7.a)2) Staff Report-Temp Dwell Code UpdateSCANDIA Staff RepoVt Date of Meeting: March 18, 2014 To: City Council From: Kristina Handt, City Administrator Re: Ord. No. 152: Temp Dwelling During Construction Background: The Planning Commission began reviewing an application for an Interim Use Permit for a Temporary Dwelling During Construction at their December meeting. The applicant wanted to continue living in his current home on the property while a new one is being built. This was the first time this section of code had been utilized. As the Commission was reviewing the potential conditions for the IUP they identified some areas of concern in the code. Issue: Should the City approve the suggested changes to the code related to temporary dwelling units during construction? Proposal: The proposed changes to the code include adding the word County to clearly identify who is responsible for approving on-site sewer systems. This is also to be consistent with the wording used in the recently adopted Rural Event Facility ordinance. More substantive are the changes proposed in Sec.4.26 (7). The Commission and the applicant didn't feel a good, quality home could always be completed in 6months (180 days) so the time period is proposed to be extended to one year. Also, as is the case in the current application (which will come to the Council in April) sometimes the Commission would like to allow for a longer period of time for removing the temporary dwelling. In this instance the homeowner would like to recycle parts of his current home and reuse them in his new home. However, if there are not special circumstances like this present, the Commission felt 30 days to remove the temporary dwelling would be sufficient. So language was added to allow for a longer time if unique circumstances exist. The Commission, and ultimately the Council, would determine what constitutes unique circumstances. However, it couldn't be extended beyond 90 days. The Planning Commission held a public hearing on the proposed changes at their March 4th meeting. No public comments were received.
