Careful, thoughtful and long term planning is critical to maintaining the incredible community we enjoy. Assuring compliance with the City's Comprehensive Plan and Development Code is important. My legal skills could help support the planning commission’s work. In terms of conservation, I have been a member of the Garden Club of America and the Saint Paul Garden Club’s Conservation Committee which educates membership on best practices to restore and protect natural resources and encourages environmental stewardship within our communities. I have also worked with the DNR on a number of projects relating to invasive species. In what volunteer activities have you participated? What was your role? I am a volunteer member of the Governing Council for the American Bar Association’s Dispute Resolution Section and the past co-chair of the ABA’s Early Dispute Resolution Committee. The ABA’s Section of Dispute Resolution is a global thought leader in the dispute resolution field. We advance and promote fair, prompt, and cost-effective dispute resolution, we facilitate and support innovative research and collaboration on policy and practices, and we unite everyone in the field to network and grow their skillset. Substantive areas of law litigated include commercial transactions, mergers and acquisitions, intellectual property, business torts, environmental law, multi-jurisdictional product liability, insurance, class actions, securities litigation, technology matters, real estate and construction law. In addition to providing strategic leadership and substantive expertise across a wide variety of disputed matters, worked extensively with 3M’s compliance function and oversaw direct outreach to federal and state regulators, NGOs, and other company stakeholders as well as managing the company’s reputational exposure. Some of the more notable cases taken through trial include: ▪ Led the 3M team in a $75 million breach of contract and environmental matter in the High Court of Justice in London. Three weeks into the trial, plaintiff dismissed all claims and made a substantial contribution to 3M’s legal costs. ▪ Led the 3M team in a $200 million breach of contract and fraud matter in the Southern District of New York. The claims arose out 3M’s sale of its European pharmaceutical business. After a two-week trial the court ruled entirely in 3M’s favor. ▪ Led the 3M team in a $25 million breach of a royalty agreement claim related to 3M’s purchase of a dental products company. The arbitrator ruled entirely in 3M’s favor. ▪ Led the 3M team in a $50 million breach of an acquisition agreement claim in the High Court of Justice in London. After a three-week trial, the High Court ruled in favor of 3M on every important issue. Faegre & Benson LLP (now Faegre Drinker Biddle & Reath LLP), Minneapolis, MN Partner 1989–2011 Trial lawyer with extensive experience in a broad range of complex commercial litigation, including general contract and business torts, environmental law, product liability, insurance, intellectual property, real estate and construction, mergers and acquisitions, new technology, class actions and securities litigation. Representative cases tried through verdict: ▪ Counsel for Seagate Technology in a patent case brought by Siemens accusing Seagate hard disc drives of infringing Siemens’ patented GMR sensor technology. Following a six- week jury trial in the Central District of California, the jury returned a complete defense verdict for Seagate. The trial was covered by IP Law360, Bloomberg and other news organizations. ▪ Counsel for Wyeth in a trade secret trial involving a billion-dollar product. The court granted Wyeth a permanent injunction prohibiting the defendant from developing the first generic version of a leading hormone replacement therapy drug. ▪ Counsel for Ramsey County where plaintiffs sought $20 million in tort claims. The jury returned a complete defense verdict for Ramsey County. ▪ Counsel for plaintiffs in a multi-party construction industry contract dispute. After a four- week trial, plaintiffs were awarded damages, and attorneys’ fees. - 3 - ▪ Counsel for Compellent Technology in a two-week arbitration in Colorado. All trade secret misappropriation and intentional tort claims were defeated. ▪ Counsel for a real estate developer in a complex commercial lending case. Following an evidentiary hearing, the court awarded a TRO and preliminary injunction against Heller Financial in the Northern District of Illinois. PRO BONO ▪ Founded and led (with others) Faegre & Benson’s Housing Court Team, which provided pro bono representation to low-income clients in eviction, repair and habitability cases. ▪ Founded and led (with others) Faegre & Benson’s Justice for Kids program, which provided pro bono representation to guardians ad litem for juveniles in detention and foster care. ▪ Represented Project 504, a Minneapolis neighborhood tenants’ organization, in a tenant remedies action against the owner of a 26-unit apartment building, which had extensive uncorrected serious housing code violations. Secured a court-appointed administrator to make the repairs with the repair costs ordered to be assessed against the property. ▪ Worked with the Family Housing Fund in bringing together NGOs, the cities of Minneapolis and St. Paul and other stakeholders to institutionalize the use of the tenant remedy statute to preserve inner-city housing on a much larger scale. ▪ Led a high-profile, first-of-its-kind lawsuit in a case for the City of Minneapolis and several neighborhood groups against an entity that had engaged in massive mortgage fraud in North Minneapolis. The court (Judge Blaeser) appointed a receiver to take over and manage 175 vacant and abandoned homes. The case was resolved by getting the financial institutions that held the mortgages to sell, for pennies on the dollar, the foreclosed homes to the Greater Metropolitan Housing Corp., which then repaired the properties and made them affordable for low-income families in the community. ▪ Counsel for Plymouth Church Neighborhood Foundation in an action opposing the Foundation’s effort to turn an abandoned nursing home into Lydia House, 40 apartments for homeless people disabled by mental illness, addiction or HIV. The court (Judge McShane) ruled that the City of Minneapolis’ spacing ordinance was discriminatory and that the City was required to waive the ordinance as a reasonable and necessary accommodation under the Federal Fair Housing Act. The case was affirmed on appeal. ▪ Counsel for the Jeremiah Program, a non-profit providing supportive housing to low-income women and children. The Program was sued to prevent its expansion to St. Paul. The court (Judge Higgs) dismissed the case with prejudice and construction was allowed to proceed. ▪ Provided representation for low-income people in family law matters, including two divorce trials. ▪ Counsel for a death row inmate in Alabama. Lead trial lawyer in a two-week Ala. R. Crim.
