Hofer, Consultant City Planner Frannie Nielsen, Consultant Planner Re: Conditional Use Permit for Solar System at 12240 238th St N Applicant: Chloe Kirks Zoning: RR-G and S-MO Owner: Eric Douglas Future Land Use: General Rural Location: PID: 0403220220003, 12240 238th St N, Scandia, MN 55073 Review Deadline November 3, 2024 The applicant is requesting a Conditional Use Permit (CUP) to allow for an existing ground- mounted solar energy system – local service (LOCAL SES) to cover approximately 984 sq. ft. of land where 800 sq. ft. is permitted by-right. BACKGROUND The property is approximately 10.78 acres along 238th Street N near Bone Lake and has an existing single-family home. The property is zoned as Rural Residential – General (RR-G) and is within the Shoreland Management Overlay District (SM-O) and is guided as General Rural. The Local SES has already been constructed at the time of staff inspection on September 20th, 2024. Additionally, a second access exists on the property, located closer to the western property line. A Conditional Use Permit and meeting conditions of approval will bring the Local SES into compliance. 2 | P a g e The Unified Development Code (UDC) Section 153.300.030 (AA) details requirements for Local SES that are accessory to a primary use and provide power predominantly to said use. Subsection IV. A. permits a ground-mounted Local SES to cover 800 sq. ft. by-right and requires a CUP for an Local SES larger than 800 sq. ft. Subsection IV.E requires additional screening from public right-of-way for ground-mounted Local SES that require a CUP. Screening may be accomplished by using setbacks, berming, existing vegetation, landscaping, or a combination thereof. EVALUATION OF REQUEST Conditional Use Permit Chapter 153.500.060 Subd. 1(C)(I) of the UDC lists the general standards to meet to grant a CUP or IUP. Below these standards are repeated in italics, with the staff’s findings following: 1. The proposed use will be in compliance with and shall not have a negative effect upon the Comprehensive Plan, including public facilities and capital improvement plans. Objectives of the Comprehensive Plan include promoting the use of renewable energy systems on housing and in areas where such systems can be safely operated and produce a minimum level of visual impact. The Local SES is a permitted accessory use within the RR-G district and helps obtain the objectives of the Comprehensive Plan. Approximate Local SES Area Second Access 3 | P a g e 2. The establishment, maintenance or operation of the proposed use will promote and enhance the general public welfare and will not be detrimental to or endanger the public health, safety, morals or comfort. The size of the proposed accessory use is permitted within this zoning district through a conditional use permit. The proposed Local SES adds to the use of the property as a single-family home, will promote and enhance the general public welfare, and will not be detrimental to or endanger the public health, safety, morals, or comfort. Reasonable conditions of approval can be added if the City Council finds issues with the proposed SES. 3. The proposed use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values or scenic views. The accessory Local SES use and size will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values or scenic views. The proposed system exceeds setbacks from adjacent properties and is setback over 400 feet from 238th Street N, exceeding the required front yard setback. 4. The establishment of the proposed use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. The proposed Local SES size and impact will not impede development or improvement of surrounding properties. 5. Adequate public facilities and services are available or can be reasonably provided to accommodate the use which is proposed. The proposed Local SES use will use existing public facilities and services and is not anticipated to substantially increase their use, cause undue wear, or cause any detriment atypical of a rural residential property. 6. The proposed use shall conform to the applicable regulations of the district in which it is located and all other applicable standards of this Chapter. The proposed use is consistent with the applicable regulations of the RR-G District and is consistent with the requirements of the UDC. Any future changes of the Local SES will be required to conform with the applicable regulations of the district and the Conditional Use Permit must be amended to allow for the change. Reasonable conditions of approval can be added if the City Council finds issues with the proposed use in relation to buffering and glare. 4 | P a g e 7. The proposed use complies with the general and specific performance standards as specified by this Section and this Chapter. The application is generally consistent with the performance standards established in the Unified Development Code for the proposed Local SES. Where the application is not consistent, conditions have been included the inconsistencies. The Local SES should be screened from view from the public right-of-way. Screening the Local SES shall be a condition of approval. The Planning Commission should discuss the lack of screening from the second access and determine if additional screening is needed. Shoreland Management Overlay District The Shoreland Ordinance Section 3.5 details additional Conditional Use Permit evaluation criteria for properties in the Shoreland Management Overlay District. Below these standards are repeated in italics, with the staff’s findings following: 1. The prevention of soil erosion or other possible pollution of public waters, both during and after construction. The applicant shall follow construction best management practices and shall be responsible for erosion control during and after construction. 2. The potential to reduce impervious surface area. Local SESs are excluded from the lot coverage requirements if the area under the SES is permanently vegetated. Although the applicant has not provided vegetation information, the current and proposed site regardless of vegetation is below the 25% impervious surface maximum coverage limit. 3. The visibility of structures and other facilities as viewed from public waters is limited. If visible from public waters, screening of the Local SES shall be a condition of approval. 4. There is adequate water supply and on-site sewage treatment. The Local SES will not impact water supply or on-site sewage treatment. 5. The types, uses, and numbers of watercraft that the project will generate are compatible in relation to the suitability of public waters to safely accommodate these watercraft. The Local SES will not impact the types, uses, or numbers of watercrafts. 5 | P a g e ANALYSIS Review Comments The submittal was sent to city staff and other regulatory agencies for review and comment. Carnelian-Marine-St. Croix Watershed District The Carnelian-Marine-St. Croix Watershed District provided no comment. Department of Natural Resources The DNR Area Hydrologist provided no comment. Engineering Department The City Engineer had no comment. Fire Department The Fire Chief had no comment. Public Works Department The Public Works Director had no comment. Staff Analysis Staff finds that the proposed plan is generally consistent with the Comprehensive Plan and UDC. Staff believes that the proposal for the Local SES is generally in compliance with the requirements outlined within the UDC. The use is consistent with the future land use shown in the 2040 Comprehensive Plan and the proposed use meets the definition of the RR-G zoning district. The Unified Development Code (UDC) Section 153.300.030 (AA) IV (e) indicates Local SESs must be screened from view from the public right of way if the Local SES requires a Conditional Use Permit, and Chapter 5 Shoreland & Wetland Management Regulations Section 3.5 indicates the view of structures from public water should be limited. The property appears to be lined with trees and shrubs along 238th Street North except for a gap located towards the west of the project that appears to serve as a second access. A condition of approval shall include the applicant submitting a landscape plan to ensure current and future screening compliance. Staff has reviewed the plan for consistency with the standards outlined for Conditional Use Permits and believes the request meets or exceeds UDC criteria with the recommended conditions of approval. 6 | P a g e COMMISSION ACTION The Planning Commission can do one of the following: 1. Recommend approval, with or without conditions, of the attached resolution. 2. Recommend denial, with findings, of the attached resolution. 3. Table the request for further review/study. Staff recommends that the Planning Commission recommend approval of the request for Conditional Use Permit for a ground-mounted, Local SES exceeding 800 sq. ft. Approval includes a resolution. The above findings and following conditions of approval are recommended: 1. The proposed structure shall not have a footprint exceeding 984 square feet in size, as shown on the plan submitted to the City and reviewed with this request. 2. Before a building permit is issued, the applicant shall submit a plan showing the Local SES screened from public right of way view and from public water view. 3. The applicant shall be responsible for erosion control upon construction completion. 4. If trucking operations to bring in equipment or materials damage any roadway, the applicant shall be responsible to repair the roadway to same or better conditions. 5. The proposed array and accessory equipment shall been in substantial compliance to the proposed setbacks, as shown on the site plan submitted to the City and reviewed with this request. 6. The applicant shall comply with all applicable local, state, and federal permits and requirements for the new development on the parcel. 7. The City may revoke the Conditional Use Permit for the site if all permits and required work to comply with approvals from other local, state, and federal permits is not completed. 8. The applicant shall obtain all necessary permits prior to work on the site. 9. The applicant shall pay all fees and escrow costs related to the application. 7 | P a g e RECOMMENDATION Staff recommends the Planning Commission: Motion to recommend approval of the attached resolution to approve a Conditional Use Permit to allow for a ground-mounted, Local SES to cover approximately 984 square feet, with conditions as described by staff within the staff report. Submitted Plans CITY OF SCANDIA, MINNESOTA RESOLUTION NO. 10-15-24-XX APPROVING CONDITIONAL USE PERMIT FOR 0403220220003 LOCATED AT 12240 238th STREET NORTH WHEREAS, Chloe Kirks (the “applicant”) made an application on behalf of Eric Douglas (the “owner”) for a Conditional Use Permit to allow for a Local SES to be larger in square footage of footprint than permitted by-right, located at 12240 238th Street North and the property legally described as follows: Lot 1, Block 1, BONNYVIEW; and WHEREAS, the Unified Development Code 153.300.030 (AA) allows as an accessory use ground mounted Local Solar Energy Systems up to 800 square feet by right and requires a Conditional Use Permit for ground mounted Local Solar Energy Systems larger than 800 square feet; and WHEREAS, the Planning Commission reviewed the request for the Conditional Use Permit (CUP) at a duly noticed Public Hearing on October 1, 2024, and recommended that the City Council approve the CUP, with conditions; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it approves of a Conditional Use Permit to allow for a 984 square foot Local Solar Energy System, located at 12240 238th Street North, based on the following findings: 1.
