Dear Mr. and Mrs. Biermaier:
The Scandia Planning Commission completed a site visit to your property and review of your
variance application at their meeting on May 2. While at the site, the Commission members
identified several significant accuracy issues related to the survey that you provided with your
application. The certificate of survey needs to provide accurate information so that the City can
determine the variances needed for the project.
The Commission tabled the application to provide time for you and your builder and surveyor to
correct the surrey and address the issues that the Planning Commission identified. The
Commission identified the following issues:
• The site visit identified the distance from the well to the parcel boundary as
approximately 35'. This would not provide the required 50 -foot separation between the
septic system and well, and does not match the distance shown on the plan.
• As staked on site, the shed appears to be within your parcel boundaries, not overlapping
the city parcel to the north, as shown on the survey. The shed orientation is also not
correct on the survey. Since you are requesting to keep the shed, the City needs an
accurate location and orientation of the shed to determine if this is possible.
The location of the shed is critical to determine if you could keep the structure on the
site. The Development Code would permit you to keep the shed in the current location
as a nonconforming structure. If you move the structure, the Code requires that it meet
the 100' setback requirement from the OHWL. If the shed is on the City parcel, the staff
recommend that it be moved.
• If you propose to keep the shed, the impervious surface calculation needs to accurately
include the shed footprint.
• Your representatives at the meeting stated that the new home maybe placed in a
slightly different location than the location shown on the survey that does not require the
variance from the side -yard setback. The location and setbacks need to be shown

accurately on the survey. If a variance is not needed from the side setback, the survey
should indicate that it meets the setback requirement.
The survey needs to show the proposed location and setbacks of the septic system
accurately to determine the variance needed. The septic system location is not shown
on the survey.
• Planning Commission members requested that the topographic contours be shown on
the survey.
With this letter, the City is extending its review of your application for an additional 60 days, for a
total review period of 120 days, as permitted by Minnesota Statute 15.99, to accommodate
completion and submittal of the correct survey. The 120 -day review period for your application
will end on August 1, 2017.
If the survey is resubmitted by May 16, 2017, your request will be placed on the June 6 Planning
Commission agenda.
