CONDITIONAL USE PERMIT AMENDMENT
TO ADD AN ACCESSORY STRUCTURE
AT 21080 OZARK COURT NORTH
WHEREAS, Bob and Michelle Carlson have made application to amend the Am-Tech
Conditional Use Permit to add an accessory structure 25 feet by 500 feet in size at 21080 Ozark
Court North; and
WHEREAS, the property is legally described as Lot 6, Block 1, Hawkinson Business
Park, Washington County, Minnesota; and
NOW, THEREFORE,BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SCANDIA,WASHINGTON COUNTY, MINNESOTA, that it should
and hereby does approve the request of Bob and Michelle Carlson to amend the Conditional Use
Permit to add an accessory structure.
FURTHER BE IT RESOLVED, that the following conditions of approval shall be met:
1. The accessory structure must be built in substantial conformance with the application
materials received by the City on June 13, 2008.
2. No separate business is allowed in the accessory structure.
3. The area between the building edge and the parking lot must be planted with decorative
ground cover.
4. All relevant conditions and requirements of the existing CUP shall remain in effect. They
are:
a. All applicable provisions of the Scandia Zoning Ordinance shall be complied with
unless waived by this permit.
b. Design and location of all drives, parking areas, and building location shall
comply with the submitted site plan.

c. Parking area and a twenty foot drive must be paved with seven individual parking
spaces striped. Handicap parking must be provided in accordance with ADA
requirements.
d. If any outdoor lighting is proposed, lighting shall be in accordance with the
standards of the Scandia Zoning Ordinance.
e. Design, locations, and specifications of signs shall conform with the Scandia
Zoning Ordinance.
f. All waste materials and refuse shall be stored inside a fenced or screened area, or
inside a structure so that they cannot contaminate the ground water.
g. Any alternations to any of the submitted development plans shall require an
amended conditional use permit.
h. The conditions of this permit shall apply to the land described and shall not in any
way except herein noted, be affected by any subsequent sale, lease, or other
change from ownership.
i. Noncompliance with the conditions and attachments of this permit shall be
considered a violation of said permit and may result in revocation of said permit.
5. All fees must be paid.

BRIEF DESCRIPTION OF THE REQUEST:
The Applicants request an Amendment to the existing Conditional Use Permit to allow construction of an
accessory building at 21080 Ozark Court North. The subject property is in the General Business (GB)
District and consists of 2.5 acres. Am-Tech Designs is a light steel fabrication business.
The Conditional Use Permit was granted in 1995 and amended in 1997. The City may wish to combine all
relevant conditions from 1995, 1997 and 2008 within one resolution, if the City approves the current request.
EVALUATION OF THE REQUEST:
Accessory Structures
Section 9.2 of the Zoning Ordinance regulates accessory structures.
• The proposed structure would be located at a greater distance from the road than the primary
structure, as required by Ordinance.

• In the General Business District, one accessory structure is allowed. The proposed accessory
structure would replace an existing accessory structure. The proposed structure would be the only
accessory building on the site and so meets this standard.
• The Ordinance states that no separate business is allowed in the accessory structure. The Applicant
has indicated that the structure will be used for storage needs for the existing business.
• In the General Business District, the Ordinance states that the accessory structure must be placed to
the rear of the principal building. The proposed structure is located behind the principal building,
relative to the road. The area to the south of the principal building would not be an appropriate
place for the accessory structure due to a wetland area.
• The Ordinance allows a maximum lot coverage of 65%impervious surface in the General Business
District. Based on an aerial photograph, the Planner estimates that with the proposed accessory
structure, there would be 42,000 square feet of impervious surface, or approximately 40% of the
site.
The Planner finds that the proposed accessory structure conforms to the standards of Zoning Ordinance,
Section 9.2 that address accessory structures in the General Business District.
Setbacks
The location of the accessory structure is proposed to the rear of the driveway and parking areas, and to the
west of the existing building. The proposed site is over 30' from the west side yard, over 150' from the front
lot line, and in excess of 100' from the rear lot line. The proposed structure conforms to all setback
standards.
Building Materials
The proposed building will be a three-sided metal building. Section 9.14(5) states that additions to an
existing building or site may be constructed of materials comparable in quality and appearance to those used
in the original construction. The existing primary building is a steel structure and thus the accessory building
would meet this requirement of the Ordinance.
Building Height
Discussion with the Applicant indicated that the proposed accessory structure is less than 18 feet in height.
The proposed structure height is less than the maximum building height of 35 feet.
Screening and Landscaping
The Applicants are not proposing any additional landscaping or screening as a result of this accessory
structure.
Section 9.12 of the Zoning Ordinance regulates screening and landscaping. The Ordinance states that when
improvements are made to an existing commercial site, landscaping requirements are applied to the portion
of the site directly affected by the proposed improvement.

The Ordinance requires decorative ground cover along building edges facing the right of way. There is an
existing fence directly adjacent to the accessory structure site, and a paved parking area is to the north of the
fence. There is an area about one foot wide along the edge of the proposed accessory structure that could be
planted with ground cover. The Planner recommends that the area between the building edge and the parking
lot be planted with decorative ground cover. The Planner suggests possible planting options that would be
successful in this narrow area adjacent to the parking lot, such as day lilies or sedum, or low shrubs such as
juniper.
Wetlands
The National Wetland Inventory shows a wetland at the southeast corner of the lot, as shown on the attached
aerial photograph. The presence of a wetland in the area has not been field verified. There is approximately
200 feet of separation between the proposed accessory structure and the wetland area identified by the
National Wetland Inventory. The accessory structure is at such a distance from this area that the Planner
finds it does not affect the request.
Parking
The approved Conditional Use Permit includes a condition related to striping of the parking lot and provision
of handicapped parking. The parking area has been paved but has not yet been striped. The condition from
1995 related to required parking and striping is repeated in the recommended conditions (see condition 4c).
ACTION REQUESTED:
The Planning Commission can recommend:
1. Approval
2. Approval with conditions
3. Denial with findings
4. Table the request
PLANNING STAFF RECOMMENDATIONS:
The Planner recommends approval of the amended Conditional Use Permit to allow an accessory structure at
21080 Ozark Court North, with the following conditions:

Background: • The Comprehensive Plan Committee has recommended dates for a
public meeting (Thursday. August 21) and a public hearing
(Thursday. September 18) on the new Comprehensive Plan.
• The public hearing will be held by the Planning Commission.
This would also be an official City Council meeting.
• Both meetings would be held in the Community Center Hall.
Recommendation: I recommend that a Commission and Council set a special meeting for
Thursday, September 18, 2008 at 7:00 p.m. for the public hearing on
the Comprehensive Plan.
