Hofer, Consultant City Planner Frannie Nielsen, Consultant Planner Re: UDC Amendment for Major and Minor Site Plan Review City staff have prepared an ordinance amendment to adjust when a major and minor site plan review by Planning Commission and approval by City Council is required. The staff report to the Planning Commission from the November 4, 2025, meetings is attached and includes the background of the amendment as well as the draft language and staff analysis. ANALYSIS Planning Commission The Planning Commission heard the ordinance amendment at the November 4, 2025, meeting. The Commission held a public hearing at the November meeting. No comments as part of the public hearing. The Planning Commission reviewed the ordinance language and believed the ordinance amendment aided in simplifying the process. The Planning Commission moved to recommend approval of the amendment. The motion was approved with a vote of 3-0 (Hogle and Cullen absent). COUNCIL ACTION The City Council can do one of the following: 1. Approve, with or without conditions, of the attached ordinance and resolutions. 2. Deny, with findings, of the attached ordinance and resolutions. 3. Table the request for further review/study. RECOMMENDATION The Planning Commission recommends approval of the attached Ordinance 2025-14 regarding determination of a Minor or Major Site Plan Review. Planning Commission “UDC Amendment for Major and Minor Site Plan Review” Packet, November 4, 2025 Page 1 of 2 CITY OF SCANDIA ORDINANCE NO.: 2025-14 AN ORDINANCE AMENDING THE SCANDIA UNIFIED DEVELOPMENT CODE 153.500.070 REGARDING MINOR AND MAJOR SITE PLAN REVIEW The City Council of the City of Scandia, Washington County, Minnesota hereby ordains: Section 1 Amendment. The City of Scandia Unified Development Code (“Development Code,” or “Code”), Chapter 153.500.070 Submission Requirements for Minor and Major Site Plan Review, shall be amended by adding the underlined text and deleting the stricken text as follows: 153.500.070 SUBMISSION REQUIREMENTS FOR LAND USE APPLICATIONS Subd. 2. Submission Requirements for Site Plan Review. All Lland Uuse Aapplications require the submission of a Site Plan as described herein. When no primary Lland Uuse Aapplications is required, the Pproject shall be classified as either a Minor Project orf Major Project as described below. (B) Classification of Project as Minor Project or Major Project. Projects shall be classified as a Minor Project or a Major Project based on the criteria set forth herein, with the exceptions as noted. Any project, Minor or Major, may submit a Ppre-Aapplication concept plan for review and comment by the Zoning Administrator, Planning Commission, or City Council. I. Exceptions to Review. The following shall be exempt from Site Plan Review: a. Agricultural uses in the AG-C, AP, and GRRR-G Base Zoning Districts. b. Single family detached dwellings and related accessory uses. c. Two family attached dwellings and related accessory uses. II. Minor Projects. Projects shall be classified as Minor, provided that: a. The site and the use are in compliance with the Comprehensive Plan;. b. The use is explicitly classified as a permitted or accessory use on Table [153.300.020-2] Table of Uses;. c. The application is complete and in compliance with the standards of the applicable codes, ordinances, and policies and does not require any variance from those standards;. d. The site is a legal parcel of record at the time of application. e. The project results in the exterior alteration of a structure to which Section [153.400.040] Character Area Standards are applicable, or the Scandia Architectural Design Guidelines (dated September 2009 and as may be amended) are applicable. The project is explicitly classified as a conditional or interim use on Table [153.300.020-2] Table of Uses.; or c. The project proposes a condition that would require an exception from Section [153.400.040] Character Area Standards through the Design Review process as detailed in Section [153.400.040 Subd. 1 (C) and (D)]. d. The project results in the exterior alteration of a structure to which Section [153.400.040] Character Area Standards are applicable, or the Scandia Architectural Design Guidelines (dated September 2009 and as may be amended) are applicable. Section 2 Planning Commission. The Planning Commission discussed the proposed ordinance at their November 4, 2025, meeting and held a public hearing on the amendment at a public hearing at their November 4, 2025, meeting. No comments were made at the public hearing. The Planning Commission voted to recommend approval of the ordinance. Section 3 Effective Date. This ordinance shall be in full force and effect upon its adoption. Passed and adopted by the City Council of the City of Scandia this 18th day of November 2025. Steve Kronmiller, Mayor ATTEST: Kyle Morell, City Administrator CITY OF SCANDIA, MINNESOTA RESOLUTION NO. 11-18-25-02 APPROVING FINDINGS OF FACT FOR AN ORDINANCE AMENDING THE SCANDIA UNIFIED DEVELOPMENT CODE 153.500.070 REGARDING MINOR AND MAJOR SITE PLAN REVIEW WHEREAS, the City of Scandia adopted the Unified Development Code (UDC) on September 20, 2022, to replace the previous zoning and subdivision codes; and WHEREAS, the City Council established Section 153.500.070 Subd. 2 in the Unified Development Code to establish when a project is considered a minor or major project; and WHEREAS, the City identified the need to update the UDC to amend language regarding when a project was determined to be a minor or major project, as required in Section 153.500.070; and WHEREAS, the City of Scandia has proposed to amend the Unified Development Code Chapter 153.500.070 Submission Requirements for Minor and Major Site Plan Review; and WHEREAS, the Planning Commission reviewed a draft of Ordinance 2025-14, regarding minor and major site plan review, and held a public hearing on November 4, 2025, and recommended approval of the ordinance; and WHEREAS, the City Council reviewed Ordinance 2025-14, regarding minor and major site plan review on November 18, 2025; and, WHEREAS, the City took public input on Ordinance 2025-14, regarding minor and major site plan review, on November 4, 2025, at duly called public hearings; and WHEREAS, the City Council has adopted an Ordinance 2025-14 amending the Unified Development Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it should and hereby does support the request for an amendment to the Unified Development Code Section 153.500.070 regarding minor and major site plan reviews. BACKGROUND A recent application for a site plan review was deemed a major project as the proposed alterations included an exterior alteration to which Character Area Standards applied. During the review staff identified that the extent of the process for a major project site plan review may be unnecessary given other review procedures in the Unified Development Code (UDC). The application in question was proposed to meet all standards within the UDC, but still required a review by the Planning Commission and City Council. Site Plan reviews are either reviewed as a Minor Site Plan Review or a Major Site Plan Review. Minor Site Plan Reviews are initiated by the following circumstances: a. The site and the use are in compliance with the Comprehensive Plan b. The use is explicitly classified as a permitted or accessory use on Table [153.300.020 -2] Table of Uses c. The application is complete and in compliance with the standards of the applicable codes, ordinances, and policies and does not require any variance from those standards; d. The site is a legal parcel of record at the time of application Major Site Plan Reviews are initiated by the following circumstances: a. The project is not classified as an exception or as a Minor Project; and b. The project is explicitly classified as a conditional or interim use on Table [153.300.020- 2] Table of Uses; or c. The project results in the exterior alteration of a structure to which Section [153.400.040] Character Area Standards are applicable, or the Scandia Architectural Design Guidelines (dated September 2009 and as may be amended) are applicable. Major site plan review for exterior alterations of a structure is not needed because Character Area Standards will still apply and be reviewed as part of any site plan review. Character Area Standards are imposed to support and reinforce the desired physical development patterns and ATTACHMENT D 2 | P a g e forms in the City based on the described Character Area. Applications that meet circumstance c. from the major site plan review that meet the standards established in the Character Area Standards are proposed to be moved to minor site plan review to streamline the approval process for this type of request. Staff is recommending an additional circumstance to trigger a major project if an applicant requests an exception to the Character Area Standards through Design Review as detailed in the UDC. Exceptions to the Character Area Standards are subject to the review, establishment of reasonable conditions, and review by the Planning Commission and approval by the City Council. OVERVIEW OF DRAFT ORDINANCE Staff have drafted the attached amendment to amend the existing UDC relating to site plan reviews. The following language in the ordinance is shown with removed text as red strike through and added text as red underlined. 153.500.070 SUBMISSION REQUIREMENTS FOR LAND USE APPLICATIONS Subd. 2. Staff believes the proposed amendments will create a more efficient process for applicants while still providing an opportunity for review by Planning Commission and decision by City Council when flexibility from Character Area Standards are requested. COMMISSION ACTION The Planning Commission can do one of the following: 1. Recommend approval, with or without conditions, of the attached draft ordinance. 2. Recommend denial, with findings, of the attached draft ordinance. 3. Table the request for further review/study. RECOMMENDATION Staff recommends that the Planning Commission open a public hearing and receive any and all comments from the public. Staff recommend the Planning Commission recommend approval of the ordinance amendment regarding determination of a Minor or Major Site Plan Review, with any amendments deemed necessary: Motion to recommend the City Council approval of the attached ordinance to amend 153.500.070 of the Unified Development Code regarding Minor and Major Site Plan Reviews, with the findings and conditions described within the staff report. Steve Kronmiller, Mayor ATTEST: Kyle Morell, City Administrator City of Scandia, MN CHAPTER 153: UNIFIED DEVELOPMENT CODE (UDC) SECTION 153.500 ADMINISTRATION AND PROCEDURES 153.500 Adopted 09.20.2022, Last Amended 06.17.2025 (Ordinance No. 2025-10) page-14 (F) Administrative Permits for Land Alteration and Grading – Supplemental Procedures. I. Applicability. A grading, erosion and sediment control plan shall be submitted and an Administrative Permit obtained for the following activities: a. All new commercial or industrial construction and additions. b. All new residential construction and any new impervious surface if: i. 5% or more of lot area is disturbed ii. Construction or improvement are proposed within 50 ft. of a property line c. As required by the Shoreland Management Ordinance within the Shoreland Overlay. d. Clearing trees in an area larger than 20,000 square feet. e. Any excavating, grading or filling or change in the earth’s topography in any designated wetland, wetland setback area, floodplain, or the St. Croix River District. f. All major or minor subdivisions g. Any land alteration or development activity, regardless of size, that the City determines is likely to cause an adverse impact to an environmentally sensitive area, to another property, or to a City right-of-way. II. Exemptions. A permit is not required for the following: a. Installation and maintenance of home gardens or minor landscaping where the total volume of earth disturbed does not exceed 10 cubic yards of graded or fill material added to or removed from the site or excavated within the site. b. Routine agricultural activities such as tilling, planting, harvesting, and associated activities. c. Cemetery graves. d. Driveways permitted in conjunction with a building permit provided there is less than 10 cubic yards of land alteration or grading of material added to or removed from the site or excavated within the site and/or the disturbance of land area of 600 square feet or less. e. Regular maintenance of existing driveways. f. Emergency work necessary to protect life, limb or property. g. Mining and Related Activities that regulated by Chapter 154 of the City’s Code of Ordinances. III. Other Permits. The applicant may be required to obtain additional permits from other regulatory agencies having jurisdiction over the land alteration activities. It shall be the responsibility of the applicant to obtain all required permits. 153.500.070 SUBMISSION REQUIREMENTS FOR LAND USE APPLICATIONS. Subd. 1. Submission Requirements for Land Use Applications. All Land Use Applications shall include the following submission materials. The Zoning Administrator shall provide assistance to the applicant to determine the applicable application type based on the proposed request. All Land Use Applications shall be submitted both electronically and hard copy and the number of hard copies shall be determined by the Zoning Administrator. (A) Requirements for Pre-Application Concept Plan Review. Any applicant for a Land Use Application may request a Concept Plan review prior to submission of a formal application. The Concept Plan may be conceptual and may include the following related materials: I. A brief narrative of the following: a. Description of the proposed use and/or request. Statement of proposed density of the project, with the method of calculating the density. c. Description of proposed sewage disposal facilities, water service, and storm drainage. d. Proposed schedule of development. e. Information on the proposed developer. f. Acknowledgement from the Owner, if the Owner is different than the applicant indicating support of the applicant’s request. II. A drawing to scale of the proposed site, such drawing may include an aerial with parcel boundaries. III. General location of proposed structures. IV. Tentative street arrangements, both public and private. V. Amenities to be provided such as recreational areas, open space, walkways, etc. VI. General location of parking areas. VII. Topographic contours at 10 foot or 2-foot intervals. VIII. Wetland delineation or general location of wetlands from the National Wetlands Inventory. IX. Other information or materials useful in reviewing the Concept Plan. (B) Submission Requirements for all Land Use Applications. All Land Use Applications shall include the following submission requirements: I. All materials as identified in Section [153.500.050 and 153.500.060] II. Narrative. A narrative of the proposed project and use shall accompany all Site Plan applications. The narrative shall include: a. Description of the proposed Project request and operations. At a minimum, the narrative must describe: i. Conditional Use Permit or Interim Use Permit Application. All requests for conditional or interim use shall include a description of the number of employees, anticipated site activity including number of visitors, hours of operations, and any other information that descripted onsite operations and activities. ii. Variance Application. All requests for variance from this Chapter shall include a description of the Practical Difficulties of the Project present. iii. Proposed schedule of development of the Project or phasing, if applicable. iv. Identification of any other agencies contacted that may have jurisdiction over the proposed Project. III. Site Plan as described in Subd. 2. IV. An electronic version of the submission materials, and any hardcopies as requested by the Zoning Administrator. Subd. 2. If the Site Plan application includes a Primary Land Use Application for conditional use, interim use or variance then the request will be classified as a Major Project, and the submission requirements shall include those stated within this Section and the applicable Primary Land Use Application. The purpose of the Site Plan review process is to verify that the proposed application and project is consistent with the standards of this Chapter and any other applicable ordinances. The site is a legal parcel of record at the time of application. III. Major Projects. Projects shall be classified as Major, provided that: a. The project is not classified as an exception or as a Minor Project; and b. The project is explicitly classified as a conditional or interim use on Table [153.300.020-2] Table of Uses; or c. The project results in the exterior alteration of a structure to which Section [153.400 .040] Character Area Standards are applicable, or the Scandia Architectural Design Guidelines (dated September 2009 and as may be amended) are applicable. (C) Submission requirements. The submission requirements for both Minor and Major Projects are generally the same, and consist of the materials as identified herein. I. Plan Set Requirements. A Plan Set shall accompany all Site Plan application submissions which shall include, but not be limited to, the following drawings: the Site Plan, Grading/Storm Water Drainage Plans, and Landscape Plan. All submitted Plan Sets shall include the following information on the Title Sheet, with individual plans of the Plan Set appropriately labeled with title, scale, date and signature of licensed preparer: a. Name and address of developer/owner. b. Name and address of architect/designer. c. Date of plan preparation. d. Dates and description of all revisions. e. Name of project or development. f. Scale of plan (engineering scale only, at 1 inch equals 50 feet or less). g. North point indication II. Site Plan. The Site Plan shall include, but may not be limited to, the following: a. Lot dimension and area. b. Required and proposed setbacks. c. Location, setback and dimension of all buildings on the lot including both existing and proposed structures. Off street parking areas for outdoor recreation uses which are illuminated must meet the requirements stated in 153.300.030 Subd. 4. (D) II. (E) Prohibitions. The following outdoor light fixtures are prohibited within the City of Scandia: I. Search lights or sky trackers II. Flashing, blinking or rotating lights III. Neon lighting on the exterior of a building IV. Raceway lighting V. Exposed fluorescent tubes VI. Mercury vapor lamps VII. Laser lights VIII. Back lit canopies or awnings (F) Submission of Plans. The applicant for any permit requiring outdoor lighting must submit evidence the proposed outdoor lighting will comply with this UDC. The submission must contain the following in addition to other required data for the specific permit: I. Plans indicating the location on the premises, and the type of illuminating devices, fixtures, lamps, supports, reflectors and other devices. II. Description of illuminating devices, fixtures, lamps, supports, reflectors and other devices and the description may include, but is not limited to, catalog cuts by manufacturers and drawings (including sections where required); III. Photometric data, such as that furnished by manufacturers, or similar showing the angle of the cutoff or light emissions. 153.400.040 CHARACTER AREA STANDARDS Subd. 1. Purpose and Intent. The City’s Base Zoning Districts are categorized and organized by Character Area as defined in [Section 153.200.010]. The development patterns and forms throughout the City differ by Character Area. The standards contained within this Section are intended to support and reinforce the desired physical development patterns and forms in the City based on the described Character Area. (A) Applicability. The following Character Area Standards do not apply to single-family detached residences or the accessory structures that are used by the inhabitants of the principal structure, unless expressly stated in subsection (B). (B) Architectural Design Standards. The City’s adopted Design Guidelines are standards which are generally suggested and encouraged. This Section is established to identify those standards and suggestions from the Design Guidelines that are required and are defined as the Architectural Design Standards. The following Architectural Design Standards are organized by Character Area. I. Character Area: Agricultural Districts (A-P and AG-C). This Character Area is defined by larger tracts of land that are used for active agricultural, small hobby farms, rural residential and associated accessory uses and activities. Single-family homes, accessory structures and farmsteads are typically setback from public rights-of-way and are buffered from adjacent properties and uses with vegetation and /or natural topography. The following standards are established for any non- residential use, conditional or interim use that proposes a new structure, expansion, or modification of an existing structure. The purpose of the following is to reinforce the character of this area as described herein: a. Architectural Design. Design of new structures must reference design elements of existing historic rural buildings if present onside including barns, farmhouses and schoolhouses. ATTACHMENT C City of Scandia, MN CHAPTER 153: UNIFIED DEVELOPMENT CODE (UDC) SECTION 153.400 DEVELOPMENT, CHARACTER AND BUILDING STANDARDS 153.400 Adopted 09.20.2022, Last Amended 08.19.2025 (Ordinance No. 2025-13) page-23 k. If new sidewalks are installed, or renovations to existing sidewalks are made, planting islands should be created to include shade trees, grassy boulevards, flowers, and other public realm landscape elements. l. Design Guidelines: In addition to the standards listed herein, conformance with the City’s adopted Architectural Design Guidelines is required for any new use or development. (C) Design Review for Exceptions. A landowner may request an exception to any of the standards listed herein, which will be subject to the review, establishment of reasonable conditions and approval of the Planning Commission and City Council. The request will be processed through a Design Review and will not be considered a variance. The Design Review does not require a public hearing, and the Design Review may or may not accompany another formal land use application. (D) Design Review. An applicant or developer may request a Design Review of any proposed exception to the Standards established within this Section 153.400.040 Character Area Standards. The following process will apply: I. If requested, Design Review will occur concurrently with the application for any Building Permit, Variance, Conditional Use Permit, Administrative Permit, Site Plan Review, Planned Unit Development or other permit(s) as may be required by this Section. II. The Planning Commission will provide recommendations to the City Council on any project referred to it for Design Review. The Planning Commission may consult with staff, consultants or other experts or resources as appropriate to the application request. The City Council has final authority to grant an exception to the standards contained within this Section. 153.400.050 OPEN SPACE, PARK DEDICATION, STORMWATER AND DRAINAGE Subd. 1. Summary and Intent. The purpose of regulating open space, stormwater and drainage is to protect, enhance and support the natural resource systems in the community. The regulations and standards established within this section are intended to protect the health, safety and welfare of the community and its structures by regulating site development and use of property. Subd. 2. Land Alteration and Grading (A) Purpose. The purpose of this section is to establish regulatory requirements for land development and land disturbing activities and to minimize potential threats to public health, safety, public and private property and natural resources within the City from construction site erosion and sedimentation. I. General Standards. The following general standards apply for any grading, drainage and erosion control associated with any development, redevelopment, or platting: a. All development must be designed to minimize the potential for soil erosion (e.g. protection of steep slopes, using topography to guide developable areas, avoiding inadequate soils, etc.). b. Slopes over 25% (4:1) should be protected to the extent possible, and any proposed alteration must be reviewed by the City Engineer. c. Development on slopes with a grade between 12% (8:1) and 25% (4:1) must be reviewed by the City Engineer to confirm that adequate measures have been taken to prevent soil erosion, sedimentation, vegetative, and structural damage. d. Plans to place fill or excavated material on steep slopes (greater than 18%) must be reviewed by the City Engineer for slope stability and finished slopes of 30 percent or greater are prohibited. e. Erosion and siltation measures must be coordinated with the different stages of development. Appropriate control measures must be installed prior to development when necessary to control erosion.
