RESOLUTION NO. 02-18-14-01
RESOLUTION FOR VACATING PARTS OF BIRCH LANE
WHEREAS, the City Council of the City of Scandia, Washington County,
Minnesota, has determined to vacate parts of Birch Lane in the City of Scandia,
Washington County, Minnesota; and
WHEREAS, a public hearing was held on the 18th day of February, 2014 at 7:00
p.m. in the Scandia Community Center Board Room, 14727 2091h Street, Scandia, MN,
after due published and posted notice had been given by the clerk, and a reasonable
attempt was made to give personal notice to all affected property owners, and all persons
interested were given an opportunity to be heard; and
WHEREAS, any person, corporation or city owning or controlling easements
contained upon the property vacated, reserves the right to continue maintaining the same
or to enter upon such way or portion of vacation to maintain, repair, replace, remove or
otherwise attend thereto; and
WHEREAS, it appears that it will be in the best interest of the city to vacate such
streets; and
WHEREAS, four-fifths of all members of the City Council concur in this
resolution;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Scandia, Washington County, Minnesota, that the portions of Birch Lane between 188th St
and Elm St as shown on Exhibit A and legally described as follows are hereby vacated:
All that part of Birch Lane that is platted and dedicated to the public on ANDERSON'S
BIG LAKE 2ND ADDITION on file and of record in the Office of the County Recorder,
Washington County, Minnesota described as follows:

Commencing at Meander Corner No. 21, Section 34, Township 32 North, Range 20
West, Washington County, Minnesota; thence South 75 degrees 15 minutes 34 seconds East,
bearings are based on the Washington County Coordinate System NAD 83 1986 Adjustment, a
distance of 719.37 feet to the most westerly corner of Lot 14 of said ANDERSON'S BIG LAKE
2ND ADDITION and to the point of beginning of the property to be described; thence North 68
degrees 42 minutes 28 seconds East, along a northwesterly line of said Lot 14, a distance of
156.94 feet; thence North 52 degrees 06 minutes 45 seconds West, a distance of 38.73 feet to its
intersection with a northwesterly line of said Birch Lane; thence South 68 degrees 41 minutes 52
seconds West, along said northwesterly line of Birch Lane, a distance of 82.78 feet; thence South
37 degrees 14 minutes 35 seconds West, a distance of 63.69 feet to the point of beginning.

Commencing at Meander Corner No. 21, Section 34, Township 32 North, Range 20
West, Washington County, Minnesota; thence South 77 degrees 32 minutes 49 seconds East,
bearings are based on the Washington County Coordinate System NAD 83 1986 Adjustment, a
distance of 698.42 feet to the most easterly corner of Lot 13 of said ANDERSON'S BIG LAKE
2ND ADDITION and to the point of beginning of the property to be described; thence North 22
degrees 32 minutes 44 seconds West, along an easterly line of said Lot 13, a distance of 89.84
feet to the most northerly corner of said Lot 13; thence North 09 degrees 33 minutes 36 seconds
West, along an easterly line of Lot 12 of said ANDERSON'S BIG LAKE 2ND ADDTION, a
distance of 106.99 feet to the most northerly corner of said Lot 12; thence South 50 degrees 19
minutes 55 seconds East, a distance of 50.32 feet to its intersection with an easterly line of said
Birch Lane; thence South 09 degrees 38 minutes 13 seconds East, a distance of 65.01 feet to an
angle point in said Birch Lane; thence South 22 degrees 35 minutes 18 seconds East, along said
easterly line of Birch Lane, a distance of 66.99 feet; thence South 37 degrees 14 minutes 35
seconds West, a distance of 38.22 feet to the point of beginning.
