Restoration Ordereee l 026110 H 2- L11 RPN# F890548715601 ._ Minnesota Wetland Conservation Act �- Restoration Order It MNDNR The Commissioner of Natural Resources hereby orders Joseph D Reinhardt and his/hers/its heirs, successors, and assigns to complete restoration of the wetland located at (legal description) parcel adjacent to 18884 Layton Ave N, Scandia, MN PIN: 3103220110039; Subdivision Name BLISS PLAT 2ND DIVISION, BLOCK 3, LOT 19 and 20; Washington (163) County State of Minnesota. Name: Joseph D Reinhardt Address: 18884 Layton Ave N, Scandia, MN 55047 Findings of Fact: A saturated, Type 7 wetland was subject to an unpermitted impacted (filled) as a result of driveway construction activities at the location provided above. Pre -impact aerials and the impacted area appears to have a dense tree canopy; the unaffected area of surrounding wetland was dominated by a canopy of black ash. On June 7, 2017 the WCA TEP met on the site mentioned above to identify and quantify WCA impacts. The TEP determined the driveway gravel fill was placed in wetland and the fill was placed without an approved replacement plan. The scope of the fill was marked using a GPS unit and totals 4,608 SF as shown in the attached map. This order is issued pursuant to Minn. Stat. § 103G.2372 and MN Rule part 8420.0900. VIOLATION OF THIS ORDER IS A MISDEMEANOR AND A DEED RESTRICTION COULD BE PLACED ON THE PROPERTY. You must either: A. Provide for restoration of the wetland in the manner required by this order. Complete restoration must be accomplished on or before October 31, 2017; or B. Submit a complete wetland replacement plan, exemption, or no -loss application to the City of Scandia within 4 5 days of receipt of this order. Restoration shall be accomplished by doing the following: 1. Remove all fill material that has been placed within the wetland area shown on attached map; 2. Seed all disturbed areas with a native wet meadow seed mix (state seed mix 34-271 which can be obtained from seed vendors); 3. Provide notification to the Washington Conservation District upon completion of the BWSR Forms, March 2015 excavation work and prior to any seeding. A site visit will be scheduled and upon confirmation that the fill has been adequately removed, the seeding may take place. 4. The removed fill must be placed in an upland location. Attachments are a part of this document (check one) ® Yes ❑ No The enforcement authority shall rescind this order if the landowner obtains approval for an after -the -fact replacement plan, exemption determination, or no -loss determination from the City of Scandia. Upon completion of the restoration required by this order, the landowner must contact Jay Riggs at the Washington County Soil and Water Conservation District (651)330-8220 x 20 and request that a Certificate of Satisfactory Completion be issued. If you choose to appeal the terms or conditions of this order, a written request must be submitted to the Minnesota Board of Water and Soil Resources (BWSR) Executive Director within 30 days of receiving this order, along with a minimum filing fee of $500. If a written request and filing fee is not submitted to BWSR within 30 days, this restoration order shall become final.
