Action Requested: 1) Hear a brief report from SRC, Inc. on the recycling program, and
2) approve an extension of the recycling agreement with SRC
Incorporated to December 31, 2011.
Deadline/Timeline: The current agreement expired on December 31, 2010.
Background: • Rick Prahl, SRC Inc., will be present at the March 15 meeting to
update the Council on the recycling program.
• In March of 2001 New Scandia Township entered into a contract
for collecting and disposing of recyclable materials. The
agreement has been extended several times.
• SRC is willing to extend the agreement at the same contract price
that has been in effect since 2001-- $2,320.50 per month.
• The contract is within the amount budgeted for 2011. Grant
revenue from Washington County helps offset a portion of this
expense.
Recommendation: Staffrecommends that the Council hear the presentation, and then
approve extending the agreement.

EXTENSION OF RECYCLING AGREEMENT BETWEEN
CITY OF SCANDIA AND SRC INCORPORATED
The undersigned parties to a certain Recycling Agreement dated March 1, 2001,
by and between New Scandia Township, now known as the City of Scandia, and SRC
Incorporated, 6320 East Viking Boulevard, Wyoming, MN 55092,hereby agree that said
Recycling Agreement may be and hereby is extended to December 31, 2011 on the same
terms and conditions contained in said Agreement.

RECYCLING AGREEMENT
THIS AGREEMENT made this 1 St day of March, 2001 by and between NEW
SCANDIA TOWNSHIP, Scandia, Minnesota(Town) and SRC INCORPORATED, 6320
East Viking Boulevazd, Wyoming, MN 55092 (Contractor).
WI-�REAS, the Town believes it to be necessary and advisable to promote the
collection for reuse and recycling of beverage containers, glass, plastic, paper, metal and
any and all other m3ierials c�utable for reuse or recycling; and
WHEREAS, the Contractor is in the business of collecting and disposing of
recyclable materials; and
WHEREAS, the Town receives funds from Washington County for recycling
services and public education related to recycling; and
WHEREAS, the Town desires to contract with the Contractor for the purpose of
collecting and disposing of recyclable materials;
NOW, T'HEREFORE, in consideration of the mutual promises and covenants
contained herein, it is mutually agre�ed as follows:
1. Contractor shall provide a curb side pick up service of recyclable materials
a mir:imum of two days each month. �ontractor shall provi.de all labor
and equipment required for the receipt and disposal of recyclable
materials.
2. The Town shall pay to Contractor, as and for services rendered by it, the
sum of$2040.00 per month commencing January l, 2001 and $2320.50
per month commencing March 1, 2001. This Agreement shall be renewed
by mutual agreement entered into 30 days prior to the end of each
agreement year.
3. Contractor sha11 at all times during the term of this Agreement keep in
force the following insurance:

(a) General liability insurance for bodily injury or property damage to
any one person for injuries or damages arising from any one
incident in an amount of not less than$1,000,000.00.
(b) Worker's Compensation for a11 employees employed by Contractor
in fulfilling its obligations under this Agreement.
(c) Motor vehicle liability insurance on any and all vehicles used in
connection with this agreement with limits of not less than
$1,000,000.00.
A certificate of insurance evidencing this insurance coverage must be
provided to the Town before the effective date of tlus Agreement.
4. All recyclable materials received by Contractor sha11 become the property
of Contractor and Contractor shall dispose of same in accord with all
government regulations and shall not permit the recyclable materials to
become a nuisance to the Town.
5. Contractor shall prepaze and submit semi-annual recycling reports to the
Town. The report covering the period January 1 to June 30 in each year
sha11 be due by July 15 and the report covering the period from July 1 to
December 31 in each year shall be due by January 15 of the following
year.
6. Contractor shall defend, indemnify and hold harmless the Town and
Washington County and their officers, employees and agents against any
and a11 liability, loss, cost, damages and expenses which the Town and
Washington County and their officers, employees and agents may
hereafter sustain, incur or be required to pay arising out of the Contractor's
performance or failure to adequately perform its obligations pursuant to
this Agreement.
7. Nothing contained in this Agreement is intended or should be construed as
creating the relationship of co-partners or joint venture with the Town. No
tenure or any rights of benefits, including worker's compensation,
unemployment insurance, medical care, sick leave, vacation leave,
severance pay, PERA or other benefits available to Town employees sha11
accrue to Contractor or employees of the Contractor performing services
under this Agreement.
8. During the performance of this Agreement, Contractor sha11 not, on the
grounds of race, color, religion, age, sex, disability, marital status, public
assistance status, criminal record, creed or national origin, exclude any
person from full employment rights in, participation in, be denied the

benefits of, or be otherwise subjected to discrimination under any and all
applicable federal and state laws against discrimination.
9. It is understood and agreed that the entire Agreement between the parties
is contained herein and that this Agreement supersedes all oral agreements
and negotiations between the parties relating to the subject matter. All
items referred to in this Agreement are incorporated or attached and are
deemed to be part of this Agreement. Any material alterations, variations,
modifications, or waivers or provisions of this Agreement shall be valid
only when they have been reduced to writing as an amendment and signed
by the parties.
The term of this Agreement shall be January 1, 2001 to December 31,
2001.
