Land Owner Signature 60-DAY DEADLINE: January 2, 2007 BRIEF DESCRIPTION OF THE REQUEST: The Applicant, Cingular Wireless, requests a Conditional Use Permit to allow co -location of 12 Cingular antennas on the existing cellular tower, to construct a 230-square foot equipment building near the base of the tower, and to install additional fencing. The tower is located at 12160 Scandia Trail North. The proposed 12 antennas would be housed on three frame mounts which would be attached to the tower at 140 feet from the ground, located below the existing antennas. The proposed equipment building would be in addition to an existing 276-square foot building located to the east of the tower. The New Scandia Zoning Ordinance allows the addition of an antenna on an existing tower by Conditional Use Permit in the Agriculture District. The subject property is 6.9 acres and the cellular tower is the only use on the property. The property is owned by Jose - Mari and Teresa Yasis. The existing cellular tower was granted a Conditional Use Permit in 1997. The tower is owned by American Tower Corporation and it houses antennas for Verizon, T-Mobile and the Washington County Sheriff. EVALUATION OF THE REQUEST: Antenna The Ordinance requires a minimum of three tenants for a tower with a height from 125 feet to 200 feet. The existing antenna is 195 feet tall and currently houses antennas for three entities. Cingular would be the fourth tenant, and so the request meets this condition. As required by Ordinance, the Applicant provided documentation from American Tower Corporation that assures the tower and foundation are adequate to support the existing antenna and the additional antennas proposed by Cingular. Also as required by Ordinance, the application materials, which include construction, grading, and electrical detail, are signed by a Registered Engineer. The Ordinance requires written acknowledgement by the landowner that they will abide by applicable Conditional Use Permit conditions (Attachment 4). Equipment Building The Ordinance requires that all equipment is located within a structure, and that the accessory structure shall be constructed of materials designed to minimize visibility in the neighborhood. The Applicant requests to construct a new equipment building of 11.5 feet by 20 feet. The existing equipment building on the site belongs to Verizon. The Applicant indicates that in the industry, equipment buildings are not shared, and that adequate space to meet Cingular's needs would not be available in Verizon's existing building. The minimum setback from Scandia Trail, designated as a Minor Arterial, is 75 feet from the right-of-way or 150 feet from the centerline, whichever is greater. The rear yard setback requirement is 50 feet and the side yard setback is 20 feet. The proposed structure is approximately 300 feet from Scandia Trail, over 400 feet from the side lot lines, and 70 feet from the rear lot line. The request conforms to the setback requirements. Two accessory structures are permitted on a lot between 3 acres and 20 acres in size. The subject property is 6.9 acres. The total square footage of accessory structures permitted for a lot between 5 acres and 10 acres is 2,500 square feet. The proposed equipment building would be the second accessory structure, and the total area of both buildings would be 506 square feet. The proposal meets the regulations for accessory structures. Cingular Wireless CUP Page 3 November 28, 2006 New Scandia Township, Minnesota The proposed siding material is pebble textured and tan in color. It closely resembles the siding of the existing equipment building (see Attachment 1, Photo 3). Grading and Erosion Control The Grading Plan shows the grading limits, location of silt fence, and topographic contours. Because an area greater than 1,000 square feet would be graded, a grading permit from Washington County is required. The disturbed area must be either seeded or sodded in order to prevent erosion after grading is completed. Fencing and Screening The Applicant proposes additional chain link fence to surround the proposed equipment building and to connect with the existing fence which surrounds the existing tower and building. The proposed fence is 6 feet tall and constructed of chain link with barbed wire on top. The proposed swing gate would be locked with a steel chain and a combination lock. The Ordinance requires that the tower be reasonably protected against unauthorized climbing. One option described in the Ordinance is to enclose the tower with a 6-foot high chain link fence with a locked gate. This is the option that the Applicant proposes. The Ordinance states that the base of the tower, and the tower accessory structures, shall be landscaped where practical. The Applicant proposes to remove one tree. There are existing trees that screen the tower from the road and neighboring properties. Because of the existing trees, the Planners find that additional tree planting is not necessary for screening purposes, although the disturbed areas must be either seeded or sodded. ACTION REQUESTED: The Planning Commission can recommend: Approval 2. Approval with conditions 3. Denial with findings 4. The Applicant requests two variances in order to complete the project. One variance request is in order to build a sewage treatment system and the other variance request is for the accessory structure location. See Attachments 1 (site plan) and 2 (letter describing the request). Variance 1. The soil borings taken at the subject property show a depth of approximately 12 inches of soil. New Scandia Township has adopted the Washington County ISTS Ordinance by reference. Variance 2, location of an accessory structure between the house and the road. The Applicant proposes a detached garage of 768 square feet located between the house and Quinnell Avenue North. The New Scandia Zoning Ordinance does not allow accessory structures to be located between the house and road unless it is at least 200 feet from the right-of-way and is on a parcel of 5 acres or more. BACKGROUND: The subject property is zoned Agricultural District, Saint Croix River Management Overlay District. The property is 6.7 acres with six wetlands and with Gilbertson Creek running across it. There is an existing one - room cabin on the site (no well or septic). The New Scandia Township Development Code allows the issuance of a variance, "where it is determined that, by reason of exceptional circumstances, the strict enforcement of the Zoning Regulations would cause unnecessary hardship." The Zoning Ordinance considers hardship to mean; 1.) that the property cannot be put to reasonable use under the conditions in the Ordinance, 2.) that the hardship is not caused by the landowner, but is due to circumstances unique to the property, and 3.) that the variance would not alter the essential character of the area. EVALUATION OF THE REQUEST: Sewage Treatment System The Applicant requests a variance to Washington County ISTS Ordinance Section 14.10 (1)(B) which requires 18 inches of permanent soil with a percolation rate faster than 60 minutes per inch. The Applicant requests that 12 inches of soil be permitted. The Applicant has explored other locations that would meet the 18 inch requirement, but locating the system where 18 inches of soil is available would put the system too close to Gilbertson Creek (within the setback). A variance for either the soil depth or the creek setback would be required to construct a sewage treatment system on the site. The Washington Conservation District finds that the proposed location is preferable from an environmental standpoint because it better protects the creek (Attachment 3). The proposed sewage treatment system is designed by North American Wetland Engineering and is called a DYN02 pretreatment system. The application materials describe it as using biological treatment to treat the wastewater before it drains to an infiltration bed (Attachment 4). The Applicant is working with the Washington County Department of Public Health and Environment in designing the sewage treatment system. A letter from the County to the system designer states that the proposed system will probably provide adequate long term sewage treatment (Attachment 5). The Planners recommend that Washington County Department of Public Health and Environment app oval of the sewage treatment system be a condition of the variance, if one is granted. Rodquist Variance Page 3 November 30, 2006 New Scandia Township For the location of the sewage treatment system the Planners find that strict enforcement of the Ordinance requirements would create a hardship in that the property could not be used for a single family residence without a sewage treatment system. The Applicant has shown that there is no way to provide for a sewage treatment system without a variance. The hardship is present due to the wetlands creek and soil conditions unique to the property. Accessory Buildhig The Applicant requests a variance to allow a detached garage of 768 square feet located between the house and Quinnell Avenue North. For parcels 3 to 20 acres, two accessory buildings are allowed and may total no more than 2,500 square feet. The one -room cabin of 144 square feet would remain and would be used as an accessory building for spiritual retreat used by the Rodquists. The one -room cabin may be used for storage of personal property and for personal use and may not be used as a residence or for lodging. The proposed garage and the one -room cabin are a total of 912 square feet and so conform to the area and quantity limits for accessory buildings. Due to the location of the proposed sewage treatment system, wetlands, the creek and associated setbacks, the proposed garage location is the only land available within 100 feet of the house. The proposed house is intended as a home for retirement. The Planners find that a garage is a typical accessory use of a residential property, and that locating it within 100 feet of the home is a reasonable expectation. The Applicant states that an existing swale prevents the garage from being moved closer to the house (as an attached garage). Because of the unique environmental conditions of the property, strict enforcement of the Ordinance would greatly limit the location and functionality of the proposed garage A variance allowing the garage to be located between the house and the road would not alter the essential character of the area The Planners recommend approval of the variance to allow the garage to be located between the house and the road as shown on the site plan. Setbacks The standard setback requirements for the subject property are: side yard of 20 feet, rear yard of 50 feet, and front yard of 40 feet. A setback of 100 feet from the centerline of Quinnell Avenue North, a Local Collector, is required. A setback of 75 feet from the Ordinary High Water level is required for unclassified waterbodies. For Type 1 (Seasonally Flooded) and Type 2 (Wet Meadow), wetlands which do not have open water, a setback of 20 feet from the delineation is required. The Washington Conservation District has confirmed the wetland delineation and that Basins A, B, C, and D are Types 1 or 2. The Washington Conservation District has also offered to work with the Applicant to minimize any impacts on vegetation and to restore disturbed areas. The property sits between Quinell Avenue and the Wisconsin Central Limited RR tracks and is wooded with a stream running through one end. There is currently a short gravel drive and an existing cabin approximately 12 feet by 12 feet which consists of one room with a small wood stove. The owners would like to build a permanent retirement home on the property and reside there. Variance ReQuest #1 � Variance to standard septic system design Due to the numerous wet areas and existing soil conditions the first variance we are requesting is for a septic system designed by North American Wetland Engineering to be located in the most acceptable location we have been able to identify on the site, conforming to all required setbacks from the boundaries and existing wetlands. The hardships which apply to the request for a variance to the standard septic system are as follows: A. The property cannot be used for residential purposes without a septic system. B Due to the particular piece of property and its natural soil conditions it is unsuitable for a standard septic design and requires a septic system designed with a pre-treatment stage prior to distribution of the waste liquids into the drainage bed. C. A single family home with on -site sewage treatment is typical of this area. Variance Reouest #2' Variance to build garage closer to road than dwelling The second variance requested is to allow the garage to be sited closer to the road than the dwelling unit. The house is shown on the enclosed site plan in the owners' preferred location to take advantage of the available views of the stream and central open portion of the site, while still respecting all required setbacks from property boundaries, wetlands, stream and septic system. Due to the restraints of the site imposed by the existing wetlands and natural drainage swales, the garage has been sited between the house and the road. Rodquist Variance Request Page 1 of 2 The hardships which apply to this request for a variance for siting the garage closer to the road than the dwelling are as follows: A. Due to the particular piece of property and the existence of its natural features, including wetlands and stream, there is not an available contiguous building site in this location for the garage to be built further back from the road, adjacent to the proposed home site, nor is there area available at this particular site for a driveway to pass adjacent to the house to allow the garage to be located behind the dwelling. B. Due to the existing swale between the proposed dwelling site and garage site, the garage cannot be moved closer to the house. C. The variance, if granted, will not alter the essential character of the locality. D. There do exist on the site alternate locations which would allow the garage to be placed further from the road than the house, however this would require placing the house much closer to the road, as well as not allowing the owners to take advantage of view of the stream and open space. The house can be attached to the garage in the current configuration by the construction of a breezeway or covered walk connecting the two structures and the owners may be interested in eventually making this connection. However, we are making this request that a variance be granted to allow this siting without the connection at the time of construction. A few weeks ago, I provided a memo regarding the water resource concerns on this parcel. Since that time, I have received additional documents and have met with the architect. Based on that information, I would recommend the Township approve the delineation as depicted on the survey maps prepared by Landmark Surveying. I also agree that the location of the house, driveway and septic system, as shown on the Proposed Site Plan dated October 11, 2006, is within the area of lesser ecological integrity. In comparison, an earlier concept had proposed the site development as closer to Gilbertson Creek and the seepage swamps. Within the next week, I expect to visit the site again, to review the vegetation within the development envelope. If significant plant communities or specimens are seen, I will work with the applicant to minimize the impacts and restore any disturbed areas. The variance would be to allow a setback of 33.5 feet from the sewage treatment system to the Bone Lake Ordinary High Water level and a setback of 45 feet from the sewage treatment system to the well. The property is at 23409 Lofton Avenue North on the west shore of Bone Lake. It is approximately a quarter of an acre and is a nonconforming lot. There is an existing 1,076 square foot house on the property with an existing well and septic system. The Applicant is not proposing a new building on the site but repairs would be made to the existing structure. A new well is also proposed. The application states that the existing septic system is believed to be an open -bottomed wood tank. BACKGROUND: The subject property is zoned Agriculture District, Shoreland Overlay. The property is located on Bone Lake, a Recreational Development Lake. The Ordinary High Water (OHW) level of Bone Lake is 909.1 feet. The New Scandia Township Development Code allows the issuance of a variance, "where it is determined that, by reason of exceptional circumstances, the strict enforcement of the Zoning Regulations would cause An Employee Owned Company Promoting Affirmative Action and Equal Opportunity Rodgers Variance Page 2 November 30, 2006 New Scandia Township unnecessary hardship." The Zoning Ordinance considers hardship to mean; 1.) that the property cannot be put to reasonable use under the conditions in the Ordinance, 2.) that the hardship is not caused by the landowner, but is due to circumstances unique to the property, and 3.) that the variance would not alter the essential character of the area. EVALUATION OF THE REQUEST: Sewage Treatment System The Applicant proposes a septic tank and drainfield to replace the existing system on this nonconforming lot (see Attachment 1). The Applicant wishes to sell the property which necessitates an upgraded sewage treatment system. The type of the existing system is not known but thought to be an open -bottomed wood tank. There is not adequate space on the parcel for a secondary sewage treatment area. The Applicant is seeking an ISTS permit from the Washington County Department of Public Health and Environment (see Attachment 2). The planners recommend that if the variance is jranted, that a condition of approval be a determination from Washington County Department of Public Health that the proposed sewage treatment system can safely provide for long-term sewage disposal needs, will not jeopardize the water quality of Bone Lake or groundwater quality, and that a permit is granted. Setbacks The subject property is an existing nonconforming lot that is smaller than would be allowed in a standard subdivision today. Due to its small size of .25 acres, the parcel is not big enough to allow for the proposed septic system to meet setback requirements. The Shoreland Ordinance requires a 75 foot setback from the OHW for sewage treatment systems. A 100-foot separation between the well and drainfield are also required. The setback requirements are in place to provide for public health and safety by preventing contamination of surface water and groundwater. A variance to the OHW setback and the well setback would be required in order to replace the existing_ septic system. The Applicant requests a setback of 33.5 feet from the OHW and a setback of approximately 45 feet from the proposed replacement well. Strict enforcement of the setback requirements would prevent construction of the sewage treatment system, and therefore prevent the sale of the property for residential use. Construction of a new sewage treatment system that meets Washington County Department of Public Health standards would better safeguard the environment than use of the current system. Nonconforming Structure The New Scandia Zoning Ordinance, Section 12, addresses nonconformities. The existing house is a nonconforming structure. The Ordinance allows repairs costing up to 50% of the appraised value to be made to nonconforming structures without a variance. Improvements worth more than 50% of the home's appraised value would require multiple variances in this case, such as lot size, buildable area, OHW and front yard setbacks, and maximum impervious surface requirements. Construction of a new structure on the subject property would also require variances. Therefore, future improvements to the existing house may not exceed 50% of its appraised value. Rodgers Variance Page 3 November 30, 2006 New Scandia Township The Applicant should understand that if the variance is granted, that it applies only to replacement of the sewage treatment system. The granting of a variance for the sewage treatment system does not imply the granting of any future variance requests, such as to construct a new home on the site or to make improvements to the existing structure worth more than 50% of the appraised value of the existing structure. Potential Title Issues The survey notes that there are potential title issues. The surveyor indicated that because the legal description includes "half of a Government Lot" the southern property line is ambiguous. However, the ambiguity results in a potential gap between the subject property and the neighboring property to the south - not an overlap and property line dispute. Also, the legal description includes "East of the Public Highway" which could be interpreted as east of the centerline or east of the edge of the right-of-way. The surveyor indicated that the Applicant is working with the title insurance company to resolve these issues. Because the variance request is for the sewage treatment system and not for changes close to the property line such as a fence, the planners find that consideration of the variance request would not need to wait for resolution of the potential title issues ACTION REQUESTED: The Planning Commission can recommend: 1. Approval 2. Approval with conditions 3. Denial with findings 4. We support updating old and failed septic systems with newer technologies that will reduce the impact of septic system discharge on the District's lakes. However, Bone Lake is listed by the Minnesota Pollution Control Agency as impaired by excess nutrients. We therefore encourage the Township to fully consider the siting and reliability of the proposed system and the potential for impacts to Bone Lake: 1. Questions to consider regarding alternate site locations: a. Has Washington County been approached for permission to locate the system in the Right of Way? b. Is it possible to purchase property from south neighbor for septic areas? 2. Request that the Township verify that Washington County would allow this type of system and the proposed variance. 3. Request Township Engineer to review manufacturers design data and performance data (not provided) to determine if system is suitable for proposed location and if system will remove nutrient loading currently impairing Bone Lake. 4. The minor subdivision would create three lots from an assemblage of 13 tax parcels. The property was previously platted as Vasa within the hamlet of Copas, causing the existing parcels to be a variety of shapes and sizes. Collectively they are 32.3 acres. The Applicant requests Parcel A of 8.2 acres (7.2 acres if excluding St. Croix Trail right-of-way), Parcel B of 3.8 acres, and Parcel C of 20.0 acres. Portions of Parcels A and C underlie the St. Croix Trail right-of-way. There is a remaining .3 acres which underlies St. Croix Trail that is proposed to be deeded to the Minnesota Department of Transportation. See Attachments 1 and 2. The Applicant also requests a variance to allow for Parcel A to be 8.2 acres. The New Scandia Zoning Ordinance Section 3.3 requires that lots in the Agriculture District must be 2.0 to 4.0 acres, or 20.0 acres or greater. The proposed subdivision puts all of the existing structures on Parcel C. The property is zoned Agriculture District and is outside of the Saint Croix River Management Overlay District. EVALUATION OF THE REQUEST: Density and Lot Size The request is for a minor subdivision using the lot averaging method. The Agriculture District allows a maximum density of 4 dwelling units per 40 acres, or one unit per 10 acres. The subject property is 31.3 acres and so the proposed 3 single-family lots are consistent witli the allowable density. The Zoning Ordinance requires that lots be 2 to 4 acres in size or 20 acres or greater. Parcel B is 3.8 acres and Parcel C is 20.0 acres and so they conform to the lot size requirement. Parcel A is 8.2 acres and the Applicant requests a variance for Parcel A's size. The Applicant indicates that strict enforcement of the parcel size requirement would result in an irregular residual parcel north of 199th Street. The density standard of one single family lot per 10 acres prevents creation of two smaller lots from the proposed Parcel A. Also, there is not adequate road frontage or buildable area to create two parcels in this area. There is not an alternative way to create the parcel without needing a variance or creating an unusable residual parcel. The unique location of the 8.2 acres, constrained by 199th Street and St. Croix Trail, creates the hardship in this case. Road Frontage Because their size is four acres or greater, Parcels A and C are required a minimum road frontage of 300 feet. Parcel A has approximately 596 feet of frontage on 199th Street and Parcel C has approximately 600 feet of frontage at the St. Croix Trail edge of the right-of-way. Because it is less than four acres, Parcel B must have a minimum of 240 feet of frontage. Parcel B has 296 feet of road frontage on 199th Street. The three parcels ineet the road frontage requirements. Right -of -Way St. Croix Trail right-of-way is dedicated as easement. A residual .3 acres of the Applicant's land is within the easement and is separated from the rest of Parcel C by the 199th Street (Market Street) right-of-way. The Applicant plans to dedicate the remnant of .3 acres to the Minnesota Department of Transportation (MnDOT). The land adjacent to the west and north of the remnant is already owned by MnDOT. The surveyor indicates that the subject property's deed does not include an easement for 199th Street right- of-way. The planners recommend that an easement 66 feet in width along the 199th Street centerline be dedicated to the Town. Andersen Minor Subdivision and Variance Page 3 December 1, 2006 New Scandia Township, Minnesota Setbacks Required setbacks are front yard setback of 40 feet, side yard setback of 20 feet, and rear yard setback of 50 feet. The minimum setback along St. Croix Trail, a Minor Arterial, is 150 feet from centerline or 75 feet from the right-of-way, whichever is greater. The required setback from the wetlands is 75 feet from the Ordinary High Water level or 20 feet from the delineation, whichever is greater. The site plan shows a setback of 73 feet from the centerline of 199th Street for Parcels A and B. This setback was drawn assuming a 66-foot right-of-way, or 33 feet from the centerline. The setback of 73 feet depicts 40 feet from the assumed edge of the right-of-way. The side yard setback of 20 feet is also shown. The 75-foot setback from the St. Croix Trail right-of-way is shown on Parcel A. The front yard setback requirement, side yard setback. acid Minor Arterial setback are inet on Parcels A and B No new structures are proposed for Parcel C and the Site Plan does not show the setbacks on this parcel. The existing house and the existing garage are located within the front yard and side yard setbacks, respectively. These structures are nonconforming as the property exists today and so are not affected by the requested minor subdivision. The setback requirements described above for side yard. front yard wetland and Minor Arterial also apply to Parcel C though not illustrated. Twenty -foot setbacks are shown along the edge of the delineated wetlands. The Washington Conservation District indicates that the 20-foot setback is appropriate for these temporarily flooded wetlands, Type 2 and Type 6. Adequate wetland setbacks are provided. The Washington Conservation District recommends that vegetative buffers be provided around the wetlands and offers to assist the property owner to plan the house and vard for minimum impact on wetlands. Buildable Land A minimum of one acre of buildable land is required for each parcel. The site plan reports 51,497 square feet, or 1.18 acres, for Parcel A and 67,672, or 1.55 acres, for Parcel B. Parcels A and B meet the buildable area minimum requirement. Buildable area is not calculated for Parcel C. Parcel C is 20.0 acres and approximately half of the parcel is wetland. The planners estimate that Parcel C has W-eater than one acre of buildable land Sewage Treatment Systems Parcels A and B show the soil test areas for the proposed sewage treatment systems. Permits for the two proposed sewage treatment systems must be received from the Wasliinp-ton County Department of Public Health and Environment. Driveway Location The site plan does not show the proposed driveways for Parcels A and B or the existing driveway for Parcel C. The Applicant indicates that the driveways for Parcels A and B will have access to 199th Street. Parcel C has an existing driveway with access to St. Croix Trail and the Applicant indicates that this driveway location would not change. The planners find that there are adequate site distances for the two new driveways located along the property's 199th Street road frontage. My participation was early in the planning stages. Since then, the plans have changed to now include the land north of 19911, Street. I revisited the site this morning to review the delineation line along the north parcel. Based on my two field reviews, and the report that was submitted, dated October 13, 2006, I would recommend New Scandia accept the wetland delineation as submitted and shown on the survey of November 28, 2006. I would also concur with the wetland type/classification as described in the delineation report. The 20' setback provided on the survey plan is consistent with the current Washington County ordinances. There may be a permanently or semi -permanently flooded area in Wetland 1, however the non -flooded fringe area is greater than 75' wide. The stream corridor present on Parcels B and C is identified as Swedish Flag Creek in the Upper St. Croix River Spring Creek Study of 2003, but not listed as a DNR Protected Waters. The Spring Creek Study identified significant natural features within this general area, and recommended the maintenance and improvement of streamside buffers, preservation of in -stream woody debris, and protection from road run-off. Our office would be happy to work with the Township, Watershed District, or prospective landowners to implement the management recommendations. It should also be noted that both Parcels A and B are within areas mapped as being Faxon silt loam, a hydric soil. This soil map unit is characterized as having a shallow depth to bedrock and frequently are subject to shallow sub -surface water flows. But if the surface soil layer is thick enough to raise the root zone above the saturated soil, non -wetland conditions will develop. Much of the wetland delineation was decided based on the dominance of hydrophytic vegetation. Feel free to call if you have questions about this memo, or if you need more information. I am assuming that they are interested in subdividing for the purpose of building on those three parcels. My question is whether or not those subdivisions will be build -able land. Some of the land in this area is very swampy. I would not favor a subdivision if it meant the need to configure the land, that is filling in the land, for building. A more general concern of mine is that the town should abide by its land use and acreage requirements. Property owners should know when they purchase land what those requirements are and should not have to make requests for variances unless there is some undue hardship.
