7.b iv Staff Report-Variance extension Staff Report Date of Meeting: January 17, 2017 To: City Council From: Neil Soltis, Administrator Re: Variance extension – 19107 Layton Ave. Background: At the Planning Commission meeting David and Tia Schlundt requested consideration of extending the deadline for the use of a variance to construct a new home at 19107 Layton Ave. The Schlundts recently newly purchased the lot. A variance had previously been granted to the previous owners (Crane). The Planning Commission recommended a one-year extension of the variance in order to allow them time to finalize their building plans. Issue: Should the expiration date for the variance be extended? Proposal Details: The initial variance was approved in 2013, administratively extended to 2015, and extended again by the Council to March 2017. The variance will be expire in March 2017 unless the variance is in use. They plan to submit a building permit in the next few months that would meet the conditions of the variance, but due to the season, are unable to use the variance before the date on which it expires. Fiscal Impact: None Options: 1. Approve the 1-year variance extension based on the {Planning Commission recommendation 2. Deny the variance extension Recommendation: Option 1. The previous owner took no action to use the variance. Extending the expiration date will allow the current owners to construct a new home that meets the terms of the variance without going through the time and expense to go through the variance approval process.
