05.c.2 MN DNR Opportunity for Comment - Ordinance Amendment Regarding Nonconforming Buildings From: Scollan, Daniel (DNR) <daniel.scollan@state.mn.us> Sent: Monday, June 1, 2026 12:04 PM To: Tom Langer <tom.langer@cmscwd.org>; TJ Hofer <tj.hofer@bolton-menk.com>; Mike Sandager <mike.sandager@clflwd.org>; William Roach <wroach@ricecreek.org> Cc: Kyle Morell <k.morell@ci.scandia.mn.us>; Greenlee Dahle <Greenlee.Dahle@bolton-menk.com>; Mike Isensee <mike.isensee@cmscwd.org> Subject: RE: Opportunity for Comment - Ordinance Amendment Regarding Nonconforming Buildings *** WARNING: This email is from outside the company. Proceed with Caution*** Hello TJ, Thank you for giving DNR the opportunity to comment on this proposed zoning ordinance amendment. We agree with the watershed district that the city’s shoreland ordinance is missing Minn. Stat. 462.357, Subd. 1e(i). This statutory provision is included in DNR’s model shoreland ordinance within Section 3.7. This omission was likely an oversight. The ordinance should be brought into compliance with the entirety of this statute. We recommend that this omission be brought to the planning commission’s attention and brought forward by staff as an additional amendment.
