5.e) Staff Report-abate assessment for 19203 Layton AveSCANDIA Staff Report Date of Meeting: March 18, 2014 To: City Council From: Colleen Firkus, Treasurer Re: Abatement of Sewer Charge Background: The property at 19203 Layton Ave. was assessed $723.44 for unpaid 201 Sewer User Fees payable on 2014 property taxes. A partial payment of $323.44 was received before the deadline of November 29, 2013 and the balance of $400.00 was received December 16, 2013. The property should have only been assessed the $400.00, not the full amount. Although the balance was paid more than 10 days after the public hearing on sewer certifications, and a week after I sent in the certifications to the County (Dec. 10th), state statutes allow the City to certify unpaid sewer assessments up until the end of the year. Since the City did receive full payment of the charges prior to the end of the year, and the charges can only be removed from the property taxes through an abatement, I am requesting the Council abate the charges to this property. Issue: Should the Council adopt Resolution No. 03-18-14-01 abating the special assessment for 19203 Layton Avenue? Proposal Details: Washington County requires that the City adopt a resolution abating the assessment from the property for taxes payable in 2014. Fiscal Impact: None Options: 1) Approve Resolution No. 03-18-14-01 2) Amend and then approve Resolution No. 03-18-14-01 3) Do not approve Resolution No. 03-18-14-01 Recommendation: Option 1.
