A meeting of the Scandia Wastewater Advisory Committee was held on the above
date. The meeting was called to order by Vice Chair Jim Schneider at 7:07 p.m. In
attendance were: Daniel Cartier, Holly Kaufhold, Brad Bergo, Council member Jim
Schneider, Staff Kristina Handt, Tim Keiffer, Colleen Firkus, Engineer Phil Gravel.
Members absent were James Malmquist, Wayne Schmidt, Mike Peterson, Doug
Salmela, Councilmember/Chair Chris Ness, and Planning Commissioner Steven
Philippi, which resulted in no quorum. A discussion of issues followed.
Council member Schneider reviewed the minutes from the previous meeting, asking
for additions or corrections. There were none.
"201" Community Wastewater Se s�
Draft Bud�et- The proposed 2013 budget was presented by Treasurer Firkus as
well as cash balance projections for 2012 and 2013. Cartier questioned the need to
have $5,500.00 as depreciation. It was explained that the $5,500.00 was actually to
build up the replacement fund. A replacement fund is required as a condition of the
"201" grant used to build the system. The city has also been warned by the State
Auditor's office about the insufficiency of its replacement fund. Cartier suggested
changing the wording from "Depreciation" to "Contingency Replacement" for the
$5,500 line item as the auditors already depreciate the system by $30,000 annually.
Staff also recommended a rate increase of 5%, or $32.04. The new total rate would
be $690.76 annually or $172.69 quarterly. Rates have been level since 2009. The
cash balance of the "201" fund is projected to decrease this year due to the
engineering study and upgrades to the system.A rate increase is necessary to
recover those costs and continue to add to the contingency/replacement fund.
Committee members were in agreement with recommending a 5% rate increase,
except for Cartier who strongly objected, stating that the $5,500 "Contingency
Replacement" expense was sufficient being 9% of expenditures.
Anderson-Erickson Collector Se s�em
Engineer Gravel presented the monitoring report for this system. His
recommendation was to continue testing before allowing any new connections. The
two samples taken were so different (nitrates high in March and low in July); further
testing is needed to see if the March reading was an anomaly. Mr. Christensen,
attorney for Continenzas, asked what happens if additional testing shows high
nitrates. Gravel said we would have to pre-treat to get the levels down. Gravel also
stated that even if the system could handle additional flow with new connections,
extra nitrates could push the system over its limit. Another sample will be done in
October and then another round next year. Gravel said a policy needs to be
developed to deal with requests for connections. Those present had a consensus to

accept the engineer's recommendation for more testing before allowing new
connections and to work on a policy at the next committee meeting.
Bliss Collector System
There were no questions about the Operating Agreement with EcoCheck/Natural
System Utilities. EcoCheck will take over as operator effective December 1, 2012 for
two years, and the city's contract with Washington County will terminate at the end
of the year. Cost is $6,660.00 per year, subject to adjustments for inflation.
Untown Wastewater System
The City Council awarded the bid for the Uptown Wastewater Improvement Project
to Septic Check in the amount of$138,683.25 at their August 21, 2012 meeting.
Engineer Brian Malm reported at that meeting that he hopes to reduce the cost by
approximately $13,750 by making some changes to the plan. The work is to be
coordinated with Washington County's curb and gutter work on Olinda Trail.
Future Meeting Date / Agenda
The next meeting is scheduled for November 1, at 7:00 p.m. Items to be discussed
will be: 1) adequacy of current connection fee of$4,250.00, 2) identify the number
of potential connections for Bliss &A-F., systems, 3) policy to handle connection
requests, and 4) the Uptown Sewer ordinance and rates.

At the last meeting, the members discussed the need to develop a connection policy for new sewer
hook ups. Phil Gravel has prepared a list of questions/points of discuss for the committee to review
and answer to help staff develop a policy. Phil's letter is attached.
Also attached are some maps showing which properties are currently connected and also which
properties are believed to be seasonal. The committee previously reviewed this information at the
first meeting so this is just a refresher to help give direction in the drafting of the new policy.

Dear Kristina;
At the last Wastewater Advisory Committee Meeting the group discussed the need to develap some criteria
and a policy fior determining when to allow additional connections to ihe Anderson-Erickson Wastewater
System. A policy for determining how connection requests will be evaluated should be estab(ished given that
there is a limited amount of available capaciiy in the sysfem. Some people who were around when the
original system was construction have said that one reason for the original system was to provide a service
for properties that had no other feasible alternative for wastewater treatment.
We have prepared some discussion items on that topic based on knowledge of the area and a review of
prgvious information. The items below are some of the issues that should be discussed as part of the
process of developing a connection policy.
1. Service Area. We should establish an ultimate service area. This has essentially been done by
previous studies. At this time we can review the parcel map and canfirm an ultimate service area.
2. Parcel size. One criterion that could be established would be that a parcel must not have space for
an individual onsite system. This criteria can be established by referencing existing County
requirements for siting onsite sewage treatment systems.
3. Multiple lots and one�wner. There are several dwellings in the service area where there is one
house and 2 or 3 parcels (lots). We should have a discussion on how we would handle possible
additional homes build in these areas. It's possible that exisiing shoreline criteria would prohibit any
new homes, but we should clarify that.
4. Flow limits. We could conside�taking steps to limit the flow from any future connections. For
example,we could set a maximum allowable flow and require meters on new homes. Similarly, a
limit on#he size of structures or the number of bedrooms could be considered.
5. Other. We can discuss other possible connection criteria too.
We suggest that the Wastewater Advisory Committee discuss the items above at the November 1s`mee#ing.
The informaiion from that discussion can be used to draft a policy. For reference purposes, we can use the
previously distributed maps of the area.
Eventually we should be able to accurately estimate the number of ultimate tuture connectians and the
ultimate design flow(under 10,000 gpd?). The ultimate flaw information will be used to develop a future
expansion program that can be used to evaluate funding optior�s and set charges/connection fees. The goal
should be to get to this point by early 2013.

The Wastewater Advisory Committee first reviewed a draft of the ordinance for the Uptown
System at the July 2012 meeting.
Changes were made to the draft following the comments received at the July meeting.
• Page 4, Section 8B: language has been added to clarify the"maintenance, repair and
operation of the Private Portion of the system" for which the users are responsible.
• Page 5, Section 8I: a table has been added to show the volume of wastewater allocated to
each user, to clarify the limits on their discharge. This gives the city a tool to work with
users who generate"extra"volume to the system to work with them to reduce their flows.
It also says that the city can change the table/allocation of flow so long as the total
volume stays within the system's limits.
• Page 5, Section 9E: changes the limits on the discharge of fats, wax grease or oils from
100 mg/1 to 50 mg/1. This limit is consistent with state standards. We have elevated FOG
in the system (sampling data showed 83mg/1 at the drainfield tanks and 76 mg/1 in the
Uptown tank; and this is causing problems. The city will need to work with the users to
get this level down. Possible corrective action could include installing grease traps where
there currently are not any and ensuring those installed are properly maintained.

ordinance as allowed by and in accordance with Minnesota Statutes. Such ordinailce
shall be kept on file and ope��to inspection in the office of the City Clerk and shall be �
uniformly enforced.
B. Bills shal]be mailed for each account on or before the fifth day of each month and
specify the charges in accordance���ith the cun-ent schedule of user charges and fees.
All charges shall be due upon receiE�t a��d considered�delinquent after the fifth day of

All costs and expense incident to the installation and connection of the building sewer
shall be borne by the User. New Users connecting to the system shall pay to the City
a sewer connection fee to be determined by the City Council at the time the
connection is made.

SECTION 8. MAINTENANCE AND OPERATION OF THE SYSTEM.
A. Subject to any assessment or other right to seek reimbursement from benefitted
properties or Owners,the City shall bear the expense for the maintenance,repair and
operation of the Public Portion of the System. Users and Owners shall allow access
to the Public Portion of the System on their property.

the User fails to provide needed maintenance or repairs,the City may make the repair
and bill it to the User. If the User fails to pay such charge within 60 days of the date

alterations,and/or application for a plumbing or mechanical permit for a property
served by the UWTS shall be reviewed by the City for its potential impact on the
UWTS. No zoning permit ar building permit shall be issued if it is found by the City
to create the potential for the design flow of the UWTS to be exceeded.
SECTION 9. PROHIBITED WASTE DISCHARGES.
A. No User shall make or maintain connection of roof downspouts,exterior foundation
drains,surface runoff or groundwater to a building sewer or indirectly into the
UWTS.
B. No User shall discharge into the UWTS any incompatible waste,defined as waste that
either singly by interaction with other wastes interferes with any waste treatment
process,constitutes a hazard to humans or animals,creates a public nuisance,or
creates a hazard in the treatment system.
C. No User shall discharge any garbage or food waste,nor shall a garbage grinder or
garbage disposal be installed in any premises served by the UWTS.
D. No User shall discharge into the UWTS any solid or viscous substances in quantities
of or such size capable of causing obstruction to the flow in sewers or other
interference with the proper operation of the treatment system.
E. No User shall discharge any water or waste containing fats,wax,grease or oils,
I whether emulsified or not,in excess of mg/I or containing substances which
may solidify or become viscous at temperatures between 32 degrees and 150 degrees
F(0 and 65 degrees C).

SECTION 10. COST OF REPAIRS.
In addition to any penalties that may be imposed for violation of any provision of this
Ordinance,the City may assess against any User the cost of repairing or restaring sewers or
associated facilities damaged as a result of actions by any user, including discharge of excessive
flows or prohibited wastes.and may collect such assessment as an additional charge for the use
of the system in the manner provided in Section 6 or may pursue any other method of collection
of the costs it deems appropriate.
SECTION ll. SEVERABILITY. �
If any provision of this Ordinance is found to be invali�l for any reason by a court of
competent jurisdiction,the validity of the remaining provisions shall not be affected.
SECTION 12. ADMINISTRATION AND ENFORCEMEN7'.
A. The City Administrator shall be responsible for administration and enforcement of the
Ordinance, and the collection of the User charges as set forth in this Ordinance. The
City Cowlcil shall hear and decide appeals and review any order, decision or
determination made by the Administrator regarding the cnforcement of this
Ordinance.
B. The City hereby establishes an Uptown Wastewater Treatment System Fund into
which all revenue collected fi-om users sl�all be deposited,and from which all
expenditures necessaiy for the operation and maintenance of the system shail be paid.
G Any person who ��iolates any provision of this Ordinance shall be guilty of a
misdemeanor,and upon calviction thereof.the violator shall be subject to a fine,
imprisonment or both,plus the cost ofprosecution.
D. The City reserves the right to disconneet service to any User or property found to be
in violation of this Ordinance. Service shall not be disconnected until notice and an
opportunity for a hearing before the City Council have been provided to the User and
to the Owner of the premises involved.

Anv ordinance or provision of an ordinance heretofare existing pertaining to the subjects

Background:
Under the current structure, users are billed annually(in August of each year) for usage on the
Uptown Sewer System. Expenses were allocated based solely on water usage. Annual rates for
each user in 2012 and 2011 are included on the attached spreadsheets.
Costs varied greatly over the years not only because of the maintenance style of Washington
County, whom the City previously contracted with,but also because of Council decisions
regarding when and how much general property tax dollars would be used to cover some
expenses. Below is a chart outlining the general fund dollars contributed to the Uptown budget
over the last five years.

Issue:
What should rates be set at for the Uptown Sewer System?
Proposal Details:
Attached are a number of proposals with varying debt amounts and terms added to the
operational costs of running the system for 2013. I've used an estimate of$155,000 for the
Uptown Sewer System Improvement Project,however all of the costs have not been finalized.
In addition to the contract for $124,943.25 with Septic Check there will also be legal,
engineering, utility, and other supply expenses related to the project.
Each sheet corresponds to a specific interest rate for the loan either 0%, 2% or 4%. The top half
of the sheet shows the rates if the entire cost of the Uptown Wastewater Improvement Project
was passed onto the users and paid back to the City's Capital Improvement Fund over a period of
ten years. The bottom half of the sheet shows the rates if the City were to forgive $77,500 of the
loan and the users only had to pay back $77,500 to the City's Capital Improvement Fund over 10
years.
The rates include a base rate and a volume rate. The rates are structured so that the base rate
covers the fixed costs associated with the system such as operating supplies, engineering, legal,
contractual permit fees, insurance, the base contract rate with EcoCheck, and staff time for
billing and regular maintenance. The volume charge covers those costs which are related to the
amount of usage such as pumping, utilities, machinery and equipment repair, and misc.
contractual (i.e. emergency calls, items beyond EcoCheck's base rate, etc).
Staff is recommending that half of the loan for the Uptown Wastewater Improvement Project be
forgiven. While the long term goal is to make this fund self-supporting from user fees, one
should not expect that to happen immediately particularly given the history of tax revenue
contributions. For example, if the City continued to contribute the average of$13,650 each year
for the next six years that would amount to more than the $77,500 being forgiven.
Fiscal Impact:
While the new rate structure impacts individual users to differing degrees, this proposal should
result in the Uptown System becoming self sufficient,barring any large unplanned expenses.
This would minimize the need in the future to budget from the general tax levy to subsidize this
service. The proposed 2013 general fund budget does NOT include any allocation of property
tax revenues.
The Capital Improvement Fund balance is projected to be at $279,277 by the end of 2013.
Forgiving $77,500 will reduce the fund to $201,777. Expenditures from the capital improvement
fund are $120,500 in 2014 and $333,333 in 2015.
Options:
1) Recommend approval of one of the options provided
2) Direct staff to structure the rates in some alternative format
Recommendation:
Staff recommends the Wastewater Advisory Committee recommend the prepared Ordinance No.
XXX to the Council for adoption. This would cover the cost of operations in 2013 and provide a
debt payment sufficient enough to repay$77,500 back to the City's Capital Improvement Fund
at 0%interest over 10 years.

AN ORDINANCE ESTABLISHING USER CHARGES AND CONNECTION FEES FOR
THE UPTOWN WASTEWATER TREATMENT SYSTEM
The City Council of the City of Scandia, Washington County, Minnesota hereby ordains:
Section 1. ESTABLISHMENT OF USER CHARGES. User charges and fees far the Uptown
Wastewater Treatment System shall be as follows:
Fee
(A) Base charge: $114.18/month
(B) Volume charge: $23.05/1,000 gallons
(C) Late payment fee: $10.00
(D) Annual interest rate on account balances 30 days 12%
past due:
(E) Annual interest rate on delinquent accounts certified 12%
for collection with property taxes:
(F) Connection fee,per dwelling unit: $4,250.00
Section 2. EFFECTIVE DATE. This ordinance shall be in full force and effect on January 1,
2013, after publication according to law.

Re: 2013 Draft Budget for Uptown Sewer System
Agenda Item#: 4.c)
A copy of the proposed expense budget for the Uptown System for 2013 is attached. Operating
expenses are projected to be appro�mately$18,000 for 2013. Utilities will increase because of the
recent improvements to the system. Transfers to the General Fund will increase because more
routine items will be completed by the public warks staff. However, this budget overall is a
significant decrease from previous years' expenses which ranged from the mid-$20,OOOs to the mid-
$30,000 depending upon the year. Debt service assumes 0% interest on a 10 year loan of$77,500
from the Capital Improvement Fund.
The revenues assume the adoptions of the rate structure recommended by staff on the previous
agenda item are adopted. This would require 50% loan forgiveness, 0% interest and a 10 year
payback to the Capital Improvement Fund.
If both expenses and revenues performed to budget the fund could begin building a reserve account
equal to about 10% of overall expenses.
