RESOLUTION NO. 11-18-25-15
AUTHORIZING THE ASSESSMENTS PURSUANT TO THE ASSESSMENT
AGREEMENT AND APPEAL WAIVER FOR THE TII GAVO COMMUNITY SEPTIC
SYSTEM
WHEREAS, Tii Gavo Community Association’s (“Association”) community septic
system (“System”) requires significant repairs and upgrades that are required to bring the System
into compliance with the Minnesota Pollution Control Agency’s (“MPCA”) regulations; and
WHEREAS, the Association approached the City of Scandia (“City”), requesting
assistance to obtain a Clean Water Partnership Loan (“CWPL”) from the Minnesota Pollution
Control Agency (“MPCA”) to help fund the work needed to complete the repairs and upgrades to
the System (“Project”); and
WHEREAS, the City agreed to assist the Association in obtaining a CWPL, provided the
City taxpayers do not ultimately pay for the costs associated with CWPL; and
WHEREAS, the Association requested that the City assess the CWPL total costs against
the real property that is part of the Association; and
WHEREAS, the City has required that prior to executing any loan documents for the
CWPL, the Property Owners of the real property that is part of the Association must either enter
into an Assessment Agreement and Appeal Waiver (“Assessment Waiver”), acknowledging and
agreeing to the Assessment Amount of $35,329.15 (“Assessment Amount), or pay the entire
Assessment Amount; and
WHEREAS, the Association has provided the City with thirty-five executed Assessment
Waivers, from thirty-five of the Property Owners.
NOW, THEREFORE, BE IT RESOLVED by the City of Scandia that the City
acknowledges and accepts the executed Assessment Waivers.
FURTHER, BE IT RESOLVED that the City of Scandia has the legal authority to
certify the Assessment Amount to the property taxes for the corresponding real property identified
in each Assessment Waiver.
FURTHER, BE IT RESOLVED that the Mayor, City Administrator and/or City
Attorney are hereby authorized to execute such documents and agreements as are necessary to
certify the Assessment Amount.
