Regarding I Rule Revisions Summary
CLFLWD has had rules in place since 2008. Permitting programs generally evolve over time with rule
revisions to benefit both the community and/or natural resources in that community. Some of the primary
goals of the revisions were to:
• Modify the thresholds for when permits are triggered — simplify and make sure we are pulling in
projects that have the potential to impact the water resources of the District.
• Maintain current stormwater standards for new development to ensure no degradation of the water
resourses in the District.
• Incorporate added flexibility for certain types of projects (road projects, redevelopment, small sites,
etc.) such that the standards are both reasonable and at the same time start to address areas that
currently discharge with no treatment.
Process:
• 3 workshops with the CLFLWD Board of Managers
• 2 Technical Evaluation Committee Meeting
• Meetings with Cities
• Public Comment (November 29th, 2017 - January 15th, 2018)
Stormwater Revision Highlights:
• Simplify trigger to be residential subdivision of 3 or more lots, 5000 SF of new or reconstructed
impervious for roads and redevelopment, and any project riparian to a public water that requires a
variance from local impervious surface requirments
■ Maintain current rule structure for new developments
• Incorporate MIDs standard for redevelopment and road projects
• Exempt road projects unless it is adding new impervious or a full reconstruction (mill & overlay,
reclamation, and paving of a gravel rural section roadway would be exempt)
• Adjust redevelopment such that only new or reconstructed impervious need to be treated unless they
are disturbing more than 50% of the site
• Provide several alternatives to meet rules such as the stormwater impact fund, stormwater credits, or
regional treatment
Erosion Control Revisions Highlights:
• Lower the general thresehold for triggering rule (50 CY or 5,000 SF)
• Require erosion control best management practices regardless of whether a permit is required
• Align rule language with MIDs standard
