Subject: Carrie Mitchell’s Concerns about the Building Official
Background:
Carrie Mitchell, 14192 209th St N, has asked to address the Council regarding the letter and report
she distributed at the September 17, 2024 Council meeting. I have attached the letter, report, and
update she provided on October 2 for your review. As the letter states, she has concerns over the
actions of the Building Official, who works for the City on contract and is an employee of the City
of Hugo. After the September meeting, I forwarded Carrie’s letter to the City’s insurance carrier at
our City Attorney's recommendation. They have opened a claim and are in contact with Carrie.
Carrie wishes to address the Council to know what the City is doing about this issue. I told her the
City is not doing anything at this time because the Council has not been made aware of the issue and
has not directed staff to take action.

Dear Scandia City Council,
I am writing to provide an update on my letter to you dated September 17 th, 2024:
This week I have been in communication with the Minnesota Department of Labor and Industry
on this matter and learned the following:
This is a matter of Building Offical procedure and policy errors in 2018 and 2024 vs.
malicious intent.
Because this is a matter of Building Official errors, DOLI will not receive a complaint.
The city’s inspection procedure and policy requirements for roof and wall cladding, door
and window installation are lacking.
Virtual video concept inspection requirements that demonstrate manufacturer instructions
are completed should be required to verify code compliance.
The city is responsible for this work and has the means to and has taken steps to make
this right as an errors and omissions to address the repairs, correct the damage to my
home, and bring the home back to code compliance.
