Hofer, Consultant City Planner Re: Conditional Use Permit for Northern Natural Gas Odorizer Station Applicant: Joe Hansmann Innovative Building & Design Zoning: Rural Residential General (RR- G) Owner: Emmet Klocker and Kirsten Freeman Future Land Use: General Rural Location: 16801 205th St Ct N PID 1903219240020 Review Deadline August 2, 2025 The applicant is requesting approval of a conditional use permit to allow for an essential service - utility substation on a 3.26-acre parcel. The substation would be an odorizer, which is used to add the odor to natural gas. The staff report to the Planning Commission from the August 5, 2025, meeting is attached and includes the full background of the request, as well as an evaluation of the request, and an analysis based on the standards in the Unified Development Code. EVALUATION OF REQUEST Proposed Conditions The applicant is proposing to develop the site as an essential service – utility substation. Improvements on the site would consist of two driveways, two structures, two facilities area that include raised pipes and a tank storage area, and a large gravel area around the structures and facilities. The proposed structures include a larger 30 ft. by 10 ft. odor building and a smaller 8 ft. by 10 ft. building that does not have a specified use. Both structures are located on the south side of the site and located on the proposed gravel area. The dimensional standards for the use are reviewed below. 2 | P a g e ANALYSIS Planning Commission The request was initially heard at the July 1, 2025, meeting of the Planning Commission. A public hearing was held and one comment was received. The comment expressed concerns regarding the number of trees proposed on the site and the amount of screening to the south and east. The Planning Commission discussed the application and moved to table the request and for the applicant to revise the plans to address the issues identified by staff. The motion was approved with a vote of 4-0 (Loeffler absent). The Planning Commission elected to leave the public hearing open. The Planning Commission heard the application again at the August 5, 2025, meeting. The applicant submitted updated plans for the site which were presented by staff. The public hearing was then continued and three comments were made. Comments expressed concern regarding screening on the east and south sides of the parcel as well as asked for additional communication to residents when construction was happening on the site. The Planning Commission discussed the screening on the site generally agreed additional screening should be included along the east and south property line. Planning Commissioners 3 | P a g e discussed the tree and woodland replacement plan. Commissioners stated that they believed there was sufficient land to accommodate the replacement trees and that the tree replacement fund should not be utilized for the project. Commissioners also stated that if the tree fund were to be used, that the applicant provide documentation as to why additional trees cannot be located on the site. The Planning Commission moved to recommend approval of the request, with amendments. The motion was approved with a vote of 5-0. The amendments include: • Landscaping shall be provided along the east and south property lines to fully obscure the proposed use from the adjacent property lines. • The tree fund shall not be utilized on the site and replacement shall be required for significant trees. Public Comment A public comment was received after the Planning Commission meeting and is attached. Review Comments The submittal was sent to city staff and other regulatory agencies for review and comment, and comments have been incorporated into the resolution. These comments are detailed in the Planning Commission report that is attached. Staff Analysis Staff have reviewed the plan for consistency with the applicant standards outlined in the Comprehensive Plan and Unified Development Code. In the July 1, 2025, staff report to the Planning Commission staff identified significant issues that the applicant must address. The revised submittal addresses these issues and are reviewed in the August 5, 2025 staff report. Fencing The applicant is proposing a six foot black vinyl fence with one foot and three inches of barbed wire for security purposes. The code restricts fences in the front yard to six feet and to four feet within 20 ft. of right-of-way. The applicant provided two provisions that they believe may allow them to exceed the standards adopted by the city. The provision references were included in an email in the August 5, 2025, Planning Commission packet. The City Attorney has reviewed the provisions and believes that the provisions do not preempt local control and are related to spacing of valves and inspections. Based on these findings, it appears that a variance would be required for the proposed fence. A condition is included in the resolution that no fence is approved with the CUP. Screening and Woodland Preservation Staff noted the difference between required screening and woodland preservation during the Planning Commission and believe it may be beneficial to reiterate the differences here. 4 | P a g e Screening is required on the use in the UDC, “to provide adequate screening from property lines and the road right-of-way.” As the use is allowed through a conditional use permit, the City has the discretion to require additional screening to create adequate screening. If the use does not or cannot meet the standards established in the code, those standards may be used as a reason for denial. Staff believes that there is additional room on the site that additional plantings could be placed to increase screening. Staff have prepared an exhibit below to detail the approximate profile of the current proposed landscaping. A condition has been included to address the recommendation from the Planning Commission. The City Council may wish to further define the condition and set a specific parameter for the screening in terms of where the screening is required. It may be impractical The UDC specifically states that tree plantings required for mitigation of significant trees and woodlands are in addition to any other landscape requirements as required in other sections of the UDC. This means that if the City is requiring additional screening on the property, those trees cannot be counted towards the mitigation for the significant trees and woodlands. The current required replacements are detailed below. The removed species are red pines and an oak. Staff have included a condition as recommended by the Planning Commission that the City Council may wish to discuss and amend. Drainage and Utility Easements The applicant is currently proposing a site plan that is not consistent with the drainage and utility easements that were approved as part of the NELSON ADDITIONAL plat. The applicant has been informed that the final plat will need to be amended. No application was received prior to the meeting. A condition has been included that the easements be revised. COUNCIL ACTION The City Council can do one of the following: 1. Approve, with or without conditions, of the attached resolution. 2. Deny, with findings, of the attached resolution. 3. Table the request for further review/study. RECOMMENDATION The Planning Commission recommends that the City Council approve a conditional use permit to allow for an essential services – utility substation, with the findings and conditions described within the staff report. Approval includes a resolution. Motion to approve a conditional use permit for an essential services – utility substation, with the findings and conditions described within the staff report. The findings and conditions recommended in the staff report. The following conditions of approval are recommended: 1. The location and layout of structures and facilities on the lot shall be substantially consistent with the plans submitted to the city and reviewed with this request with the exception of where revisions are required with this approval. 2. The fence shown on the plans submitted to the city and reviewed with this request is not approved with this CUP approval. 3. The conditions established in Resolution 04-15-25-06 must be met. 6 | P a g e 4. All items identified in the July 29, 2025, City Engineer memo shall be addressed. All comments shall be adopted herein by reference. 5. Before a building permit can be issued for the site: a. Drainage and utility easements on the site shall include the stormwater facilities on the site and structures shall not be allowed within the easements. The final plat shall be amended to correct the drainage and utility easements. b. Landscaping plans shall be submitted that provide screening to completely block direct visual access to the site improvements. c. A woodland preservation plan shall be submitted to the city and approved by staff that meets the replacements standards of Section [153.400.070(B) IV.] of the UDC. d. The applicant shall enter into a development agreement with the city. At minimum, the development agreement shall: i. Provided a financial guarantee to return the parcel to its original condition when the utility is no longer needed as described in 153.300.030 Subd. 1 (M) III. ii. Include a site improvement performance agreement and financial guarantee for the completion of landscaping and all other private exterior amenities or improvements as shown on the approved Site Plan and as required by the Site Plan approval as required by 153.500.060 Subd. 1 (D). iii. The applicant must provide the required performance guarantee following preliminary approval of the Woodland Preservation Plan and prior to any construction and / or grading. The amount of the performance guarantee to be submitted, specific to the Woodland Preservation requirements, will be calculated as follows: 1. An amount to guarantee preservation of all trees identified by the approved Woodland Preservation Plan to be preserved within the Construction Zone shall be deposited with the City. The amount will be calculated by multiplying the total caliper inches of significant trees to be preserved by the rate of payment of $100.00 per caliper inch and the total square feet of significant woodland to be preserved at the rate of $1.50 per square foot. 2. Following written request by the applicant for acceptance, the performance guarantee will be released upon verification by the City that the Woodland Preservation Plan was followed and that the applicant complied with the tree replacement schedule. In no event will the performance guarantee be released earlier than completion of the warranty requirements. 6. The applicant shall secure any and all applicable and necessary permits required from local, state, and federal entities prior to work on the site. 7 | P a g e 7. Planning Commission “Conditional Use Permit for Additional Accessory Structure Square Footage” Packet, dated August 5, 2025 CITY OF SCANDIA, MINNESOTA RESOLUTION NO. 08-19-25-02 APPROVING CONDITIONAL USE PERMIT FOR AN ESSENTIAL SERVICES – UTILITY SUBSTATION FOR LOT 1, BLOCK 1, NELSON ADDITION WHEREAS, Steve Martinez (the “applicant”), of Northern Natural Gas, made an application for a Conditional Use Permit, on behalf of Jeffery and Sherri Nelson (the “owners”), to allow for an essential services – utility substation, located on the property legally described as follows: Lot 1, Block 1, NELSON ADDITION; and, WHEREAS, the City of Scandia allows for an essential services – utility substation as a conditional use in the Rural Residential General Base Zoning District; and, WHEREAS, the applicant has proposed to construct an odorizer station; and, WHEREAS, the Planning Commission reviewed the request for the Conditional Use Permit (CUP) at a duly noticed Public Hearing on July 1, 2025, and tabled the application with direction to revise the site plan to address issues detailed within the July 1, 2025, staff report to the Planning Commission and continued the public hearing; and WHEREAS, the Planning Commission reviewed the request for the CUP and received public input on August 5, 2025, and recommended that the City Council approve the CUP, with conditions; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it approves of a Conditional Use Permit to allow to allow for an essential services – utility substation, based on the following findings: 1. The proposed use will be in compliance with and shall not have a negative effect upon the Comprehensive Plan, public facilities, or the capital improvement plans. 2. The proposed use is a conditional use in the Rural Residential General zoning district. The proposed improvements on the site will not be detrimental to the general public welfare. The use must be compliant with several other governmental standards including the Minnesota Pollution Control Agency, the Department of Natural Resources, and U.S. Army Corps of Engineers. 3. The proposed use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values or scenic views. Screening is proposed around the site. The use is required to be screened from the public right-of-way and property lines. 4. The proposed essential services – utility substation will not impede development or improvement of surrounding properties. 5. The proposed essential services – utility substation will use existing public facilities such as roads. Private stormwater management facilities are proposed on site. The use is not expected to use other public facilities. 6. The proposed use is consistent with the applicable standards of the Unified Development Code. The applicant has requested a design review for the Character Area: Rural Residential Districts (RR-G and RR-N) architectural and building material standards. 7. The application is consistent with the performance standards established in the Unified Development Code for the proposed essential services – utility substation. Where the application is not consistent, conditions have been included to address the inconsistencies. a. The use is proposed on a lot that will be owned by the utility company. No lease is proposed and the essential services – utility substation shall be the sole use. b. A development agreement, including a site improvement performance agreement, shall be required for the private improvement on the site including, but not limited to, stormwater maintenance facilities and landscaping. The development agreement shall also establish a financial guarantee that the parcel is able to be returned to its original condition when the utility is no longer needed. c. Landscaping is proposed on the for screening throughout the site from property lines and right-of-way. The screening does not appear adequate. A condition has been included to address additional screening. 8. The applicant shall follow construction best management practices and shall be responsible for erosion control during and after construction. The applicant shall work with the Rice Creek Watershed District and the City Engineer to ensure soil erosion and other possible pollutants are controlled on the site. 9. The proposed site plan would create an impervious surface coverage of 23.92%, where 25% is allowed by the Shoreland Management Regulations. 10. Structures and other facilities are not visible from public waters. 11. The essential services – utility substation is not a use that will have employees located on site regularly and will not have water service or wastewater management. 12. The essential services – utility substation will not impact the types, uses, or numbers of watercrafts. FURTHER BE IT RESOLVED that the following conditions of approval shall be met: 1. The location and layout of structures and facilities on the lot shall be substantially consistent with the plans submitted to the city and reviewed with this request with the exception of where revisions are required with this approval. 2. We own a legal, registered building site that is butting up on the East side, towards Manning Trail, of a property NNG is planning on constructing a Odorizer Station. We are planning on building a retirement home on our property in 2 years. NNG has a large amount of hard surface in the plans. We are concerned the wetland water levels will rise. There has been a revised plan submitted recently that has it going from 2 water retention ponds down to 1 retention pond. We ask what was the purpose this was done. We are concerned whether there has been enough research completed on this project site to comfirm that there will not be any rise in water level. Also that the wetland drainage is not hampered or damaged. How and will the wetland be monitored for any unforeseen consequences from this NNG project? In addition, has Rice Creek Watershed District done any in-person inspection on this project site. We are hoping Rice Creek Watershed District would go out and do their own inspection of the site to make sure it actually is within guidelines before any final approval is authorized, due to information being used is coming from a 3rd party company hired by NNG. We are depending on RCWD and Scandia Township Council to make sure NNG is following the law and not adversely affecting surrounding property values and safety. Stormwater is proposed to be managed through two onsite wet ponds. Conditional Use Permit The proposed use of an odorizer station meets the definition within the Unified Development Code (UDC) as a “Essential Services – Transmission Facilities or Utility Substation” and is considered a “Public, Semi-Public, and Utility Use.” The proposed use is allowed in the RR-G zoning district as a conditional use. 153.300.030 Subd. 1 (M) establishes use specific regulations that are reviewed below. Chapter 153.500.060 Subd. 1(C)(I) of the UDC lists the general standards to meet to grant a CUP or IUP. Below these standards are repeated in italics, with the staff’s findings following: 1. The proposed use will be in compliance with and shall not have a negative effect upon the Comprehensive Plan, including public facilities and capital improvement plans. The proposed use will be in compliance with and shall not have a negative effect upon the Comprehensive Plan, public facilities, or the capital improvement plans. 2. The establishment, maintenance or operation of the proposed use will promote and enhance the general public welfare and will not be detrimental to or endanger the public health, safety, morals or comfort. 3 | P a g e The proposed use is a conditional use in the Rural Residential General zoning district. The proposed improvements on the site will not be detrimental to the general public welfare. The use must be compliant with several other governmental standards including the Minnesota Pollution Control Agency, the Department of Natural Resources, and U.S. Army Corps of Engineers. 3. The proposed use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values or scenic views. The proposed use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values or scenic views. Screening is proposed around the site. The use is required to be screened from the public right-of-way and property lines. 4. The establishment of the proposed use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. The proposed essential services – utility substation will not impede development or improvement of surrounding properties. 5. Adequate public facilities and services are available or can be reasonably provided to accommodate the use which is proposed. The proposed essential services – utility substation will use existing public facilities such as roads. Private stormwater management facilities are proposed on site. The use is not expected to use other public facilities. 6. The proposed use shall conform to the applicable regulations of the district in which it is located and all other applicable standards of this Chapter. The proposed use is consistent with the applicable standards of the Unified Development Code. The applicant has requested a design review for the Character Area: Rural Residential Districts (RR-G and RR-N) architectural and building material standards. 7. The proposed use complies with the general and specific performance standards as specified by this Section and this Chapter. The application is consistent with the performance standards established in the Unified Development Code for the proposed essential services – utility substation. Where the application is not consistent, conditions have been included to address the inconsistencies. I. Notwithstanding the prohibition against two or more uses on an individual parcel, the lot area for essential service-utility substation can be acquired by lease provided, however, the lot must have adequate area so that all structures and/or facilities comply with the required setbacks for the Base Zoning District. 4 | P a g e The use is proposed on a lot that will be owned by the utility company. No lease is proposed and the essential services – utility substation shall be the sole use. II. When the utility no longer needs the lot or parcel for the intended use, the parcel must be returned to its original condition. The City may require a financial guarantee to ensure compliance with this standard. A development agreement, including a site improvement performance agreement, shall be required for the private improvement on the site including, but not limited to, stormwater maintenance facilities and landscaping. The development agreement shall also establish a financial guarantee that the parcel is able to be returned to its original condition when the utility is no longer needed. III. The area of the site used for the utility facility or structure must be landscaped to provide adequate screening from property lines and the road right-of-way. Landscaping is proposed on the for screening throughout the site and appears to provide adequate screening from property lines and right-of-way. Shoreland Management Overlay District The Shoreland Ordinance Section 3.5 details additional Conditional Use Permit evaluation criteria for properties in the Shoreland Management Overlay District. Below these standards are repeated in italics, with the staff’s findings following. All conditional uses in the shoreland area are subject to a thorough evaluation of the waterbody and the topographic, vegetation, and soil conditions to ensure: 1. The prevention of soil erosion or other possible pollution of public waters, both during and after construction. The applicant shall follow construction best management practices and shall be responsible for erosion control during and after construction. The applicant shall work with the Rice Creek Watershed District and the City Engineer to ensure soil erosion and other possible pollutants are controlled on the site. 2. The potential to reduce impervious surface area. The proposed site plan would create an impervious surface coverage of 23.92%, where 25% is allowed by the Shoreland Management Regulations. 3. The visibility of structures and other facilities as viewed from public waters is limited. Structures and other facilities are not visible from public waters. 4. There is adequate water supply and on-site sewage treatment. The essential services – utility substation is not a use that will have employees located on site regularly and will not have water service or wastewater management. 5 | P a g e 5. The types, uses, and numbers of watercraft that the project will generate are compatible in relation to the suitability of public waters to safely accommodate these watercraft. The essential services – utility substation will not impact the types, uses, or numbers of watercrafts. The proposed site plan includes two structures, for a total of 372 sq. ft., and two equipment areas, for a total of approximately 5,598 sq. ft., which are consistent with the use of a utility substation. All structures and facilities are part of the principal use. The applicant has detailed the impervious surface coverage in the submitted narrative; however, the calculations do not net out the area that was dedicated as right-of-way by the NELSON ADDITION plat. The previous submittal was over the allowed impervious surface limit, but the revised site plan has reduced the amount of total impervious surfaces. By measuring elements on the submitted site plan, staff believe there to be approximately 30,500.65 sq. ft. of impervious surface on a lot that is approximately 12,537.8 sq. ft., for a total of 23.92% impervious surface. Wetlands are present on and around the site and additional wetlands are shown on the site plan compared to the wetlands noted on the NELSON ADDITION plat. Impervious surfaces and structures must meet the setbacks established in the Shoreland Management Ordinance 6.4 B. Jay Riggs of the Washington Conservation District provided a MnRAM determination and classified the wetland as a Manage 1, which required a 75 ft. setback. Previously the improvements on the site encroached into the wetland setback, however, the revised site plan has addressed this issue. Utilities The applicant has stated that there will be no permanent on-site staff. The proposed use will not be served by water or wastewater management. 6 | P a g e Stormwater management is proposed through the use of one ponds. The pond will be maintained privately. The pond is not entirely located within the drainage and utility easements dedicated with the NELSON ADDITION plat. The stormwater facilities must be located entirely within drainage and utility easements. Streets, Access, and Parking Right-of-way for 180th Street North was dedicated with the approval of the NELSON ADDITION plat. Site plans do not show the right-of-way and staff have requested that the plans be revised to correctly show the right-of-way easement. The proposed site plan shows two accesses on 180th Street North. Driveway locations for nonresidential uses requires Engineering approval. The City Engineer has not provided a comment regarding the two accesses. No formal parking is proposed on the site, but the applicant has shown a location for vehicles to be parked while on the site. These locations are located near the south side of the improvements and do not appear to create conflicts with site circulation. No parking standards for the proposed use are established in the UDC. Staff believe the proposed area for parking will be sufficient based on the proposed use and the limited amount of traffic and parking generated by the site. Landscaping and Screening 153.400.060 Subd. 2 (F) requires a minimum five-foot strip from building walls facing a public right-of-way must be treated with decorative ground cover and/or foundation plantings, except for garages, loading areas, and pedestrian access areas. The applicant proposes a five-foot strip of plantings on the south, east, and west sides of the proposed buildings that will be planted with shrubs and ornamental grasses. 7 | P a g e Various different seed mixes are proposed throughout the site and it appears that all unimproved areas will be seeded and remain vegetated. Table 153.400.060-1 of the UDC establishes landscaping requirements for uses, but does not have requirements for “Public, Semi-Public, and Utility Uses.” The highest requirements established in the UDC are for “Commercial/Industrial” uses which require 10 trees or one tree per 1,000 square feet of gross building floor area, whichever is greater. The proposed site plan show a total of 372 sq ft. of buildings on the lot. The applicant is proposing to install 38 trees on the property, eight of which are proposed as understory trees. The previous submittal did not meet the required number of deciduous trees. The revised plan proposes varied species of trees and includes at least 25% coniferous and deciduous, with all trees included in Table 153.400.060-3. List of Recommended Plant Materials. 153.300.030 Subd. 1 (M) requires that an essential service - utility substation site or structure must be landscaped to provide adequate screening from property lines and the road right-of-way. As proposed, the right-of way screening on the south side of the lot shows screening that appears to effectively screen the use. Additional plantings along the eastern side of the southern lot line may be beneficial, specifically south of the tank area, but the proposed screening will be effective for a majority of the site once vegetation reaches maturity. Along the western side of the site, plantings are proposed on the south side and north side of the site, but a gap exists between the screening to the south and the bituminous driveway. This gap is likely due to the presence of the underground utility. Tall grasses combined with opaque fencing could be installed to provide screening. The seed mixture currently proposed is similar to turf grass in terms of height. The eastern side has been revised to include an oak as well as three “American Hophornbeam,” also known as Ironwood, a 20 – 40 ft. tree with a spread between five and 12 ft. The property to the east contains numerous mature trees. With the revisions to the site and the reconfigured stormwater facility, additional room for plantings exists. The proposed trees should provide screening to the eastern property line. The property owners to the east of the site have expressed concerns regarding the amount of screening along both the southern and eastern sides of the property. The Planning Commision should discuss if the proposed screening is sufficient to meet the standards in the code. Provided that the use must be adequately screened from property lines and right-of-way, additional screening could be warranted. Additional plantings along the eastern side of the southern lot line may be beneficial, specifically south of the tank area, but the proposed screening will be effective for a majority of the site once vegetation reaches maturity. Additional plantings along the eastern property line may be possible, but the use of shrubs may be more effective considering tree spacing. Woodland Preservation A tree inventory and removal plan was submitted as part of a woodland preservation plan. Two trees within the inventory, Tree ID 31 and 33, do not have enough information provided to determine if the trees are significant or not as elms are considered primary deciduous trees if they are a species resistant to Dutch elm disease. As a licensed landscape architect prepared the plan, 8 | P a g e staff believe they should not be counted, but the plan should be revised to clearly indicate the scientific species’ name. The applicant is proposing to remove two significant conifers and one significant deciduous tree. All significant trees removed must be replaced by the applicant as determined by the tree replacement schedule in Table 153.400.070-1. Option A, B or C, or some combination may be proposed by the applicant. In the event that sufficient land area is not available to plant the replacement trees, as determined by the City, the Applicant shall provide to the City payment for the planting of the required trees elsewhere at a rate of $100 per caliper inch. This would require a payment of $4,600.00. As staff is recommending the applicant provide additional screening and the applicant has expressed concerns regarding tree plantings on the site and the impacts to the facility, staff believes that the request to pay cash-in-lieu to the tree fund of $4,600.00 is reasonable. Fences The proposed site plan shows a fence around the facility with gates located along the driveway. Fence details were provided. The applicant is proposing a black vinyl coated aluminum chain link fence with barbed wire on top. The fence is proposed at six feet with an additional one foot and three inches for the barbed wire. The proposed fence is not consistent with the standards for fences in the UDC. Fences proposed within 20 ft. of the street right-of-way may be a maximum of four feet high and fences proposed in front of the principal structure are allowed to be up to six feet high, up to 20 ft. from the right-of-way. The applicant has submitted a statement regarding the need for the security fence which may preempt the city’s local standards. The City Attorney is currently reviewing the standards. If the standards referenced by the applicant do not justify preemption, then the applicant may need to request a 9 | P a g e variance or possibly an amendment to the code to address non-residential fences. The fence is not approved as part of the CUP approval and will require a fence permit to be installed. The applicant is proposing a gate located along both driveways. The gates appear to be consistent with the standards established in the Driveway and Fire Apparatus Access Road Requirements. The gates must be equipped with an approved means of emergency operation. Easements Drainage and utility easements were dedicated on the property as part of the NELSON ADDITION plat. The platted easements are not currently shown on the site plans. The proposed structures on the site are currently within a drainage and utility easement that was approved with the final plat of NELSON ADDITION. Additionally, the drainage and utility easement located on the northeast corner of the site does not fully encompass the proposed stormwater facility and includes some of the area where the applicant has proposed the fence to be located. The easements must be shown on the site plans. Structures and improvements cannot be located within areas with drainage and utility easements dedicated to the City. The applicant will either need to revise the proposed plan or amend the plat by submitting for a new final plat that shows the drainage and utility easements dedicated on the site to match the proposed improvements. Signs No signage has been proposed. Any signs proposed in the future will be subject to 153.400.100 of the UDC. Architectural Design Standards The proposed subdivision will fall within the Character Area: Rural Residential Districts (RR-G and RR-N). While no architectural or building plans were proposed as part of the application, structures constructed in the subdivision will be subject to the standards established within the Design Guidelines. The Character Area requires that the design of new structures must reference design elements of the existing rural buildings in Scandia including barns, farmhouses and schoolhouses. The applicant has not requested a design review exception to this requirement but may do so. 10 | P a g e In accordance with Section 153.400.040 (B) IV (D) Design Review, an applicant or developer may request a design review of any proposed exception to the standards established within Section 153.400.040 Character Area Standards. The following process applies: a. If requested, Design Review will occur concurrently with the application for any Building Permit, Variance, Conditional Use Permit, Administrative Permit, Site Plan Review, Planned Unit Development or other permit(s) as may be required by this Section. b. The Planning Commission will provide recommendations to the City Council on any project referred to it for Design Review. The Planning Commission may consult with staff, consultants or other experts or resources as appropriate to the application request. The City Council has final authority to grant an exception to the standards contained within this Section. As the applicant is requesting an exception the Planning Commission and City Council have large amount of discretion in approving the exception. While the applicant has not provided details regarding plans that provide details regarding the structures, a small single story structures the buildings are unlikely to resemble “barns, farmhouses and schoolhouses.” Based on the requirements for screening on the site, the buildings will be less visible than many other uses. The structures proposed by the applicant appear typical to essential service uses. ANALYSIS Review Comments The submittal was sent to city staff and other regulatory agencies for review and comment. The comments from other reviewers were included in the July 1, 2025, staff report to the Planning Commission. Any additional comments received have been detailed below. City Engineer The City Engineer has provided a comment letter which is attached to the staff report. Planning Commission The request was initially heard at the July 1, 2025, meeting of the Planning Commission. A public hearing was held and one comment was received. The comment expressed concerns regarding the number of trees proposed on the site and the amount of screening to the south and east. The Planning Commission discussed the application and moved to table the request and for the applicant to revise the plans to address the issues identified by staff. The motion was approved with a vote of 4-0 (Loeffler absent). The Planning Commission elected to leave the public hearing open. Staff Analysis Staff has reviewed the plan for consistency with the applicant standards outlined in the Comprehensive Plan and Unified Development Code. In the July 1, 2025 staff report to the Planning Commission staff identified significant issues that the applicant must address. The revised document addresses these issues. 11 | P a g e Stormwater Management and Easement Stormwater management facilities are currently shown outside of the platted drainage and utility easements. Stormwater management facilities must be entirely located within drainage and utility easements. Additionally, structures and improved areas are proposed within the existing drainage and utility easements. The site must either be revised to move these elements outside of the easements, or, the applicant may apply for a revised final plat. Impervious Surface Cover The proposed site has been revised and now meets the impervious surface cover maximum. Wetland Setbacks The proposed site has been revised and now meets the required wetland setbacks. Landscaping The proposed landscaping has been revised and now meets the requirements in the UDC. Screening Provided that the use must be adequately screened from property lines and right-of-way, additional screening could be warranted. Additional plantings along the eastern side of the southern lot line may be beneficial, specifically south of the tank area, but the proposed screening will be effective for a majority of the site once vegetation reaches maturity. Additional plantings along the eastern property line may be possible, but the use of shrubs may be more effective considering tree spacing. The Planning Commision should discuss if the proposed screening is sufficient to meet the standards in the code. Woodland Preservation The applicant has not proposed plantings on the site for the replacement trees and has instead requested to pay cash-in-lieu. This would require a payment of $4,600.00. Staff believes that the request to pay cash-in-lieu to the tree fund of $4,600.00 is reasonable. Public Comment Staff received concerns from the property owner to the east prior to the public notice being issued. Concerns generally related to screening and potential noise. COMMISSION ACTION The Planning Commission can do one of the following: 1. Recommend approval, with or without conditions, of the attached resolution. 2. Recommend denial, with findings, of the attached resolution. 3. Table the request for further review/study. 12 | P a g e RECOMMENDATION Staff recommends the Planning Commission open the public hearing and receive any and all comments. Staff recommends the Planning Commission: Motion to recommend the City Council approval a conditional use permit to allow for an essential services – utility substation, with the findings and conditions described within the staff report. The above findings and following conditions of approval are recommended: 1. The location and layout of structures and facilities on the lot shall be substantially consistent with the plans submitted to the city and reviewed with this request with the exception of where revisions are required with this approval. 2. The fence shown on the plans submitted to the city and reviewed with this request is not approved with this CUP approval. 3. The conditions established in Resolution 04-15-25-06 must be met. 4. All items identified in the July 29, 2025, City Engineer memo shall be addressed. All comments shall be adopted herein by reference. 5. Before a building permit can be issued for the site: a. Stormwater management facilities shall be wholly located within drainage and utility easements. b. The applicant shall enter into a development agreement with the city. At minimum, the development agreement shall: i. Provided a financial guarantee to return the parcel to its original condition when the utility is no longer needed as described in 153.300.030 Subd. 1 (M) III. ii. Include a site improvement performance agreement and financial guarantee for the completion of landscaping and all other private exterior amenities or improvements as shown on the approved Site Plan and as required by the Site Plan approval as required by 153.500.060 Subd. 1 (D). iii. Provide a payment of $4,600.00 to the Tree Fund in lieu of planting trees required by 153.400.070 Woodland and Tree Preservation. 6. The applicant shall secure any and all applicable and necessary permits required from local, state, and federal entities prior to work on the site. 7. According to the existing ground contours, water is being trapped on the southwest side of the site after flowing through the culvert at the westernmost driveway. Is there a culvert at the existing gravel driveway west of this site? 8. Grading contours should be smoothed for easier long-term maintenance and to ensure that slopes are not damaged in the future. 9. Multiple ditch grades are displayed at 0.6% or flatter. Consider increasing grades to 1-2% to minimize standing water in unintended areas. Sheet C5.01: Storm Sewer Plan 10. The minimum storm sewer pipe size in Scandia is 15”. Nelson Future Land Use: General Rural Location: 18180 Manning Trl N PID 31.032.20.34.0005 Review Deadline: August 11, 2025 The applicant is requesting approval of a conditional use permit to allow for an essential service - utility substation on a 3.26-acre parcel. The substation would be an odorizer, which is used to add the odor to natural gas. BACKGROUND The existing site consists of a 15.68-acre parcel zoned Rural Residential General (RR-G) and located within the Shoreland Management Overlay District (SM-O) for Big Marine Lake. The applicant previously requested a variance and minor subdivision for the property. Both requests were approved by the City Council though Resolution 02-18-25-01 and 04-15-25-06, respectively. At the time of writing this report, the subdivision has not yet been recorded with Washington County, but staff have reviewed the application as if it were proposed for Lot 1, Block 1, NELSON ADDITION (subject property) that was approved with Resolution 04-15-25- 06. As approved, Lot 1, Block 1 meets the dimensional standards of the RR-G zoning district as detailed below. The subject property is currently vacant. Parcels surrounding the subject property are zoned Rural Residential General (RR-G), guided General Rural, and are either vacant or used for single-family dwellings. Parcels to the south of the subject property are in May Township. ATTACHMENT F 2 | P a g e EVALUATION OF REQUEST Applicant’s Proposal The applicant is proposing to develop the site as an essential service – utility substation. Improvements on the site would consist of two driveways, two structures, two facilities area that include raised pipes and a tank storage area, and a large gravel area around the structures and facilities. The proposed structures include a larger 30 ft. by 10 ft. odor building and a smaller 8 ft. by 9 ft. building that does not have a specified use. Both structures are located to the rear of the site and located on the proposed gravel area. The dimensional standards for the use are reviewed below. Water and wastewater are not proposed for the site as they are not required by the use. Stormwater is proposed to be managed through two onsite wet ponds. Conditional Use Permit The proposed use of an odorizer station meets the definition within the Unified Development Code (UDC) as a “Essential Services – Transmission Facilities or Utility Substation” and is considered a “Public, Semi-Public, and Utility Use.” The proposed use is allowed in the RR-G zoning district as a conditional use. 153.300.030 Subd. 1 (M) establishes use specific regulations that are reviewed below. 3 | P a g e Chapter 153.500.060 Subd. 1(C)(I) of the UDC lists the general standards to meet to grant a CUP or IUP. Below these standards are repeated in italics, with the staff’s findings following: 1. The proposed use will be in compliance with and shall not have a negative effect upon the Comprehensive Plan, including public facilities and capital improvement plans. The proposed use will be in compliance with and shall not have a negative effect upon the Comprehensive Plan, public facilities, or the capital improvement plans.. 2. The establishment, maintenance or operation of the proposed use will promote and enhance the general public welfare and will not be detrimental to or endanger the public health, safety, morals or comfort. The proposed use is a conditional use in the Rural Residential General zoning district. The proposed improvements on the site may be detrimental to the general public welfare by exceeding the allowed impervious surface maximum and encroaching into the setback of a Manage 1 wetland. The use must be compliant with several other governmental standards including the Minnesota Pollution Control Agency, the Department of Natural Resources, and U.S. Army Corps of Engineers. 3. The proposed use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values or scenic views. The proposed conditions do not fully screen the facility and structure and due to this the essential services – utility substation may be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, or substantially diminish and impair property values or scenic views. The use is required to be screened from the public right-of-way and property lines. The applicant is proposing plantings to provide screening from public right-of-way and property lines, but gaps exist in the screening and screening is absent from the eastern property line. 4. The establishment of the proposed use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. The proposed essential services – utility substation will not impede development or improvement of surrounding properties. 5. Adequate public facilities and services are available or can be reasonably provided to accommodate the use which is proposed. The proposed essential services – utility substation will use existing public facilities such as roads. Private stormwater management facilities are proposed on site. The use is not expected to use other public facilities. 4 | P a g e 6. The proposed use shall conform to the applicable regulations of the district in which it is located and all other applicable standards of this Chapter. The proposed use is consistent with the applicable regulations of the RR-G District, but is not consistent with the Unified Development Code Use Specific Regulations or the wetland setbacks required by the Shoreland Management Overlay. The proposed structures appear to not be consistent with Character Area: Rural Residential Districts (RR-G and RR-N) architectural and building material standards. The applicant is proposing to deviate from the landscaping requirements in 153.400.060 Subd. 2 (H) I. and requesting the City Council waive the requirement that trees meeting the landscaping requirement be not less than 25% deciduous and not less than 25% coniferous and is proposing 100% coniferous trees. The proposed conditions of the site do not meet the screening requirements established in 153.300.030 Subd. 1 (M) III. The proposed conditions would create an impervious surface coverage of 25.86%, where 25% is allowed by the Unified Development Code and Shoreland Management Regulations. The proposed conditions would create impervious surfaces that encroach on a 75-foot setback from an on-site and off-site Manage 1 wetland by approximately 35.09 ft. to 11.04 ft. 7. The proposed use complies with the general and specific performance standards as specified by this Section and this Chapter. The application is not consistent with the performance standards established in the Unified Development Code for the proposed essential services – utility substation. Where the application is not consistent, conditions have been included to address the inconsistencies. I. Notwithstanding the prohibition against two or more uses on an individual parcel, the lot area for essential service-utility substation can be acquired by lease provided, however, the lot must have adequate area so that all structures and/or facilities comply with the required setbacks for the Base Zoning District. The use is proposed on a lot that will be owned by the utility company. No lease is proposed and the essential services – utility substation shall be the sole use. II. When the utility no longer needs the lot or parcel for the intended use, the parcel must be returned to its original condition. The City may require a financial guarantee to ensure compliance with this standard. A development agreement, including a site improvement performance agreement, shall be required for the private improvement on the site including, but not limited to, stormwater maintenance facilities and landscaping. The development agreement shall also establish a financial guarantee that the parcel is able to be returned to its original condition when the utility is no longer needed. III. The area of the site used for the utility facility or structure must be landscaped to provide adequate screening from property lines and the road right-of-way. Landscaping is proposed to the north and south of the property. Additional landscaping shall be required to the east and west of the property, as well as an 5 | P a g e additional row of screening along the south side of the property. Screening can be accomplished through a mix of vegetation, including trees, tall shrubs, tall grasses, and opaque fencing. Shoreland Management Overlay District The Shoreland Ordinance Section 3.5 details additional Conditional Use Permit evaluation criteria for properties in the Shoreland Management Overlay District. Below these standards are repeated in italics, with the staff’s findings following. All conditional uses in the shoreland area are subject to a thorough evaluation of the waterbody and the topographic, vegetation, and soil conditions to ensure: 1. The prevention of soil erosion or other possible pollution of public waters, both during and after construction. The applicant shall follow construction best management practices and shall be responsible for erosion control during and after construction. The applicant shall work with the Rice Creek Watershed District and the City Engineer to ensure soil erosion and other possible pollutants are controlled on the site. 2. The potential to reduce impervious surface area. The proposed site plan would create an impervious surface coverage of 25.86%, where 25% is allowed by the Unified Development Code and Shoreland Management Regulations. 3. The visibility of structures and other facilities as viewed from public waters is limited. Structures and other facilities are not visible from public waters. 4. There is adequate water supply and on-site sewage treatment. The essential services – utility substation is not a use that will have employees located on site regularly and will not have water service or wastewater management. 5. The types, uses, and numbers of watercraft that the project will generate are compatible in relation to the suitability of public waters to safely accommodate these watercraft. The golf driving range will not impact the types, uses, or numbers of watercrafts. The proposed site plan includes two structures, for a total of 372 sq. ft., and two equipment areas, for a total of approximately 5,598 sq. ft., which are consistent with the use of a utility substation. All structures and facilities are part of the principal use. The applicant has detailed the impervious surface coverage in the submitted narrative; however, the calculations do not net out the area that was dedicated as right-of-way by the NELSON ADDITION plat. By measuring elements on the submitted site plan, staff believe there to be approximately 33,273.37 sq. ft. of impervious surface on a lot that is approximately 12,8691.60 sq. ft., for a total of 25.86% impervious surface. This must be revised. Wetlands are present on and around the site and additional wetlands are shown on the site plan compared to the wetlands noted on the NELSON ADDITION plat. Impervious surfaces and structures must meet the setbacks established in the Shoreland Management Ordinance 6.4 B. Jay Riggs of the Washington Conservation District provided a MnRAM determination and classified the wetland as a Manage 1, which required a 75 ft. setback. Impervious surfaces are proposed as close as approximately 39 ft. and the structure appears to be located approximately 71 ft. from the wetland. This would be an encroachment into the wetland setbacks and would either require revisions to the plans or a request for a variance. 7 | P a g e Utilities The applicant has stated that there will be no permanent on-site staff. The proposed use will not be served by water or wastewater management. Stormwater management is proposed through the use of two ponds. The ponds will be maintained privately. The pond located on the southwest portion of the site is not entirely located within the drainage and utility easements dedicated with the NELSON ADDITION plat. The stormwater facilities must be located entirely within drainage and utility easements. Additionally, the proposed site plan shows fencing around the proposed ponds. Staff recommends that the fence be revised to exclude the stormwater management facilities. Streets, Access, and Parking Right-of-way for 180th Street North was dedicated with the approval of the NELSON ADDITION plat. Site plans do not show the right-of-way and staff have requested that the plans be revised to correctly show the right-of-way easement. The proposed site plan shows two accesses on 180th Street North. Driveway locations for nonresidential uses require Engineering approval. No formal parking is proposed on the site, but the applicant has shown two locations for vehicles to be parked while on the site. These locations are located near the north side of the improvements and do not appear to create conflicts with site circulation. No parking standards for the proposed use are established in the UDC. Staff believe the proposed area for parking will be sufficient based on the proposed use. Landscaping and Screening 153.400.060 Subd. 2 (F) requires a minimum five-foot strip from building walls facing a public right-of-way must be treated with decorative ground cover and/or foundation plantings, except for garages, loading areas, and pedestrian access areas. The applicant proposes a five-foot strip of plantings on the south, east, and west sides of the proposed buildings that will be planted with shrubs and ornamental grasses. Various different seed mixes are proposed throughout the site and it appears that all unimproved areas will be seeded and remain vegetated. Table 153.400.060-1 of the UDC establishes landscaping requirements for uses, but does not have requirements for “Public, Semi-Public, and Utility Uses.” The highest requirements established in the UDC are for “Commercial/Industrial” uses which require 10 trees or one tree per 1,000 square feet of gross building floor area, whichever is greater. The proposed site plan show a total of 372 sq ft. of buildings on the lot. The applicant is proposing to install 23 trees on the property. Species of trees include eastern red cedar and black hills spruce. Black hills spruce is not a prohibited species of tree but is not included in Table 153.400.060-3. List of Recommended Plant Materials. 8 | P a g e 153.400.060 Subd. 2 (H) I. requires that trees fulfilling the requirements of the landscaping requirements be not less than 25% deciduous and not less than 25% coniferous, unless the proposed plantings are designed to create a natural setting and it is approved by the City Council. The applicant has stated that including deciduous trees on the site reduces the screening that they are required to meet due to private agreements with the landowner to the north. A representative of the applicant has stated the following regarding the placement and types of trees in an email dated June 11, 2025, and attached to this staff report: Northern has to maintain a clear zone around the inside and outside of the fence to reduce ingress/egress risk into the facility. Also, Northern is required to reduce combustible materials inside a natural gas facility and eliminate large trees that may fall onto buildings or above grade piping and cause damage. …Northern is planting 100% coniferous trees to provide year-round visual screening per agreements with the adjacent landowners. Northern is not able to plant 25% deciduous trees and still meet the agreements made with the landowners. 153.300.030 Subd. 1 (M) requires that an essential service - utility substation site or structure must be landscaped to provide adequate screening from property lines and the road right-of-way. As proposed, the screening on the south side of the lot shows black hills spruce planted at 12 ft. intervals. Black hills spruce typically grow to be up to 10 – 15 ft. wide and will not screen the facility from the right-of-way fully. Additional planting should be proposed to the south of the current proposed trees. Along the western side of the site, plantings are proposed on the south side and north side of the site, but a gap approximately 104 ft. exists between the screening to the south and the bituminous driveway. This gap is likely due to the presence of the underground utility. Tall grasses combined with opaque fencing could be installed to provide screening. 9 | P a g e The eastern side is unscreened on the property, but the property to the east contains numerous mature trees. The presence of the wetland creates conditions that are prohibitive for establishing screening through the use of trees, but tall shrubs or grasses combined with opaque fencing would provide additional screening. Woodland Preservation A tree inventory and removal plan was submitted as part of a woodland preservation plan. Two trees within the inventory, Tree ID 31 and 33, do not have enough information provided to determine if the trees are significant or not as elms are considered primary deciduous trees if they are a species resistant to Dutch elm disease. As a licensed landscape architect prepared the plan, staff believe they should not be counted, but the plan should be revised to clearly indicate the scientific species’ name. The applicant is proposing to remove two significant conifers and one significant deciduous tree. All significant trees removed must be replaced by the applicant as determined by the tree replacement schedule in Table 153.400.070-1. Option A, B or C, or some combination may be proposed by the applicant. In the event that sufficient land area is not available to plant the replacement trees, as determined by the City, the Applicant shall provide to the City payment for the planting of the required trees elsewhere at a rate of $100 per caliper inch. This would require a payment of $4,600.00. As staff is recommending the applicant provide additional screening and the applicant has expressed concerns regarding tree plantings on the site and the impacts to the facility, staff believes that the request to pay cash-in-lieu to the tree fund of $4,600.00 is reasonable. Fences The proposed site plan shows a fence around the facility with gates located along the driveway. Fence details were not provided, but renderings of the site show what appears to be a wrought iron style fence. Any fence will be required to meet the standards established in 153.400.060 Subd. 4 and 153.400.040 Subd. 1 (B) II. d. Notably, fences cannot be higher than 6 ft. unless located behind the principle structure and must be constructed of natural materials, such as wood 10 | P a g e or stone, composite materials if similar in appearance, wrought iron fences, vinyl-wrapped chain link, chain link with decorative slats, or decorative aluminum fencing. Fences may be used in combination with landscaping to meet the required screening on the site. Easements Drainage and utility easements were dedicated on the property as part of the NELSON ADDITION plat. The platted easements are not currently shown on the site plans. The easements must be shown on the site plans. Signs No signage has been proposed. Any signs proposed in the future will be subject to 153.400.100 of the UDC. Architectural Design Standards The proposed subdivision will fall within the Character Area: Rural Residential Districts (RR-G and RR-N). While no architectural or building plans were proposed as part of the application, structures constructed in the subdivision will be subject to the standards established within the Design Guidelines. The Character Area requires that the design of new structures must reference design elements of the existing rural buildings in Scandia including barns, farmhouses and schoolhouses. The applicant has not requested a design review exception to this requirement but may do so. In accordance with Section 153.400.040 (B) IV (D) Design Review, an applicant or developer may request a design review of any proposed exception to the standards established within Section 153.400.040 Character Area Standards. The following process applies: a. If requested, Design Review will occur concurrently with the application for any Building Permit, Variance, Conditional Use Permit, Administrative Permit, Site Plan Review, Planned Unit Development or other permit(s) as may be required by this Section. b. The Planning Commission will provide recommendations to the City Council on any project referred to it for Design Review. The Planning Commission may consult with staff, consultants or other experts or resources as appropriate to the application request. The City Council has final authority to grant an exception to the standards contained within this Section. As the applicant is requesting an exception the Planning Commission and City Council have large amount of discretion in approving the exception. While the applicant has not provided details regarding plans that provide details regarding the structures, a small single story structures the buildings are unlikely to resemble “barns, farmhouses and schoolhouses.” Based on the requirements for screening on the site, the buildings will be less visible than many other uses. The structures proposed by the applicant appear typical to essential service uses. ANALYSIS Review Comments The submittal was sent to city staff and other regulatory agencies for review and comment. 11 | P a g e Washington County At the time of writing this staff report, Washington County has not provided comments. Washington Conservation District The Washington Conservation District (WCD) provided a MnRAM determination that classified the wetland as a Manga 1 wetland and recommended a level 2 wetland delineation. Rice Creek Watershed District The Rice Creek Watershed District (RCWD) stated they have received permits for the subdivision process, which will likely be an administrative process, and will also require a Rule C – Stormwater Management application. RCWD also stated in response to the recommendation from WCD that a Level 2 wetland delineation was not required for their permitting purposes. Department of Natural Resources At the time of writing this staff report, the DNR Area Hydrologist had not provided comments. Public Works Department At the time of writing this staff report, the Public Works Director has not provided any comments. Engineering Department The City Engineer commented that the stormwater management facilities shall be located entirely within drainage and utility easements. The City Engineer also stated that the stormwater management facility should be located outside of the proposed fencing, unless site conditions or other regulatory standards prohibit the facilities from being located outside of the fenced area, as approved by the City Engineer. City Engineer recommended taking the recommendations of RCWD regarding their permitting and not requiring a level 2 wetland delineation. Fire Department The Fire Chief had no comment. Staff Analysis Staff has reviewed the plan for consistency with the applicant standards outlined in the Comprehensive Plan and Unified Development Code. Significant issues exist that the applicant must address. As such staff have not prepared a draft resolution. Stormwater Management Stormwater management facilities are currently shown outside of the platted drainage and utility easements. Stormwater management facilities must be entirely located within drainage and utility easements. 12 | P a g e Impervious Surface Cover The applicant’s proposal exceeds the impervious surface coverage maximum. Staff recommend plans be revised to lower the total amount of impervious on the lot rather than requesting a variance. Wetland Setbacks Both proposed structures and impervious surfaces encroach into the required 75 ft. setback. Staff recommend plans be revised to reorient the site to be located outside of the setbacks, rather than requesting a variance. Landscaping The applicant is requesting to be allowed to be exempt from the requirement to provide at minimum 25% coniferous and 25% deciduous trees in the landscaping plan. The standards for this within the code state that to be waived the purpose should be when the plantings are, “are designed to create a natural setting.” The proposed plantings are not in effort to make a natural setting. If the Council wishes to allow for the proposed planting, the Council could reduce the required number of trees through 153.400.060 Subd. 2 (D) III. which states, “If requested by the applicant, the City Council may consider reducing the required number of trees if the landscape plan reflects the natural landscape.” Reducing the required number of trees to zero would mean that the requirement for 25% coniferous and 25% deciduous trees would not apply. All trees then would be provided for screening purposes and not to meet the requirements of 153.400.060 Subd. 2 Landscaping. The applicant would still be required to meet the screening requirements of the UDC. Screening Staff do not believe that the proposed screening will effectively screen the use from right-of-way or adjacent property lines based on the findings detailed above. The southern property line and right-of-way must be further screened to be consistent with the Use Specific Regulations. Staff recommends a second row of vegetative screening be added south of the proposed black hills spruce on the south side of the lot to fill the gaps between the proposed trees. The western property line must be further screened to be consistent with the Use Specific Regulations. Addition screening through trees is potentially not feasible on the west side of the lot due to the presence of the underground pipes. Any trees installed may not damage the pipes but would need to be removed if maintenance were needed to be performed on the underground pipes. The area could be seeded with a seed mix that includes tall grasses; however, the structures and pipes are unlikely to be fully screened by any tall grass. The eastern property line must be further screened to be consistent with the Use Specific Regulations. While the area beyond the property line on the adjacent property is heavily wooded, the standards require screening from property lines. As the UDC establishes a use specific regulation regarding screening, if the use cannot provide screening that meets the standards, either a variance would be required, or the application should be denied. Screening can be provided between a mix of vegetation and opaque fencing. 13 | P a g e Woodland Preservation The applicant has not proposed plantings on the site for the replacement trees and has instead requested to pay cash-in-lieu. This would require a payment of $4,600.00. Staff believes that the request to pay cash-in-lieu to the tree fund of $4,600.00 is reasonable. Public Comment Staff received concerns from the property owner to the east prior to the public notice being issued. Concerns generally related to screening and potential noise. COMMISSION ACTION The Planning Commission can do one of the following: 1. Recommend approval, with or without conditions, of the attached resolution. 2. Recommend denial, with findings, of the attached resolution. 3. Table the request for further review/study. RECOMMENDATION Staff recommends the Planning Commission open the public hearing and receive any and all comments. Staff recommends the Planning Commission: Motion to table the application for a conditional use permit to allow for an essential services – utility substation, with revisions requested to address the code compliance issues outlined in the staff report from the July 1, 2025, Planning Commission meeting. Staff does not recommend the Planning Commission recommend approval at this time. The following conditions have been prepared for consideration: 1. The location and layout of structures and facilities on the lot shall be substantially consistent with the plans submitted to the city and reviewed with this request with the exception of where revisions are required with this approval. 2. Before a building permit can be issued for the site: a. Plans shall be revised to show: i. Stormwater management facilities shall be wholly located within drainage and utility easements. ii. Total impervious surface coverage of 25% or less. iii. Wetland setbacks shall be met for all structures and impervious surfaces. iv. Additional screening shall be added through a combination of vegetation and opaque screening to the south, east, and west side. v. Proposed structures shall be consistent with Character Area: Rural Residential Districts standards. 14 | P a g e b. The applicant shall enter into a development agreement with the city. At minimum, the development agreement shall: i. Provided a financial guarantee to return the parcel to its original condition when the utility is no longer needed as described in 153.300.030 Subd. 1 (M) III. ii. Include a site improvement performance agreement and financial guarantee for the completion of landscaping and all other private exterior amenities or improvements as shown on the approved Site Plan and as required by the Site Plan approval as required by 153.500.060 Subd. 1 (D). iii. Provide a payment of $4,600.00 to the Tree Fund in lieu of planting trees required by 153.400.070 Woodland and Tree Preservation. 3. The area of the site used for the utility facility or structure must be landscaped to provide adequate screening from property lines and the road right-of-way. 4. The applicant shall secure any and all applicable and necessary permits required from local, state, and federal entities prior to work on the site. 5. While we understand his concerns, we must respectfully express that we cannot accommodate this request without causing undue environmental disruption and potentially violating ecological best practices. This portion of the property is a sensitive wetland area, and introducing new plantings there could adversely affect the existing habitat, disrupt natural drainage patterns, and run counter to local environmental guidelines. We have consulted with environmental professionals who agree that additional disturbance in this area should be avoided to preserve the integrity of the wetland. Moreover, we believe the request for additional screening is unnecessary given the current conditions. The adjacent property already benefits from two dense stands of mature trees, which were included in our original application submission and serve as a natural vegetative buffer between our properties. These trees are well-established and provide substantial visual screening in both directions—from his property to ours and vice versa. It’s important to highlight that this existing screening is not only effective but has been in place for many years, contributing to both privacy and aesthetic value without requiring intervention. Adding further plantings would not significantly enhance the screening already provided, and doing so in the wetland area would likely cause more harm than benefit. For these reasons, we are asking for the support of the reviewing staff in acknowledging that additional screening measures on the east side of our property are both unfeasible and unwarranted. We remain committed to working in good faith with our neighbors, but we must also prioritize responsible land stewardship and compliance with environmental protections. Proposed parking lot layout and configuration clearly identifying the number of standard and ADA compliant stalls and the dimensions of existing and proposed parking spaces. Parking spaces do not need to be marked on site. Concern comes from location of parked vehicles and emergency vehicle access and circulation. This will be a private facility and is not a permanently manned facility - - Theresa Mas Henderson….. Northern has shown the emergency vehicle access and circulation on the truck routing plan (C2.02) and site dimensions on C2.01. The vehicular traffic from Northern’s local operation personnel will be expected onsite approximately once per month for maintenance tasks (likely only one team member at a time). This will be a ¾ ton or 1-ton service truck (no trailer). Once per year, a company such as ATTACHMENT F 2 USDI or Arkema will need to deliver approximately 7,000 – 8,000 gallons of odorant. This will need to be delivered with an 18-wheeler tanker truck (combination vehicle). Other than that, there could be maintenance tasks completed by third parties to complete tasks such as spraying for weed control. This would likely be only once or twice per calendar year. Northern has identified a parking area and ADA compliant parking on Drawings C2.01 and C3.01. Exhibit showing vehicular circulation for emergency services and commercial vehicles (semis or box trucks) when service vehicles are parked on site. This detail is shown on Drawing C2.02 Truck Routing Plan. Location of rooftop equipment and proposed screening, or statement that none is proposed. There is no rooftop equipment proposed. Provisions for storage and disposal of waste, garbage, and recyclables, if any exterior storage of such materials is proposed. No exterior storage of waste, garbage or recyclable material is planned at this site. Grading/Storm Water Drainage Plan. Current design provided in this email. Northern does note that RCWD has asked for updates to the stormwater modeling, which is targeted for completion by June 20, 2025. Northern will submit the updated information on that date. A minimum five-foot strip from building walls facing a public right-of-way must be treated with decorative ground cover and/or foundation plantings, except for garage/loading and pedestrian access areas. Details of planting beds and foundation plantings shall be provided. Northern has added a 5-foot buffer to the odorizer and EFM buildings on the sides that face the public ROW. This includes a 5-foot landscape bed at building foundation with foundation plantings. Where landscape or man-made materials are used to provide screening from adjacent and neighboring properties, a cross-through section shall be provided showing the perspective of the site from the neighboring property at the property line elevation. Cross-sectional views along the north, west and south sides of the property are provided. Woodland Preservation Plan. Boundary lines of the property with accurate dimensions as established by survey. Northern has included the dimensions in latest site plans. Location of existing and proposed buildings, structures, parking lots, roads, impervious surfaces and other improvements. Northern is not able to plant 25% deciduous trees and still meet the agreements made with the landowners. The requirement for the five-foot strip is in our landscaping standards in Section 153.400.060 which does not have any built in flexibility, so it would require a variance for it to omitted. The standards do state, “decorative ground cover and/or foundation plantings” which you can interpret how makes sense for your use. If staff feels what is proposed is inconsistent with the ordinance we will flag it for the Planning Commission and City Council to discuss. I’ll also note, this isn’t something that needs to be revised for the application to be considered complete, but we have the following standard regarding tree species: The complement of trees fulfilling the requirements of this Section may be not less than 25% deciduous and not less than 25% coniferous, unless the proposed plantings are designed to create a natural setting and it is approved by the City Council. Single-family detached housing development is exempt from this requirement. Right now I think the proposed trees are 100% coniferous.
