PUBLIC HEARING: CONDITIONAL USE PERMIT AND VARIANCE REQUEST FOR
HOME OCCUPATION AT 14035 205TH STREET NORTH
Consultant City Planner Greenlee Dahle presented the application from Josh and Kayla Loew for
a Conditional Use Permit (CUP) and variance for a home occupation at 14035 205th Street
North. The CUP is required because the proposed home occupation would exceed the
performance standards in the Unified Development Code (UDC). The variance is requested to
allow the proposed accessory structure to be located in front of the principal structure.
Dahle explained that seasonal agricultural businesses are not permitted in the zoning district. The
proposed home occupation would include a permanent structure for produce sales located
approximately 50 feet from the front lot line and accessed from the same driveway as the home.
The proposed use would exceed the home occupation standards related to additional traffic,
exterior storage, and outdoor display and sale of goods. The application meets the requirements
for a CUP and variance as required by the UDC.
The application was sent out for review and comment. The Watershed District stated that the
proposed improvements are below the stormwater approval requirements for Laurel Ridge and
therefore no Watershed permit is required. Public Works stated that a secondary driveway would
not be permitted.
Staff recommended approval of the CUP and variance with the conditions presented.
Hogle asked about signage and whether the sale of produce is exempt from the sign ordinance.
Josh and Kayla Loew addressed the Commission regarding their desire to sell goods a couple of
times each week. The Commission discussed the definition of temporary and noted that

temporary produce stands are an accessory use, but a CUP is required because the proposed use
exceeds the home occupation standards.
The public hearing was opened. There were no public comments.
Marosok stated that parking needs to be adequate on the property to allow vehicles to pull in,
back up, and drive out without backing onto the street. He also recommended that maintenance
of the structure be included as a condition to ensure it does not fall into disrepair.
Fodor stated that conditions should address turnaround capabilities on the lot and signage
indicating whether the site is open or closed. Kayla Loew stated that signage would be displayed
when the farmstand is open and concealed when the structure is closed.
Marosok moved to recommend approval of the CUP and variance as presented, with the
additional conditions discussed by the Planning Commission. Fodor seconded the motion.
The motion carried.
GENERAL BUSINESS: REVIEW OF ORDINANCE 2026-04 ACCESSORY
