I hereby apply for consideration of the above described request and declare that the information and materials submitted
with this application are complete and accurate. I understand that no application shall be considered complete unless
accompanied by fees as required by city ordinance. Applications for projects requiring more than one type of review
shall include the cumulative total of all application fees specified for each type of review. I understand that applicants
are required to reimburse the city for all out-of-pocket costs incurred for processing, reviewing and hearing the
application. These costs shall include, but are not limited to: parcel searches; publication and mailing of notices; review
by the city's engineering, planning and other consultants; legal costs, and recording fees. An escrow deposit to cover
these costs will be collected by the city at the time of application. The minimum escrow deposit shall be cumulative total
of all minimum escrow deposits for each type of review required for the project, unless reduced as provided for by
ordinance. The city may increase the amount of the required escrow deposit at any time if the city's costs are reasonably
expected to exceed the minimum amount. Any balance remaining after review is complete will be refunded to the
applicant. No interest is paid on escrow deposits.

DESCRIPTION OF REQUEST
Joseph Reinhardt and Katherine Reinhardt ("Reinhardts") seek review of the Technical
Evaluation Panel Findings Report and Notice of Decision denying their application for an after
the fact Wetland Replacement Plan Application allowing use of the drive constructed to access
Lot 19, Block 3, Bliss Plat 2nd Addition (PIN 31.032.20.11.0039) ("Lot 19") and the North 200
feet of Lot 18, Block 3, Bliss Plat 2"d Addition (PIN 31.032.20.11.0038) ("Lot 18").
Reinhardts live in at 18884 Layton Ave. No., located on Lots 6, 7, and 8, Block 3, Bliss Plat 2nd
Division ("Residence:"). Lot 18 and Lot 19 lie northwest of the residence. Lot 18 and Lot 19
are separate lots or parcels that were of record on or before January 1, 1973. They are assigned
separate tax parcel numbers by Washington County. The plat of Bliss Plat 2"d Division
contemplated access to Lot 18 and Lot 19 over Langly Avenue.
Reinhardts maintain an outbuilding located on Lot 18. Tanks for the 201 Septic System serving
their house are located at the rear of their house. Until recently, they accessed the outbuilding
using a drive located on their neighbor's property. When the neighbor constructed a fence
denying use of that drive, Reinhardts constructed a drive off Langly Ave., over Lot 19.
Construction of the drive impacted wetlands. Reinhardts applied for an after the fact permit, and
proposed replacing the impacted wetlands using credits.
The Technical Evaluation Panel ("TEP") "deferred to the City to assess if the rear portion of the
property [Lot 18 and Lot 19] was buildable in order to determine if this fill was avoidable." The
TEP relied on a letter from the City's Planner that focused on whether Lot 18 and Lot 19 could
be developed. Reinhardts have not, however, applied to develop those lots at this time.
Therefore, it is currently irrelevant, and unnecessary, to determine whether Reinhardts could
separately develop Lot 18 and Lot 19.
In any event, Reinhardts are entitled to vehicular access the outbuilding located on Lot 18. In
addition, it may be necessary to access the tanks for the septic system for maintenance or
replacement. The TEP determined that Reinhardts would have access to the outbuilding on Lot
18 and the septic tanks from Layton Avenue over a portion of the Residence lying to the south of
their house. The steep terrain in that area, and the presence of the septic tanks would, however,
prohibit installation of a drive in that area. The drive Reinhardts constructed from Langly
Avenue provides the only practical access to the outbuilding on Lot 18 and the septic tanks.
Therefore, Reinhardts request that the City Council reverse the TEP and grant the after the fact
Wetland Replacement Plan Application enabling the maintenance of the drive they constructed.
