Re: Removing the conditions of Resolution 05-17-11-02 from the title for Lot 2, Block 1 Hawkinson
Business Park – 21150 Ozark Court.
Background: In 2011 the City Council approved a condition use permit for Dr. Steven Luginbill,
d.b.a. Croix Ridge Chiropractic for a chiropractic health care clinic at 21150 Ozark Court N. The
clinic was located in a multi-tenant building and there is a separate restaurant building on the same
parcel. The conditional use permit was recorded at the County and remains on the title for the
property. The cloud on the title from the conditional use permit is an impediment to a closing for
the sale of the property.
Note that in February, 2016 the Council approved an Ordinance amending the uses in the Village
Mixed Use zoning district where this parcel is location. With the amendment Medical or Dental /
Chiropractic / Physical Therapy Offices and Clinics are now allowed uses in both the VMU A & B
zoning districts.
Issue: Should the City take action to remove the conditional use permit from the title of Lot 2,
Block 1 Hawkinson Business Park
Fiscal Impact: none
Proposal Details: City Attorney Pratt is evaluating the options for removing the conditional use
permit from the title for the property.
Options:
1. Take action or direct action to remove the title
2. Defer for additional information on the necessary process.
3. Take no action on the matter
Recommendation: Option 1
