Deadline/Timeline: N/A Background: At their September 10, 2012 meeting, the Park and Recreation Committee discussed possible changes to the ordinance, as shown in the draft meeting minutes, attached. Recommendation: If the Council agrees that changes are needed, the next step would be to refer the changes to staff and the City Attorney for preparation of an ordinance for review at a future meeting. Chair Bildeaux led a review of current Ordinance No. 115, with a discussion of each subdivision rule. Changes to the following rules were recommended: • Subdivision 1. Park Hours: Parks are closed between the hours of 10:00 p.m. and 4:00 a.m. Vogen recommended that the closing time be extended by one hour—longer daylight in the summer has people in parks beyond the 10:00 p.m. hour. The Committee agreed to closing parks at 11:00 p.m. • Subdivision 5. Motorized Vehicles: The Committee recomrr�ended that"No overnight parking"be added to this rule. • Subdivision 7. Open Fires Prohibited: The Committee recommended that it should be clear that all types of fires are banned within Wind in the Pines, including the use of grills. Staff will advise on wording for this rule. • Subdivision 10: Animals: The Committee recommended that wording be added which would require pet owners to clean up pet waste before leaving the park. • Subdivision 12. Other Prohibited Acts: Chair Bildeaux stated that he would investigate how "Conceal and Carry" laws fit into rule that no one may be in possession of a firearm, except for a peace officer. The Committee referenced Ordinance No; 62 which dedicated parkland as "Wind in the Pines Preserve", adopted in 1998. They recommended that Ordinance No. 115 be amended to replace "Wind in the Pines Park"with"Wind in the Pines Preserve"each time it is identified in the current ordinance. Motion by Lee,seconded by White,to recommend to the City Council that Ordinance No 115 be amended as recommended by the Committee(park hours,fires prohibited in WIP,pet waste and "Park" changed to "Preserve"). The motion carried 6-0. b) Donated Labor/Volunteer Contracts At the August PRC meeting, the Committee recommended that an agreement for volunteer work be documented before the donation of labor to avoid any misunderstandings regarding the completion of the work. This would not apply to volunteer work days,but larger projects. Zauner explained this as being in agreement up-front about the expectations of the work for both parties. The Committee agreed that a"volunteer expectation letter" could be a proper term, rather than a binding contract. Motion by White, seconded by Lee,to table the discussion to the October PRC meeting,to further research an acceptable type of letter for volunteer agreements. The motion carried 6- 0. c) Hay Lake Signage (requested by Dan Lee) Lee explained that members of the Lions and Friends of Scandia Parks are pursuing a project to install a park sign at the Hay Lake site. Lee recommended that one or two PRC members serve as a CITY OF SCANDIA ORDINANCE NO.: 115 AN ORDINANCE ESTASLISHING RULES AND REGULATIONS FOR THE USE OF SCANDIA PARKS The City Council of the City of Scandia,Washington County, Minnesota hereby ordains: Section 1. DEFINITIONS. For the purpose of this ordinance,the following definition shall apply unless the context clearly indicates or requires a different meaning: PARKS shall mean a park,playground, athletic field,trail,nature area, open space area or recreational facility, including adjacent parking areas, owned or operated by the City of Scandia for the purpose of recreation or open space use. Section 2. RULES AND REGULATIONS FOR PARK USE. Subdivision 1. Park Hours. No person,except authorized city personnel, shall enter or be in or remain in any park between the hours of 10:00 p.m. and 4:00 a.m. except with a permit issued by the City Clerk. Subdivision 2. Removing,Defacing or Destroying Property Prohibited. No person shall remove, deface, destroy, diminish or impair the value of public property located on or within any park, including buildings, structures,trees, shrubs, grass,vegetation, signs,tables, benches, fireplaces,trash receptacles, notices or placards,boundary markers or fences, or any other public property, either real or personal. Subdivision 3. Erection of Structures. No person shall construct or erect any tent, building, or structure of any kind, whether permanent or temporary in character, or run or string any public service utility into, upon or across any park, except with a permit issued by the City Clerk. Subdivision 4. Littering and Dumping.No person shall litter, or cast upon or allow to remain any rubbish or trash of any kind or nature in or about any park. Subdivision 5. Motorized Vehicles. Motorized vehicles shall be driven or parked only in designated areas in any park and shall be driven therein at a maximum speed of 5 miles per hour. Snowmobiles and all-terrain vehicles shall not be operated in any park except in areas specifically designated or posted for their operation. Subdivision 6. Non-Motorized Vehicles. Bicycles or other non-motorized vehicles of any type are not permitted in Wind-in-the-Pines Park. f'��_._" � T� __. �� TOWN OF NEW SCANDIA ORDINANCE NO.62 AN pRDiNANCE DEDICATING CERTAIN PROPERTY OF TI�TOWN AS PUBLIC PARK The Town Board of New Scandia Township, Washington County, Minnesota hereby ordains: Subd. 1. The following described real property of the Town situated in the County of Washington, State of Minnesota is hereby established and dedicated as Public Pazk to be used for such park and park related purposes as the Town Boazd from time to time may approve. Subd. 2 The property so dedicated for Public Pazk purposes is legally described as follows: The Northwest Quarter of the Southwest Quarter (NW '/4 of SW '/4) of Section Seven(7), Township Thirty-two(32),Range Nineteen(l9). According to the United States Government Survey thereof. Subd. 3 The Public Park so established shall be lrnown as "Wind in the Pines Preserve".
