8. Discussion on the sale of the Goose Lake lotCITY OF SCANDIA SUMMARY OF DEVELOPABLE CITY -OWNED PARCELS NOT BEING UTILIZED AS PARKS 3.65 acres — Olinda Lane N — lot between 21710 and 21750 This lot was acquired by New Scandia Township as a condition of approving the Hawkinson Highlands subdivision. Prior to the development of this subdivision, the Township owned an outlot adjacent to the property to be platted. The development agreement provided for the transfer of the outlot to the developer in exchange for one of the new lots created by the subdivision with the condition that the lot remain as open space for a period of five years after conveyance There was some opposition to the sale of the Township's land to the developer, which neighboring property owners viewed as park land. The minutes of the Township Board meeting of December 4, 1990 indicate that the intent was not to restrict the lot for park use, but to allow the Town to sell it as a buildable lot in the future should it ever become necessary. The agreement with the developer required the Township to share the development costs for the new lot. It appears that this lot is buildable for a single family home. It is zoned "SFE", Single Family Estate, and is within the Shoreland Overlay District for Goose Lake. The City Assessor estimates its market value at $227,500 (2008.) This lot was acquired by New Scandia Township as a condition of approving the Hawkinson Highlands subdivision. Prior to the development of this subdivision, the Township owned an outlot adjacent to the property to be platted. The Township sold the outlot to the developer, who included them in his plat, in return for receiving one of the new lots created by the subdivision. There was some opposition to the sale of the Township's land to the developer, which neighboring property owners viewed as park land. The minutes of the Town Board meeting of December 4, 1990 indicate that the intent was not to restrict the lot for park use, but to allow the Town to sell it as a buildable lot in the future should it ever become necessary. The agreement with the developer required the Town to share the development costs for the new lot. The development contract for the subdivision required that the conveyance of the lot to the Town would be subject to a condition that the lot remain as open space for a period of five years. Members present from the board were: Russell Jackson, Beverly Pratt, Kenneth Ostlund, Charles Nordin and Kevin Nickelson. Residents present from Olinda Lane were: Mike Arndt, Greg Adams, Lee Goodyear, Ray Burris and Earl Coleman. Mr. Ostlund spoke regarding the land sale of Outlot E on Goose Lake. He stated Howard and Audrey Hawkinson owned the land next to the parcel which was owned by the township and the board would have not acted any differently regarding the sale of the property even if someone else had owned the parcel next to the township's parcel. Mr. Ostlund stated the reason the town acquired the land was for future development and the board and members of the planning commission knew the Hawkinson land would be developed in years to come. Mr. Ostlund expressed his concern if residents on Olinda Lane would want a piece of public park land in a residential area. Mr. Nickelson stated if the property was for future development this was not in the minutes when Goose Lake Woods was platted. Mr. Goodyear requested that the deed for Outlot E should specify that this piece of property is park land. There was discussion of problems with noise and parties if this would be designated as park. Mr. Adams informed the board there have been no problems in the 12 or 13 years since this was deeded to the township. The Parks Committee could view this property and decide what it should be used for. Mr. Nickelson stated this could be open space and used for wildlife. Mr. David Hebert Township Attorney informed the board if it is stated on the deed as park property this would be hard to change if this would ever become necessary. It was agreed this parcel should be a buildable lot if this would need to be disposed of in years to come. The restriction of open spaces for Outlot E could be in the development agreement and this matter could be reviewed in 15 years. The lines drawn for this parcel equal 3.8 acres and 1. 4 acres of this parcel in the water. Nordin made a motion to accept Mr. Howard Hawkinsonsagreement to offer to amend the purchase agreement for Outlot E of Goose Lake Woods Plat. This shall provide for the proposed land exchange and the lot the township shall own will be buildable. The land shall be conveyed to Mr. Hawkinson and then be reconveyed to the township when the plat is recorded. With restrictions on the development agreement and the deed. Nickelson seconded and adopted. Pratt made a motin to adjourn the meeting. Ostlund seconded and adopted. New Scandia Township Clerk Dolores ( Peterson /1 I . I ) 4)'7"— 143 rRUS AMUMMU, made this /8 day of December, 1990 by and between Howard Hawkinson and New Scandia Township: The parties to this Agreement are the parties to a certain purchase agreement dated October 17, 1990 wherein the Township agreed to sell and convey to Howard Hawkinson Outlot E, Goose Lake Woods for the stun of $20,000.00. The parties now wish to cancel said Agreement and enter into the Agreement hereinafter stated for the exchange of parcels of land owned by each. NOW, THERERM, In consideration of the mutual promises and covenants hereinafter stated the parties agree as follows: 1. Upon request by Howard Hawkinson and not later than one year from the date of this agreement, the Township shall convey to Howard Hawkinson Outlot E, Goose Lake Woods for the purpose of including said describe property in a residential plat to be prepared by Howard Hawkinson and presented to the Town Board for approval. A 2. Immediately upon the filing of the plat, Howard Hawkinson shall convey to the Township the northerly most lot in the plat in approximately the same configuration as presented by Landmark surveying, Inc. at the New Scandia Township Planning Commission meeting held on December 4, 1990 provided, however, that the lot shall conform in all respects to the zoning and subdivision regulations of New Scandia Township. 3. The Township and Howard Hawkinson shall share in the development expenses relating to said lot in an amount to be determined at or before the filing of the plat. 4. Howard Hawkinson shall place on the deed of conveyance to the Township of said lot such restrictions as the Township may reasonably request. 5. The Township shall immediately return to Howard Hawkinson earnest money paid of $500.00 under the contract dated October 17, 1990 and neither party shall have any further obligation or liability in connection with said contract. Developers shall convey to Lowell Isaackson the property described as Outlot A on the preliminary plat of Hawkinson Highlands within 30 days after approval and signing of the final plat of Hawkinson Highlands. Said Outlot A shall be combined with property presently owned by Lowell Isaackson to make one residential building site. b. The Developers shall furnish the Town with a title opinion establishing fee ownership of the platted property in the Developers. C. The Town, prior to the filing of the plat, shall convey to the Developers real property in Washington County, Minnesota, described as follows: Outlot E, Goose Lake Woods. subsequent to the filing of the plat, the Developer shall convey to the Township, real property in Washington County, Minnesota, described as follows: Lot 9, Block 1, Hawkinson Highlands subject to the condition that the described tract shall remain as open space for a period of five [5) years from the date of the deed of conveyance. d. Breach of any material term of this Contract by the Developers shall be a ground for denial of buildimf permits. e. If building permits are issued prior to the completion and acceptance of the street improvement, the Developers assume all liability and costs resulting from delays in completion of the improvement.
