02. Potential Land Swap - 196th St N
Staff Report Date of Meeting: April 3, 2024 For: Honorable Mayor and Council From: Kyle Morell, City Administrator Subject: Potential Land Swap – 12160 196th St N. Background: Project Engineer Isiah Bubany, Public Works Director Fischer, and I have held multiple meetings with Ron Helms, the owner of 12160 196th St N., to discuss the planned improvements to 196th St N. The new road configuration shifts the road slightly to the north. It necessitates the removal of a line of trees that currently run along the road, starting on the City right-of-way at the corner of 196th St N and Maxwill Ave N and continuing along the road onto property owned by Mr. Helms. The City owns the parcel in green shown on the map below. For reasons that remain unclear, a family member of the current owner quitclaimed the property to the city in 1998. Before that, the property had been in private ownership by the Helms family since the 1950s. The City is proposing a property swap. In this swap, the City would gain the necessary right-of- way to complete the 2024 Street Project without removing trees from private property (the area outlined in red in the survey below), and in exchange, the property owner would receive the part of the City owner's parcel outside of the road right-of-way (shown in blue). The new City right-of-way will extend 10 feet from the edge of the new road, from the corner of 196 th St N and Maxwill Ave N, west along the road until it bends to the southwest. City staff and the property owner met on-site on Wednesday, March 27, and marked the westernmost tree to be removed, thereby agreeing to the area where tree removal will occur as part of the road project. If the land swap is agreed to by the Council, the City Attorney will draft the necessary documents with survey work and property descriptions provided by the City Engineer.
