Hofer, City Planner Re: Easement Vacation for PID 14.032.20.43.0008 & 14.032.20.43.0010 Applicant: Jerry Anderson, Jamb Architects Zoning: V-C Owner: Howard E & Emily A Stegner Trust Security State Bank Future Land Use: Village Mixed Use Location: 21190 Ozark Avenue North 14.032.20.43.0008 & 14.032.20.43.0010 Review Deadline July 13, 2024 BACKGROUND Jerry Anderson, on behalf of the property owners of 14.032.20.43.0008 & 14.032.20.43.0010, has proposed an expansion of the existing structure at 21190 Ozark Avenue North, known as Scandia Plaza. The applicant is proposing either a lot line adjustment or lot combination to accommodate the expansion of the existing structure. Regardless of the subdivision process, an easement vacation is required to vacate the drainage and utility easement on the shared lot line between the two properties. EVALUATION OF REQUEST Staff Analysis The applicant is proposing either a lot line adjustment or a lot combination. If the lot line adjustment is requested, the existing drainage and utility easement will become unnecessary and a new easement will be required on the new lot line. If the lots are combined, the existing drainage and utility easement will be unnecessary and any required easements for drainage will be required as part of the site plan review for the property. 2 | P a g e RECOMMENDATION Staff recommends the City Council adopt Resolution 06-18-24-02 Setting a Public Hearing. Application 1 CITY OF SCANDIA, MINNESOTA RESOLUTION NO. 06-18-24-02 A RESOLUTION SETTING A PUBLIC HEARING ON THE PROPOSED VACATION OF DRAINAGE EASEMENT WHEREAS, the City Council pursuant to Minnesota Statute § 412.851 desires to consider the vacation of certain public drainage easements on the properties (the “Properties”) legally described as: Lot 1 and Lot 3, Block 1, Hawkinson Business Park WHEREAS, the drainage easements proposed to be vacated were created with the plat of Hawkinson Business Park, as filed in the Office of the County Recorder of Washington County, Minnesota. The easements were dedicated via the plat for Hawkinson Business Park, and are described as follows: A portion of the drainage and utility easement shown on Hawkinson Business Park Plat, Block 1, Lot 1, and Block 1, Lot 3, being 20 feet in width and adjoining lot lines. WHEREAS, new drainage and wetland easements will be dedicated over the Property as part of the a lot line adjustment, which can only be approved following a vacation of the existing easement; NOW THEREFORE, be it resolved by the city council of the city of Scandia, Minnesota as follows: The City Council will consider the vacation of such street and a public hearing shall be held on such proposed vacation on the 16th day of July, 2024, located in the City Hall at 7:00 p.m., BE IT FURTHER RESOLVED that the City Clerk is hereby directed to give published, posted and mailed notice of such hearing as required by law.
