If approved, it would mean the owners of that property would have a commercial business hosting events with large numbers of people, added traffic, considerable noise and alcohol consumption. This was the first that my wife and I had heard anything regarding this. When we attended that meeting, two things became very apparent to us: 1) There was an overwhelming number of families (standing room only) who strongly voiced their opposition to the proposed event center. Most of which also had little or no advance knowledge of this. 2) There was clearly a great deal of advance planning, advice and direction given by the city to the owners of said property. This was made clear by the number of zoning requirements which they seemed to be trying to accommodate. A number of community members voiced their concerns regarding noise levels, traffic safety, unsupervised alcohol consumption, diminished property values, effect on the surrounding city nature trails and overall peace and enjoyment which we, as a community, were under the impression would go unchanged. (continued) On Wednesday August 3, 2016, my wife Paula went to the residence at 12680 Scandia Trial and spoke directly to the owner Jeff Gacek. Jeff seemed to be a very polite and sincere person. He spent quite some time showing Paula the structures and explaining the planning that had gone in to the proposed facility. He emphasized that his original plans were on a much smaller scale. He had not planned on as many venues or customers as was indicated at the public hearing. He also showed Paula the restrooms that would be used and had not made any requests for portable facilities. He went on to state that it was the city who had recommended that the numbers and accommodations be made higher. This makes it very apparent that the city has long had an "agenda" regarding the proposed facility and IUP and has been assisting the owners with furthering that direction without any regard to the community's homeowners as a whole. Such favoritism or "Spot Zoning" should never be allowed. I am certain that you have received an overwhelming number of logistical reasons from our community as to why this IUP should be denied. It should be pointed out that our own daughter was struck by a drunk driver only a few minutes west of that residence on Hwy 97 just a few weeks ago. Some of the residents' concerns may also include added stipulations requiring the owners to further demonstrate. For us this decision is very simple. If an entire community is overwhelmingly opposed to such a venue and vermit taking place, then the city of Scandia has a responsibility to uphold the wishes of the communi as a whole upon which it serves My wife and I share our community's recommendation to deny said permit. My name is Chris Ferderer. My wife and I have 3 children. I am a resident of Meadowbrook Ave North. I was disappointed to find out about the possibility of a rural event center amidst this residential farmland. Not only have I lived at this address for several years, but on July 19th, 2016, 1 closed on the adjacent land to build my new home I have been saving up years to build. This took place the day before the letter was drafted and mailed regarding the Gacek Rural Event Facility. I was devastated and shocked to learn about this and would not have purchased my land had I known. I have many concerns about the proposed Gacek Rural Event Facility, and I am asking that the City of Scandia deny this permit application for the following reasons: Currently, I feel the intersection at Meadowbrook & Hwy 97 is dangerous. It is a poorly marked road. When traveling eastbound on 97 there is a large hill prior to the left-hand turn. When I am waiting to turn left onto Meadowbrook, cars come flying up the hill and often don't have time to stop. Therefore, they are coming into the right turn lane to go around me. When there is a car preparing to turn right in the turn lane it becomes even more dangerous. I am anticipating having multiple cars turning left onto Meadowbrook for an event, and that will create an even more dangerous situation because the cars traveling 55 MPH up the hill will have little to no time to react to the stopped traffic. What about the safety of my children and pets out enjoying a beautiful day? It would disrupt our lifestyle. Here I am, living on rural Meadowbrook Avenue with quiet, peaceful surroundings. Now there is a potential for a parking lot way larger than the Scandia Plaza which holds approximately 45 vehicles and the Gammelgarden Museum which holds over 30 vehicles. In fact, it would be almost the size of the huge 118 parking spots in Community Center lot right in the middle of this rural area. It doesn't make sense to place parking in a quiet rural setting that seeks to overtake the amount of available parking in our city lots. In addition, I visited the website for Redeemed Farms and was extremely taken back and disappointed to learn that reservations are already being taken, including those for overnight stays in the bunkhouse. Is it okay to proceed to set things up commercially for 2 Y2 years without notice or intentions being given? Instead, the public is going to be allowed to come on any given day and disrupt the tranquil setting we currently live in. It would change the entire living situation. It is not right and we do not deserve to be subjected to unwanted traffic, noise, lights, loitering, and other disturbances to our peaceful neighborhood. I strongly urge you to think about my concerns and reread the criteria listed on page 3 of the memorandum distributed regarding the Rural Event Facility and how it shall meet applicable standards for the IUP and AOP regarding: *"Impact of proposed use on the health, safety, and general welfare of the occupants of surrounding lands, traffic conditions, property values, and scenic views. Our scenic views of the landscape will now become views of people at events and cars in a parking lot during our entire spring, summer, and fall seasons when we love to be outdoors. Although I initially denied his request to move the barn across our land, he told me he wanted to have occasional worship services and really needed my cooperation. This resulted in cutting down several large oak trees to enable the barn to move through my land. I feel duped by this dishonesty. The proposed event center will increase traffic and could pose public safety concerns for the people that live in the area. 2. Will alcohol be involved? Will they serve alcohol then ask for a permit afterwards? Our children will be in danger if cars are leaving with drivers under the influence. 3. Noise from the site will be a disturbance to our country living. Will they comply with noise ordinances? We enjoy having our windows open for the fresh country air and sounds. 4. I have read on the Scandia website that they are not within setback requirements. If they are residents actually living there I would be okay with that, but not as a business that is infringing on my rights. 5. The land is zoned for agriculture. They restored the farm with no intention of living there. They live in White Bear Lake. Once the farm was close to being done, they decide to ask for a permit. One does not start a business, then ask for permission from the city after the fact. As a resident and neighbor to the farm, I plead with the city council to not allow someone to destroy our beautiful, peaceful rural neighborhood for their own personal profit. My three kids are able to ride their bikes up and down the road and walk their dogs without any concerns. It has always been a very safe and quiet road for such activities. It would all change if a 100 -car parking lot was placed on our road. Not only the safety of the children from the vehicles, but of the people themselves. We have no idea as to what type of people could attend events and whether or not they themselves pose a threat to our children and the residents of Meadowbrook. The potential volume of traffic on Meadowbrook is alarming. What if we want to make a quick trip to the store, or pick up our kids? We would be stuck in traffic. What if I need to bring a child (or anyone else) to the emergency room right when an event is being let out? There is not even close to enough room to bypass 100 cars to get through to 97 and there is only one way to exit our road. It would simply not be safe in emergency situations. In addition to emergencies, there is the issue of the school busses. School busses travel up and down our road several times a day, and their route would be greatly affected with the traffic pile up on Meadowbrook and also on Highway 97. Not to mention the dozens of busses that would be affected that travel on 97 with the backups related to turning onto Meadowbrook. So we are not only talking about the safety of my children, but the safety of all the school children and bus drivers riding busses each day. With the potential of events happening 7 days a week, I must also address the noise from the people at the events and also sound amplification on school nights. My kids have to get up before 6:00 each morning for school and go to bed by 8:00. Why should we have to close all the windows to drown out the annoying noise from the event center? With the noise and traffic disturbances, how likely is it that our family can enjoy the outdoors like we are used to doing. Our outdoor bonfires? Our reading on the porch? Our going for a quiet walk? It is not fair that we would not only have to view the events from our property as they are happening, but we would not be able to have the eace_apnd tranquility we moved here to enjoy. The events would be disruptive to the family life we are used to enjoying in this quiet neighborhood. Please don't let this happen to so many neighbors that co -exist perfectly in peace, quiet and respect for each other - especially so that one non-resident individual can make a profit. I respect everyone's right to do as they wish with their own property — but common sense, decency and courtesy must prevail when so many people will be adversely and negatively affected. Someone or many will be injured or die. This property is in a terrible location for this purpose. The topography of Hwy 97 and the heavy traffic use makes it a death trap. I just moved back to Scandia from Minneapolis to get away from traffic, noise and crowds. I work in Minneapolis and commute a long distance so I can come home to my beautiful Scandia farm. It's incomprehensible to me that I would have to face twice daily traffic jams for every event held at the applicant's property. Additionally, I'm building a house and was required by the city to apply for an interim use permit, as well as a building permit. Which I did. I never would have considered it an option to build my house first and then ask for a permit later. In my opinion, Jeff Gacek is doing exactly that. His business has been launched. I live just north of the Gacek property at 21617 Meadowbrook Drive N. Patty and I formerly lived in White Bear Lake at 3441 Glen Oaks Ave... While we loved our quiet, peaceful White Bear neighborhood we longed to someday live in the country and have our own tranquil space to grow our own produce and someday have a few livestock. My wife Patty and I looked for a new place to call home for over 4 yews before deciding to purchase our Scandia property. We looked for a property that was not adjacent to high voltage power lines, railroads, highways, brown sites, junk yards or pipelines. We looked for property that had space, peace and a quiet natural setting. We looked for a place to call home and slowly develop a small rural farm. When we first purchased our property in the fall of 2012 the junk, weeds, grass and trees were so overwhelming and unmanaged that we really didn't have an accurate assessment of the property. Once we started working on clearing junk and undesirable vegetation from the land it was evident that the property was a literal dumping ground. I don't think the former owners (the Forsell's) ever threw anything away or cared for the property for a long, long time. Many things were left right where they failed or broke. So far we have removed over 370 tures, 67 appliances, 3 old buildings, countless bins of glass and 5 large dumpsters of steel. Most of this was done with a wheelbarrow, pick and shovel. Needless to say, we have placed a great deal of time and effort into attempting to revive this potentially beautiful property. Our labor of love held great promise that someday we could enjoy beautiful mature trees, gardens and bountiful crops, all while enjoying a quiet peaceful setting teaming with buds and other natural wildlife. All our dreams, hard work and ambitions are now on hold with the proposed Gacek rural event center. Patty and I have more concerns and questions than answers concerning the event center. Here are some of our comments and issues concerning this proposal: 1) I feel scammed. When Jeff first purchased his property he stated that he plans to revitalize the farm and live there. Over the last few years Jeff has approached Patty and I a number of times to purchase our barn and or some of our land. He always maintained that he really wanted to improve his property so he could move in and live there. This is the reason why I and many other gracious neighbors allowed the Gacek's to move the former Johnson Brothers barn through their farm fields. If I had known that this Barn would be used strictly for a commercial business that will have a negative effect on our properties I would have refused. 2) A rural event center in this particular area seems like a square peg in a round hole. A non -fit to the surrounding area and even a bit of spot zoning. If I were to pick and area for weddings and receptions and large gatherings it would be in a urban area where you have lots of surrounding commercial property or in a very urban area where you have hundreds if not thousands of acres so that traffic, noise and or loitering may not be a disturbance or nuisance to the neighborhood. 3) Meadowbrook Ave N is only a 17.5 foot road (near our home) with no shoulders. It is not designed to support higher volume traffic and especially commercial traffic. Two regular cars have a hard time passing each other. Two cars plus anything else like a pedestrian, bicyclist or roller bladder would be a potential accident. 4) Highway 97 can support a higher volume of traffic and seems to be the best solution for ingress/egress to the facility. However, the curve and hill combination on Highway 97 just west of Meadowbrook Ave N creates a blind approach as you travel eastbound. There is no room to create a bypass lane due to Meadowbrook Ave south of Hwy 97. I could see this being the site of many horrific accidents if you have a number of cars backed up on 97 waiting to take a left onto Meadowbrook Ave N. 5) Sight Sound issues. From my house I can see directly to the Gacek property. I can see his outdoor shelter, barn and other outbuildings. A few weeks ago I could hear music and see bright lighting from inside my house. I believe Jeff was having a party for guests that evening. This happened just once so far. I can't imagine this happening every day or even every weekend. This would be a definite nuisance. 6) The rural event facility seems like it could be open for business 7 days a week. That includes every weekend. Would you like a full blown wedding with the decorated cars, horns, limousines, balloons, confetti, bands, music, dancing, yelling, drinking (alcohol) and loitering going on at your neighbor's house every weekend? Patty and I cherish our weekends as we both work more than full time. Isn't home about quiet, peace and tranquility? I hope so. 7) I believe Jeff Gasek did not carefully plan, disclose or meet with the City to confirm his project met requirements before he started his quest to develop a commercial venture on his agricultural property. It was a "build it and they will come" scenario. I don't think the City or the neighbors could grant pity for any hardship since the plan was not properly disclosed. 8) It appears the purpose of the Core AG district is to protect and reserve long term agricultural production and to preserve the rural character of the City. A rural event facility does not accomplish any of these purposes. A rural event facility would extend Core Ag into a much higher or greater commercial use category; it would be a commercial business not rural Agricultural production. 9) I am looking at a document published on the City of Scandia website titled "City of Scandia Allowable Land Uses". It will create more noise, lighting, traffic, congestion and loitering. 11) The rural event center will lower surrounding property because it creates an intensive use, noise, traffic and disturbance in a quiet, peaceful residential setting. 12) The rural event facility will create traffic hazards and more congestion to the existing neighborhood. 13) Where will the parking lot and adequate screening be situated? 14) It seems that before that IUP has been granted the Gacek's have already started their commercial business. As you can see there are no sound or visual protections from the proposed rural event facility. This property is an example of how a forced non -conforming business could move in and Scandia would lose its integrity and rural peaceful character of why we all live here! I do not want Scandia to become another area that does not value its heritage. I would like to reinforce that this site is a poor place to situate this type of business. I strongly feel that this belongs in a highly urban or completely rural setting with far less population. I don't know too many people who would want a wedding and or large event every weekend right next to their home. And I have for almost 30 years. I have several concerns with the proposed IUP the Gacek's are applying for. First of all, I'm wondering why Jeff (Gacek) was allowed to develop the property under the disguise of agricultural use. The property did not meet the acreage requirements. And none of the buildings are used to house livestock, crops or farming equipment — which is the intent of agricultural use. The little crops that are grown on the premises are farmed by others. To me this is a separate issue than the IUP they are applying for, but speaks to the deceit that may follow the permit. Second, I am wondering why the IUP even made it past the City Planner and was brought to the Planning Board — as it clearly did not meet several of the requirements: • Inadequate setbacks • Amplified noise request within 1000 feet of other homes • Little to no scenery. screening for neighbors • Exceeding possible hardscape limits • Overnight lodging • No studies to show impact on traffic, noise pollution, light pollution, or the impact on the environment • And many other unanswered questions, such as: alcohol use, enforcement of ordinances, time frame for IUP expiration To me the burden should be on the applicant to show that all requirements are 100% met, and that studies have been done by either the applicant or city to show us the facts on the impact to the neighborhood. My third concern is the request to put a parking lot onsite that would be accessed from Meadow Brook, Meadow Brook is a dead end road with no cul de sac and is only 18' wide with no shoulder — it is considerably narrower than Meadow Brook to the south. It was built for three residents that used the road at that time. Now we have several residents on the road with school buses, garbage trucks and tractors that already make it tough to pass and unsafe for an evening stroll, Adding 100 cars or more would be a disaster. Also I can say from first hand experience that every time I have to sit on Hwy 97 waiting to take a left, I cringe as the traffic comes over the hill from the west at 55mph or faster and realizes that there is no bypass lane and they screech to a stop. If there were more than a couple of cars backed up to turn left onto Meadow Brook, the traffic coming over the hill would not have time to stop and there would be a messy accident. At the August Planning Board meeting, Jeff was asked to do a traffic study. I suggest the city does their own, or strongly/thoroughly vets the information that Jeff is giving them - as he has shown deceit in the past. Fourth, I see no need for Scandia to bring a for-profit business into our quiet neighborhood. This is not a Scandia resident. He has no intention of using it for his primary residence. He only plans to bring people up from the city to enjoy a Few hours of our lifestyle and Leave ... only to leave behind a long- lasting negative impact on the people who live here every day. Lastly, I would like to say that the best part of living in the rural Scandia area, even above the peaceful sounds, quiet nights and frankly, the lack of drama are the neighbors and the neighborhood in general, Everyone gets along. We don't need privacy walls, we are respectful of each other. We help each other and watch out for one another. The last thing we need is a business plopped right in the middle of it all under hostile circumstances. I don't believe if this IUP is allowed that everyone will just go back in their house and say, "Oh well, I tried and I guess I will go back to being happy." What I believe will happen is that the neighborhood will be full of drama for some time — traffic accidents, 911 calls, sirens and just general hostility towards the event venue. In summary, I highly urge you all to consider the lifestyle of an entire neighborhood over the wishes of one and deny the IUP permit or the event center the Gacek's are proposing. If you choose to allow this IUP, I have only one request — that you postpone the issue of the permit for one year so I have a chance to sell and move before my property declines in value. I live directly across the highway from this proposed parking lot and event facility, and can attest to the amplification of sound across the open wetland fields, especially at night. This facility is not in a remote isolated location, unlike other rural event centers that are isolated by both distance and woodlands that buffer noise. This particular area has a growing number residential homes coming in, and the event center will create noise disturbances in this flat, open area from traffic including motorcycles (and late at night), music, and PA systems. Residents will have to keep windows shut, and this will only minimize the noise. This problem will be exacerbated by any alcohol present, whether served by the event facility or brought in by the guests. Traffic issues. Multiple vehicles coming or leaving the facility on the side street off the highway (97) will create increased danger. Highway 97 is a 55 MPH highway, and the small side street access cannot safely accommodate a large number of vehicles at one time for business activity. Even with traffic control, this will significantly jam the traffic flow on highway 97 creating delays and hazards. Local area residents will also have difficulty in this traffic which will be similar to a construction zone when events occur at this facility. Property values. Prospective home buyers always inquire about the neighborhood, including any local concerns, i.e. ambulance facilities, fires stations, bar activity, and any deterrents to a peaceful environment. This event center will most certainly be a concern and will decrease residential property values for all within miles of the event facility. The continued progress of residential properties in this area is advantageous to the development and economic growth of the community, and also beneficial to local businesses in the City of Scandia. The applicants are proposing outdoor amplified sound for ceremonies, indoor amplified sound for receptions and worship, and outdoor lighting. a. At the hearing, there was discussion over the decibels allowed by the city's ordinance, and it sounded like the Gacek's did not currently meet the allowance. However, the Gacek's have not submitted any formal plan for sound amplification, decibels, etc. b. The Gacek's have also not submitted a plan for outdoor lighting. Outdoor lighting will certainly cause a disruption to the quiet peaceful nights we all enjoy. Outdoor amplified sound at any time of day will definitely cause us all to have to keep our windows closed on beautiful Minnesota Spring, Summer, and Fall days- which is not what we moved to the country for. 1. I'm requesting that an environmental study be conducted. 2. I'm requesting that a noise and light pollution study be conducted. 12. The Gacek's application also includes that they do not intend install septic systems to accommodate extra indoor restroom facilities so they are planning to provide portable toilets to event guests. Our home boasts a large deck that overlooks our backyard, which also gives us a direct view to the Gacek's property. We are not thrilled about the prospect of spending a beautiful evening on our deck grilling our dinner, only to enjoy the sight of a row of plastic restrooms. This applicant's existing investment in their proposed event center should not be a consideration for approval. If the applicant failed to follow the proper process, or the proposal does not meet the codes of the city — that is the applicant's responsibility. I firmly believe that with the above listed concerns as well as the concerns brought forth by other neighbors listed below that the planning commission must deny this permit. As a physician and scientist and property owner, I deeply believe the proposed Center will be a significant public health threat to our community. I am one of the owners of Scandia Meadowbrook Farm,a 131 acre farm at the North end of Meadowbrook. I am also a homeowner in Scandia 23601 Quentin Ave N. There are many reasons why I strongly oppose this Center related to that fact that it will disrupt the peace, tranquility, and beauty of the environment of the neighborhood. However, above all else it will be an immediate and direct threat to public health. The proposed event Center will bring large volumes of traffic to a section of the Route 97 which will significantly increase the risk of bodily injury and death to those who currently use the roads in that vicinity. In the ten plus years since my family bought our house on Quentin Ave there have already been two highway deaths on Rt 95 and another on Rt 97 this past summer in Forest Lake. Three too many! The Gasek proposal shamefully lacks ANY safety studies related to the potential for more deaths. We know that traffic volume at very high speeds on Rt 97 will increase markedly during the proposed events. Combine this with alcohol, without any policing or regulating, is throwing fuel onto an already hot fire. There have been no traffic studies, no safety studies, no plans to limit alcohol use, no plans to police traffic or alcohol. This is a public health threat and it is the responsibility of your Commission to say no. A green light to this Center from the Commission will undoubtedly result in the eventual harm to one or more citizens of Scandia. The very reason our Planning Commissions exist is to govern this kind of dangerous proposals. We have to remember the Center is on agricultural land in the middle of an otherwise peaceful rural setting. While zoning regulations are intended to serve many purposes, first and foremost is the safety of our community. What is more important than the safety of our community - an event center?? Based upon the health and safety risks to our Scandia community I urge you to reject the Gasek proposal. It is a disaster waiting to happen. This event center will create a dangerous traffic situation with vehicles coming from the west making a left hand turn into the center. We are also concerned with the noise level, with the fact that alcohol will be served and the potential loss of property values. Please do not let this event center ruin Scandia's rural community setting. We plead that you not allow one individual that does not even live in Scandia, and we doubt has any plans to do so, ruin our rural community. All of the changes to the existing buildings have been done under Agriculture. It is clear the intended use of these structures will not be Agricultural. They are over the square footage allowed and no one is living in the residence. There is a website already advertising and booking wedding receptions and events at this location. We purchased our property in 1998 and have always intended to build a retirement home or have our sons build homes on the Meadowbrook Avenue side of our property. This would be directly looking into a parking lot if this IUP goes through. We purchased our property to raise our children, cattle, hogs and chickens. We never imagined there would be a commercial parking lot and business across the road from our property in a rural agricultural setting. Our driveway is off of 213th which is north of Highway 97, Highway 97 and Meadowbrook are already a risky turning situation. The site lines are horrible and cars race by on the right side (fog line) when we turn left into our property. There is not a bypass lane. Shortly after our road, 213th Street is Meadowbrook. There is a right turn lane that cars will be tempted, as they are on 213th street, to bypass traffic. This is a dangerous situation with all the semi -trucks and existing traffic on Highway 97. Meadowbrook is a small county road with a dead end. There is nowhere for traffic to go. We are concerned about the use of alcohol and traffic leaving these events in the evening as well and the noise that will be involved. We have no desire to hear or participate in the event facilities music, wedding ceremonies, and vows etc. while we are on our front porch to enjoy the peace and quiet of the country and our home and property. Adding trees and a berm may visually screen but does nothing for sound. They are also planning to have a gift shop and bunk house which will create additional traffic and overnight guests. How will this be monitored for alcohol and traffic? That is clearly a commercial business they are looking to profit from. Will there be overnight guests in the parking lot, such as campers? Who will monitor this? It appears the Gacek's have ignored existing code and ordinances. Over limit for buildings for the number of acres, intended use, residential occupancy, setbacks etc. How this has gotten this far is beyond us.
