croix Watershed's permit. May 6, 2008 Scandia City Council Page 4 Chairman Ness asked for public comments. • Mike White, 13310 188th Street, stated that the data from the DNR's groundwater monitoring well near Big Marine Lake may not be comparable to the Bracht site, as the elevation near the lake measures 940 feet above mean sea level versus 915 feet amsl at the gravel pit. As there were no other comments, Chairman Ness closed the public hearing. The Planning Commission further discussed hours of operation and reclamation plans. Planner Thompson will further revise the recommendations based on these comments. An additional meeting will be forthcoming with the applicants, representatives of the city and the Planning staff to establish all final conditions. The Planning Commission moved to recommend to the City Council approval of a Conditional Use Permit for the Bracht Bros. Mining Operation with modifications and revisions as outlined in Planner Thompson's report. The City Council postponed any action until a final resolution is presented to the City Council at their next meeting. DRESEL CONTRACTING, INC.—CONDITIONAL USE PERMIT Key groundwater issues must be addressed by the installation of three monitoring wells, one of these being a shared well with Tiller in the northwest corner of the property. The configuration of the recommended wells will better determine the ground-water flow direction and ground- water fluctuations across the site. The depth to water table readings must be measured from all wells on a monthly basis for at least the first year, to determine excavation limits and to test for any contamination. Wells of surrounding property owners within '/2-mile of the site must be identified. Chairman Ness asked for public comments. • John Lindell, 11240 218th Street, asked how groundwater flow will be determined. Mr. Hume, LBG: Readings from a minimum of three observation wells will determine gradient flow. Mr. Lindell asked how the two wetlands on the site will be handled. Planner Thompson: The wetlands will be delineated and buffer requirements of the Car- Mar-St. Croix Watershed will be followed as a condition of the permit. Mr. Lindell noted that many potholes on 218th Street and Lofton Avenue have been identified. • Mike White, 13310 188th Street, noted that the Washington Conservation District monitors a well within the vicinity of the Dresel pit, and may supply pertinent data to the consultants. As there were no other comments, Chairman Ness closed the public hearing. May 6, 2008 Scandia City Council Page 5 Discussion of the hours of operation, reclamation plan and elevations continued. Revisions will be made and presented in a final resolution. A condition to keep 218th Street free of gravel debris will become a condition of the Annul Operators Permit. The Planning Commission moved to recommend to the City Council approval of a Conditional Use Permit for the Dresel Contracting Mining and Processing Operation with modifications and revisions as outlined in Planner Thompson's report. The City Council postponed any action until a final resolution is presented to the City Council at their next meeting. TILLER CORPORATION—CONDITIONAL USE PERMIT Tiller's proposal to excavate into the groundwater using a dragline is being introduced with this permit application. A 50-acre lake in the central portion of the site is noted on the reclamation plan. LBG's review of this proposal has found no detrimental effects in allowing the withdrawal of gravel below the water table. German Lake has been identified as a perched lake, meaning it is not hydraulically connected to the underlying water table aquifer. A total of three observation wells will be installed to monitor water-table levels and presence of any contamination products. Chairman Ness asked for public comments. • John Lindell, 11240 218th Street, commented on a number of issues. 1) That additional screening (berms, trees) be extended along the Stevenson property line; 2) Require an Environmental Assessment Worksheet (EAW) in an effort to analyze the impacts of mining into the water table; 3) Questions outlined in a previous letter were not adequately addressed; 4) Concerns of contamination to the drinking water and to German Lake through operation of the asphalt plant. As there were no other comments, Chairman Ness closed the public hearing. In discussion among the Planning Commission, it was agreed that it is critical to establish a defined monitoring plan. Before withdrawal of gravel below the water table begins, a minimum of three months of data readings must be analyzed by the consulting hydrogeologist. Baseline conditions must first be established, then analyzed for trends during the extraction of material below the water table. In answer to a question of requiring an EAW, Mr. Hume commented that extensive studies are in place with multiple agencies above and beyond what is necessary. To require a completely new EAW should not be a condition of approval at this time. Commissioners Rodsjo and Krinke expressed their reservations of allowing mining into the water table. Commissioner Krinke proposed a six-month moratorium until additional data is reviewed. May 6, 2008 Scandia City Council Page 6 The Planning Commission moved to recommend to the City Council to approve the Conditional Use Permit for the Tiller Corporation Mining and Processing Operation with revised conditions as outlined in Planner Thompson's report, specifically that extraction of material below the water table be delayed a minimum of three months in order to evaluate the baseline readings, and then proceed provided there are no significant issues as determined by the consulting hydrogeologist. The City Council postponed any action until a final resolution is presented to the City Council at their next meeting. Councilmember Peterson, seconded by Councilmember Yehle, moved to adjourn the meeting. medical calls. > There have been fifty-six emergency response calls, 2008 YTD. That compares to fifty- three emergency response calls through April 2007. > Zero injuries YTD. Fire and Medical Training ➢ Two new hire firefighters are taking thier EMT certification test this month and one new hire firefighter is attending Firefighter II training & certification. ➢ Firefighters trained on emergency medical protocols. > Firefighters utilized the burn trailer to train on interior fire attack tactics in live fire conditions. > Firefighters utilized the burn trailer to train on basement fire tactics in live fire conditions. > Firefighters trained on apparatus placement when responding to vehicle accidents. In particular placement on roadways such as state highway 97 and state highway 95. > Fire Department Officers trained on several tabletop scenarios for developing strategies and tactical plans for fighting structure fires. Department Activities and Administration ➢ O&M expense budget is favorable to plan. > Some of the funds raised at the Firefighters Ball were used to purchase direct response safety coats and vests. > Fire Department Officers attended the Washington County Fire Chiefs Association. Topics included 800 MHz implementation schedule changes. > The siren sounding for medical and fire emergencies is being converted to a two tone approach. One tone for setting off pagers and one tone for sounding the sire. Sounding the siren will become an exception based operation only used for "all call situations" and pager failure situations. The siren would remain at its current location. Implementation is targeted for the end of May. > The fire department is moving forward with resurfacing and sealing the floor in the fire bays. > ISO results are in. However, at the time of this update the Fire Chiefs had not been able to get a copy of the report. THE ISO PUBLIC PROTECTION CLASSIFICATION(PPC)PROGRAM ISO's PPC program evaluates communities according to a uniform set of criteria defined in the Fire Suppression Rating Schedule(FSRS). These criteria incorporate nationally recognized standards developed by the National Fire Protection Association and the American Water Works Association. Utilizing the FSRS, ISO objectively reviews the fire suppression capabilities of a community and assigns a Public Protection Classification—a number from 1 to 10. Class 1 represents exemplary fire protection, and Class 10 indicates that the area's fire suppression program does not meet minimum recognition criteria. Assuming all other factors are equal,the price of property insurance in a community with a good PPC is lower than in a community with a poor PPC. The FSRS allocates credit by evaluating the following three major features: • Fire Alarm and Communication System-This review accounts for 10%of the total classification which centers upon a community's facilities and support for handling and dispatching fire alarms. • Fire Department-This review accounts for 50%of the total classification which focuses upon items such as engine companies,distribution of fire stations and fire companies, department manning,and training. • Water Supply System-This review accounts for 40%of the total classification highlighting the water supply a community uses for fire suppression. Split Classifications When ISO develops a single classification for a community, all of the community's properties receive that classification. In many communities,ISO develops a split classification(for example, 5/9). Generally,the first class, (Class 5 in the example)applies to properties within 5 road miles of a fire station and within 1000 feet of a fire hydrant. The second class (Class 9 in the example)applies to properties beyond 1000 feet of a hydrant but within 5 road miles of a fire station. ISO generally assigns Class 10 to properties beyond 5 road miles of a fire station. In a class 5/10 community,Class 5 applies to properties within 5 road miles of a fire station. City Projects: 1. 2007 Street Paving • Two year warranty period ends October, 2009, • Record Plans complete • Dresel Contracting will be removing all silt fences the week of May 12-16. Deadline/ Timeline: N/A Background: • The next major street improvement project would include the paving of Pilar Road. At the April 15 meeting, the Council discussed the recommendation from the city's engineering firm to do preliminary work with the residents now, either by a public information meeting or by mailed surveys. It was agreed that involving public input before the design stage will be helpful in determining specific concerns, and help better estimate the potential costs for the city's Capital Improvement Program. • Staff and the engineer were directed to develop a sample survey for the Council's review. • The attached draft survey would be mailed to all residents on Pilar Road and the cul-de-sac streets off of Pilar (Paris, Perkins and Penfield.) • The survey would be mailed to each resident with a stamped return envelope to encourage a response. Residents would be given about 2 weeks to complete the survey and return it. They could remain anonymous if they wish. Results would be tabulated and a report prepared for the Council's review. Recommendation: The Council should review the survey and give direction for any changes in the cover letter or the survey. The project includes Oakgreen Avenue, Old Marine Trail, 185th Street, Paris Avenue, Perkins Avenue, Penfield Avenue, and Pilar Road. Due to budget limitations, the roadway improvements would likely be constructed in the 2010 construction season or later. The Paris Avenue, Perkins Avenue, Penfield Avenue, and Pilar Road improvement area is thought to be unique in character from recent City road improvement projects due to the meandering road, heavily wooded areas, and surrounding terrain. We are seeking resident input in the roadway improvements in advance of preliminary design. The City Council values resident input and is asking for your assistance with several questions listed on the enclosed survey. Please complete the survey and return it using the self-addressed stamped envelope by June 6, 2008. After that date we will compile the responses for review by the City Council so they can decide on the timing and next steps for the paving project. Deadline/Timeline: County Parks staff plans to purchase a siren for the park sometime in 2008. Background: • Last fall,the Fire Department identified an opportunity to partner with Washington County Parks to provide civil defense siren coverage in the southeast corner of Scandia in conjunction with the development of the new County park (see park schematic, attached.) The Council directed staff to work with County staff to further develop this idea. • The park budget includes $7,000 for the installation of a warning siren. The siren that could be purchased for this amount would cover an area with only about a 1,000 foot radius. As shown on the attached aerial photo, this is a small area that would not cover the active use areas of the park much less any significant area of the lake or adjacent residential areas. • For approximately$20,000, a siren covering a radius of about 6,000 feet could be installed. The attached aerial photos shows that such as siren located at 185th Street and Maiming Avenue (the blue circle) would cover the active area of the park, significant residential areas in Scandia and May Township, and small parts of Hugo and Forest Lake. It would also cover much of the surface of Big Marine Lake and potentially reach to the Camp Lakamaga Girl Scout facility. • County Parks staff has worked with the Sheriff's Department and have found that there are no grant funds that would be available to fund the larger siren. Parks staff is willing to consider the larger siren but have not offered any suggestions for funding, other than from the affected local governments. • May Township may be interested in participating with Scandia in securing funding for the larger siren. Forest Lake was contacted but has indicated they are not interested due to the small area of Page 1 of 2 05/12/08 their community benefited. Hugo was not contacted as the likely location would have little benefit to Hugo. • The funding gap is $13,000. Neither Scandia nor May Township have funds identified in their budgets for such a purchase. Recommendation: Upgrading the siren presents a good opportunity to increase public safety for park users and nearby residents of the affected communities. The County has significant responsibility for public safety on public waters, and is locating a major facility in our communities. How much of the additional cost should be borne by the City and/or May Township compared to Washington County should be discussed with County policy makers. May Township officials (per Bill Voedisch) are interested in participating in a meeting with Scandia officials,the Sheriff and the two County Commissioners representing the area. If directed by Council, the next step would be to arrange for such a meeting. Background: • Last fall, the Fire Department identified an opportunity to partner with Was' 'ngton County Parks to provide civil defense siren coverage in . e southeast corner of Scandia in conjunction with the developm. t of the new County park (see park schematic, attached.) The k ouncil directed staff to work with County staff to further develop th's idea. • The park budget in udes $7,000 for the installation of a warning siren. The siren that suld be purchased for this amount would cover an area with onl .bout a 1,000 foot radius. As shown on the attached aerial photo, his is a small area that would not cover the active use areas of the pi rk much less any significant area of the lake or adjacent residenti. areas. • For approximately$20,000, a s' en covering a radius of about 6,000 feet could be installed. Department and have found that there are no grant funds that wouki\be available to fund the larger siren. Deadline/ Timeline: N/A Background: • Scandia has had an informal policy regarding the application of dust coating chemicals (calcium chloride) to gravel roads. Residents desiring dust control on their gravel roads have been asked to contribute part of the cost. Typically an advertisement was placed in the local paper(see sample, attached) asking for a minimum payment of$60.00 for up to 300 feet of frontage, plus $60.00 for each additional 300 feet. If a resident did not pay, the dust control was not applied in front of their property. The fee covered only a portion of the cost(approximately half,based on 2007 costs.) • In addition to dust control on public roads, the town/city also arranged for dust control on some private roads, parking lots and on streets in the City of Marine on St. Croix, charging back the cost billed by the contractor. • Now that most of the city streets have been paved, dust control is an issue only for a few remaining streets. A more formal policy is needed at this time because: o The way we notify property owners needs to change, as the number of affected residents is relatively small compared to the cost of advertising. o There are maintenance benefits to dust control (the need for grading may be reduced) so the city does benefit to some degree. But it's not clear what principle governs the cost sharing with the property owners. o Applying dust control only in front of property where the owners have paid is not very practical. If property owners are across the street from each other and one has not paid, should the dust control be applied, giving one owner a "free ride?" Also, it becomes a problem when you have small gaps in the spraying when you grade as the dry gravel gets dragged onto the treated area and people "lose" their treatment. Last year, Page 1 of 2 05/12/08 dust control was applied to the entire length of Pilar, even though there were a couple of owners who had not paid. The city has no recourse to collect from property owners who do not request dust control. o The fee to property owners has not been changed in a number of years (how long is not clear from written records). We have been notified that the cost will increase this year by about 7.5%. The cost per homeowner should go up from $60.00 to $65.00, to keep their cost share about the same as last year. o The city incurs staff time and other costs for arranging dust control on private property that is not reimbursed to the city. The Maintenance Supervisor rides with the contractor to direct the application of the material, and the Treasurer and Deputy Clerk spend time arranging the service and collecting payments. o I am not comfortable with staff soliciting residents for payment of a dust control fee without a clear policy and Council approval. This is especially a concern as the Treasurer has been organizing dust control on her street and some people give their payments to her. A policy would help protect her from accusations of unfair or improper actions. Recommendation: The Council could choose to discontinue the dust control program or make changes from past practice if you wish to do so. A draft policy based on the past practice has been prepared for your review. One proposed change is the addition of a 15% charge for staff time and administration to the dust control charge for private streets. The policy also includes a statement that "if the owners of a minimum of 75% of the frontage of a given street do not request dust control by paying the fee, the city may elect to not apply it to that street." The Council could change these percentages if you wish. Adopted by the City Council SCANDIA (date) m i n n e s o t a The City of Scandia considers that applying dust control measures improves the quality of life of its residents living on gravel roads. The application of calcium chloride improves the gravel surface by compacting the gravel, which makes for a smoother surface and thus requires less grading, as well as reducing dust. The City also encourages the application of dust control to private roads and parking lots. Dust Control on Public Roads The City of Scandia will subsidize approximately fifty percent of the cost of one application of dust control to city streets. In the spring of each year, city staff will obtain a quote to establish the cost of for the current year. For 2008, the fee will be set at a minimum of$65.00 per 300 feet of frontage, with an additional minimum fee of$65.00 for each additional 300 feet of frontage. In subsequent years, staff will set the fee based on the change in cost compared to the previous year. Staff will notify residents of gravel roads of the current cost by mail and inquire if they wish to participate in the dust control program. To express their interest to the City to participate in dust control, residents will pay the fee (by check or cash)to the City prior to the application of calcium chloride. If the owners of a minimum of 75% of the frontage of a given street do not request dust control by paying thefee, the city may elect to not apply it to that street. If the owners of a minimum of 75% of th'e frontage of a given street request dust control by paying the fee, the city may elect to apply it to the entire street. Residents will stake out their road frontage with laths provided by the City, if they are requested to do so. Special Provisions for 185`h Street Because 185th Street serves and active sand and gravel mine, the need for dust control far exceeds what would be necessary due to normal traffic volumes. Consistent with the requirements of Chapter 4 ofthe Development Code and the Conditional Use Permit and Annual Operators Permit for the mine, the City will arrange for dust control applications for this street at its discretion. The/operator will pay the full cost of dust control applications for this street. Private Roads, Driveways and Parking Lots Business owners, residents of private roads and driveways, and other local governments may also participate in the dust control program by paying the full cost of the calcium chloride applied to the area they designate, plus fifteen percent of the contractor's cost to cover city staff time and administration of the program. Deadline/ Timeline: N/A Background: • Concerns with erosion on these two streets were identified during consideration of the 2007 paving projects. 197th(except for the area closest to Highway 95) and 205th (serving the Log House Landing) were deleted from the paving project because of high costs and possible environmental impacts. • CMSCWD has funding set aside to help property owners and communities with issues that impact water quality. • City staff, watershed district staff, and staff from the Washington Conservation District (WCD)recently toured both of these roads to determine whether any of the issues identified for these roads could be addressed with their assistance. • After our site visit, CMSCWD offered to provide technical assistance (through WCD staff) at no cost to the city, to design improvements to address a problem occurring near the end of the newly-paved section of 197th Street. Water is flowing over the bluff just north of the road, causing considerable erosion. • We also looked at 205th Street for a potential technical assistance project. WCD staff is researching some methods that could help reduce erosion along the existing gravel road, which is impacting the stream to the south and washing soil into the boat launch area. A specific offer of technical assistance has not yet been made, but is expected soon. • No project or improvements would occur as a result of this assistance without approval by the Council and any affected property owners, and would be contingent on further funding. WHEREAS, the site has been actively mined since before permits were required, and has operated under a previous Conditional Use Permit granted by Washington County, when the County exercised land use authority within New Scandia Township. Permitted activities include the mining and processing of aggregate; and WHEREAS, Ordinance No. 103, Chapter 4 of the Development Code of the City of Scandia, Minnesota, adopted August 28, 2007 (hereinafter referred to as "the ordinance") replaced the requirements of the ordinances adopted by Washington County and the former New Scandia Township and required the issuance of a new Conditional Use Permit for continued operation of existing mining operations; and WHEREAS, Bracht Bros. Inc. submitted an application for a Conditional Use Permit to the City of Scandia, which was found to be complete for review on February 13, 2008; and WHEREAS, the Scandia Planning Commission held a duly-noticed public hearing on March 5, 2008 and continued the hearing to April 1, 2008 and then to May 6, 2008 to gather public input and review the application; and WHEREAS, the Planning Commission has recommended that the City Council approve the Conditional Use Permit subject to certain conditions required for compliance with the ordinance and with the general criteria for granting conditional use permits as established by Chapter 1, Section 7.3 of the Scandia Development Code; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it should and hereby does find that the Conditional Use Permit shall be and hereby is issued, with the following conditions made a part thereof: 1. All activities on the site shall be in accordance with the Conditional Use Permit Application, as updated with submittals through May 1, 2008, except for any changes therein that may be required by conditions of approval that may follow. 2. The Applicant must at all times comply with the ordinance and all rules and regulations of Federal, State, County, and local agencies, and maintain existing permits granted by these agencies for all operations at the site. 4. The Applicant must receive all required permit(s) from the Carnelian-Marine-St. Croix Watershed District, and maintain said permit(s) over the life of the mining operation. 5. Within 60 days of approval of the CUP, the Applicant shall install two (2) monitoring wells. One well will be installed adjacent to the exiting production well and down gradient from the fuel tanks; the other well will be installed along the east property line of the site. The wells will be screened in the upper part of sand and gravel, water-table aquifer to ensure that the water level does not fall below the bottom of the well screen. The depth of the well shall be determined by the Applicant in consultation with the City's hydrogeologist, and will consider the time of year and anticipated water table fluctuations. 6. Within 60 days of adoption of this resolution, the Applicant shall prepare and submit to the City a detailed plan for ground-water monitoring and protocols, which will be reviewed and approved by the City's consulting hydrogeologist. 7. The Applicant shall keep records of when the production well is pumping, and provide these to the City as requested for ground water monitoring activities. 8. The Applicant shall document when the wash plant operates to better identify when the production well is pumping. 9. The Applicant shall not excavate deeper than the current lowest point in the mine (920 feet amsl) until authorized by the City. The City's consulting hydrogeologist shall review and evaluate the groundwater monitoring data gathered from the new monitoring wells, and establish the elevation of the groundwater table in the mine area. The depth of excavation will be determined and authorized based on the elevation of the groundwater. In no case shall the Applicant excavate closer than three(3) feet to the highest groundwater elevation. 10. Ground-water samples shall be analyzed for DRO (diesel range organics.) If gasoline is to be stored on site, then GRO (gasoline range organics) and benzene shall be added to the analyte list. 11. The Applicant shall update the Site Plan to illustrate the MN County Well index wells in the vicinity of the site within 60 days of approval of the CUP. 12. The Applicant shall post another `trucks hauling' sign on 185th Street for the westbound approach to the east of the site. Supplemental signing below this new sign and the existing sign must be added detailing the approximate number of feet until the eastern driveway. The signs shall be installed within 60 days of approval of the CUP. 13. The Applicant shall discourage trucks from using Old Marine Trail except when necessary for local hauling. 14. The Applicant shall provide a dust control plan as required in the City's ordinance. The Applicant shall be required to provide dust control on 185th Street and Old Marine Trail, as deemed necessary by the City. 15. The applicant shall mark and maintain an undisturbed buffer area of at least 50 feet from the wetlands on the site. Resolution No.: 05-20-08-01 Page 4 of 4 16. The Applicant must, within 60 days of approval of this resolution, prepare an updated reclamation plan for approval by the City. Reclamation shall proceed concurrently and proportional to mining operations. The reclamation plan shall minimize the amount of the exposed, mined portion of the site. Progress on concurrent reclamation shall be demonstrated in the AOP application. 17. Final reclamation will include removal of any equipment,and backfilling and seeding of the operations area. 18. The revised plans shall indicate that the lowest final grade after reclamation activities will leave the lowest land surface at least ten (10) feet above the highest groundwater elevation. 19. Approval of the reclamation plan shall not constitute an approval by the City of Scandia of the"concept ultimate use plan" included in the application. Ultimate use shall be determined based on the Scandia Comprehensive Plan and ordinances in effect at the time the mining is complete and applications for development of the site may be submitted. 20. The reclamation plan shall be updated every five years. 21. The Applicant shall, within 60 days of the date of this resolution,provide to the city an Irrevocable Letter of Credit or other security satisfactory to the city in the amount of$ 75,000 to guarantee the completion of approximately 20 acres that the Applicant estimates will be reclaimed and restored on the site during the next five years, and the performance of its obligations set forth by this permit. The city may require the amount of this security to be adjusted in future years based on inflationary increases in construction costs, or upon re-evaluation of the needs for reclamation, as a condition of approval of an Annual Operating Permit. Future reductions in this security shall be made as provided by the ordinance. The City may allow reductions in portions of the Letter of Credit or other security for completed and approved reclamation on a five-year basis. 22. The Applicant must apply for and obtain an Annual Operating Permit from the City. The application shall be completed within 60 days of approval of the CUP and annually as required by the ordinance. WHEREAS, the site has been actively mined since the 1960's, and has operated under a previous Conditional Use Permit granted by Washington County, when the County exercised land use authority within New Scandia Township. Permitted activities include the mining and processing of aggregate; and WHEREAS, Ordinance No. 103, Chapter 4 of the Development Code of the City of Scandia, Minnesota, adopted August 28, 2007 (hereinafter referred to as "the ordinance") replaced the requirements of the ordinances adopted by Washington County and the former New Scandia Township and required the issuance of a new Conditional Use Permit for continued operation of existing mining operations; and WHEREAS, Dresel Contracting. Inc. submitted an application for a Conditional Use Permit to the City of Scandia, which was found to be complete for review on February 13, 2008; and WHEREAS, the Scandia Planning Commission held a duly-noticed public hearing on March 5, 2008 and continued the hearing to April 1, 2008 and then to May 6, 2008 to gather public input and review the application; and WHEREAS, the Planning Commission has recommended that the City Council approve the Conditional Use Permit subject to certain conditions required for compliance with the ordinance and with the general criteria for granting conditional use permits as established by Chapter 1, Section 7.3 of the Scandia Development Code; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it should and hereby does find that the Conditional Use Permit shall be and hereby is issued, with the following conditions made a part thereof: 1. All activities on the site shall be in accordance with the Conditional Use Permit Application, as updated with submittals through May 1, 2008, except for any changes therein that may be required by conditions of approval that may follow. 2. The Applicant shall provide an updated copy of the Application materials and plan sheets to the City within 60 days of approval of this resolution. 3. The Applicant must at all times comply with the ordinance and all rules and regulations of Federal, State, County, and local agencies, and maintain existing permits granted by these agencies for all operations at the site. The Applicant must receive all required permit(s) from Carnelian-Marine-St. Croix Watershed District and maintain said permit(s) over the life of the mining operation. 5. Within 60 days of approval of the CUP, the Applicant shall install at least three monitoring wells in the sand and gravel, water table aquifer. These include the observation well proposed to be shared with Tiller Corporation Sand and Gravel Mine at 22303 Manning Avenue North. The Applicant shall construct the wells with 10 feet of screen to ensure the water table does not fall below the bottom of the screen during dry periods. The depth of the well shall be determined by the Applicant in consultation with the city's hydrogeologist, and will consider the time of year and anticipated water table fluctuations. 6. The Applicant shall not excavate deeper than the current lowest point in the mine (928 feet amsl)until authorized by the City. The City's consulting hydrogeologist shall review and evaluate the groundwater monitoring data gathered from the monitoring wells, establish the depth to groundwater, and recommend the depth of excavation. In no case shall the Applicant excavate closer than three (3) feet to the groundwater. The Applicant shall revise the Proposed Conditions Mining Plan to raise the pit bottom elevations to at least three (3) feet above the water table elevation. 7. Within 60 days of adoption of this resolution, the Applicant shall submit a detailed plan for ground-water monitoring and protocols to the City for approval and review by the City's consulting hydrogeologist. 8. The Applicant shall update plan Figure 2 of the Site Plan to illustrate the MN County Well index wells in the vicinity of the site within 60 days of approval of the CUP. 9. The Applicant shall establish a permanent benchmark elevation in the mine. The benchmark location shall be approved by City staff 10. Ground-water samples shall be analyzed for DRO (diesel range organics.) If gasoline is to be stored on site, then GRO (gasoline range organics) and benzene shall be added to the analyte list. 11. Within 60 days of approval of the CUP, the Applicant shall provide supplemental signage below the existing"truck hauling" signs on 218th Street to indicate the approximate number of feet remaining to the site access point. 12. The Applicant must keep 218th Street North free of dirt and debris caused by trucks hauling between its access and Lofton Avenue. 13. The Applicant shall delineate the northern wetland (designated PUBGx )on the site plan. Requirements for exemption or replacement shall follow Minnesota Wetland Conservation Act requirements. The applicant shall mark and maintain an undisturbed buffer area of at least 50 feet from all wetlands on the site. 14. The Applicant must, within 60 days of approval of this resolution, prepare an updated reclamation plan for approval by the City. Reclamation shall proceed concurrently and proportional to mining operations. The reclamation plan shall minimize the amount of the exposed, mined portion of the site. Progress on concurrent reclamation shall be demonstrated in the AOP application 15. Final reclamation will include removal of any equipment, and backfilling and seeding of the operations area. Ultimate use shall be determined based on the Scandia Comprehensive Plan and ordinances in effect at the time the mining is complete and applications for development of the site may be submitted 17. The reclamation plan shall be updated every five years. 18. The Applicant shall, within 60 days of the date of this resolution,provide to the city an Irrevocable Letter of Credit or other security satisfactory to the city in the amount of$120,000 to guarantee the completion of approximately 32 acres that the Applicant estimates will be reclaimed and restored on the site during the next five years, and the performance of its obligations set forth by this permit. The city may require the amount of this security to be adjusted in future years based on inflationary increases in construction costs, or upon re-evaluation of the needs for reclamation, as a condition of approval of an Annual Operating Permit. Future reductions in this security shall be made as provided by the ordinance. The City may allow reductions in portions of the Letter of Credit or other security for completed and approved reclamation on a five-year basis. 19. The Applicant must apply for and obtain an Annual Operating Permit from the City. The application shall be completed within 60 days of approval of the CUP and annually as required by the ordinance. The depth of the well shall be determined by the Applicant in consultation with the city's hydrogeologist, and will consider the time of year and anticipated water table fluctuations. 6. Within 60 days of approval of the CUP, a detailed plan for ground-water monitoring and protocols shall be submitted to the City for review and approval by the City's consulting hydrogeologist. 7. The City's consulting hydrogeologist shall review and evaluate the groundwater monitoring data gathered from the monitoring wells, establish the depth to groundwater, and direction of ground water flows. Excavation below the water table shall not begin sooner than 3 months (90 days) after installation of the monitoring wells and evaluation of the depth to groundwater-level data from the monitoring well. The onset of excavation below the water table shall be based on recommendations to the City Council by the City's consulting hydrogeologist. 8. The Applicant shall keep records of when the Production well is pumping, and provide these to the City as requested for ground water monitoring activities. 9. Ground-water samples required in the groundwater monitoring plan shall be analyzed for DRO (diesel range organics.) The asphalt plant and related storage structures shall be set back at least 100 feet from the shore of the proposed lake. 12. The lake which is created as a result of the mining below the water table shall not be deeper than 50 feet or larger than 50 acres. 13. The Applicant shall post `trucks hauling' signs for the northbound lane on Maiming Avenue and both north and southbound lanes on Lofton Avenue. Supplemental distance signs shall also be provided below these signs and the existing sign to inform drivers of the approximate location of the access. Signs shall be approved by Washington County and shall meet the County's requirements 14. The Applicant shall restrict truck traffic that imports Add Rock to the site from using the Lofton Avenue (County Road 1) access during non-daylight hours. Non-daylight hours shall be defined as one-half hour after sunset to one-half hour before sunrise. 15. The Applicant shall post a sign at the Maiming Avenue access that is similar to the existing sign at the access to Lofton Avenue that restricts trucks using 228th Street, to keep the truck traffic off the local roadway near the site. 16. The Applicant must, within 60 days of approval of this resolution, prepare an updated reclamation plan for approval by the City. Reclamation shall proceed concurrently and proportional to mining operations. The reclamation plan shall minimize the amount of the exposed, mined portion of the site.
