The Commission must hold a public hearing on the variance request. The Commission must determine if a practical difficulty exists, and if the variance being issued is the minimum action necessary to alleviate the practical difficulty. The Commission is asked to make a recommendation to the City Council. The applicant is requesting approval of a variance to replace an existing septic system.  City of Scandia Ordinance No. 198 Shoreland Management Regulations, Sec. 6.4 – Manage 1 Wetland Setback  Washington County Ordinance No. 206, Chapter 4 Subsurface Sewage Treatment System (SSTS) Regulations, Sec. 16.2 (6) The city has adopted the Washington County Ordinance No. 206, Chapter 4 Subsurface Sewage Treatment System (SSTS) Regulations (SSTS Regulations) by reference. Washington County reviews and permits SSTS, but the city is responsible for reviewing and acting on variance 2 | P a g e requests from the regulations. Staff recommend approval of the requested variance with conditions. BACKGROUND The applicant is requesting approval for a variance to replace an existing subsurface sewage treatment system (SSTS or septic). The applicant has stated that the existing septic system is noncompliant and must be replaced. The Unified Development Code (UDC) states in 153.400.030 Subd. 2 (B) (emphasis added): (B) Sewage Treatment. Washington County Development Code Chapter Four Subsurface Sewage Treatment System Regulations (referenced as “Washington County SSTS Regulations” throughout this UDC) as adopted on July 27, 2018, and as may be amended from time to time is hereby adopted by reference as if herein printed in full. However, Variances and modifications related to setbacks from wetlands must be heard by, and approved by, the Scandia City Council. As the existing septic encroaches into a wetland setback, a variance is required to be reviewed and acted on by the City Council. Existing Conditions The existing lot is a conforming lot in the Rural Residential General (RR-G) zoning district and is partially within the Shoreland Management Overlay District (SM-O) of Clear Lake. The relevant standards from the UDC and the SSTS Regulations are included in the table below. The relevant nonconformity for the current request is the encroachment into the required 75 ft. wetland setback. The existing septic tanks are located in approximately the same location as the proposed tanks. Staff contacted WCD staff to verify the wetland boundaries shown on the certificate of survey, who confirmed that the boundaries and elevations can be used for variance approvals. EVALUATION OF REQUEST Proposed Conditions The applicant proposes to replace the existing septic system which is noncompliant and required to be upgraded by Washington County. The new septic would be a Type III mound system, and the applicant has worked with a licensed septic designer to establish a site plan. The mound system is proposed as a rock bed with sand below and no drain field due to the soils on site. The existing and proposed tanks are located 87.4 ft. from the wetland boundary on the northwest of the site. There is a proposed pump tank located 19.2 ft. from the wetland boundary on the southeast of the site. The proposed soil treatment area (absorption extent) would be 35.0 ft. from the wetland boundary to the south on the site. According to the submitted narrative, the system is designed to utilize gravity by directing flow to the rock bed in a PVC line. Variance Section 153.500.060 Subd. 1 (B) establishes the standards for when the City shall approve a variance and mirrors Minn. Stat. 462.357, subd. 6(2). The variance must be consistent with the Comprehensive Plan and must be in harmony with the general purpose and intent of this Chapter. A variance may be granted when enforcement of this Chapter would result in practical difficulties. The Practical Difficulties test criteria as established by Minnesota Statute and codified in the UDC and are listed below in italics followed by Staff’s analysis: a. The applicant proposes to use the property in a reasonable manner not permitted by this Chapter. 4 | P a g e The proposed use of a subsurface sewage treatment system (SSTS) is reasonable and necessary for the existing use, a single family dwelling, to continue on the site. b. The plight of the landowner is due to circumstances unique to the property not created by the landowner. The site has an existing and noncompliant SSTS that must be replaced as it has been found noncompliant with the adopted standards for subsurface sewage treatment systems by Washington County. The property is an existing nonconforming lot of record and is uniquely encumbered by wetland setbacks, which limit usable space on the lot. c. The variance, if granted, will not alter the essential character of the locality. The variance will replace an in ground system with a mound system, as the site cannot support an in ground system. The mound system is consistent with the neighborhood and will not alter the essential character of the locality. d. Economic conditions alone shall not constitute practical difficulties. Economic conditions are not the sole factor in the variance. e. May include, but is not limited to, inadequate access to direct sunlight for solar energy systems. The variance is not related to inadequate access to direct sunlight for solar energy systems. f. The proposed variance will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion of the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood. The requested variance is the minimum action required to eliminate the practical difficulty as there are no alternatives to address sewage treatment on the property. 5 | P a g e ANALYSIS Review Comments The submittal was sent to city staff and other regulatory agencies for review and comment. Comments from other entities have been incorporated into the conditions for approval. Washington County Washington County staff provided the following comment: We have not received a design or application for the proposed septic system. We would recommend that they apply for the septic installation permit as soon as possible so we can determine that the proposed septic system would be permittable, besides for the setback issue they are seeking a variance for, before getting the variance. Washington Conservation District (WCD) WCD staff provided the following comments: The shown wetlands are adequate for setback purposes. The NWI wetland closest to the rock bed extends further up slope than what I measured in the field. The dimensions and setbacks on the plan appear accurate. Comfort Lake-Forest Lake Watershed District (CLFLWD) CLFLWD staff provided no comment. Department of Natural Resources (DNR) The DNR Area Hydrologist provided no comment. Engineering Department The City Engineer provided no comment. Fire Department The Fire Chief provided no comment. Public Works Department The Public Works Director provided no comment. Staff Analysis Staff find that the proposed variance is consistent with the UDC and the Comprehensive Plan. The application meets the standards for practical difficulty, and the proposed plan is the minimum action required to address it. The 50-ft. setback from the well is necessary to maintain public health and safety. According to the applicant, the proposed design will improve the environmental conditions on the property. Staff find an encroachment into a wetland setback is a more minimal action than encroachment 6 | P a g e into a well setback. Staff find the proposed variance request to be reasonable and necessary for the installation of a compliant septic system. A compliant septic system is necessary for the existing use of a single-family dwelling on the property. Staff contacted the applicant who subsequently submitted the application materials to Washington County. Approval of the septic permit from Washington County is a condition of the approval but does not need to happen prior to City Council acting on the variance request. COMMISSION ACTION The Planning Commission can do one of the following: 1. Recommend approval, with or without conditions, of the attached ordinance and resolutions. 2. Recommend denial, with findings, of the attached ordinance and resolutions. 3. Table the request for further review/study. RECOMMENDATION Staff recommend that the Planning Commission open a public hearing and receive any and all comments from the public. Staff recommend that the Planning Commission recommend approval of the proposed variance. Motion to recommend the City Council approval a 40.0-foot variance for a soil treatment and dispersal area and a 55.8-foot variance for a sewage tank from the 75-foot Manage 1 wetland setback and the 75-foot Unclassified Body of Water setback to replace an existing noncompliant septic system for the property at 10740 230 th Street North, with the findings and conditions described within the staff report. The above findings and following conditions of approval are recommended: 1. The location and layout of the subsurface sewage treatment system on the lot shall be substantially consistent with the plans submitted to the City and reviewed with this request except where revisions are required with this approval. 2. The variance shall be recorded with Washington County within one year of the date when the variance is approved by the City. 3. The applicant shall secure the septic installation permit from Washington County, obtain any other applicable permits from the watershed district, and all other local, state, and federal entities. 4. Septic Design Plan CITY OF SCANDIA, MINNESOTA RESOLUTION NO. 07-21-26-XX APPROVING A VARIANCE FROM A WETLAND SETBACK OF A MANAGE 1 WETLAND TO ALLOW FOR THE REPLACEMENT OF A SUBSURFACE SEWAGE TREATMENT SYSTEM FOR PARCEL 07.032.20.21.0003 LOCATED 10740 230th STREET NORTH WHEREAS, George Wilkinson (the “applicant”), on behalf of Kristel and George Wilkinson (the “owners”), has requested and made an application for a 40.0-foot variance for a soil treatment and dispersal area and a 55.8-foot variance for a sewage tank from the 75-foot Manage 1 wetland setback and a 75-foot Unclassified Body of Water setback to replace an existing septic system for the property at 10740 230th Street North and the property is legally described as; See Attachment A; and, WHEREAS, the Washington Conservation District determined that the wetland on the property is classified as a Manage 1 wetland; and, WHEREAS, the City of Scandia has adopted Ordinance 198 Shoreland Management Regulations which requires a 75-foot minimum setback for Sewage Treatment Systems from Manage 1 wetlands; and, WHEREAS, the City of Scandia has adopted Washington County Development Code Chapter Four Subsurface Sewage Treatment System Regulations (“Washington County SSTS Regulations”) as adopted on July 27, 2018, and as may be amended from time to time is hereby adopted by reference as if herein printed in full; and, WHEREAS, the Washington County SSTS Regulations requires a 75-foot minimum setback for sewage tanks and soil treatment and dispersal areas from Unclassified Body of Water, and; WHEREAS, the Planning Commission reviewed the variance request at a duly noticed Public Hearing on July 7, 2026, and recommended that the City Council approve the request with conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it should and hereby does approve, a 40.0-foot variance for a soil treatment and dispersal area and a 55.8-foot variance for a sewage tank from the 75-foot Manage 1 wetland setback and a 75-foot Unclassified Body of Water setback to replace an existing septic system for the property at 10740 230th Street North, based on the following findings: 1. The proposed use of a septic system is reasonable and necessary for the existing use, a single-family dwelling, to continue on the site. 2. The site has an existing septic system that must be replaced as it has been found noncompliant with the adopted standards for subsurface sewage treatment systems by Washington County. The property is an existing lot of record and is uniquely encumbered by wetland setbacks, which limit usable space on the lot. 3. The variance will replace an in ground system with a mound system, as the site cannot support an in ground system. The essential character of the locality is not impacted by this change. 4. Economic conditions are not the sole factor in the variance. 5. The variance is not related to inadequate access to direct sunlight for solar energy systems. 6. The proposed variance will not impair adequate supply of light and air to adjacent property, or substantially increase the congestion of the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood. 7. The requested variance is the minimum action required to eliminate the practical difficulty as there are no alternatives to address sewage treatment on the property.
