Background: • AECOM has requested an amendment to their agreement with the
city for preparation of the EIS. The contract budget has been
exceeded because of the large number and complexity of comments
on both the preliminary draft reviewed by the PAC and on the Draft
EIS. More time than expected is required for review, evaluation,
technical analysis, meetings, and subconsultant work to prepare
responses for the Final EIS.
• A contract amendment has been prepared. The budget would
increase by $53,853.00.
• All of the city's costs for preparation of the EIS will be paid by the
proposer.
Recommendation: Staff recommends that the Council approve the amendment.

Dear Ms. Huriburt:
This modification letter amends and modifies the Agreement entered into between the City of
Scandia and AECOM Technical Services, Inc. ("AECOM"), formerly EDAW, Inc.,with an effective
date of March 2010.
It is understood and agreed that performance of the Basic Services identified under Appendix A
to the Agreement will require an additional fee to be charged to the Client. Therefore, the
contract budget as described in Appendix 8 is hereby increased by the amount of fifty three
thousand eight hundred and fifty three dollars ($53,853.00)so that the new not-to-exceed amount
shall be four hundred and forty six thousand five hundred and seventy eight dollars($446,578J.
By execution hereof, AECOM agrees that the basic services can be (barring unforeseen events
or occurrences) performed for this amount.
The amendment is required to address the following items:
• Number and complexity of PAC comments on the Preliminary Draft EIS that required
review, evaluation, additional technical analysis, and incorporation into the Draft EIS as
appropriate.
• Number and complexity of comments received on the Draft EIS, including reports by
consultants that require significant time to review, assess, conduct additional technical
analysis, and the prepare responses for the Final EIS.
• Additional meeting attendance for technical and facilitation staff.
• BRKW review of Tiller Property Value report.
This cost is based on the assumption that Tiller will pay for printing and distribution mailing of the
Final EIS directly.

The foregoing is the sole modification or amendment to the Agreement, and no other express or
impfied modification or amendment is intended or shall be construed herefrom. All other
provisions, prior amendments [if anyJ and obligations of the Agreement shall continue in full force
and effect.
