06.g Marine School PTO Gambling Permit Staff Report Date of Meeting: March 17, 2026 To: City Council From: Brenda Eklund, City Clerk Re: Marine School Association PTO Application for an Excluded Raffle Permit Background: The Marine School Association PTO has applied for an Excluded Raffle Permit for their fundraising event planned for April 25, 2026, being held at the Scandia Community Center. The Gambling Ordinance, Chapter 130.01-130.99 of the City’s Code of Ordinances, requires a local permit to conduct lawful gambling that is excluded or exempted from state licensure requirements. Issue: Should the City approve Marine School Association PTO’s application for an Excluded Raffle Permit? Proposal Details: The organization will sell raffle tickets for prizes. The value of all prizes awarded will be valued at $3,500. State law allows an excluded raffle to be conducted by a nonprofit 501(c)(3) organization if the total value of all prizes donated and purchased for one event does not exceed $5,000. The PTO’s nonprofit 501(c)(3) status with the IRS is active and in good standing. The application appears to meet all the requirements of the ordinance. Fiscal Impact: The $15 application fee has been paid. Options: 1) Approve Marine School Association PTO’s Excluded Raffle Permit. 2) Do not approve the request for a gambling permit. 3) Make no decision at this meeting. Recommendation: Option 1. An excluded raffle may be conducted by a nonprofit organization when for the calendar year: •the total value of ALL prizes donated and purchased is less than $1,500, OR •if the organization is a 501(c)(3) organization, the total value of ALL prizes donated and purchased for one event does not exceed $5,000 (see Minnesota Statutes, section 349.166, Subd. 1(c) ). The City Council meets on the third Tuesday of each month. Applications must be received not less than 5 days prior to the meeting date.
