The structural design, mounting and installation of the tower and antennas shall be in compliance with manufacturer's specifications. Final plans shall be approved and certified by a registered professional engineer. 4. If this conditional use permit is revoked, or use of the tower ceases, the tower and all accessory structures shall be removed and the site restored to its original condition within 120 days. If the applicant fails to do so, the City will complete removal and restoration, and the City's cost shall be assessed against the property. 5. The tower shall be painted a light grey or similar color that is as visually inconspicuous as possible. The equipment building shall be painted an earth-tone color that is inconspicuous from the roadway and surrounding properties. The proposed colors shall be reviewed and approved by the City Administrator. 6. The property owner shall preserve the existing vegetation that screens the tower from views from County 15A and adjacent residences. 7. The applicant shall screen the compound area with native trees and shrubs planted in a relatively natural configuration. The final landscape plan shall be approved by the City Administrator. 8. The tower owners shall lease space to other users if requested so long as there is no disruption in the existing service provided by the tower's existing users and no negative structural impact on the tower. The City Council reserves the right to act as arbiter in determining if the tower owner is acting in good faith in leasing to other tenants. The location of the proposed facilities is on James and Nancy Beimert's property. The property is located in the General Rural (GR) Zoning District. A CUP is required for new towers in excess of 35 feet in all districts. The subject property is approximately 20 acres in size. BACKGROUND: The application materials (included in Attachment I) indicate that AT&T plans to construct a 150' monopole telecommunications tower and a 12' x 20' prefabricated communications equipment shelter within a fenced compound on the Beimert property. AT&T will use an existing private driveway to access the tower. The An Employee Owned Company Promoting Affirmative Action and Equal Opportunity AT&T CUP Page 2 December 22, 2010 Scandia, Minnesota landowners have signed a lease agreement with AT&T/New Cingular Wireless for the ground space necessary for the tower and shelter construction and maintenance. AT&T indicated that they evaluated potential sites within the service area, and found that this site best met the needs for service coverage, the City's zoning requirements and the requirements for construction and operation of the tower. There are no existing towers within a two-mile radius of the site. The site exceeds the required '/ mile setback from parks, trails and open space sites and State Highways. It is less than '/ mile from Manning Trail (County Road 15A), and therefore the applicant must demonstrate that the tower will be visually inconspicuous when viewed from that roadway. The proposed location is more than '/o mile from the St. Croix River Overlay District and any DNR protected lakes or streams, as required by the City's Development Code. (See Maps in Attachment II) The application indicates that AT&T will comply with all applicable FCC and FAA requirements associated with the construction and maintenance of the facilities, as well as the requirements of the City's ordinance. The application indicates that AT&T/New Cingular Wireless plans to construct this tower and a second new tower southwest of this tower during the next five years. A specific location has not been identified for the second tower. The towers will provide cellular services, and may provide other wireless device services and capacity for WiFi services in the future. (See Maps in Attachment II) CRITERIA FOR GRANTING A CONDITIONAL USE PERMIT (CUP) The City's Development Code identifies the criteria that should be considered for evaluating a CUP request and granting a CUP. The Code indicates that the criteria that the Planning Commision shall consider include the following: • Impact of the proposed use on the health, safety and general welfare of the occupants of surrounding lands • Existing and anticipated traffic conditions, including parking facilities, and impacts • Effect of the proposed use on utility and school capacities • Effect of the proposed use on property values and scenic views • Relationship to the Comprehensive Plan • Ability of the proposed use to meet the standards of the Development Code • Effect of the proposed use on groundwater, surface waters and air quality • That the proposed use is allowed with a conditional use permit in the designated zoning district in which it is proposed. DETAILED EVALUATION OF THE REQUEST: Comprehensive Plan The Comprehensive Plan does not include specific goals or policies related to communications infrastructure, though it does include goals to support the economic health of the community, and adequate communications infrastructure is needed to support the general economic health of the community. AT&T CUP Page 3 December 22, 2010 Scandia, Minnesota The comprehensive plan does include goals and policies to support the community's rural character and natural landscape, and minimize the visual impact of new development. The proposed tower will need to address the ordinance requirements to be visually inconspicuous when viewed from Manning Trail to be consistent with the �oals of the Comprehensive Plan and the City's Development Code. Proposed Tower—Location and Height The City's ordinance requires that new towers in excess of 35 feet obtain a Conditional Use Permit. The proposed 150' tower therefore requires a CUP. The proposed location is in the General Rural (GR) District. The maximum tower height allowed in Scandia is 300 feet. The development code requires monopole towers in all zoning districts. Wireless Communications Antennas and Towers are an allowed use in the General Rural (GR) District. However, the performance standards for this use were inadvertently left out of the performance standards in Chapter 2, Section 4.30 of the code. Staff have therefore proposed a "housekeeping" amendment to the code to add the GR District to the list. This amendment will be addressed before the Planning Commission reviews the AT&T Application. The ordinance requires that the minimum lot size for construction of a tower over 35' in height be 5 acres in the General Rural District. The parcel proposed for the new AT&T tower is approximately 20 acres in size. The ordinance requires that no tower be located within one mile of another tower, regardless of municipal boundaries. The applicant provided a map of existing and proposed towers in the Scandia area. The map indicates that there is no existing or proposed tower within two miles of the proposed tower location. (See color figure titled East Side Forest Lake Site (Beimert)—Propagation without Site in Attachment II.) The applicant indicated that a new tower is needed in order to provide adequate coverage for cellular services in the northwest Scandia area. The applicant indicated that AT&T engineer's first looked for potential options for collocation of antennas on existing towers within the area where service is not adequate, including both their own towers and those of other communication providers. They were not able to identify an existing tower that could be utilized for antenna collocation within the area. AT&T next searched for properties where a new tower could be located based on property conditions, land elevation, zoning and setback requirements, and other factors. They concluded that the proposed site best meets the service needs and regulatory requirements within the area where service is not adequate. The applicant indicated that the proposed tower design will allow for future co-location of at least three additional antennas, as required by the ordinance. Setbacks and Views Scandia's ordinance requires that the proposed 150' tower be constructed at least 300 feet from any residential dwelling other than the dwelling on the parcel on which the tower is to be located. The site plans indicate that the proposed tower is located 419 feet and 544 feet from the nearest residential dwellings that are not on the parcel on which the tower is proposed to be located. AT&T CUP Page 4 December 22, 2010 Scandia, Minnesota The ordinance also requires the following setbacks: '/ mile from the boundary of existing or proposed state, county or city parks '/ mile from the centerline of State Highways 95 and 97, and County Roads 3, 4, 15 and 52, unless the applicant can demonstrate that the tower will be visually inconspicuous as viewed from the road on a year-round basis. '/ mile from the St. Croix River Overlay District '/ mile from a DNR protected lake or river The proposed tower meets the required setbacks from parks, the St. Croix River Overlay District, and lakes and rivers. (The tower would be within % mile of DNR protected wetlands, but not protected lakes or rivers, as specified in the ordinance—see map in Attachment II.) The proposed tower is within '/ mile from County Road 15A (Manning Trail). The ordinance requires that towers proposed within '/ mile of County Roads demonstrate through visual impact simulation that the tower will be visually inconspicuous as viewed from the road on a year-round basis. This issue is discussed in the next section. The ordinance also requires that the tower be located on a parcel of land so that it has the least impact on surrounding properties, and that any potential negative impact of the tower be confined as much as possible to the property on which the tower is located. The following elements may help to limit the impact of the proposed tower: • The tower location exceeds the required setbacks from surrounding properties. • The proposed location is at a relatively low elevation within the property. • No lighting or illumination will be added to the facility. • The tower color will be light grey or another color recommended by the City. • The applicant indicated that it is willing to consider landscaping around the proposed compound to minimize the impacts to surrounding roadways and properties. The Planning Commission may consider the potential impact of the tower on surrounding properties, and determine whether landscaping with trees and shrubs will be required to provide some screening of the tower and building from the views of adjacent properties. The visual simulations provided by the applicant indicate that under existing conditions, the proposed tower would have little or no vegetative screening when viewed from 240th Street. Visual Simulation and Screenin,�from Mannin� AT&T provided several visual simulations of the proposed tower, including existing views and views with the proposed tower(Attachment III). One view is from 240th Street directly north of the tower; the other three views are from locations along Manning Trail. They also provided a plan sheet indicating the topography of the area around the proposed tower. The topographic information indicates that the tower is within a one foot elevation of the lowest point on the property that meets most of the setback requirements. The land rises to the east of the proposed location. If the tower were positioned to the east of the proposed location (farther from County 15A/Manning Trail), it would be at a higher elevation, and therefore potentially more conspicuous. If the tower were positioned AT&T CUP Page 5 December 22, 2010 Scandia, Minnesota further to the north or south, it may encroach on required setbacks from nearby dwellings and DNR protected lakes. The visual simulation and aerial photo attached indicate that the tower will be partially screened from view by existing trees at some locations along County 15A. Screening is variable along the roadway. The City may require that the tower be painted a gray color that will help it to blend with the sky to be less conspicuous, and require landscaping to screen the equipment building. AT&T has indicated that it is willing to work with the City on color selection (a light grey is proposed), landscaping, or other options to make the tower less noticeable from County 15A. The draft conditions include items that address tower appearance, including color, landscaping and a requirement that existing vegetation that screens the tower from views from County 15A and adjacent residences be maintained. Staff propose that AT&T screen the compound area with native shrubs or trees planted in a relatively natural configuration, as this will be less visually conspicuous than non-native evergreens in this location. Suggested species include wild plum (Prunus Americana), staghorn sumac (Rhus typhina), nannyberry viburnum (Viburnum lentago); gray dogwood (Cornus racemosa), American hazel (Corylus americana) or similar native species. The application indicates that the tower will not have lights or other illumination. The applicant has proposed a safety sign, but no other identification or advertising sign on the tower or antennas. The Planning Commission should discuss the proposed conditions and issues related to the potential visual impact of the proposed tower. The Commission should determine whether the proposed location and conditions regarding color and vegetative screening are adequate to meet the code requirements, so that the tower is visually inconspicuous from Manning Trail and has the least impact on adjoining properties. Equipment Building AT&T is proposing a shelter building for its equipment, to be located within the fenced compound with the monopole tower. The location of the compound is shown on sheet C2 provided with the project plans, and the location of elements within the compound is shown on sheet C2.1 (Attachment I). The appearance and typical earth tone color applied to the prefabricated structure are shown in the color figure example in Attachment IL The applicant indicated that the tower and structure will be enclosed by a 6' fence and gate that will be locked at all times. Other Ordinance Requirements and Considerations The application materials submitted by AT&T generally meet the ordinance requirements detailed in Section 4.30, Item 10. Staff will request that the applicant provide a presentation-size map of existing and proposed tower sites in the community for the public hearing. The applicant included a general description of the facility plan, including services to be provided by the tower, and the map showing the location of existing and proposed towers in the Scandia and Forest Lake area. Some of the requirements that address long-term issues, such as insurance and maintenance are also addressed in the proposed conditions so that compliance with the conditions can be monitored and required for the long-term. AT&T CUP Page 6 December 22, 2010 Scandia, Minnesota The ordinance requires that the design and installation of the tower comply with manufacturer's specifications, and that plans be approved and certified by a registered professional engineer. All antennas and towers must be adequately insured. The City will require that the applicant comply with these conditions. The ordinance requires that towers that are 125 to 200' in height allow for the co-location of at least three additional antennas. The applicant indicated that the proposed tower will provide for three additional antennas in an e-mail to staff on December 15, 2010. The ordinance requires that the owners conduct an annual inspection of their facilities, and that a copy of the annual inspection report shall be provided to the City. Staff included a condition for the CUP to meet this requirement. ACTION REQUESTED: The Planning Commission can recommend/City Council can act to: 1. Approve the request. 2. Approve the request with conditions. 3. Deny the request with findings. 4. Table the request.
