Background: • The mining operation received a Conditional Use Permit (CUP) under the city's Mining Ordinance in May, 2008. The CUP and the ordinance require issuance of an AOP. • The Tiller applicat:ion includes the adjacent site formerly operated by Dresel Contracting, Inc. on 218th Street, west of Lofton Avenue. The Applicant shall continue to provide the production well records for the site to the City so the pumping records can be compared to past and future groundwater level trends at the site. The application notes that the water level in the groundwater pond was inadvertently not recorded in conjunction with the fall 2010 water level readings of the remaining wells. The Applicant shall record water levels in the pond in the early spring of 2011 and in the fall of 2011 to ensure sufficient water level data for future evaluation of the groundwater and surface water relationships. 3. The reclamation plan shall be updated by May 1, 2011 to meet the requirements of the ordinance, including placement of at least four inches of topsoil, and additional information regarding the proposed plantings for 2010. 4. The applicant shall revise the reclamation plan by May 1, 2011 to bring it in conformance with the ordinance regarding proportionality of mining and reclamation areas, or provide a rationale for the lack of proportionality between the reclamation effort and active mining on the site, and how this proportionality will be achieved in the future. 5. The Applicant shall provide the required Letter of Credit (LOC) or other security for Tiller's Scandia Mine site and the former Dresel Mine site to the City by May 1, 2011. The former Dresel site is south of the Tiller site. Tiller purchased the Dresel site in 2009 and is operating both sites. The City issued a CUP for mining and processing at the Dresel site on May 20, 2008. As the Owner of both sites,Tiller needs to comply with the conditions of both the Tiller and Dresel CUP's. Issues and compliance with each are discussed in this report. EVALUATION OF THE AOP REQUEST The Applicant is requesting an Annual Operating Permit(AOP)for a mining operation.The permit requirements are governed by the City's Ordinance No. i 03,Mining and Related Activities Regulations. OPERATING CONDITIONS-EVALUATION FOR THE AOP Site Operations-Background Information The site includes several parcels, as indicated on the Site Plan(Figure C-1). Excavation activities in 2010 to removed material between the Tiller site and former Dresel Mine site,merging the two sites into one.The mining operation includes removal of overburden,excavation of sand and gravel,crushing,washing, screening, stockpiling of sand and gravel; recycling of concrete and asphalt products;the production of hot- mix asphalt and reclamation activities.The overburden is removed from areas to be mined,and stockpiled on the site for use in reclamation activities. The site usually operates on a seasonal basis from mid-April to mid- November, depending on weather conditions. Scandia City Council Page 5 March 15, 2011 Tiller Corporation AOP for Mining The Applicant indicated that the site will continue to operate as it has in the past during the 201 i mining season. Proposed active mining areas are indicated on the Site Plan(sheet C 1). The Applicant indicated that enougtx material was processed at the site in 2010 to meet the estimated needs for 2011. Therefore,the application indicates that processing activity is not planned at the site in 2011. If 2011 demand exceeds forecasts, additional processing may be needed. Mining into the groundwater began at the site in 2009. This activity has been described in the previous mining plans for this site, and was evaluated in the Environmental Assessment Woz•ksheets completed for the Tiller site in 198'7 and 1999. The 201 l AOP application indicates that no rraining into the groundwater is expected in 2011. The asphalt plant at the site is equipped with a baghouse air pollutant collection device, and operates u.nder a Minnesota Pollution Control Agency(MPCA)Air Emissions Permit. Storage tanks as the site(for fuel and asphalt cement)are regulated by the MPCA. The main access routes to and from the site are Manning Avenue (County Road 15)and Lofton Avenue (County Road 1). Both Manning and Lofton are paved.The haul road from Manning Avenue is paved through the site to the hot-mix asphalt plant and loading area. Ground Water Monitoring Plan and Monitoring Issues The approved Groundwater Monitoring Plan for the site is on file at the City. LBG Analysis and Recommendations Based on ZO10 Monitoring Data LBG reviewed the data and analytical reports from the monitoring wells on the Tiller site that were submitted with the application, and indicated that no issues of concern related to the annual operating permit were identified. The apptication notes that the water level in the groundwater pond was inadvertently not recorded in conjunction with the fai12010 water level readings of the remaining wells. The app(icant indicated that the water level will be i�ecorded in the early spring of 2013 and in the fall of 2011 to ensure sufficient water level data for future evaluation of the groundwater and surface water relationships. LBG concurred with this approach. The condition will be included in the conditions for the 2011 AOP. Scandia City Council Page 6 March 15,2011 Ti11er Corporation AOP for Mining LBG provided a hydrograph that illustrates the groundwater elevations on the site as part of their analysis {attached). Ground YYater Analysas. The results of the ground water analysis note that a sample taken from the pond on the site in October,2010 identified Diesel Range Organics(DRO) at low levels (0.11 mg/I). The sample was further analyzed for the presence of Polycyclic Aromatic Hydrocarbons (PAHs), which were not detected. Based on the DRO detection, the pond was resampled for DRO in November 2010 at the request of the City. No DRO were identified in the second sample, suggesting that there is no ongoing DRO-contamination issue. LBG identified no issues related to the ground watei•analysis provided in the application. Setbacks The application indicates that the mining operation main#ains setbacks as follows: • 50 feet from the adjoining property line . 200 feet from an existing occupied structure • 100 feet from residential property boundaries of 5 acres or less • 100 feet from arny road right-of-way The setbacks were reviewed at a site visit by City staff, and found to meet the requirements of Ordinance 103. Fencing The applicatian indicates that the majority of the site is fenced with 3-strand wire fencing, except where prohibited due to topography,heavy vegetation and wetlands. There are locking metal gates at both entrances. The fencing meets the intent of th�City's Ordinance. City staffreviewed the fencing during site visits in 2009, and verified that it meets the requireznents of the Ordinarace and CUF. Hours of Operation The site is operated fronn 7 a.m.to 7 p.m. Monday through Friday, except holidays.The Applicant no#ed that eartended hours were requested on several occasions in 2010 and approved by the City. The Applicant is required to obtain the City's permission:for any extended hours in accozdance with procedures set in Ordinance No. 103. The City received no complaints during any of the projects that operated with the approved e�rtended hours. Extended hours were requested to finish paving on MN Highway 243 and MN Highway 96, and to complete interchange/overpass projects on Intersta.te 35 and 35E. Screening The application describes screening at the site, and notes that trees have been planted in the past to screen site activities. No additional berms or plantings are proposed in 2011. The CUP did not require additional screening. These actions will be continued as needed in 201 l. The CUP did not require additional dust control efforts. Noise The Applicant must comply with all Federal, State, and City noise standards. The City did not receive noise complaints regarding this site during 2010. Depth of Excavation The CUP requires that the depth of excavation will not exceed fif#y feet below the water table($65 feet above mean sea level). The application indicates that no rz�ining into the water table is planned in ZO11,and excavation will not exceed the depth specified in the CUP. Si[e CCeara�ce Site cleazance occurred along the common mining bordex with Dresel Corporation in 2010, as indicated on the Site Plan. No clearing activity is expected in 2011. The City's Ordinance requires that the Applicant address the disposal of stumps,trees or other debris accumulated during clearance. The application indicates that logged materials are used for lumber or firewood,and that chipped materials are used as mulch,bio-fuel at approved facilities, for erosion control,and similar activities. The methods proposed in the application meet the requirements of the CUP. Appearance/Condition The City's site inspections in 2010 conf'�rmed that the site and facilities are maintained in a neat condition. The CUP did not include conditions for improvement of the appearance or condition of the site. Sanitary Facilities The application indicates that site is served by sanitary facilities that meet the requirements of the City's Ordinance and the Mine Safety and Health Administration. City staff inspection confirmed that the City's requirements were met in 2010. Waste Disposal The application indicates that waste generated by the operation is disposed of in accordance with Federal, State and City requirements. Site visits in 2010 confirined that the Applicant is meeting the requirennents of the CUP. Water Quality Monitoring Plan The CUP required that Tiller Corporation complete a plan for groundwater monitoring within 60 days of approval of the CUP (July 20, 2008}. The approved �ound water monitoring plan is on file at the City. The Applicant notes that these materials are stored in accord with Federal and State standards and County requirements. The storage meets the requirements of the CUP. Contingency Response Plan The application zndicates that the site operates under a Spill Prevention,Control and Countermeasure Plan {SPCC)Plan,and that no changes to the plan have been made in 2010. The Applicant submitted a copy of the Contingency Response Plan that is on file at the City. Prvicessing The CUP application describes the operation of permanent processing equipment on the site, and indicates that the equipment is operated in accordance with Federal, 5tate and City air c�uality,water quality and noise standards. The CUP requires that the asphalt plant and related structures be set back at least 1 QO feet from the ' shore of the proposed lake on the site. The processing facilities meet the setback requirements of the CUP. Trucking Operations The application indicates that truck opera#ions have access to County Road 15 (Manning Avenue)and County Raad 1 (Lofton Avenue),which are paved roads. The City received no complaints regarding trucking opera.tions associated with the site in 2010. Asph�lt Plant The site operates a permanent hot-mix asphalt plant that was in operation at the time the City adopted its mining ordinance. The plant operates under an air quality permit issued by the MPCA. The City received no complaints regarding the operation of the asphalt plant in 2010. Reclnmation Plan The applicant submitted a Reclamation Plan with the AOP application that combines the Tiller and Dresel site reclamation plans. The applicant indicated that the 2010-2011 Reclamation Activity area is approximately 3 acres in size. The proposed Active Mining Area for 2011 is 27 acres. Staff identified two issues related to the proposed rec�amation plan,based on the requirements of Ordinance103: 1) Section 8.4 of the ordinance requires the following for reclamation areas where excavations will not result in water areas after rehabilitation: . All banks must be graded or backfilled; e Graded or backfxlled areas shall be surfaced with soil of a quality at least equal to the topsoil of areas immediately sur�ounding,to a depth at least four inches; Scandia City Council Page 9 March 15, 2011 Tiller Corporation AOP for Mining • The topsoil shall be planted with trees, shrubs,legumes or grasses • Slopes shall not be steeper than 4:1 The reclamation plan included in the application plan indicates that reclamation will consist of "sloping,backfilling, and establishment of vegetation." The application does not indicate that topsoil will be applied as required, and does not indicate the specific types of plantings that will be included in reclamation areas. T'he reclamation plan in the application should be updated by May 1,2011 to meet the requirennents�f the ordinance,including placement of at least four inches of topsoil, and specific infoimation regarding the proposed plantings for 2010. 2) Section 8.2 of Ordinance 103 requires the"restoration shal!proceed concurrently and proportional to actual rnining operations,and will be subject to review and approval at each annual inspection and at the end of the permit period." This section is included in the ordinance to ensure that: • Large areas of the site are not left in an unreclaimed state,encouraging erosion, dust and weed establishment • The mining operation is making an ongong investnnent in reclamation,to avoid potential problems that may occur at the end of the mining operation if a large investment is needed in reclamation, and the applicant's resources are limited at that point, or the applicant abandons the site. The proposed active mining area for 2011 is nine times lazger than the area proposed for reclamation. This is a signficant change from the relationship between the reclamation area and active nnining area included in the 2010 Tiller application for the site. The applicant should revise the reclamation plan to bring it in conformance with the ordinance by May 1,2011,or provide a rationale for the lack of proportionality between the reclamation effort and active mining on the site,and how this proportionality will be achieved in the future. Relationship of Application fo Zavoral Mine ELS` An Environmental Iznpact Statement(EIS)is currently in process for the proposed Zavoral Mine Site in the City of Scar�dia. The project includes potential processing of material from the Zavoral Mine at the Scandia Mine site in the future. This activity is not proposed at the Scandia site in 2Q10,and is not related to the AOP application. SITE INSPECTION City staff completed site visits to the Tiller Corporation Mining Operation in during 2010,including documenting conditions on the site in site photos. Ti11er operates a gravel mining and processing operation within the City of Scandia. ; ;�; The site has been active{y mined since at least 1966. Prior to the incorporation of Scandia in 2006, New Scandia Township and Washington County were the permitting authorities. The City of Scandia issued a Conditional Use Permit (CUP) for the site in the spring of 200$. {I. ANNUAL REPORT A. Operating Conditions: _ The site operates in accordance with operating conditions regulated by Section 7 of the Scandia Ordinance 103. 1. Setbacks: No mining, stockpiling or land disturbance activities, with the exception af screening activities, are proposed to take p{ace within the setback areas. Minimum setback areas are maintained as follows: . 50 feet from an adjoining property line . 20Q feet from an occupied structure existing on May 20, 2008. . 100 feet ftom any contiguous property subdivided into residential lots of 5 acres or less . 100 feet from any road right-of-way. 2. There are locking metal gates at both entrances to the site. 3. Hours of operation: The site is operated from 7:00 a.m. to 7:00 p.m. Monday through Friday except holidays. In accordance with procedures set forth in Ordinance No. 103, extended hours were requested and approved in 2010. As part of the request for extended hours, Tiller asked to be notified if the City received any complaints regarding the extended hours of operations. To Tiller's knowledge no complaints were received during any of the projects operating with approved extended hours. Extended hours were approved for the operation of the asphalt ptant, including trucking operations, past 7:00 p.m. to finish paving MN Hwy 243. By extending operating hours, Tiller's customer was able to complete paving on Friday evening and lane restrictions were removed for weekend travelers. Saturday operations (asphalt plant and trucking, 7:04 a.m. to 4:00 p.m.} � were requested twice and approved for interchange/overpass projects on 1-35 and I-35E. Saturday operations were necessary because MNDOT - required ce�tain portions of the projects be completed on Saturday in order to minimize impacts to weekday traffic. Saturday operations (asphalt plant and trucking, 7:00 a.m. to 4:00 p.m.) were requested and approved twice for paving on Hwy 96. Because of an extremely rainy September this project was running well behind schedule. Consecutive Saturday operations were requested in order to ge#the project back on schedule and completed before the end of the season. The weather turned very favorable for construction in October and the City was notified that only the first of the finro approved Saturdays would be needed. 4. Screening: Screening berms, wooded buffer areas and agricultural fields separate the mining activity from surrounding properties. A large number of trees have been planted in the past to screen site activities. Processing and stockpiling operations are conducted in recessed po�tions of the site to minimize visibility. Screening berm construction or modifications are not anticipated during 2011. 5. Dust control: A water truck is used to water unpaved portions of the site to control dust. During periods of increased trucking activity, calcium chloride is applied to provide additional dust controf. These practices will continue throughout the 2011 mining season. fi. Noise: All activities are conducted so as to be in accordance with al1 .. Federal, State and City noise standards. 7. Trees, stumps, roots and other vegetative material removed during site clearance or other activities are disposed of by logging and/or chipping. Logged material is be used for lumber or fi�ewood. Chipped material are be used as mulch, bio-fuel at approved facilities, erosion control devices or other approved utilizations. 9. Appearance/condition: All buildings, plants and equipment at the site are maintained in a neat condition. Weeds and other unsightly or noxious vegetatian are controlled as necessary to preserve the appearance of the reclaimed areas. 10. Sanitary Facilities: The scake area is served by an individual sewage ; , ; treatmen# system. Portable sanitary facilities are provided in the operating areas as required by the Mine Safety and Health Administration. � 11. Waste Disposal: Waste generated from the operation is disposed of in accardance with Federal, State and City requirements. 12. Water Quality Monitoring: A plan for groundwater monitoring has been developed and approved in conjunction with the monitoring wells placed in 2008 and the CUP permitting process. Groundwater monitoring was conducted in 2009 and 2�10 and the results were submitted to the City. Water level data is summarized on Table 1 and water quality data is summarized on Table 2. The water level in the groundwater pond was inadvertently not recorded in conjunction with the fall 2010 water (evel readings of the remaining wells. The water level will be recorded in the early spring of 2011 and again in the fall in 2011 to ensure sufficient water level data for future evaivation of the groundwater surface water relationships. 13. Fuel and Chemical Storage: All fuel and chemicals stored on site are stored in accordance with Federal and State standards. On-site fuel storage consists of a 1,000- gallon above-ground storage tank which is located within a concrete secondary containment area and a five hundred gallon above-ground double walled tank located next to the electricity generafior. When production equipment is pres�nt, an additional 1,040- ga{1on double walled tank is brought to the site and used to fuel processing equipment. All asphalt cement storage tanks are above-ground. These tanks consist of two 40,000 gallon tanks and one 20,000 gallon tank. The used oil is utilized as an alternative fuel supply for the asphalt plant. All tanks are within the secondary containment area and are registered with MPCA's Storage Tank Program. MPCA Site ID 51999 is for the asphalt plant and MPCA Site ID 55016 is for the sand and gravel operation. Small amounts of chemicals utilized by the QM Lab are regulated by Washington County under United States Environmental Protection Agency (EPA) rules. EPA ID Number MND 981 953 417 has been issued for the site which is classified as a Very Small Quantity Generator. 14. Contingency Response Plan: The site operates under a SPCC Plan. Portable crushing equipment is placed on the floor of the facility and setbacks per Ordinance No. 103 are maintained between the processing equipment ' and the properiy lines. 97. Recycling: Recycling activity at the facility meets all applicable standards contained in Section 7.1 (1) of Ordinance No, 103. Approximately 50,000 tons of Recycled Asphait Products (RAP) were processed in 2010. Processed RAP is used in asphalt production or sold in various aggregate products. The stockpile of material to be recycled does not exceed the volume of material that can be processed in two consecutive operating seasons. � 18. Trucking Opera#ions: The site has access to County Road 15 (Manning Trail) and County Road 1 (Lofton Avenue). These are paved 9 ton roads. 19. Asphalt Plants: The site operates a permanent hot-mix asphalt plant and the plant was in operation at the time the City adopted its mining ordinance. Therefore the plant may expand in the future subject to the setbacks set forth in Section 7.1(1) of Ordinance No. 103. The plant operates in accordance with all Federal, State, and City air, water and noise quality standards. Updated Copy of Application Material: A completed bound book that includes all of the information and plans submitted to the City during the CUP process was previously submitted and is on file at the City. 2. Watershed District Permit: A Watershed District Permi#was obtained for the site and was previously submitted to the City. 3. Monitoring Wells: All required monitoring wells have been installed. 4. Ground Water Monitoring Plan: A monitoring plan with protocols is on fite with the City. 5. Excavation Below Water Table: Excavation into the water began in 2009. Excavation into the groundwater table is not currently planned in ,F = 2011. Water level data is collected on an on-going basis and submitted ... annually to the City. 6. Production Well Records: Records of the production well are kept. They r will be provided to the City upon request. 7. Tiller has posted signs on 218'h Street per City of Scandia �equirements. 12.Lofton/Hwy 97 Intersection: Tiller Corporation restricts importing add- rock from Lofton Avenue during non daylight hours. Current reclamation progress is indicated on the Site Plan submitted with the AOP application. C. Annual Activity 1. Amount of material removed from the site: Approximately 184,000 tons of material were removed in 2010. 2. Amount of add-rock brought onto the site in 2009: Approximately 131,000 tons of add-rock were imported to the site in 2010. 3. Amount of recycled asphalt brought to the site in 2010: Approximately k ;�_�, 40,000 cubic yards nf asphalt for recycling were impo�ted to the site in 2010. 4. Amount of recycled concrete brought ta the site in 2010: Approximately 20,000 cubic yards of concrete for recycling were imported to the site in ' 2010. 5. Area reclaimed and type of reclamation in 2010: Reclamation activities in 2Q10 cons9sted of placing suitable reclamation fill material in the portion of the site previously owned by Dresel Contracting. This area is shown on the Site Plan. 6. Average number of trips hauling material to and from the site per day for the season: The average number of trucks travelling to and from the site per day in 2010 was 182. - D. Description of operating conditions planned for the coming year: 1. During the 2011 mining season, the site will continue to operate as it has in the past. The mining operation includes the removal of overburden, excavation of sand and grave(, crushing, washing, screening, stockpiling, and recycling of concrete and asphalt products. Portable crushing and screening plants are ' brought to the site periodically and material is excavated, processed, and stockpiled. Hot-mix asphalt is produced and sold throughout the construction ' ` season and add rock materials are delivered to the site as needed. Screening operations began at the site in late spring/earty summer 201 Q and full processing activity in the fall of 2010. The 2010 production schedule was put together so the season could end in Scandia. Therefore processing activity is not planned +n 2011. However, if 2011 demand exceeds forecasts, then there will be a need for additional processing in 2011. Excavation into the water table began in the fall of 2009. 2. Site Plan: A site plan is attached which illustrates the areas planned to be mined in 2011, the stockpile and processing area, and reclaimed areas. 3. Aerial Photo: An aerial photo is attached which illustrates the areas planned to be mined in 2011, the stockpile and processing area and reclaimed areas. 4. Reclamation: Reclamation activities in 2010 consisted of placing reclamation fill in the portion of the Site that was previously owned by Dresel Contracting. This area is shown on the Site Plan. As mining progresses to the perimeter of the mining area in the future, then � reclamation consisting of sloping, backfilling and establishment of vegetation can occur. Reclamation activities planned for 2011 will be similar to 2010 � activities. � 5. Operating Conditions for 2011: Active mining will occur predominantly in the areas indicated on the site plan. D.
