9.b) Approve Annual Operating Permit for Gravel Mining and Processing, Tiller Corporation r , Meeting Date: 04/19/2011 Agenda Item: / �. �J City Council Agenda Report City of Scandia 14727 209`h St. North Scandia, MN 55073 (651) 433-2274 Action Requested: Consider the application for an Annual Operator's Permit (AOP) for the Tiller Corporation sand and gravel mining operation located at 22303 Manning Trail. Deadline/Timeline: 120-day review period ends June 8, 2011. The AOP will cover the mining season through December 31, 2011. Background: • The mining operation received a Conditional Use Permit(CUP) under the city's Mining Ordinance in May, 2008. The CUP and the ordinance require issuance of an AOP. • The Tiller application includes the adjacent site formerly operated by Dresel Contracting, Inc. on 218�' Street, west of Lofton Avenue. The AOP must also comply with the CUP issued for the former Dresel site. • The Council considered the application at its March 15, 2011 meeting and postponed action to the April 19 meeting. Staff was directed revise the conditions of approval to clarify that the proportionality of mining and reclamation activities must occur over time, not year by year. After that meeting, Tiller Corp. submitted the attached letter describing what they explained verbally at the March meeting. Condition#4 in the draft resolution approving the AOP has been revised to read as follows: "The applicant shall maintain proportionality of mining and reclamation areas over time, as described in the letter from Tiller Corporation dated April 13, 2011." • Also at the March 15 meeting, the Council was addressed by Mr. John Lindell who requested that a statement in the AOP application concerning expansion of the asphalt plant be removed, or that language should be included in the approval indicating that the city does not agree with the statement. He submitted a similar comment in an e-mail dated April 8, 2011. The specific language he objects to reads as follows: "the site operates a permanent hot- mix asphalt plant and the plant was in operation at the time the City adopted its mining ordinance. Therefore the plant may expand in the future subject to the setbacks set forth in Section 7.1(1) of Ordinance No. 103. Permitted activities include the mining and processing of aggregate, the production of hot-mix asphalt, and the recycling of concrete and asphalt products; and WHEREAS, an Environmental Assessment Worksheet (EAW) was prepared for this mining facility in 1987, and a second EAW was completed in 1999 for a proposed expansion of the facility; and WHEREAS, the scope of operations and mining limits proposed in the current permit application to the City are consistent with the scope of the operations and mining limits reviewed in the 1999 EAW, WHEREAS, Ordinance No. 103, Chapter 4 of the Development Code of the City of Scandia, Minnesota, adopted August 28, 2007 (hereinafter referred to as "the ordinance") replaced the requirements of the ordinances adopted by Washington County and the former New Scandia Township and required the issuance of a new Conditional Use Permit and Annual Operating Permits for continued operation of existing mining operations; and WHEREAS, the City approved a Conditional Use Permit for the mining and processing operations on May 20, 2008; and WHEREAS, Tiller Corporation, Inc. submitted an application for an Annual Operating Permit to the City of Scandia, which was found to be complete for review on February 8, 2011; and WHEREAS, the Scandia City Council reviewed the application; at its regular meeting on March 15, 2011; Resolution No.: 04-19-11-04 Page 4 of 4 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it should and hereby does find that the Annual Operating Permit shall be and hereby is issued, with the following conditions made a part thereof: 1. The application notes that the water level in the groundwater pond was inadvertently not recorded in conjunction with the fall 2010 water level readings of the remaining wells. The Applicant shall record water levels in the pond in the early spring of 2011 and in the fall of 2011 to ensure sufficient water level data for future evaluation of the groundwater and surface water relationships. 3. The reclamation plan shall be updated by May 1, 2011 to meet the requirements of the ordinance, including placement of at least four inches of topsoil, and additional information regarding the proposed plantings for 2011. 4. The applicant shall maintain proportionality of mining and reclamation areas over time, as described in the letter from Tiller Corporation dated April 13, 2011. 5. The Applicant shall provide the required Letter of Credit (LOC) or other security for Tiller's Scandia Mine site and the former Dresel Mine site to the City by May 1, 2011. FURTHER, BE IT RESOLVED, any significant variation from these plans and conditions of approval shall require an application to amend this Annual Operating Permit. To start this explanation we offer a brief history and description of our mining and reclamation operations. In the past we have reclaimed significant areas mainly to the north and west of the stockpile and processing area.Also,overburden was removed from areas to be mined and was stockpiled on site in screening berms to be used later for reclamation. These screening berms were required by Washington County and were not intended to be used for current reclamation. This material is reserved for final phases of reclamation once mining is more or less complete. After these screening berms are established,overburden that is being removed is placed directly into areas that are being reclaimed. Mining occurs above and below groundwater at our facility. Aggregate is excavated above groundwater using front end loaders. A dragline or excavator is used to excavate material below groundwater. Mining below groundwater typically occurs once a mining facility begins to mature. A fairly large floor area is needed for a stockpile area,a processing area and an area to begin excavation below groundwater. Our Scandia facility has reached the stage where the floor area is large enough to accommodate mining below groundwater. Due to the variable nature of the aggregate deposit,it is beneficial to mine above and below groundwater concurrently in order to obtain the proper blend of aggregates. This is important to understand because there are very limited areas where mining is complete and reclamation can occur. However once mining reaches the perimeter of the site and is completed,reclamation is performed in conformance with the approved reclamation plan to allow for future development of the land. There are primarily two types of reclamation activities that occur at this facility;the ongoing reclamation activities and the mass reclamation activities. The ongoing reclamation activities April 13, 2011 �� Page 2 of 2 generally occur each season. Often materials suitable for reclamation but not suitable for aggregate production are encountered and these materials are used for reclamation. In addition various local construction projects will encounter materials not suitable for the specific project and/or excess materials. If these materials are suitable for reclamation we will accept them for placement in our ongoing reclamation area. In our 2011 Annual Operating Permit Application we have identified the area where the ongoing reclamation activities are expected to occur. The mass reclamation activity occurs concurrently with removal of overburden from an area in preparation for mining. We commonly refer to these combined activities,overburden removal and reclamation,as a striping/reclamation project. We do not have plans for this type of a project for 2011. These projects occur approximately once every five to seven years depending on aggregate demand. During these projects it is not uncommon to have suitable material volumes well in excess of 100,000 cubic yards available for reclamation. It is our intent and goal to proportionally open new areas for mining and reclaim areas during these projects. It is important to note that these two areas will not always be exactly the same size in area. Overburden removal and reclamation are three dimensional. In other words the overburden removed from say seven acres may or may not be enough and may be more than enough to reclaim exactly seven acres. However when you consider the mass reclamation combined with the ongoing reclamation there is proportional newly opened areas and reclaimed areas. Tiller was actively involved with the City's staff, Planning Commission, Mayor and Council during the development and adoption of the current mining ordinance. Because of this involvement Tiller is aware of the proportionality language in the ordinance. At the time the ordinance was adopted we were comfortable with the language because as explained above we are reclaiming areas proportionate in size to new areas being opened for mining. Tiller's statement that the asphalt plant may be expanded in the future is factual, subject to ordinance requirements. It would require an amendment to their CUP, which has not been approved or applied for. Any statements in their permit application do not change that fact. 2) If you talked to Frank Langer this weekend I'm sure he may have already handled your concern, or explained that you may come to tonight's Board of Appeals meeting (5 to 6 pm.) 3) The City is only responsible mailboxes if they were hit directly by a snowplow. If you believe that yours was hit, please arrange with Steve Thorp to have someone take a look at the remains to verify that. There were a lot of mailbox posts this year that were pushed over because of the weight of the snow. The city is not responsible for those. 4) Yes, a building permit is required for re-roofing. "Approval of the annual operating pernut for Tiller is not an approval of the contents and representations in the application which are not affirmatively being approved. Specifically the representations in the application that Tiller has authority to expand its asphault plant based on the fact it currently has authority to have an asphault plant is not accepted by the Council." (Its not a issue at this time so there shouldn't be any objection) I expect to address this issue at the meeting but I wanted specific proposed language available for the Council's consideration. 1 2) Is the Board of Appeals meeting already set for who can be considered for appeal? I expecUwant to appeal my valuation. I will be talking to Langer over the weekend on this. 3) I read about mailboxes being tipped or damaged and that Scandia will provide some compensation for that.
