Re: Parking Ordinance
Background: One of the issues discussed during the review of the Gacek Interim Use Permit
was the proposed condition that there be no parking on Meadowbrook Ave. N on the north
side of Scandia Trail (STH 97). In the past the City Council has designated certain areas "No
Parking" by resolution and presumably similar action was taken by the Township Board.
The League of Minnesota Cities provides the following guidance regarding using an ordinance
versus a resolution:
Any council enactment that regulates people or property and provides a penalty if
violated should be adopted in the form of an ordinance. As a result, the council must
pass, in ordinance form, all police regulations for public health, morals, economic well-
being, welfare, and safety. Ordinance regulations should be of general application
within the city, and of a permanent and continuing nature.
Based on this guidance, a draft of an amendment to the existing parking ordinance follows this
report. The draft lists the areas that have previously been designated as "No Parking" within
the City.
The draft is provided for review and comment in advance of the November 15 City Council
meeting. The changes to the current ordinance are underlined.
