8.e) Attorney's Monthly Report-Miller �� � � M E M O R A N D U M DATE: September 10, 2012 FROM: Thomas F. Miller TO: Anne Hurlburt, City Administrator and City of Scandia City Council Members RE: Attorney's Report FILE: 12-SO1-TFM The following is a summary of the various matters as to which services were provided on behalf of the City of Scandia since my last report and to the present date and is provided to each of you for purposes of the City of Scandia Council meeting scheduled for September 18, 2012. CITY MATTERS 1. Tiller Corporation CUP (12-S02-TFM). We have continued our review of the comments to the draft final EIS. In consultation with staff we have been working on the Resolution for consideration by the Council. We continue to analyze and discuss with staff the conditions which would be considered if the CUP is granted. Finally, we are preparing some materials to be presented to the Planning Commission regarding the legal standards applied to processing a CUP request including the Tiller request. 2. Continenza Variance Request (12-SO4-TFM). Based on the City Engineer's report, we understand that the Council will give final consideration to this Variance request. We have reviewed and commented on the options presented to you by the City Administrator. 3. Uptown Sewer Svstem Project (12-S10-TFM). We have been in discussions with the City's engineer regarding the current capacity for these systems and the potential for new connections. 4. Citv Administrator Contract(12-517-TFM). The Employment Contract for Kristina Handt to serve as City Administrator has been finalized and signed. 5. NSU Wastewater Operations Contract (12-S20-TFM. We reviewed the revised Agreement for operation of the City septic systems. We proposed some changes which have been dealt with in the Agreement presented to you for approval. 6. Campbell Dan�erous Do�(12-S25-TFM. We reviewed the registration requirements for a dog which has received the designation of"potentially dangerous by another jurisdiction. We researched this issue and provided our opinion to the City Administrator.
