Re: UDC Amendment for Cannabis and Lower-Potency Hemp Businesses
City staff have prepared a draft ordinance related to cannabis and lower-potency hemp
businesses to clarify existing standards and use allowances.
BACKGROUND
Staff became aware of an issue with how cannabis and lower-potency hemp businesses were
identified and allowed in Section 153.300.020 Subd. 1 (B) Table 153.300.020-2. Table of Uses.
This is described in more detail in the City Council packet linked at the end of the report.
Staff were also informed of an allowance for microbusiness licenses that permits more than one
license to be issued for a single property due to the legal definition of the term “premises.” Staff
have not identified a direct issue with this allowance as it so far has just meant larger cultivation
areas. Staff believed it was important to bring it to the attention of Planning Commission and
City Council. f
Staff presented a draft ordinance amendment to the City Council at the July 21, 2026, City
Council meeting. At the meeting, the City Council discussed the amendment and asked staff to
prepare it to be heard at a public hearing. Councilmember Libby also noted that she would
review the adopted ordinance, as she has experience in the cannabis industry from a legal
perspective.
SUMMARY OF DRAFT ORDINANCE
The draft ordinance has a significant number of changes. Because the tracked-changes version of
the draft ordinance is difficult to read, staff have included a version with the deleted text
removed.
The proposed amendment makes only one change to the effective standards for cannabis
businesses, which is the proposed language limiting a site or parcel to the operation of one
licensed business. This is an optional standard, but the Office of Cannabis Management has
indicated to city staff that a local government could adopt it.
The remainder of the proposed amendments do not change the required standards for cannabis
and lower-potency hemp uses, but aim to simplify the language.
2 | P a g e
The ordinance amendment would:
• Change the uses in Table 153.300.020-2. Table of Uses to reflect the activities and
endorsements that the Office of Cannabis Management issues to license holders.
• Reorganize the cannabis and lower-potency hemp use standards in Section 153.300.030
Subd. 1 based on the new terms for the uses.
• Restrict the operation on a lot or parcel to a single licensed cannabis business.
• Move references to lighting, odors, screening, and signs and add those references to the
Design Standards for Cannabis Businesses and Hemp Businesses.
• Move the standards for microbusinesses and mezzobusinesses and add microbusinesses
to the Cannabis Businesses and Hemp Businesses standards since the uses were removed
from Table 153.300.020-2.
• Amend definitions to reflect the new terminology and endorsements and add missing
definitions.
COMMISSION ACTION
The Planning Commission can do one of the following:
1. Recommend approval, with or without amendments, of the attached ordinance.
2. Recommend denial, with findings, of the attached ordinance.
3. Table the request for further review/study.
RECOMMENDATION
Staff recommend that the Planning Commission open the public hearing, receive any public
comments that may be available, and:
Motion to recommend approval of the attached ordinance amending the Unified
Development Code zoning standards for cannabis and lower-potency hemp.
