(AECOM) for preparation of the Zavoral Mining and Reclamation Project EIS (Environmental Impact Statement.) Deadline/Timeline: The Draft EIS is expected to be delivered approximately one week prior to the November 16, 2011 PAC meeting. Background: • In order to keep the schedule for preparation of the Draft EIS on track, AECOM has found it necessary to do some work that is beyond the scope of their current agreement with the City. Specifically, they found the noise analysis submitted by the project proposer(Tiller Corp.) to be inadequate and needed to do some monitoring and modeling that was not originally anticipated. The cost of this work is estimated at $7,000. Some additional tasks may also be necessary. • A contract amendment has been prepared. It would authorize the City Administrator to authorize work to fill data gaps identified by AECOM up to a total cost of$15,000. • All of the city's costs for preparation of the EIS will be paid by the proposer. Recommendation: Staff recommends that the Council approve the amendment. ("AECOM"), formerly EDAW, Inc.,with an effective date of March 2010. It is understood and agreed that performance of the Basic Services identified under Appendix A to the Agreement will require an additional fee to be charged to the Client. Therefore, the contract budget as described in Appendix 8 is hereby increased by the amount of up to fifteen thousand dollars ($15,000)so that the new not-to-exceed amount shall be three hundred and ninety two, seven hundred and twenty five dollars($392,725J. By execution hereof, AECOM agrees that the basic services can be (barring unforeseen events or occurrences) performed for this amount. This$15,000 dollar increase is an allowance that the City Administrator can award on an as- needed individual work order basis to address data gaps identified by AECOM as the EIS process proceeds. In order to facilitate progress these work orders can be approved by Anne Hurlburt, City Administrator. The foregoing is the sole modification or amendment to the Agreement, and no other express or implied modification or amendment is intended or shall be construed herefrom. All other provisions, prior amendments [if any] and obligations of the Agreement shall continue in full force and effect. Noise impacts along the truck haul routes: • Monitoring ambient noise levels at 2 locations along proposed haul roads • Modeling of noise impacts at locations along proposed haul roads • Data analysis and documentation for the EIS 2. Modeling of facility operations noise impacts at a worst case receptor location including data analysis and documentation for the EIS The cost for these items is estimated at$7,000. That said, preparing a quality preliminary EIS suitable for review takes time.This is an iterative process and because Tiller has missed delivery dates for information or responses to questions on their submittals, it delays our work. We continue to try to make up the time and maintain Project schedule and continue to work toward meeting the PAC deadline. As you know, we have set up review sessions with you on October 31 and November 1 to review the draft EIS and make a determination as to whether it is ready to distribute to the PAC. We will decide at that time if it can be distributed on by November 9. If it is determined that it is not ready,we would then need to reschedule the PAC meeting in order to allow the PAC time for meaningful review. Thanks, Leslie Leslie H.
