CHAPTER 72: PARKING REGULATIONS

72.02 Snow removal; parking
§ 72.01 MUNICIPAL PARKING LOT.
(A) No vehicle shall be left standing or parked in the Municipal Parking Lot located upon
Lots 1 through 11, inclusive, Block 26, of the city for more than 30 minutes before 2:00 a.m. and
6:00 a.m.
(B) The parking of any trucks or other vehicles in excess of a gross weight of 10,000 lbs. on
the Municipal Parking Lot is strictly prohibited.
(C) Any person or organization violating any provision of this section shall be guilty of a
petty misdemeanor and upon conviction thereof, shall pay a fine of $35.

§ 72.02 SNOW REMOVAL, PARKING.
(A) General.
(1) No vehicle shall be left standing or parked for more than 30 minutes on any street within
the city between 2:00 a.m, and 6:00 a.m., from November 1 through April 15, inclusive.
Recreational vehicles, as described in § 153.260, may not be parked on any public street at any
time. Vehicles exceeding 1- ton carrying capacity, as described in § 153.129(B), may not be
parked on any public street in residential districts at any time.
(2) On -street parking of non -recreational vehicles in all districts and vehicles not exceeding
1 -ton carrying capacity in residential districts shall be permitted at all other hours, except where
otherwise specifically prohibited by signs or marking, when such parking does not interfere with
the removal of snow and ice from the city streets, or with other street or utility repair and
maintenance activities and, in any event, for a period not to exceed 24 consecutive hours in any
one location. A vehicle parked on a street shall be removed from the street by its owner within
15 minutes of demand made by a city employee for snow and ice removal and street and utility
repair and maintenance activities. After removal, it shall be unlawful to park on the street until
the snow removal operation or street or utility repair or maintenance activity is completed in the
area involved.
(3) In the event that the on -street parking of a vehicle is deemed to constitute a traffic
hazard, it shall be removed from its parking location upon the order of a police officer.
(4) Failure to move a vehicle from the public street after having been directed to do so by a

police officer or other employee of the city may result in the vehicle being towed at the owner's
expense.
(B) Exceptions. All emergency and official vehicles responding to an emergency call,
including doctor's automobiles, shall be excluded from the provisions of this section.
(C) Snow removal from sidewalks.
(1) It shall be the obligation of the property owner or tenant of any business or commercial
building or parcel of land to promptly and adequately keep the sidewalk in front of his or her
business property clear from snow at all times.
(2) It shall be unlawful for any person to remove snow from private property and to deposit
same upon any street right-of-way or upon any other city property without first obtaining written
permission therefore in writing from the City Clerk. It shall be further unlawful to deposit snow
upon any property within the city in such a manner as to obstruct the visibility of vehicular
traffic at street intersections.
(D) Violations. Any person violating any provision of this section shall be guilty of a
misdemeanor and, upon conviction thereof, shall be punished according to law.

Sec. 78-2. Parking restrictions for snow removal and for trailers; violations.
(a) In order to expedite the prompt and efficient removal of snow from the streets of the city it
is unlawful for any person to stop, stand or park any vehicle or trailer or permit the same to stand on
any street within the city between the hours of 2:00 a.m. and 7:00 a.m. from November 1 until
March 31 of the following year. At all times of the year it is unlawful for any person to stop, stand or
park any vehicle or trailer or permit it to stand on any public street within the city between the hours
of 2:00 a.m. and 7:00 a.m. after a continuous or intermittent snowfall, during which there has been
an accumulation of two inches or more of snow on any street, until the snow has been plowed or
removed to the full width of the street. In addition to the foregoing, at all times it shall be unlawful for
any person to park any trailer on any street within the city for an excess of 72 consecutive hours.
(b) Any vehicle parked in violation of this section more than two times in any 30 -day period may
be towed pursuant to Minn. Stats. § 169.041. Violation of this section shall constitute a petty
misdemeanor.

AN ORDINANCE RELATING TO THE PARKING OF VEHICLES
THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY,
MINNESOTA, DOES ORDAIN:
1117.01 Definitions.
As used herein, the term:
A. "Vehicle" means any device in, upon, or by which any person or property is
or may be transported or drawn upon a highway, except devices moved by
human power or used exclusively upon stationary rail or tracks, and
B. "Street"means any street, avenue, place, drive, or any other public way in the
City of Oak Park Heights.
1117.02 No Parking.
There shall be no parking at any time of any vehicle at the following street locations
in the City of Oak Park Heights:
A. South side of 64th Street North.
South side of Upper 63rd Street North, West of Paris Avenue.
C. South side of 63rd Street North.
D. East side of Paul Avenue.
E. North side of 62nd Street North.
Peller Avenue North, 40 feet back from 59th Street North, East side from
60th Street North to Upper 61st Street.
G. West side of Stagecoach Trail.
H. Both sides of Mill Road, now called 59th Street North, West of 95.
West side of Peabody Avenue North, North of Beach Road North.
East side of Olinda Avenue North.
K. Both sides of Omaha Avenue North, from 60th Street North to the dead end
near the St. Croix Bowl.
11 17.03 No Parking for More than Twenty -Four Hours.
No vehicle shall be parked on any street in the City of Oak Park Heights for more
than twenty-four (24) consecutive hours.
1117.04 Emergency Declaration.
Whenever, in the opinion of the Mayor of the City Of Oak Park Heights, an
emergency exists in the City, or in a section or sections thereof, because of snow,
freezing rain, sleet, ice, snowdrifts, or other natural phenomena which create, or are
likely to create hazardous road conditions impeding, or likely to impede, the free
movement of fire, health, police, emergency, or other vehicular traffic, or the safety
and welfare of the community, the Mayor may declare an emergency to exists for a
period of seventy-two (72) hours, but such emergency may be sooner terminated if
conditions permit. If the Mayor is absent from the City or is unable to act, the said
emergency may be declared by any two (2) members of the City Council. Notice of
such emergency shall be given by radio, television, or press, which news media shall
be requested to cooperate with the City officials, and when given such notice, shall
constitute due and proper notice. Said notice shall specify the hour that said
emergency commences and there shall be an interval of at last six (6) hours between
the first time that notice is given and the commencement of said emergency.
1 1 17.05 Emergency Parking Restrictions.
A. During said period of emergency, no vehicle shall be parked or left standing
on any streets from 1:00 A.M. to 8:00 A.M.
B. The parking of vehicles directly in front of all-night eating establishments on
the above-described streets during said emergency between the hours of 1:00
A.M. and 8:00 A.M. will not be prohibited under Section 1117.07 of this
Ordinance if the owner or operator of the vehicle is inside the eating
establishment while it is parked, and is available to move said vehicle if it is
hindering snow removal operations. If the owner or operator does not
remove his vehicle when requested by a police officer or a City employee
engaged in removing snow, said vehicle may be removed as provided in
Section 1117.07.
C. Parking may be resumed on individual streets in this area as soon as the snow
has been removed from these streets, except as may be otherwise restricted
by ordinance.
1117.06 Parking During Emergency.
During the period of said emergency, all vehicles on streets, avenues, places, and
drives of the City of Oak Park Heights shall be parked as follows:
A. All vehicles on streets, avenues, places, and drives of the City of Oak Park
Heights, between the hours of 8:00 A.M. and 8:00 A.M. of the succeeding
day, shall be parked only on the side of the streets, avenues, places, and
drives bearing even -numbered United States Post Office addresses on even -
numbered days of the month.
B. All vehicles on streets, avenues, places, and drives of the City of Oak Park
Heights, between the hours of 8:00 A.M. and 8:00 A.M. of the succeeding
day, shall be parked only on the side of the streets, avenues, places, and
drives bearing odd -numbered United States Post Office addresses on odd -
numbered days of the month.
C. Where parking is normally permitted only on one side of the street, vehicles
parked pursuant to the aforesaid provisions may be parked on that side of the
street only.
D. The parking of vehicles on streets during the period of said emergency that
are directly in front of business places during business hours will not be
prohibited unless the vehicle in front of said business establishment is
hindering snow removal.
1117.07 Temoorary Parkine Restrictions Imposed by the Chief of Police for the Citv of
Oak Park Heights. The Chief of Police for the City of Oak Park Heights may
impose temporary parking restrictions in any area of the City for up to forty-eight
(48) hours as may be required under either or any of the following circumstances
and implementing the following procedures:
A. To facilitate the public safety, health and welfare of the residents of the
City of Oak Park Heights and the community should the Chief of Police
determine that a temporary parking restriction imposed within the given
neighborhood or district of the City is required because of any significant
traffic impacting event such as major sporting events, civic activities,
public works projects or other events that will have a significant impact on
traffic circulation and flow through a neighborhood or neighborhoods in
the City of Oak Park Heights as a result of such an event the Chief may
impose parking restrictions.
B. When such temporary parking restrictions are declared by the Chief of
Police for the City of Oak Park Heights, all existing parking signs now
located within the area to be temporary restricted shall be covered and
temporary signs establishing the temporary no parking restriction shall be
posted throughout the affected areas at the beginning of such parking
restricted time and removed and collected by the City at the end of the
parking restricted time.
C. There shall also be posted at the public bulletin board for the City of Oak
Park Heights a notice by the Chief of Police that he has declared a
temporary parking restriction, identifying the area or areas so impacted by
the temporary restriction, the dates and times and hours of the restriction,
and the purpose for which the restriction is being imposed. Copy of said
notice will also be provided to the Director of Public Works and published
in a legal newspaper established by the City of Oak Park Heights.
1117.08 Removal.
A. Any vehicle which shall be left parked or standing in violation of this
Ordinance may be summarily removed without notice to the owner or
operator by officers of the police department of the City of Oak Park Heights,
or persons employed or designated by them, and stored in any appropriate
place. All necessary costs and expenses of towing, removing and storing of
such vehicles shall be first paid to the person or persons designated, by the
person claiming the vehicles before release of the same.
B. The City of Oak Park Heights shall not be responsible for any damage to
such vehicles removed in accordance with the provisions of this Ordinance.
1117.09 Violation.
It shall be unlawful for any firm, person, or corporation to cause, allow, suffer, or
permit any vehicle operated by or registered in the name of such person, firm, or
corporation to be parked contrary to the provisions of this Ordinance. The presence
of any vehicle on a public street in the City of Oak Park Heights, parked contrary to
the provisions of this Ordinance, shall be prima facie evidence that the registered
owner of said vehicle submitted or authorized the commission of the violation.
1117.10 Penalty.
Any person, firm, or corporation violating the provisions of this Ordinance shall be
guilty of a misdemeanor and upon conviction thereof shall be subject to a fine not
exceeding Seven Hundred Dollars ($700.00) or imprisonment not exceeding ninety
(90) days, or both.
ORDINANCE NO. 16
AN ORDINANCE PROHIBITING THE PARKING OF VEHICLES ON CERTAIN PORTIONS
OF THE TOWNSHIP ROADS AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF.
THE TOWN TOARD OF SUPERVISORS OF NEW SCANDIA TOWNSHIP DOES ORDAIN:
Section 1. It shall be unlawful for any person or organization
to cause, allow, permit or suffer any vehicle to be parked on the roads,
streets and by -ways of the township in areas designated as no parking
zones and so posted.
Section 2. Any person or organization violating the provision
of this ordinance shall, upon conviction thereof, be guilty of a petty
misdemow&r and shall pay a fine of $5.00.When such vehicle is parked so
as to impede the free flow of traffic and/or is hazardous to traffic
movement, the vehicle may be towed from the no parking zone at the owner's
expense.
Section 3. This ordinance shall be in full force and effect
from and after its passage and publication according to law.

operation is completed in the area involved.
Section A.
No person shall stop, park, or leave starKling army vehicle, whether

part of any street, road or byway in the township when it is
practical to stop, park, or so leave suoh vehicle off such part of
said street, but in every event a clear and unobstructed width of
at least 20 feet of such part of the highway opposite such
standing vehicle shall be left for the free passage of other
vehicles and a clear view of such stopped vehicle shall be
available from a distance of 200 feet in each direction upon such
street.
Section 5. Any person or organization violating the provisions of this
ordinance shall, upon conviction thereof, be guilty of a petty
misdemeanor and shall pay a fine of $10.00. When any police
officer finds a vehicle unattended upon any street or road, where
such vehicle constitutes an obstruction to traffic, such officer
is hereby authorized to provide for the removal of such vehicle
and remove the same to the nearest convenient garage or other
place of safety at the owner's expense.
This ordinance shall be in full force and effect from and after its passage and
publication according to law.

6-2-1: GENERAL PARKING RESTRICTIONS:
A. On Street Parking Restrictions:

November 1 and March 31 following no vehicle shall be left standing or parked on the
streets of the city between the hours of two o'clock (2:00) A.M. and six o'clock (6:00)
A.M. on any day. At all other hours during such period, on street parking shall be
permitted only when the same does not interfere with the removal of snow and ice from
the city streets, and vehicles so parked shall be removed from the street by their
owners. If a motor vehicle is found in violation of this subsection a police officer is
authorized to issue a citation and/or have the motor vehicle removed at the owner's
expense.
2. Snow And Ice Removal Before November 1 And After March 31: Before November 1
and after March 31, on street parking shall be permitted only when the same does not
interfere with the removal of snow and ice from the city streets, and vehicles so parked
shall be removed from the street by their owners. It shall be unlawful to park on such
streets until the snow removal operation is completed in the area involved. If a motor
vehicle is found in violation of this subsection a police officer is authorized to ticket
and/or have the motor vehicle removed at the owner's expense. (Ord. 919, 10-2-2013)
3. Number Of Days Limited: No vehicle shall be parked continuously on a public street
for a period of seventy two (72) hours or more. This prohibition is in addition to
subsection Al of this section.
4. Exemptions: All emergency and official vehicles responding to an emergency call,
including doctors' automobiles, shall be excluded from the provisions of this subsection
A. (1971 Code § 14-7; amd. Ord. 919, 10-2-2013)
B. No Parking Zones: No vehicle shall be left standing or parked on the streets of the city:
1. Where any section of street has been designated as a no parking zone by resolution of
the city council or by order of the fire chief or designee.
2. Within fifteen feet (15') of any mailbox between the hours of ten o'clock (10:00) A.M.
and four o'clock (4:00) P.M. on Monday through Saturday. (1971 Code § 14-7.1; amd.
2000 Code)
C. Liability Of Owner: Whenever any motor vehicle shall be parked or left standing within the
city by any person other than the owner, with the consent of the owner, express or
implied, the operator thereof shall be deemed to be the agent of the owner of such motor
vehicle for the purposes of subsections A and B of this section. (1971 Code § 14-7)
