Action Requested: Consider an agreement with the Comfort Lake Forest Lake Watershed
District (CLFLWD) to allow construction of a rough fish barrier at the
inlet to Bone Lake.
Deadline/Timeline: N/A
Background: • The CLFLWD is proposing to construct and maintain a barrier to
prevent rough fish from entering the north inlet to Bone Lake.
Construction would occur in the right-of-way of 238th St. N.
• The proposed encroachment agreement allows the CLFLDWD to
build and maintain the project in the right-of-way. CLFLDWD
would be responsible for all construction and restoration of
disturbed areas. The City will have no ownership or responsibility
for the construction or any ongoing maintenance.
• The City Engineer has reviewed the plans for the project, and
provided some comments (see attachments.) Before construction
begins, CLFLWD will be required to obtain a utility permit from
the city, at which time the final plan will be subject to the City
Engineer's approval.
• The City Attorney has reviewed the encroachment agreement.
• Doug Thomas, CLFLWD Administrator, will be at the June 21
meeting to present the project and answer any questions.
Recommendation: Staff recommends that the Council approve the encroachment
agreement.

ENCROACHMENT AGREEMENT
THIS ENCROACHMENT AGREEMENT ("Agreement") is entered into between the Ciry of
Scandia and the Comfort Lake - Forest Lake Watershed District (CLFLWD),political
subdivisions of the State of Minnesota. The parties agree as follows:
1. The CLFLWD is installing structures at the north inlet to Bone Lake within the City in order
to control nuisance fish movement and otherwise manage the waters of Bone Lake for the
benefit of the public, all within its authorit��under Minnesota Statutes chapters 103B and 103D.
The inlet structures and associated fill and cover (the "Project") will be located at least in part on
Ciry land,including within right-of-wa}� for 238`'' Street.
2. The parties enter into this Agreement to allow the CLFLWD to install and maintain the
Project on or under Ciry properry. The CLFLWD is expending funds and staff resources on the
Project in reliance on the authorization provided by the City, and the parties agree that there is
mutual consideration for this Agreement and that it is legally binding according to its terms. The
CLFLWD has provided the City the plans and specifications for the Project and will provide the
City with any amendments to the plans and specifications.
3. The CLFLWD is authorized to enter and occupy the areas delineated as "Project r�rea" on the
site plan attached as Exhibit A and incorporated herein for the purpose of installing inlet
structures,including fish barriers and related structures on or under the lands so delineated.
This authorization includes the right to operate and stage equipment and materials, disturb and
grade soils, place and move fill,revegetate and otherwise stabilize disturbed areas, and engage in
all other actions as necessary or convenient for performing the Project. The CLFLWD will
notify the Ciry at least one week before commencing construction.
4. The CLFLWD will remain subject to any applicable City permits or approvals necessary to
perform work that is a part of the Project. Any road disturbance associated with the Project will
be coordinated with the City. As between the parries, the CLFLWD will repair, or pay for repair
of, any road damage resulting from its activity. CLFLWD and Ciry representatives will meet on-
site before construction commences to idenufy trees that may be removed. The CLFLWD will
restore all unimproved areas to preexisting condition or better.
5. The installed structures will remain CLFLWD property. Under this Agreement, the
CLFLWD also has the ongoing right to enter the Project Area for ongoing inspection, operarion
and maintenance of the Project. All Project maintenance will be the responsibility of the
CLFLWD and the Ciry will have no such maintenance responsibiliry.
6. This Agreement is effective for five years from the date it is fully executed,and will renew
automatically for successive five-year periods unless amended or termulated by written
agreement of the parties. The encroachment rights here conveyed extend to the authorized
representarives and contractors of the CLFLWD.
7. The CLFLWD agrees to indemnify, defend and hold harmless the City and its governing
members and employees from and against any and all actions, causes of action, claims,
proceedings, costs and damages arising out of installation or maintenance of the Project, except

to the extent the action, cause of action, claim,proceeding, cost or damage relates to an action
or inaction of the City that is an independent basis for liability.

Regarding � Bone Lake Fish Barrier Draft Plans
Draft CADD plans were created for Low-Velocity Fish Barriers for the Bone Lake Outlet and Inlet.
Several design modifications were incorporated since the original feasibility design. Design
considerations included constructability, redundancy and safety measures. The existing outlet pipe
under Lofton Avenue will be connected to the proposed outlet structure. The rusted out 36-inch CMP
under 233th Street will be removed and replaced with a concrete pipe of the same size. Access is
assumed to be throu�h County or City Right-of-Way.
General Description of Design
The Design incorporates an innovative low-velocity design that has been recommended by the DNR
with the goals of limiting carp movement while maintaining flows and water levels. The design to date
has only been incorporated on small ponds, therefore the design needed to be scaled up with additional
safeguards incorporated. The desi�n consists of a concrete outlet structure, header pipes (half-round
Stormtech chambers), a rock drain field, and thousands of feet of drain tile pipe embedded in the rock
bed discharging into the header pipe. As designed, water would have numerous flow paths: either
through the rock directly into the Stormtech chambers or though the drain tiles into the Stormtech
chambers to allow for minimal head differences across the system and low vetocities to minimize
plugging and maintenance.
The system is head driven. As water levels increase on the lake side the multiple flow paths throu�h the
rock and drain tile are desiDned to allow water to equilibrate in the header pipe, flow to the outlet
structure and then into the outlet pipe. The capacity of the drain field is several times the flow rates for
the 10-year event even with very small head differences across the system. The redundancies and
oversized capacity is intended to keep flow rates small, limit clogging, and should clogging of sections
occur allow for alternate flow paths without adversely effecting upstream water levels.
The outlet structure is a custom concrete structure that connects to the outlet pipe under the road, the
header pipes connect into both sides of the structure, and an adjustable weir is inciuded on the lake side.
An aluminum grating is proposed over the top and over the front lip for safety and to eliminate the
potentia( for large fish to jump over the weir (sizing of the gratin� needs to be discussed with DNR).
The current layout sets the top of the stop logs at the 10-year elevation. The intent is to limit the times
that flow is utilizing the overflow, but allow for large storm events to exit the system without affecting
upstream flood levels. That exact overflow of the system could be adjusted based on monitored
performance after installation. Also, should the system clog or not perform as expected the stop logs
could be rernoved and the system would operate exactly as it does today. This limits the risk associated
with this new type of fish barrier design.

The original survey did not cover a large enough area for the currently proposed drain fields.
Therefore, additional surveying will be performed after ice out and the exact layout of each will be
modified as needed to fit the landscape. Soil borings will also be taken to determine soil type and
bearin� capacity. Additional considerations for the weight of the rock bed and/or outlet structures may
be needed depending on the soil conditions.
Summary
The preliminary CADD plans are draft and additional details of the design will be finalized after the
remaining field data is gathered and through discussions with DNR fisheries and road/ permitting
authorities. It is recommended that the draft plans along with this memo be forwarded to the DNR and
road authorities for preliminary review and comment.

The Comfort Lake Forest Lake Watershed District (CLFLWD is proposing a low velocity flow fish
barrier for the inlet located on 238th Street North (north end of the Lake) and outlet on Lofton
Avenue North (NW corner of the Lake) of Bone Lake.
The following list of items should be incorporated in the City draft plan review comments to the
CLFLWD:
1. The CLFLWD summary memorandum prepared by EOR, dated April 4, 2011, indicates
that the proposed fish barrier system has been constructed in other locations, but only
on small ponds. There may be issues with silting of the rock drain and draintile system
over time in an active lake installation.
2. The Plans include the inlet plan and detail sections for both the inlet and outlet locations.
The plans should include a detailed location map of the northern portion of the Lake
indicating the inlet and outlet, and contain sectional view labels to clarify the sectional
detail locations.
3. The CLFLWD should provide a summary of constructability indicating how it is anticipated
the project will be constructed.
4. The proposed culvert material and class needs to be indicated on the plans where
crossing City rights of way.
5. It appears from the plan that construction equipment and materials will be staged in the
City rights of way and streets. The plan will need to contain a traffic control plan and
detour signage for roadway closures in accordance with the Minnesota Manual on
Uniform Traffic Control Devices.
6. The proposed street section restoration needs to be modified to include 2.5 inches of
bituminous non-wear pavement instead of the 1.5 inches shown. The current Mn/DOT

speciflcation for bituminous materials and pavement design shall be required. The
specific bituminous mixture design number is to be included ion the plans.
7. Manhole structures 1 and 2 will need to be installed flush with the surrounding grade to
reduce conflict with traffic. The structures cannot be placed with the structure or casting
above the ground line. We recommend the castings be bolted to the manhole top slab to
reduce the sliding of the casting by traffic or other influences.
8. Side-slopes of the embankment area disturbed by construction are to be restored at a
1:3 (vertical: horizontal) slope within City rights of way.
9. Turf restoration details were not included in this submittal. The specific information
should include 4 inches of topsoil an sufficient roadside seed for this application.

The City of Scandia provided a preliminary review of the proposed fish barriers for Bone Lake.
Based on our review of those comments we feel that they can all be address with the final
design. Responses to the comments are provided below and we are including an updated draft
plan set which have been updated based on City comments and further refinement of the
design. Traffic control and site restoration plan sheets have not been created yet, however as
indicated below, the City comments will be incorporated into those plan sheets and provided to
the City for review upon completion of a final plan set.
Responses to City Comments
l. The CLFLWD summary memorandum prepared by EOR, dated April 4, 2011, indicates
that the proposed fish barrier system has been constructed in other locations, but only on
small ponds. There may be issues with silting of the rock drain and draintile system over
time in an active lake installation.
Some siltation over time is expected; therefore the drain tile and rock d��azn system is
designed to provide S to 10 times the required capaciry for the design,�low through the
drain tiles. The design also includes redunda�cy i� water�low paths through the ��ock
into the bottom of the Contech Chambers in addition to the flow through the drain tile.
As an addrtional contingency, in the event that water levels are adversely affected in the
future there is always the ability to pull stop logs and thus return the system to the same
function as exists today. This is a pilot project and there is an understanding that there
are some unknowns as to how the system will perform long term, hence the various
redundancies in the design.

The revised title sheet includes a location map indicating both the inlet and outlet
locations. Sectional view labels have been added as needed.

We had anticipated the need for feedback from contractors and are in the process of
requesting feedback.from contractors that are familiar N�ith construction in aquatic

provided upon completion of this process. The drain field would need to be installed
below the waterline. It is anticipated that work would be performed in low water
conditions, if possible, to make installation easier and reduce transportation of sediment
downstream. I,f there is active flow during construction, bypass piping or pumping would
likely be part of the construction operations.

The pipe will be RCP Class 3 as indicated in the revised plans.
