Structures Ordinance

The Planning Commission will hold a public hearing on amendments to several ordinances that
govern accessory structures, exterior storage and parking at its January meeting. Staff have
updated the amendments based on the discussion at the December Planning Commission
meeting. The changes include:
• Keep the City's current definition of impervious surface (potential change removed from
amendments for the hearing)
• Add a definition for "motor vehicle"
• Edit the Vehicle, Abandoned definition to include "one or more of the following" and
specify "motor" vehicle in the definition and throughout the amended ordinance
• Include the Hugo definition of Large Recreational Vehicle (LRV) in the draft for the
hearing
• Include the revised versions of the "yard" definitions in the draft ordinance
• Add a statement that the Zoning Administrator may require screening of accessory
structures on small parcels that are placed between the primary building and the
roadway "if needed to protect views from adjacent properties or public roadways."
• Change the parcel sizes for storage of LRV's to one-half acre (0.5 acres) or less in area,
and larger than one-half (0.5 acres) in area, and eliminate the screening requirement on
the larger parcels that was included in the previous draft
• Specify that the time period for parking licensed vehicles outside on residential or
agricultural properties shall be up to 72 hours
Since the Accessory Structures section of the Development Code is included in these updates,
staff have also included the update for the garage exception discussed at the December
meeting in this amendment. The note below the accessory structure table has been modified to
state that the exception applies as follows:
If the property has no attached garage
An employee owned company promoting affirmative action and equal opportunity

• The square footage of the detached garage may not be added to the total square
footage of accessory structures permitted on the property
• The property owner must demonstrate that there is adequate space for a primary and
back-up septic drainfield location that meets the ordinance requirement
• Update the Accessory Structures ordinance to cross-reference Accessory Dwelling Units
in Item 3(A)
Neil requested that the Planning Commission discuss several items that are included in the
current storage and parking ordinances that are not usually enforced, to determine if these
items should stay in ordinance or be modified. The items include:
• Section 4 Amendment, Item (4) Off Street Parking for Residential and Agricultural Uses,
(C) Vacant Lots
• Section 5 Amendment, Item (1) (E) Parking of commercial vehicles
• Section 5 Amendment, Item (3) (A) 1 — Residential parking on same lot as principal use
Please review the changes and the highlighted items for discussion at the meeting on January
3.
